Section 00 21 16 - Instructions to Proposers
PROPOSAL SUBMISSION REQUIREMENTS
A. INSTRUCTIONS, CONDITIONS, AND NOTICE TO OFFERORS
1. PROPOSAL REQUIREMENTS OVERVIEW
1.1. This Request for Proposal (RFP) solicits work for the construction of a FY25 AIWW Charleston to Port Royal.
The work consists of furnishing all plant, equipment, labor, transportation, fuel, lubricant, supplies, and materials; and performing all operations in connection with raising dikes and berms, and installation of new spillway systems in AIWW Placement areas 1717 C-P, 1789 C-P, 1835 C-P, & 2237 C-P, including clearing and appurtenant items.
1.2. Proposal Submissions and the Best Value Trade-off Source Selection Process: This process requires offerors to submit technical and performance capability information for evaluation by the Government against the uniform requirements identified in evaluation factors. Each of the factors will be evaluated against the evaluation criteria set out in this section.
2. PROPOSAL SUBMISSION INSTRUCTIONS
2.1. Who May Submit: Any legally organized Offeror qualified and eligible to receive an award under applicable laws and regulations.
2.1.1. The Government will only consider past performance of affiliates of the Offeror and those entities in a teaming agreement, whether a predecessor company, affiliated company, subsidiary (including wholly owned subsidiaries), or subcontractors, if the proposal demonstrates that the affiliate will participate meaningfully (e.g., roles, resources, responsibilities, etc.) in the performance of the contract. Absent a firm commitment of meaningful participation, the experience and/or past performance of any affiliate or team member outside of the Prime Offeror will not be considered.
2.1.2. Contractor Team Arrangements.
2.1.2.1. Recognition of Contractor Teams. In accordance with FAR Subpart 9.6, it is Government policy to recognize the integrity and validity of contractor team arrangements. For a teaming arrangement to be recognized for purposes of source selection evaluation and the application of non-price factors and sub-factors, there must be full disclosure of the teaming arrangement and company relationships in the team's proposal. The proposal must include a narrative that explains the major or critical aspects of the work to be performed by each team member. For joint venture teams, the proposal must also include an agreement that has been or will be executed prior to award between/among all team members. In the case of prime-sub teams, the prime contractor remains fully responsible for contract performance, regardless of any team arrangement between the prime contractor and its subcontractors. However, regardless of whether a formal team arrangement is proposed or recognized, consistent with FAR 9.104, the Government may consider the responsibility of subcontractor team members when it may adversely affect the prospective prime contractor’s responsibility or when it is in the Government’s interest to do so.
2.1.2.2. Joint Venture Team Agreement. The teaming agreement submitted with the proposal will govern the performance of the work by the joint venture. The agreement must address the following items:
identification of team members, a delineation of roles and responsibilities of team members, the duration of the agreement, and the percentages of the participants including the controlling party.
Agreements should not be subject to substantive revision because the agreement will be part of the evaluation process. The timely submission of the executed teaming agreement prior to award shall be a precondition to a finding of responsibility.
2.1.2.3. Restriction on Substitution. Regardless of any provision to the contrary in a team or subcontract agreement, all members of a recognized team arrangement are bound to perform any resulting contract and options by means of the same team. There can be no substitution of team members except that, in the case of a prime-sub team arrangement, the Government may (in its sole discretion and without any obligation whatsoever), at the request of the prime, permit the substitution of a subcontractor with equivalent or greater capability for a subcontractor on the identified team. The failure of the Offeror to perform with one or more subcontractors on a recognized team may be grounds for termination for default.
2.2. General Proposal Submission Requirements. To ensure timely and equitable evaluation of proposals, Offerors must follow the instructions contained herein. Offerors are required to meet all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors. The Offeror shall submit in the proposal all requested information specified in this section of the Request for Proposal (RFP) solicitation at or before the exact time specified.
There will be no public opening of the proposals received as a result of this RFP. Failure to meet a requirement may result in an offer being ineligible for award. Copies of the RFP are available by INTERNET ACCESS ONLY. All RFP documents will be made available for viewing at the Sam.Gov website (https://sam.gov). All Solicitation Amendments will be made available for viewing in Sam.Gov. It shall be the Offeror’s responsibility to check the website for any Solicitation Amendments.
