PERFORMANCE WORK STATEMENT
Performance Work Statement
Mussel Sampling for Aquatic Ecology Projects
This Performance Work Statement (PWS) covers tasks and deliverables for mussel sampling for aquatic ecology projects. Project topics include development of biotic indices of sampled communities and interpretations of abundance, population status and condition of both native and non-native species occurring in large river systems.
The project area includes multiple USFWS Threatened and Endangered (T&E) mussel species and several state listed mussel species that requires the dive team to possess valid scientific collecting permits (e.g., USFWS permit, Kentucky and Illinois state permits) to handle/possess the noted species. Criteria outlined on the T&E permit application emphasize prior experience with each species and extensive familiarity working with these sensitive species in their natural settings.
Qualifications:
The contractor must have: 1) Valid scientific collecting permits (e.g., USFWS permit, Kentucky and Illinois state permits) to handle/possess the noted species Threatened and Endangered (T&E) mussel species; 2) experience sampling native and introduced mussels in rivers using total substratum removal methods as well as qualitative and transect survey methodologies for sampling large river mussel beds using divers; 3) experience with USACE diving requirements and certifications; 4) the ability to be approved for USACE dive projects.
Tasks and Deliverables
Task 1. Dive Requirements for Mussel Sampling for Olmsted L&D: Year 1
Annual surveys to monitor the mussel population in selected streams and rivers are ongoing. A certified dive team is required to access the mussel beds in the main channels where water depths may range 12-25’ deep depending on seasonal conditions. Each survey takes 5-days to collect mussel and zebra mussel samples and record GPS locations and water depths at sampling locations. The crew shall include divers experienced and familiar with sampling native mussels in rivers using total substratum removal methods as well as qualitative and transect survey methodologies for sampling large river mussel beds. Transect sampling requires previous experience locating mussels within a mixture of substrates and is solely dependent upon an effective tactile search to provide high quality data to address project deliverables. The work will include three work days utilizing a 6 diver team, conducting quantitative sampling (total substratum removal) as well as qualitative work, and two days of transect work with a 4 diver team. The crew will provide its own boats, trucks, trailers, and gear. Their responsibility will be to collect samples and associated data at sites using methods identified by ERDC scientists. ERDC scientists will be responsible for all aspects of survey design.
ERDC will provide a field crew with its own boat and gear to process samples as work proceeds.
Travel: One trip requiring 5-days of effort.
Deliverable: The dive crew’s obligations will be satisfied upon departure from the field once a log is provided to the chief of the ERDC field crew identifying an accounting of hours, persons responsible for retrieving each sample, and depths and locations of each sample location

