FOB: Destination
PSC CD: Y1PZITEM
Section 00 21 00 – Instructions, Conditions, and Notices to Offerors
1. GENERAL:
1.1. The Multiple Award Task Order Contracts (MATOCs) resulting from this solicitation are intended to support the U.S. Army Corps of Engineers, Galveston District (SWG) and the Southwestern
Division (SWD) primarily for the Bipartisan Budget Act of 2018 (BBA18). The MATOCs may also be used for horizontal construction needs in support of other USACE programs within the boundaries of the Southwestern Division (SWD), such as civil works, military, and Interagency and International
Services (IIS) support.
1.2. The contractor shall submit a proposal in accordance with the terms and conditions set forth in
Phase 1 of a two-phase procurement. DO NOT PROVIDE A PRICING PROPOSAL IN PHASE ONE
OF THIS RFP.
1.3. The Government intends to evaluate proposals, establish a competitive range that consists of the most highly rated proposals, and award after discussions. The Government reserves the right not to conduct discussions if the Contracting Officer determines they are not necessary.
1.4. Do not include exceptions to the terms and conditions of the solicitation in your proposal. If the offer includes any standard company terms and conditions that conflict with the terms and conditions of the solicitation, the offer may be determined "unacceptable" and thus ineligible for award. Any questions related to specific terms and conditions must be resolved prior to submission of the proposal.
1.5. In accordance with the FAR, no contract shall be entered into unless the contracting officer ensures that all requirements of law, executive orders, regulations, and all other applicable procedures have been met.
1.6. As this is a competitive negotiation acquisition, there is no public bid opening, and no information will be given out as to the number of offerors or the results of the competition until all awards are made.
1.7. Oral explanations or instructions are not binding. Any information given to an offeror which impacts the solicitation and/or offer will be given in the form of a written amendment to the solicitation.
1.8. The Government will not pay any costs incurred in the preparation and submission of the initial and/or any subsequent proposals.
1.9. Responders are advised that this requirement may be delayed, cancelled, or revised at any time during the solicitation, selection, evaluation, negotiation and/or final award process.
1.10. Offerors must be registered in System for Acquisition Management (SAM) (https://sam.gov) to be eligible for award. SAM requires new and updated accounts to be accompanied by a notarized letter appointing the authorized Entity Administrator for their SAM account(s). Acceptance of the letter and subsequent approval of SAM registration can take up to two months. In addition, ensure your SAM account indicates your firm is eligible for “All Awards.”