The Contracting Officer (KO) has determined there is a reasonable probability of adequate price competition in this acquisition. Upon examination of the initial offers, the KO will review this determination and if, in the KO's opinion, adequate price competition exists, no additional cost information will be requested and certification under FAR 15.406-2 will not be required. However, if at any time during this competition, the KO determines that adequate price competition no longer exists, Offerors may be required to submit information to the extent necessary for the KO to determine the reasonableness and affordability of the price. The Government will evaluate all proposals pursuant to FAR 15.305(a). Offerors are advised that, pursuant to FAR 15.306, the Government reserves the right to eliminate any or all offers from consideration for award at any time prior to award of the contract. Therefore, each initial offer should contain the Offeror’s best terms from a technical and price standpoint. The Government reserves the right to discuss aspects of proposals with Offerors in the competitive range, if one is determined to be necessary, upon completion of the evaluation.
If an Offeror believes that the requirements in these instructions contain an error, omission or are otherwise unsound, the Offeror shall immediately notify the Contracting Division in writing (e-mail is the preferred method) with supporting rationale. Questions or other Requests for Information (RFI) shall be submitted via ProjNet (See Section 2.2.1).
This Request for Proposal (RFP) does not commit the Government to reimburse any costs incurred in the preparation and submission of a proposal or for any other costs incurred by any firm submitting a proposal in response to this Solicitation. Issuance of this RFP does not constitute an award commitment on the part of the Government. Proposals must set forth full, accurate and complete information as required by this RFP, including attachments, if applicable. The penalty for making false statements is prescribed in 18 U.S.C. § 1001.
Offerors are cautioned that “parroting” of the Technical requirements with a statement of intent to perform does not reflect an understanding of the requirement or capability to perform. Offerors are responsible for including sufficient details to permit a complete and accurate evaluation of each proposal. Proprietary information shall be clearly marked.
2.2.1. Inquiries. Interested parties with technical inquiries shall submit their inquiries in writing via “Bidder
Inquiry” in ProjNet at www.projnet.org\projnet. The bidder inquiry key is UAI4TD-686TUM. The Government reserves the right to decline addressing certain questions. Further, no questions, unless in the Government’s interest, will be answered any later than seven (7) calendar days prior to the stated deadline for responses to this announcement. Simple questions and answers will be made via ProjNet.
Official amendments to the RFP will be made on Sam.Gov. All Offerors are encouraged to register on ProjNet for alerts to stay abreast of Q&A’s that are posted in reference to this solicitation. Only self-registered users on ProjNet can submit & review inquiries.
To self-register, go to the webpage, click Register, select Agency USACE, SAC Charleston District, enter the required information, and select Register. Once registered, enter your email address and the Bidder Inquiry Key and from there you may submit and view inquiries. Those submitting inquiries will receive a system generated email notification when their inquiry has been processed and answered. It is the Offeror’s responsibility to monitor for inquiries and responses.
2.2.2. Electronic Proposals.
The Offeror’s bid/proposal shall be submitted electronically, as described below. The Offeror’s proposal shall not contain classified data. The use of hyperlinks in proposals are prohibited. The offeror’s proposal is due no later than the time and date specified in block 13 of the SF1442.

OTHER TRANSMISSION METHODS (EMAIL, FACSIMILE, REGULAR MAIL, HAND
CARRIED, ETC.) WILL BE ACCEPTED. The Government will neither accept proposals outside of the PIEE system, nor late proposals due to system delays or glitches. The Offeror’s proposal must be received by the Government by the date/time specified in the solicitation.
2.2.2.1. INSTRUCTIONS FOR SUBMITTING ELECTRONIC BIDS:
In an effort to reduce paperwork and cost, all bids shall be submitted electronically through the PIEE site. Submission shall be in Adobe PDF format.
Electronic submission sent via facsimile will not be accepted. Hand carried delivery or USPS/UPS/Fedex delivery of hard copies and/or CD-ROMs is not authorized. Offerors are responsible for ensuring that bids are submitted so as to reach the designated recipient. Offerors are responsible for allowing for allowing sufficient time for the bid to be received in accordance with the instructions provided.