Dive Requirements
Contractors are required to comply with the latest version, and all posted changes, of the U.S. Army Corps of Engineers Safety and Health Requirements Manual in effect on the issue date of this solicitation. EM 385-1-1 and changes are available on the Internet at https://www.usace.army.mil/Missions/Safety-and-Occupational- Health/Safety-and-Health-Requirements-Manual/. Prior to making an offer, offerors should check the referenced website for the latest changes. No separate payment will be made for compliance with the requirements of this paragraph, or for compliance with other safety requirements of the contract.
Prime contractor will be ultimately responsible for the implementation and enforcement of the project safety and occupational health (SOH) program for contractor employees, subcontractors, suppliers, visitors, and all others on the worksite.
All dive activities will be summarized in a dive plan and approved by the ERDC Dive Coordinator. A Dive Inspector will also be present in the field during diving activities. Contract requires an identified individual, Dive Inspector, to be qualified IAW with EM 385-1-1, 30.A.12 and have safety specific training required of a full-time safety officer (EM 385-1-1, 01.A.17). The Dive Inspector may be a Prime Contractor or Sub-Contractor employee and be designated in writing by the Prime Contractor. The Dive Inspector, who through experience and training, has the technical knowledge needed to anticipate, recognize, and evaluate hazardous conditions and recommend adequate corrective action and ensure corrections are made in a timely manner. Copies of safety specific certifications must be submitted prior to contract award.
Contracted work represents expertise in requested services. Contract requires verification by providing a copy of certification/qualification for the following services based off requirements in the most recent version of EM 385-1- 1:
Diving Operations (Chapter 30) Marine Activities (Chapter 19.D)
A qualified person must prepare the written APP in accordance with the format and requirements of EM 385-1-1, Appendix A. The APP must be job-specific and address any unusual or unique aspects of the project or activity for which it is written. The APP shall be submitted to the KO per the PWS requirements. Prime contractor shall review and update the APP, as necessary, throughout the life of the contract, whenever there is a significant change in hazards, and at least annually. When updates are made resubmit only the updates to the GDA for review and acceptance.
Contractor is responsible for all Personal Protective Equipment (PPE) as required to safely execute services IAW EM 385-1-1, OSHA, CFR, and contractor management. This includes labor that is assigned to work under the direction of other government employees (not the COR) but within the scope of the PWS.
The Contractor shall follow all accident reporting requirements, Exposure Hours and Lost Workday Reporting as per EM 385-1-1.
Note: USACE does not accept contractor risk.
Emergency Response and Contingency Procedures. Document a plan for responding to emergencies at the project.
Identify the emergency response team that would dispatch to the cleanup and investigation site at the time of an emergency, their location, contact information or calling instructions, average response time, capabilities of emergency response teams, and means of determining their present status. Procedures that will be used to assure that emergency response providers are equipped, qualified and familiar with the site configuration to provide rescue services before site operations begin. Describe emergency responses services to be performed by site workers and the resources available to them.
Government Furnished Property and Services
The government will provide sampling locations for all tasks.
Security Requirements
Access and General Protection/Security Policy and Procedures:
All contractor and all associated sub-contractors employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). The contractor shall also provide all information required for background checks to meet installation/facility access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office. Contractor workforce must comply with all personal identity verification requirements (FAR clause 52.204-9, Personal Identity Verification of Contractor Personnel) as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any installation or facility change, the Government may require changes in contractor security matters or processes.
Pre-screen candidates using E-Verify Program:
The Contractor must pre-screen Candidates using the E-verify Program (http://www.uscis.gov/e-verify) website to meet the established employment eligibility requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to enrollment to ensure the correct information is entered into the E-verify system. An initial list of verified/eligible Candidates must be provided to the COR no later than 3 business days after the initial contract award." *When contracts are with individuals, the individuals will be required to complete a Form I-9, Employment Eligibility Verification, with the designated Government representative. This Form will be provided to the Contracting Officer and shall become part of the official contract file.

The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services-- Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications- Commercial Products and Commercial Services. Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition.
(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.
115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to--
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.
115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to--
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services."
(d) Representations. The Offeror represents that--
(1) It [ ___ ] will, [ ___ ] will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation. The Offeror shall provide the additional disclosure information required at paragraph (e)(1) of this section if the Offeror responds "will" in paragraph (d)(1) of this section; and
(2) After conducting a reasonable inquiry, for purposes of this representation, the Offeror represents that--

(1) Disclosure for the representation in paragraph (d)(1) of this provision. If the Offeror has responded "will" in the representation in paragraph (d)(1) of this provision, the Offeror shall provide the following information as part of the offer:
(i) For covered equipment--
(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, if known);
(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and
(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
(ii) For covered services--
(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or
(B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
(2) Disclosure for the representation in paragraph (d)(2) of this provision. If the Offeror has responded "does" in the representation in paragraph (d)(2) of this provision, the Offeror shall provide the following information as part of the offer:
(i) For covered equipment--

