Section 00 21 16 - Instructions to Proposers
PROCEDURES FOR SUBMITTAL OF OFFERS AND PROPOSAL EVALUATION
1. Overview
1.1. The purpose of this acquisition is to provide a readily available contract tool that will enable the Charleston
District (SAC) to proactively and responsively execute the construction, renovation and repair requirements identified by the Department of Veteran Affairs (VA) or other partners of the Charleston District. The Government intends to establish a Multiple Award Task Order Contract (MATOC) with a target pool of five (5) contractors in order to provide Design Build (DB) services primarily for SAC’s program to support the Department of Veteran’s Affairs.
1.2. This contracting effort ensures that the Charleston District will be able to support the construction needs of the VA over the next five (5) years. The Government will evaluate the proposals in accordance with the criteria described herein.
1.3. This is a two-phase procurement, and the basis of award is the Best Value Trade-Off Process. Potential offerors are invited to submit the information described in this section for review and evaluation by the Government.
Following completion of the evaluation of Phase One, up to a maximum of eight (8) most highly qualified offerors will be selected to participate in Phase Two.
1.4. The selected offerors for Phase Two will be invited to submit the information described in Section 00 21 16, Procedures for Submittal of Offers for Phase Two, for review and evaluation by the Government. Site visit information (if held) will be provided during Phase Two.
1.5. Following completion of the Phase Two evaluation, the Contracting Officer will award a firm fixed price
MATOC to the responsible offerors whose proposals conform to the solicitation, are fair and reasonable, and offers the best overall value to the Government, all factors considered. It is anticipated that a seed project will also be awarded as a result of this solicitation. The Government reserves the right to accept other than the lowest priced offer or to reject all offers.
2. Submittal of Offers
2.1. Who May Submit: Any legally organized Offeror qualified and eligible to receive an award under applicable laws and regulations.
2.1.1. Contractor Team Arrangements.
2.1.1.1. Recognition of Contractor Teams. In accordance with FAR Subpart 9.6, it is Government policy to recognize the integrity and validity of contractor team arrangements. For a teaming arrangement to be recognized for purposes of source selection evaluation and the application of non-price factors and sub-factors, there must be full disclosure of the teaming arrangement and company relationships in the team's proposal. The proposal must include a narrative that explains the major or critical aspects of the work to be performed by each team member. For joint venture teams, the proposal must also include an agreement that has been or will be executed prior to award between/among all team members. In the case of prime-sub teams, the prime contractor remains fully responsible for contract performance, regardless of any team arrangement between the prime contractor and its subcontractors. However, regardless of whether a formal team arrangement is proposed or recognized, consistent with FAR 9.104, the Government may consider the responsibility of subcontractor team members when it may adversely affect the prospective prime contractor’s responsibility or when it is in the Government’s interest to do so.
2.1.1.2. Joint Venture Team Agreement. The teaming agreement submitted with the proposal will govern the performance of the work by the joint venture. The agreement must address the following items:
identification of team members, a delineation of roles and responsibilities of team members, the duration of the agreement, and the percentages of the participants including the controlling party.
Agreements should not be subject to substantive revision because the agreement will be part of the evaluation process. The timely submission of the executed teaming agreement prior to award shall be a precondition to a finding of responsibility.
2.1.1.3. Restriction on Substitution. Regardless of any provision to the contrary in a team or subcontract agreement, all members of a recognized team arrangement are bound to perform any resulting contract and options by means of the same team. There can be no substitution of team members except that, in the case of a prime-sub team arrangement, the Government may (in its sole discretion and without any obligation whatsoever), at the request of the prime, permit the substitution of a subcontractor with equivalent or greater capability for a subcontractor on the identified team. The failure of the Offeror to perform with one or more subcontractors on a recognized team may be grounds for termination for default.
2.2. General Proposal Submission Requirements. To ensure timely and equitable evaluation of proposals, Offerors must follow the instructions contained herein. Offerors are required to meet all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors. The Offeror shall submit in the proposal all requested information specified in this section of the Request for Proposal (RFP) solicitation at or before the exact time specified.