3.2. Significant Strength. An aspect of an offerors’ proposal that has appreciable merit or appreciably exceeds specified performance or capability requirements in a way that will be appreciably advantageous to the Government during contract performance.
NOTE: Strengths identified in the successful offerors proposal will be incorporated in the resultant contract, if deemed appropriate.
3.3. Weakness. A flaw in the proposal that increases the risk of unsuccessful contract performance. See FAR
15.001.
3.4. Significant Weakness. A flaw in the proposal that appreciably increases the risk of unsuccessful contract performance. See FAR 15.001.
3.5. Deficiency. A material failure of a proposal to meet a government requirement or a combination of significant weaknesses in a proposal that increases the risk of unsuccessful contract performance to an unacceptable level.
See FAR 15.001.
3.6. Uncertainty. Any aspect of a non-cost/price factor proposal for which the intent of the offeror is unclear (e.g., more than one way to interpret the offer or inconsistencies in the proposal indicating that there may have been an error, omission or mistake).

The summary sheet shall include information for all columns.
Offerors shall include the Contractor’s Performance Assessment Reporting System (CPARS) record or completed Past Performance Questionnaire (PPQ), Attachment 3 at the end of this section for each project submitted. An interim completed CPARS rating will be considered if a final record is not available. If a completed CPARS record is not available, Offerors shall complete and provide a PPQ. If a CPARS is submitted, the first page of the PPQ (with blocks 1-5 completed) shall also be submitted.
The PPQ is provided for the Offeror to submit to the client (Point of Contact) for each relevant project submitted. Offeror must ensure correct phone numbers and email addresses are provided for the client.
Completed PPQs must be submitted with your proposal by the specified closing date and time.
Offerors should follow-up with clients to ensure timely submittal of completed questionnaires. If the offeror is unable to obtain a completed PPQ from a point of contact for a project(s) before proposal closing date, the Offeror shall complete blocks 1 – 5 of the PPQ and submit it with the proposal. Please note that, at a minimum, this first page of the PPQ must contain sufficient information for the government to determine the relevancy of the project. In addition, this will provide contract and client information for the respective project(s).
The Government may call and confirm information provided by the Offeror on the PPQs with the points of contact to the extent necessary to verify the information in the PPQ or to obtain additional information. The Government reserves the right to interview other individuals with direct knowledge of the offeror’s performance. The Offeror must provide the correct phone numbers and email addresses for the client Point of Contact. If the Government is unable to verify the information provided on the PPQs with the client Point of Contact, or by other sources available (e.g., CPARS), the Government reserves the right to disregard that project when evaluating the Offeror’s past performance and experience. Similarly, it is important for the PPQs to be signed by the Point of Contact. If PPQs are not signed by the client, the Government reserves the right to disregard the past performance ratings for that particular project.
By exception, the client may request submission of questionnaires directly to the Government’s point of contact (Contract Specialist), Evelyn Halliburton. Request may be made via email to Evelyn.I.Halliburton@usace.army.mil. This request must be coordinated by the client in advance no later than five (5) business days before the proposal due date. If the PPQ fails to arrive before the closing date and time, or if the information on the PPQ is insufficient to determine the Offeror’s name and appropriate solicitation number, it will not be considered.
Offerors are cautioned that the information submitted pertaining to a project shall be limited to the PPQ form and an additional page referenced below and shall contain enough information to determine the recency and relevancy of a project. Likewise, Project Information submitted in a format other than or in lieu of the PPQ format (to include CCASS /ACASS/CPARS) will not be considered. If available, an Offeror may include a completed CPARS in addition to the PPQ but not in lieu of. Offerors shall not incorporate by reference into their proposal PPQs previously submitted for other solicitations. Offerors may submit PPQs submitted on other procurements provided they are on the NAVFAC/USACE Past Performance Questionnaire Form.
