MEMORANDUM FOR 110 MSG/MSC (CONTRACTING)

SUBJECT: Justification and Approval for other than Full and Open Competition – 500KW
GENERATOR FUEL TANK FOR RPA OPERATIONS FACILITY
In accordance with 10 U.S.C. 2304 (c)(1) as stated in the Federal Acquisition Regulations, Part 11.105, I am requesting your approval for a "Brand Name Justification ". The following facts and rationale are presented for your consideration in accordance with FAR11.105 and FAR 6.303-1 (b)(1)(i).
1. I request the following purchase as a brand name purchase:
850 gallon Cummins Bridgeway dual-wall diesel fuel tank for 500kw fixed back-up generator.
Replacement of existing tank with larger dual-walled tank is required to utilize existing $120,000 generator for new RPA mission. Work will include replacement of fuel lines to meet Michigan code, fuel spill box, alarms, battery charger and batteries, and installation of seismic isolators.
2. In order to fulfill mission requirements, the following is needed:
The RPA Operations center requires a permanent 500kw diesel generator with a fuel tank sized to run for 24 hours without refueling. 110 CES was able to acquire a Cummins/Onan generator from Air Force surplus, saving approximately $120,000. The existing fuel tank does not meet
Michigan environmental code, nor does it have the fuel capacity to operate for 24 hours. A larger, code-compliant tank is required.
3. I request the purchase as a brand source purchase for the following reasons:
The base has an existing $120,000 Cummins/Onan diesel generator that will be used for the new
RPA Operations facility. The estimated $24,500 purchase price of the replacement fuel tank is significantly less than the cost of a new generator set with compliant fuel tank. Cummins
Bridgeway has the original specifications of the equipment they originally manufactured and manufacturer fuel tanks and accessories for that equipment. Failure to make this purchase will render the existing generator unusable for this mission, causing purchase of an alternate generator set at a much higher cost than this fuel tank and accessories.
4. The following harms may be experienced by the Government if “other than full and open” competition is not used.
Failure to make this purchase will render the existing generator unusable for this mission, causing purchase of an alternate generator set at a much higher cost (approximately $100,000) than this fuel tank and accessories. In accordance with FAR 6.302-1(a)(2)(iii), this substantial duplication in cost is justification for supporting a brand name determination.
5. The following Market Research was accomplished:
Research of manufacturer of existing generator. Consideration of alternate technical solutions including a separate fuel tank and construction of a secondary containment structure at the proposed generator location. No other option was considered feasible for this application. At this time, no other manufacturer appears to exist that can fulfill the Government requirement.
The required product is available from Cummins Bridgeway, LLC in Grand Rapids, MI. They are able to supply the products and perform he installation. They have a DUNS (127539034) and a Cage code (4NZT5) issued to their New Hudson, MI dealership.
6. Price Reasonableness:
The engineers estimate (prepared by Mead & Hunt for the RPA Operations Center project design) for the overall genset purchase was $125,000. The total line item price including labor and mark-ups was $180,021. Reusing the government-owned genset avoided the $125,000 purchase cost.
Price reasonableness will be based on a combination of market research in accordance with FAR
13.106-3(a)(2)(i), and historical pricing on proposed prices found reasonable in previous contracts in accordance with FAR 13.106-(a)(2)(ii).
7 I understand that this Justification and Approval will be posted on the Federal Business
Opportunities website in order to obtain maximum exposure for this requirement.
8 The following sources have expressed, in writing, their interest in this requirement: N/A
9 The following steps may be taken to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required:
In accordance with FAR 8.405-6(a)(2), this J&A will be posted on the website of the ordering activity agency for a minimum of 30 calendar days to notify all competing venders of this decision to limit sources. All interested sources will be able to challenge this decision for future consideration.