There will be no public opening of the proposals received as a result of this RFP. Failure to meet a requirement will result in an offer being ineligible for award. Copies of the RFP are available by INTERNET ACCESS ONLY. All RFP documents will be made available for viewing at the Sam.Gov website (https://sam.gov). All Solicitation Amendments will be made available for viewing in Sam.Gov. It shall be the Offeror’s responsibility to check the website for any Solicitation Amendments.
The Contracting Officer (KO) has determined there is a reasonable probability of adequate price competition in this acquisition. Upon examination of the initial offers, the KO will review this determination and if, in the KO's opinion, adequate price competition exists, no additional cost information will be requested and certification under FAR 15.406-2 will not be required; however, if at any time during this competition, the KO determines that adequate price competition no longer exists. Offerors may be required to submit information to the extent necessary for the KO to determine the reasonableness and affordability of the price. The Government will evaluate all proposals pursuant to FAR 15.305(a). Offerors are advised that, pursuant to FAR 15.306, the Government reserves the right to eliminate any or all offers from consideration for award at any time prior to award of the contract. Therefore, each initial offer should contain the Offeror’s best terms from a technical and price standpoint. The Government reserves the right to discuss aspects of proposals with Offerors in the competitive range, if one is determined to be necessary, upon completion of the evaluation. Offerors are advised that the Government may make award without discussions, clarifications or any contact concerning the proposals received. Offerors shall not assume that they will be contacted or afforded an opportunity to clarify, discuss or revise their proposals.
If an Offeror believes that the requirements in these instructions contain an error, omission or are otherwise unsound, the Offeror shall immediately notify the Contracting Division in writing (e-mail is the preferred method) with supporting rationale. Questions or other Requests for Information (RFI) shall be submitted via ProjNet (See Section 2.2.1). The Offeror is reminded that the Government reserves the right to award this effort based on the initial proposal, as received, without discussions.
This Request for Proposal (RFP) does not commit the Government to reimburse any costs incurred in the preparation and submission of a proposal or for any other costs incurred by any firm submitting a proposal in response to this Solicitation. Issuance of this RFP does not constitute an award commitment on the part of the Government. Proposals must set forth full, accurate and complete information as required by this RFP, including attachments, if applicable. The penalty for making false statements is prescribed in 18 U.S.C. § 1001.
Offerors are cautioned that “parroting” of the Technical requirements with a statement of intent to perform does not reflect an understanding of the requirement or capability to perform. Offerors are responsible for including sufficient details to permit a complete and accurate evaluation of each proposal. Proprietary information shall be clearly marked.
2.2.1. Inquiries. Interested parties with technical inquiries shall submit their inquiries in writing via “Bidder
Inquiry” in ProjNet at www.projnet.org\projnet. The bidder inquiry key is MAY53G-DGXKZN. The Government reserves the right to decline addressing certain questions. Further, no questions, unless in the Government’s interest, will be answered any later than seven (7) calendar days prior to the stated deadline for responses to this announcement. Simple questions and answers will be made via ProjNet.

4.1. Submission Requirements
4.1.1. (Applicable to 4.1.2 and 4.1.3 below) The Offeror shall demonstrate a record of construction or design performance and experience on recent and relevant projects using the Past Performance Questionnaire Summary Sheet, Attachment 2, and the Past Performance Questionnaire (PPQ), Attachment 3 at the end of this section. PPQ is provided for the Offeror to submit to the client (Point of Contact) for each relevant project submitted. Offeror must ensure correct phone numbers and email addresses are provided for the client. Completed PPQs or CPARS must be submitted with your proposal by the specified closing date and time. If submitting a CPARS assessment in lieu of a completed PPQ form, the offeror must also, at a minimum, include a completed first page of the PPQ form. Offerors should follow-up with clients to ensure timely submittal of completed questionnaires. If the offeror is unable to obtain a completed PPQ from a point of contact for a project(s) before proposal closing date, the Offeror shall complete blocks 1 – 5 of the PPQ and submit it with the proposal. Please note that, at a minimum, this first page of the PPQ must contain sufficient information for the government to determine the relevancy of the project. In addition, this will provide contract and client information for the respective project(s). The Government may call and confirm information provided by the Offeror on the PPQs with the points of contact to the extent necessary to verify the information in the PPQ or to obtain additional information. If the PPQ fails to arrive before the closing date and time, or if the information on the PPQ is insufficient to determine the Offeror’s name and appropriate solicitation number, it will not be considered.
