Questions and Requests for Information in response to Notice of Procurement
W912HV-21-R-0005
1. Would subcontractors not having a JCAGE with a corresponding Japanese physical address be ineligible to be part of this contract?
Government response: Subcontractors are not required to have a CAGE code or JCAGE code. The prime contractor is required to have a JCAGE code and is required to have physical address in Japan. That physical address must be shown on the prime contractor’s record in the System for Award Management (SAM)
2. Could it be possible to have TOs >$500K (SRM funds, for example) under this IDC?
Government Response: No task orders exceeding $500,000 in value will be awarded under the proposed IDCs.
3. Does a “local” Japanese JV have to be registered with the Government of Japan or is a letter agreement JV acceptable?
Government Response: A copy of the joint venture’s operating agreement or joint venture resolution may be used to document the business relationship between parties within a joint venture. Companies operating physically in Japan must meet Japanese legal and regulatory requirements to operate in Japan, including any company registration or licensing requirements from the Government of Japan.
4. Do all partners in the JV require a Japanese business license (Tokibo Tohon) or is one locally registered partner sufficient?
Government Response: A joint venture, properly registered in SAM, is considered a separate company. The licensing of the joint venture depends on the authorities and responsibilities within the joint venture’s operating agreement or joint venture resolution. Also see the Government Response to question 3.
5. On the NOP, it doesn't seem to mention any preference on how the SF330 should be packaged, such as 3-hole-punch or 2-hole-punch, ring binder, or etc. Is there any preference to this or vice versa, what NOT to do?
Government Response: There is no preference. Please follow the submission requirements shown in paragraph 4 of the NOP.
6. It mentions that HN-funded programs are more favorable, meaning that we can include non-HN projects, but it would be less favorable, correct?
Government Response: Correct, as it relates to Sub-criterion a(1) and a(2).
7. What is the range of HN-funded projects? From our understanding, HN project would include JFIP, DPRI/SACO, and ATARA (Alliance Transformation and Realignment Agreement), but could it be any project that is funded by the Host Nation? Is there any other example of a HN project?
Government Response: HN-funded projects provide facilities in direct support of DoD personnel or programs and are funded by the HN which DoD personnel are stationed. JFIP/FIP, DPRI, and SACO are all examples of HN-funded programs.
Other HN-funded programs include, but are not limited to, Futenma Refurbishment program, Facilities Adjustment Panel – Sasebo (FAP-S) program, and Facilities Adjustment Panel – Kanagawa (FAP-K) program.
8. Would NAVFAC Far East project and DB/DBB projects be considered? NAVFAC is funded by the US, so we figured that it would be considered a non-HN project.
Government Response: Offerors should use their discretion when deciding which projects to submit. The Government will evaluate in accordance with the NOP.
9. PPQ wouldn't be applicable to US Gov. client, so NAVFAC wouldn't be applicable, correct? If so, what kind of project would be applicable for PPQ?
Government Response: Offerors may submit PPQs but they are not required. US Government clients routinely complete PPQs for contractors when requested.
10. For Joint Ventures: Will you require that all partners of the JV be located and licensed/registered here in Japan or can one of the partner of the JV be the one registered (lead of the JV) and the other a foreign company who does not have an residence/license/office here in Japan?
Government Response: Please see the Government Response to questions 3 and 4.
11. For the submittal: Is a hand carried submission be allowed to be provided at the USACE Okinawa Area Contracting Division due to we are located here in Okinawa?
Government Response: Firms may use their discretion to determine the best means for delivering SF330s (such as hand carried or use of delivery service), but SF330s must be delivered to both addresses required in the NOP. Please refer to Section 4 of Amendment 0001 for information on delivery options for the Okinawa Area Office.
12. The solicitation states that "Example projects must have contract completion dates within ten (10) years of the closing date for this announcement." This would imply that the CPs or BCPs must be 100% for inclusion in Section F. Can projects that are currently in progress be used in Section F? Will these projects be considered less favorably since it is not complete or not at all? Because these projects are in-progress, a CPARS would not have been issued. Would this disqualify the project or make it less favorable?
Government Response: Ongoing projects can be included as example projects in Section F, but will be evaluated less favorably than completed projects. Ongoing projects must be beyond the Pre-Final Report phase for report preparation or beyond the intermediate design phase for design document preparation as of the closing date for this announcement to be considered. If no performance information is available to evaluate ongoing projects, the offeror will be assigned a rating of neutral and shall not be evaluated favorably or unfavorably.