52.204-27 PROHIBITION ON A BYTEDANCE COVERED APPLICATION (JUN 2023)
(a) Definitions. As used in this clause--
Covered application means the social networking service TikTok or any successor application or service developed or provided by ByteDance Limited or an entity owned by ByteDance Limited.
Information technology, as defined in 40 U.S.C. 11101(6)--
(1) Means any equipment or interconnected system or subsystem of equipment, used in the automatic acquisition, storage, analysis, evaluation, manipulation, management, movement, control, display, switching, interchange, transmission, or reception of data or information by the executive agency, if the equipment is used by the executive agency directly or is used by a contractor under a contract with the executive agency that requires the use-
(i) Of that equipment; or
(ii) Of that equipment to a significant extent in the performance of a service or the furnishing of a product;
(2) Includes computers, ancillary equipment (including imaging peripherals, input, output, and storage devices necessary for security and surveillance), peripheral equipment designed to be controlled by the central processing unit of a computer, software, firmware and similar procedures, services (including support services), and related resources; but
(3) Does not include any equipment acquired by a Federal contractor incidental to a Federal contract.
(b) Prohibition. Section 102 of Division R of the Consolidated Appropriations Act, 2023 (Pub. L. 117-328), the No TikTok on Government Devices Act, and its implementing guidance under Office of Management and Budget (OMB) Memorandum M-23-13, dated February 27, 2023, "No TikTok on Government Devices" Implementation Guidance, collectively prohibit the presence or use of a covered application on executive agency information technology, including certain equipment used by Federal contractors. The Contractor is prohibited from having or using a covered application on any information technology owned or managed by the Government, or on any information technology used or provided by the Contractor under this contract, including equipment provided by the Contractor's employees; however, this prohibition does not apply if the Contracting Officer provides written notification to the Contractor that an exception has been granted in accordance with OMB Memorandum M-23-13.
(c) Subcontracts. The Contractor shall insert the substance of this clause, including this paragraph (c), in all subcontracts, including subcontracts for the acquisition of commercial products or commercial services.

52.209-1 QUALIFICATION REQUIREMENTS (FEB 1995)
(a) Definition: "Qualification requirement," as used in this clause, means a Government requirement for testing or other quality assurance demonstration that must be completed before award.
(b) One or more qualification requirements apply to the supplies or services covered by this contract. For those supplies or services requiring qualification, whether the covered product or service is an end item under this contract or simply a component of an end item, the product, manufacturer, or source must have demonstrated that it meets the standards prescribed for qualification before award of this contract. The product, manufacturer, or source must be qualified at the time of award whether or not the name of the product, manufacturer, or source is actually included on a qualified products list, qualified manufacturers list, or qualified bidders list. Offerors should contact the agency activity designated below to obtain all requirements that they or their products or services, or their subcontractors or their products or services, must satisfy to become qualified and to arrange for an opportunity to demonstrate their abilities to meet the standards specified for qualification.

(d) Even though a product or service subject to a qualification requirement is not in itself an end item under this contract, the product, manufacturer, or source must nevertheless be qualified at the time of award of this contract.

If, after award, the Contracting Officer discovers that an applicable qualification requirement was not in fact met at the time of award, the Contracting Officer may either terminate the contract for default or allow performance to continue if adequate consideration is offered and the action is determined to be otherwise in the Government's best interests.
(e) If an offeror, manufacturer, source, product, or service has met the qualification requirement but is not yet on a qualified products list, qualified manufacturers list, or qualified bidders list, the offeror must submit evidence of qualification prior to award of this contract. Unless determined to be in the Government's interests, award of this contract shall not be delayed to permit an offeror to submit evidence of qualification.
(f) Any change in location or ownership of the plant where a previously qualified product or service was manufactured or performed requires reevaluation of the qualification. Similarly, any change in location or ownership of a previously qualified manufacturer or source requires reevaluation of the qualification. The reevaluation must be accomplished before the date of award.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e) (1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial products or commercial services. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause—
(i) 52.203-13, Contractor Code of Business Ethics and Conduct (NOV 2021) (41 U.S.C. 3509).
(ii) 52.203-19, Prohibition on Requiring Certain Internal Confidentiality Agreements or Statements (JAN 2017) (section 743 of Division E, Title VII, of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L.
113-235) and its successor provisions in subsequent appropriations acts (and as extended in continuing resolutions)).