Offerors are cautioned that the information submitted pertaining to a project shall be limited to the PPQ form and an additional page referenced below and shall contain enough information to determine the recency and relevancy of a project. Likewise, Project Information submitted in a format other than or in lieu of the PPQ format (to include CCASS /ACASS/CPARS) will not be considered. If available, an Offeror may include a completed CPARS in addition to the PPQ but not in lieu of. Offerors shall not incorporate by reference into their proposal PPQs previously submitted for other solicitations. Offerors may submit PPQs submitted on other procurements provided they are on the NAVFAC/USACE Past Performance Questionnaire Form.

In addition to the PPQ, the Offeror’s proposal shall include the Past Performance Questionnaire Summary Sheet (Attachment 2) to provide a summary of the PPQs included and/or submitted to clients.
The summary sheet shall include information for all columns.
If the offeror is a joint venture, the submitted projects may have been performed by the joint venture itself or by a member of the joint venture, subject to the requirements found in Sections
4.1.5 and 4.1.6. Offerors are advised to submit projects wherein the Offeror, or proposed joint venture members, played a significant role and to clearly define those roles. If any Offeror has multiple functions or divisions, limit the project examples to those performed by the division or unit submitting the offer. Ensure that the PPQs submitted for this Factor clearly describe the relevant characteristics of the project.
4.1.2. Submission Requirements for the Prime Offeror (Construction Offeror):
4.1.2.1. The Prime/Construction Offeror shall submit a minimum of three (3), but no more than five (5), substantially complete or completed projects as the prime contractor within the last five (5) years which are relevant to the work described in the scope of this contract. If an Offeror submits more than five (5) total project examples, only the first five (5) will be evaluated. (See following paragraphs.)
At least two (2) submitted projects shall have been completed in a medical/clinical facility.
4.1.2.2. Recency. All projects submitted for the Prime/Construction Offeror must be substantially completed within the last five (5) six (6) calendar years prior to the issuance of this solicitation. An Indefinite Quantity Indefinite Delivery (IDIQ) contract may be submitted only if a single task order could be considered similar to this project. Submissions referencing the base indefinite delivery contract alone will not be considered.
4.1.2.3. Relevancy. Projects Each project submitted for the construction contractor shall have an awarded value of at least $8,000,000 and be for new construction or renovation/construction with minimal incidental or associated work. Task orders or other projects may not be combined in order for the project to be considered similar or to meet minimum dollar thresholds stated herein.
The projects submitted must demonstrate that the Construction offeror was the prime contractor for that project. The prime contractor must have self-performed at least 15% of the work in accordance with FAR 52.219-14, Limitations on Subcontracting.
For projects submitted for work in a medical or clinical facility, such facilities shall mean an institution providing health care services. This can include a hospital or other licensed inpatient center; an ambulatory surgical or treatment center; a skilled nursing center; a home health agency; a diagnostic, laboratory, or imaging center; and a rehabilitation or other therapeutic health setting Projects shall demonstrate the same or similar type of work and complexity to those described in this solicitation. Projects completed outside the Continental United States (OCONUS) must also demonstrate similar construction techniques and standards as CONUS projects.
4.1.3. Submission Requirements for the A-E/Designer of Record (DOR):
4.1.3.1. The A-E/Designer of Record shall submit a minimum of three (3), but no more than five (5), substantially complete (100% design progress completed or at least 50% construction completed) projects within the last five (5) years which are relevant to the work described in the scope of this contract. If an Offeror submits more than five (5) total project examples, only the first five (5) will be evaluated. The proposed A/E firm must have been the DOR on the submitted project. (See following paragraphs.)
At least two (2) submitted projects shall have been completed in a medical/clinical facility.