Offerors may attach one (1) additional single-sided page (per PPQ) to further describe how the project is relevant to the RFP requirements. The following items shall be able to be derived from either the PPQ or the additional page:
a) Project Title, Contract Number, Location, and identify the entity serving as the Prime Contractor. Provide the role of the submitting offeror if not serving as the Prime Contractor.
b) Current percentage of construction complete and when it was or will be completed. If project is not yet complete, provide a description of work remaining to be completed.
c) Scope of the project, to include purpose/use of facility.
d) Size of the project (sq ft). Differentiate square footage of new construction versus renovation if the project includes both.
e) Role of firm; provide a description of type of work performed and percentage of work self-performed.
f) Dollar value of the project. List award and final including explanations for cost increases over
10%.
g) Award date, original Construction Completion Date (CCD) and explanations for schedule growth over 10%.
h) Whether the project was design/build (indicate designer of record) or design/bid/build.
i) Customer Primary Point of Contact and alternate POC (name, relationship to project, agency/firm affiliation, city, state, current and correct phone number, and current and correct email address).
If the offeror is a joint venture, the projects may be submitted for the joint venture itself or by a member of the joint venture. Offerors are advised to submit projects wherein the Offeror, or proposed joint venture members, played a significant role and to clearly define those roles. If any Offeror has multiple functions or divisions, limit the project examples to those performed by the division or unit submitting the offer. Ensure that the PPQs submitted for this Factor clearly describe the relevant characteristics of the project.
6.1.2. Submission Requirements:
6.1.2.1. The Prime / Construction Offeror shall submit a minimum of two (2), but no more than five (5), projects that are seventy-five percent (75%) or more complete or completed as the prime contractor or a major subcontractor within the last ten (10) years which are relevant to the work described in the scope of this contract. If an Offeror submits more than five (5) total project examples, only the first five
(5) will be evaluated. (See following paragraphs.)
6.1.2.2. Recency. All projects submitted for the Prime / Construction Offeror must be substantially completed within the last ten (10) calendar years prior to the issuance of this solicitation. An Indefinite Quantity Indefinite Delivery (IDIQ) contract may be submitted only if a single task order could be considered similar to this project. Submissions referencing the base indefinite delivery contract alone will not be considered. Task orders may not be combined in order for the project to be considered similar or to meet minimum dollar thresholds stated herein.
6.1.2.3. Relevancy. Projects submitted for the construction contractor shall have a total project value of at least
$5,000,000 at the time of award.
6.1.2.3.1. Projects considered similar in scope to this requirement include prior experience working in upland dredge material areas or similar in scope.
6.1.2.3.2. Other elements of relevancy that will result in additional consideration for a higher relevancy rating:
i. Larger (acreage/size) work areas
6.2. Other Sources. In addition to the above, the Government may review any other sources other than those provided by the Offeror for evaluating past performance and experience. These other sources may include but are not limited to, past performance and experience information retrieved through the Past Performance Information Retrieval System (PPIRS), including Contractor Performance Assessment Reporting System (CPARS), using all CAGE/UEI numbers identified in the proposal on the Proposal Data Sheet, inquiries of owner representative(s), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), and any other known sources not provided by the Offeror. If a CPARS evaluation exists for a submitted project, it will be considered.
While the Government may elect to consider data from other sources, the offeror must provide detailed, current, accurate and complete past performance information for evaluation by the Government.
6.3. Evaluation Criteria
6.3.1. Past Performance Evaluation: The past performance and experience evaluation results in an assessment of the Government’s confidence in the ability of the Offeror to meet the solicitation requirements. The past performance evaluation considers each Offeror’s demonstrated record of performance and experience on recent and relevant projects that involve a similar scope and magnitude of effort and complexities as this solicitation requires. One performance confidence assessment rating is assigned for each Offeror after evaluating the Offeror’s recent past performance and experience, focusing on performance and experience that is relevant to the contract requirements.
6.3.2. Recency and Relevancy Evaluation: Projects must meet the minimum criteria in sections 6.1. (and subsections) to be considered recent and relevant. If minimum criteria are met, projects will then be evaluated against the requirements of the RFP. Projects will be evaluated for relevancy based on the description of the project.
TABLE 1 - Past Performance Relevancy Ratings Rating Definition Very Relevant Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.
Relevant Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.
Somewhat Relevant Present/past performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires.
Not Relevant Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.
6.3.3 Confidence Assessment:
6.3.3.1 Offerors may increase the SSEB’s level of confidence if they are able to demonstrate successful performance in more or larger work areas as described in this RFP. Conversely, the SSEB may have a decreased level of confidence in Offerors whose past performance is limited amongst the project numbers and size as described in this RFP.
