The time stated for completion shall include final cleanup of the premises.

(End of supplemental instructions)

TIME EXTENSIONS FOR UNUSUALLY SEVERE WEATHER (ER 415-1-15) (OCT 1989)

(a) This provision specifies the procedure for the determination of time extensions for unusually severe weather in accordance with the contract clause entitled DEFAULT (FIXED-PRICE CONSTRUCTION). In order for the Contracting Officer to award a time extension under this clause, the following conditions must be satisfied:

(1) The weather experienced at the project site during the contract period must be found to be unusually severe, that is, more severe than the adverse weather anticipated for the project location during any given month.

(2) The unusually severe weather must actually cause a delay to the completion of the project. The delay must be beyond the control and without the fault or negligence of the Contractor.

(b) The following schedule of monthly anticipated adverse weather delays is based on National Oceanic and Atmospheric Administration (NOAA) or similar data for the project location and will constitute the base line for monthly weather time evaluations. The Contractor’s progress schedule must reflect these anticipated adverse weather delays in all weather dependent activities.

MONTHLY ANTICIPATED ADVERSE WEATHER DELAY

WORKDAYS BASED ON 5-DAY WORK WEEK

JAN FEB MAR APR MAY JUN JUL AUG SEP OCT NOV DEC

8 6 8 3 6 5 5 6 4 3 4 7

10 7 10 4 7 6 6 7 5 4 5 8

(c) Upon acknowledgment of the Notice to Proceed and continuing throughout the contract, the Contractor will record on the daily Contractor Quality Control report the occurrence of adverse weather and resultant impact to normally scheduled work. Actual adverse weather delay days must prevent work on critical activities for 50 percent of more of the Contractor’s scheduled workday. The number of actual adverse weather delay days shall include days impacted by actual adverse weather (even if adverse weather occurred in previous month), be calculated chronologically from the first to the last day in each month, and be recorded as full days. If the number of actual adverse weather delay days exceeds the number of days anticipated in paragraph (b) above, the Contracting Officer will convert any qualifying delays to calendar days, giving full consideration for equivalent fair weather workdays, and

Section 00 73 00 Page 2 issue a modification in accordance with the contract clause entitle DEFAULT

This section requires the Contractor to implement practices and procedures for general contract requirements.

1.2. PAYMENT

Separate payment will not be made for general contract requirements, and all associated costs therewith shall be included in the applicable unit prices or lump sum prices contained in the Bidding Schedule.

1.3. PRECONSTRUCTION CONFERENCE

1.3.1. Conference

A Preconstruction Conference will be arranged by the Contracting Officer's Representative after award of contract and before commencement of work. The Contracting Officer's Representative will notify the Contractor of the time and date set for the meeting. At this conference, the Contractor shall be oriented with respect to Government procedures and line of authority, contractual, administrative, and construction matters. Additionally, a schedule of required submittals will be discussed. The Contractor shall bring to the preconstruction conference the required preconstruction submittals in completed form.

A Letter of Record will be written documenting all items discussed at the conference and a copy will be furnished by the Contracting Officer's Representative to all in attendance.

1.4. CERTIFICATES OF COMPLIANCE

Any certificates required for demonstrating proof of compliance of materials with specification requirements shall be executed in three (3) copies unless otherwise specified. Each certificate shall be signed by an official authorized to certify in behalf of the manufacturing company and shall contain the name and address of the Contractor, the project name and location, and the quantity and date or dates of shipment or delivery to which the certificates apply. Certification shall not be construed as relieving the Contractor from furnishing satisfactory material.

1.5. PHYSICAL CONDITIONS AND DATA

1.5.1. General

In accordance with Contract Clause FAR 52.236-4, data and information furnished or referred to below are for the Contractor's information. The Government shall not be responsible for any interpretation of or conclusion drawn from the data or information by the Contractor.

1.5.2. Physical Conditions

The physical conditions indicated on the drawings and in the specifications are the results of site investigations by the U.S. Army Corps of Engineers, Charleston District (USACE-SAC). It highly recommended that bidders conduct their own investigations and examine the areas of work to decide for themselves the wetness of the site, the character of the materials, and the difficulties of performing the work.