4.1.3.2. Recency. All projects submitted for the A-E DOR must be substantially completed within the last five
(5) six (6) calendar years prior to the issuance of this solicitation. An Indefinite Quantity Indefinite Delivery (IDIQ) contract may be submitted only if a single task order could be considered similar to this project. Submissions referencing the base indefinite delivery contract alone will not be considered.
4.1.3.3. Relevancy. Projects submitted for the A-E DOR shall have an awarded value of at least $700,000
$500,000 and be for new construction or renovation/construction with minimal incidental or associated work. Task orders or other projects may not be combined in order for the project to be considered similar or to meet minimum dollar thresholds stated herein.
The proposed A/E firm must have been the DOR on the submitted projects. The role and responsibilities as the DOR must be identified for each project. Identification of more than one (1) design firm will result in an evaluation based on the least qualified firm. Indicate any previous working relationship with the prime contractor. All PPQ's or CPARS submitted for the DOR must be for that entity and describe / evaluate their performance on that project.
For projects submitted for work in a medical or clinical facility, as defined in 4.1.2.3 such facilities will be defined as being completed in a facility that is used primarily for the purpose of delivering health care.

4.1.8. Other Sources. In addition to the above, the Government may review any other sources other than those provided by the Offeror for evaluating past performance and experience. These other sources may include but are not limited to, past performance and experience information retrieved through the Past Performance Information Retrieval System (PPIRS), including Contractor Performance
Assessment Reporting System (CPARS), using all CAGE/DUNS numbers identified in the proposal on the Proposal Data Sheet, inquiries of owner representative(s), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), and any other known sources not provided by the Offeror. If a CPARS evaluation exists for a submitted project, it will be considered.
4.1.9. While the Government may elect to consider data from other sources, the offeror must provide detailed, current, accurate and complete past performance information for evaluation by the Government.
4.1.10. The Government will only consider past performance of affiliates of the Offeror and those entities in a teaming agreement, whether a predecessor company, affiliated company, subsidiary (including wholly owned subsidiaries), or subcontractors if the resources of those affiliates will have a direct impact on the performance of this contract. If relying on affiliate past performance, it is the Offeror’s responsibility to clearly demonstrate any such direct impact on performance. For the Past Performance factor only, the Government will consider projects submitted for the DOR if a letter of commitment, or teaming arrangement, is provided with the proposal.
4.2. Evaluation Criteria
4.2.1. Past Performance Evaluation: The past performance and experience evaluation results in an assessment of the Government’s confidence in the ability of the Offeror to meet the solicitation requirements. The past performance evaluation considers each Offeror’s demonstrated record of performance and experience on recent and relevant projects that involve a similar scope and magnitude of effort and complexities as this solicitation requires. One performance confidence assessment rating is assigned for each Offeror after evaluating the Offeror’s recent past performance and experience, focusing on performance and experience that is relevant to the contract requirements.
4.2.2. Recency and Relevancy Evaluation: Projects must meet the minimum criteria in sections 4.1.2 and
4.1.3 (and subsections) to be considered recent and relevant. If minimum criteria are met, projects will then be evaluated against the requirements of the RFP. Projects will be evaluated for relevancy based on the description of the project. Past performance evaluations on projects that are not recent and relevant will not be considered.
Table 1. Past Performance Relevancy Rating Method:
Rating Definition
Very Relevant Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.
Relevant Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.
Somewhat Relevant
Present/past performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires.
Not Relevant
Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.
4.2.2.1. Offerors may increase the Source Selection Evaluation Board’s (SSEB) level of confidence by demonstrating previous projects where the Offeror and the design firm(s) proposed in this factor worked together to complete a project with at least satisfactory results.
4.2.3. Confidence Assessment:
4.2.3.1. Offerors may increase the SSEB’s level of confidence if they are able to demonstrate successful performance in a wide variety of work as described in this RFP (General Description of Work, and Factor relevancy descriptions). Conversely, the SSEB may have a decreased level of confidence in Offerors whose past performance is limited amongst the project types described in this RFP. Offerors may increase the SSEB’s level of confidence if they submit more than three Design-Build projects.