6.3.3.2 The Government will evaluate the Offeror's past performance and experience using the sources available to it including but not limited to: the example projects identified by the Offeror and submitted on the PPQs and any additional information received from references and CPARS or other sources.
Offerors may be provided an opportunity to address any negative past performance information, through clarifications, which the Offeror has not previously had an opportunity to respond if such information is determined to impact the rating to be assessed.
6.3.3.3 The Government will consider the recency of the performance, the relevancy including the context of the data, and the quality of the performance and general trends in performance and source of the information to reach a confidence assessment rating using Past Performance Confidence Ratings.
6.3.3.4 If no recent/relevant performance record is available or the Offeror’s performance record and experience is so sparse that no meaningful confidence assessment rating can be reasonably assigned this factor will be assigned a rating of “Unknown Confidence” (Neutral).
TABLE 2 - Performance Confidence Assessments Rating Description Substantial Confidence Based on the offeror’s recent/relevant performance record, the Government has a high expectation that the offeror will successfully perform the required effort.
Satisfactory Confidence Based on the offeror’s recent/relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.
Limited Confidence Based on the offeror’s recent/relevant performance record, the Government has a low expectation that the offeror will successfully perform the required effort.
No Confidence Based on the offeror’s recent/relevant performance record, the Government has no expectation that the offeror will successfully perform the required effort.
Unknown Confidence (Neutral) No recent/relevant performance record is available, or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned.
7. Tab C – Factor 2: Technical Approach Narrative
7.1 Submission Requirements: The Offeror shall submit a technical narrative describing their expertise and approach to constructing this project’s scope. The narrative shall be no more than 5 pages long and must contain the following information and be organized the same:

7.2 Evaluation Criteria:
7.2.1 Management Evaluation: The Government will evaluate proposals to ensure that they include and address each item from Paragraph 2.1 above. A proposal lacking any one of these items will be rated Unacceptable. The Management Approach will be evaluated to ensure that it includes distinct sections describing Superintendence, Quality Control Procedures, and Safety Management. Omission of adequate descriptions specific to this project for any area of the Management Approach may result in a rating of Unacceptable.
7.2.2 The Government will evaluate the strengths, weaknesses, and any deficiencies in the submission, as defined above (See Section 3 above). Based on the submission provided, the Government will evaluate the Offeror’s overall management narrative, and its understanding and capability to execute an awarded contract. For this factor, Offerors will be assigned a combined risk rating from the following table, based on the evaluation of the Offeror’s proposal in accordance with the requirements of the solicitation.
TABLE 3 - Combined Technical/Risk Ratings Adjectival Rating Definition
Outstanding Proposal indicates an exceptional approach and understanding of the requirements and contains multiple strengths, and risk of unsuccessful performance is very low.
Good Proposal indicates a thorough approach and understanding of the requirements and contains at least one strength, and risk of unsuccessful performance is low.
Acceptable
Proposal meets requirements and indicates an adequate approach and understanding of the requirements, and risk of unsuccessful performance is no worse than moderate.
Marginal Proposal has not demonstrated an adequate approach and understanding of the requirements, and/or risk of unsuccessful contract performance is high.
Unacceptable Proposal does not meet requirements of the solicitation, and thus contains one or more deficiencies, and/or risk of unsuccessful performance is unacceptable. Proposal is not awardable.
TABLE 4 - Technical Risk Ratings Adjectival Rating Description
Low Proposal may contain weakness(es) which have little potential to cause disruption of schedule, increased cost or degradation of performance.
Normal contractor efforts and normal Government monitoring will likely be able to overcome any difficulties.
Moderate Proposal contains a significant weakness or combination of weaknesses which may potentially cause disruption of schedule, increased cost, or degradation of performance. Special contractor emphasis and close Government monitoring will likely be able to overcome difficulties.
High Proposal contains a significant weakness or combination of weaknesses which Is likely to cause significant disruption of schedule, increased cost or degradation of performance. Is unlikely to overcome any difficulties, even with special contractor emphasis and close Government monitoring.
Unacceptable Proposal contains a material failure or a combination of significant weaknesses that increases the risk of unsuccessful performance to an unacceptable level.
