JUSTIFICATION FOR OTHER THAN
FULL AND OPEN COMPETITION
I. Contracting Organization
USPFO for Texas – Procurement and Contracting is proposing a sole source procurement under the authority of FAR 6.302-1 – Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
II. Description of Action
This procurement action will be a firm fixed price contract for Harris Radio medium and long range communication equipment in support of 2-149 GSAB deployment
III. Description of Supplies/Services
Please see attached quote from Harris Corporation (Enclosure 1)
IV. Authority
10 USC 2304(c)(1), as implemented by FAR 6.302-1(a)(2)(ii)(A) and (B).
V. Applicability of Authority
In accordance with FAR 6.302-1(b)(1)(i), Harris Radio Corporation (HARRIS) is the only known manufacturer of MIL-STD-188 base station radio equipment, i.e. AN/PRC-150, to operate on the HF spectrum currently used in theater. Furthermore HARRIS is the only known JTRS compliant manufacturer of MIL-STD-810E radio equipment, i.e. AN/PRC-117G, to support 30-2000 MHz frequency range currently used in theater. The AN/PRC- 117G is compatible with the AN/ARC- 231 VHF/UHF/LOS/SATCOM radio currently used by Army Aviation assets in theater and supports SINCGARS ECCM (Electronic counter-countermeasure), VHF/UHF AM/FM, MIL- STD-188-181B, MIL-STD-188-182-/A, MIL-STD-188-183-/A, HAVE QUICK II, ECCM, and the High performance waveform (HPW). Communication Interoperability among aviation, ground, and coalition units is crucial to mission success and Soldier survivability. If competing brand radios, other than HARRIS, were to be procured in support of this request the 2-149 GSAB may incur communication software compatibility and interoperability issues with higher, lower, and lateral units in theater. 2-149 GSAB cannot adequately quantify the effect or scope of these issues without knowing and planning for an alternative brand, model number, and capabilities of such radio systems procured.
VI. Efforts to Obtain Competition
Due compatibility issues mentioned above HARRIS is the only manufacturer and retailer available to meet the requirements of this procurement and ensure 2-149 GSAB mission success.
VII. Fair and Reasonable Costs
Comparable sources were not easily identified due to the proprietary nature of these products.
Previous purchases of these radios were found, but prices were not included as part of the award package (W15P7T-16-D-0002). Some sources for comparison were found for spare parts and radio components which were equal or less in dollars value charged for those components. Based upon established negotiated contracts from the program office, and comparison of historical spares contracts this price is considered fair and reasonable.
VIII. Market Research
After conducting market research utilizing the internet and interviews with local technical representatives it is determined that, HARRIS is the only known manufacturer of base station radio equipment to operate on the HF spectrum currently used in theater. The only known MIL- STD competitor to HARRIS is RATHEON who produces a competing multiband radio, the PSC- 5D, however the spectrum covered by the RATHEON radio, 30-512 MHz, does not equal the spectrum or the HARRIS 117G, 30 MHz to 2 GHz. Software compatibility and interoperability issues could result if RATHEON or another competing radio brand were procured to support this request.
IX. Interested Sources
Harris Radio Corporation
X. Steps to Foster Competition
Steps to foster competition will be limited unless the DOD at large changes the communication platform used in theater.
XI. Contracting Of f icer’s Certif ication
The contracting officer’s signature on the Justification Review Document evidences that he/she has determined this document to be both accurate and complete to the best of his/her knowledge and belief (FAR 6.303-2(a)(12)).
XII. Technical/Requirements Pe rsonnel’s Cer tif ication
As evidenced by their signatures on the J&A signature page, the technical and/or requirements personnel have certified that any supporting data contained herein which is their responsibility is both accurate and complete (FAR 6.303-2(b)).