4.2.3.2. The Government will evaluate the Offeror's past performance and experience using the sources available to it including, but not limited to, the example projects identified by the Offeror and submitted on the PPQs and any additional information received from references and CPARS or other sources. Offerors may be provided an opportunity to address any negative past performance information about which the Offeror has not previously had an opportunity to respond if such information is determined to impact the rating to be assessed.
4.2.3.3. The Government will consider the recency of the performance, the relevancy including the context of the data, and the quality of the performance and general trends in performance and source of the information to reach a confidence assessment rating using Past Performance Confidence Ratings.
4.2.3.4. If no recent/relevant performance record is available or the Offeror’s performance record and experience is so sparse that no meaningful confidence assessment rating can be reasonably assigned this factor will be assigned a rating of “Unknown Confidence” (Neutral).
Table 2. Past Performance Confidence Ratings
Rating Definition
Substantial Confidence
Based on the offeror’s recent/relevant performance record, the Government has a high expectation that the offeror will successfully perform the required effort.
Satisfactory Confidence
Based on the offeror’s recent/relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.
Neutral Confidence
No recent/relevant performance record is available or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned.
The offeror may not be evaluated favorably or unfavorably on the factor of past performance.
Limited Confidence
Based on the offeror’s recent/relevant performance record, the Government has a low expectation that the offeror will successfully perform the required effort.
No Confidence Based on the offeror’s recent/relevant performance record, the Government has no expectation that the offeror will be able to successfully perform the required effort.
5. Phase One – Tab H – Factor 2: Technical Approach for Design/Build
5.1. Submission Requirements
5.1.1. Provide a narrative that describes the offeror’s philosophy and intended technical approach for executing design-build projects. Clearly and concisely describe the offeror’s Design-Build team, and how the team will work collaboratively to ensure timely, quality completion of the project. The Technical Approach narrative shall address the information described in paragraphs 5.1.1.1. & 5.1.1.2.
below:
5.1.1.1. Roles and Responsibilities: Describe the roles and responsibilities of the offeror’s Design-Build team and how their resources will be utilized in order to deliver a design-build project. Describe the proposed management structure for the Design-Build team (i.e., key members), explaining how the design and construction process will be managed throughout the entirety of the project life cycle (e.g., Design - Review Process, Fast Track, etc.), Construction – Subcontractor Management, Commissioning, etc.), Close-out – As Built, O&M Manuals, etc.)).
5.1.1.2. Communication Plan: Describe interactions and communications both within the Design-Build team and with the Corps of Engineers throughout the entirety of the project life cycle.
NOTE: There is a page limit of eight (8) single-sided, 8.5” x 11” pages, using a minimum font size of 11 10 and a minimum margin of one-half inch on all sides, for the Technical Approach for Design/Build Factor.
5.2. Evaluation Criteria:
5.2.1. The Government will review and identify the strengths, weaknesses, and any deficiencies in the proposal. The Government will evaluate the proposal based on the offeror’s understanding of the USACE Design/Build process and how well it has demonstrated its ability to successfully execute design-build projects. Offerors are encouraged to tailor their proposal to demonstrate their approach for successfully completing work under this MATOC.
5.2.2. The Government will evaluate the offeror’s understanding of the design process and the roles of the designers of record, construction firm, and the Government reviewers. The evaluation will be based on how well the offeror demonstrates their organizational (i.e., the structure and staffing) ability to execute design/build projects, to include the integration of the design and construction firms during design and construction. Proposals demonstrating that construction personnel will be actively involved in the design process may be viewed more favorably by the SSEB. The Government will evaluate the role of the designer in maintaining design integrity throughout the process, including its key roles during construction.
5.2.3. The Government will evaluate the offeror’s capabilities and understanding of the contractually required quality control processes for both design and construction, as well as the strength of the offeror’s proposed approach to control and track revisions to the design. The Government places value upon continued participation by the designers of record during the construction quality control process.
5.2.4. Proposals demonstrating a detailed approach for working multiple construction projects of $8,000,000 or greater may be viewed more favorably by the SSEB.