SECTION 01 10 00 PAGE 3

1.5.3. Weather Conditions

The areas in which work is to be done under these specifications are workable during the entire year; however, tropical storms may require that operations be suspended temporarily. The season for tropical storms is during the period June – November; during such disturbances precaution should be taken to secure all plant and equipment. In addition, heavy saturating rains can occur at any time of the year which will render the placement site and/or the materials too wet to work for extended periods of time.

1.5.4. Transportation Facilities

The Port of Charleston is served by the CSX Railroad Company. Marine repair facilities, docking and fueling facilities, provisions, and marine supplies are also available.

1.5.5. Tidal Information

Tidal benchmark information may be obtained from U.S. Department of Commerce, National Oceanic and Atmospheric Administration, National Ocean Service at the NOS website, www.co-ops.nos.noaa.gov.

1.5.6. Channel Traffic

Charleston Harbor is served by large commercial ocean-going vessels, small freight boats, tugs, tow boats, barges, launches, pleasure crafts and fishing vessels.

1.5.7. Obstruction of Channel

The Government will not undertake to keep the channel free from vessels or other obstructions, except to the extent of such regulations, if any, as may be prescribed by the Secretary of the Army, in accordance with the provisions of Section 7 of the Rivers and Harbors Act approved 8 August 1917. The Contractor will be required to conduct the work in such a manner as to obstruct navigation as little as possible, and in case the Contractor's plant so obstructs the channel as to make it difficult or endanger the passage of vessels, said plant shall be promptly moved on the approach of any vessel to such an extent as may be necessary to afford a practicable passage. Upon completion of the work the Contractor shall promptly remove his plant, including ranges, buoys, piles and other markers placed by him under the contract in navigation waters or on the shore.

1.5.8. Site Location and Access

Clouter Creek Placement Area is located on the east bank of the Cooper River, about four (4) miles upstream of the confluence of the Wando and cooper Rivers, and about seven (7) miles north of Charleston, South Carolina, and is accessible only by water. The Contractor shall obtain any and all rights-of-of-entry across private lands which he may use. The Contractor shall be held responsible for liabilities of any nature or kind arising from any trespassing or damage occasioned by his operations.

1.6. SUSPENSION OF OPERATIONS

The government may suspend operations of any and all equipment when conditions exist which would hinder satisfactory performance. These conditions include, but are not limited to, adverse weather, wet materials, unstable foundations, or Contractor inefficiency. No payment will be made for lost time under such suspensions. The Contractor has the option, under suspensions of more than fourteen (14) calendar days, of moving equipment http://www.co-ops.nos.noaa.gov/

SECTION 01 10 00 PAGE 4

from the site of assignment, as convenience requires. If the Contractor exercises this option, additional mobilization and demobilization costs will be negotiated, but only in cases where such suspension does not involve Contractor inefficiency. The plant shall be returned, during such authorized suspensions, within five (5) calendar days after receipt by the Contractor or his authorized representative of notice to resume operations.

1.7. MOVEMENT OF EQUIPMENT

It shall be the responsibility of the operator to determine suitability of supporting ground prior to advancement of equipment. If the operator advances a piece of equipment in a negligent manner, as determined by the Contracting Officer, and bogs down equipment, no payment will be allowed for such bogged-down time.

SD-01 Preconstruction Submittals

Submittal Register (Reference Subsection SUBMITTAL

REGISTER)

1.5. SUBMITTAL CLASSIFICATION

Submittals are classified as follows:

1.5.1. Government Approved

Governmental approval (G) is required for extensions of design, critical materials, deviations, and other items as designated by the Contracting Officer. Government approval is required for any deviations from the Solicitation or Accepted Proposal and other items as designated by the Contracting Officer. Within the terms of the Contract Clause 52.236-21 SPECIFICATIONS AND DRAWINGS FOR CONSTRUCTION, they are considered “shop drawings.”

1.5.2. Information Only

Submittals not requiring Government approval will be for information only.

They are not considered “shop drawings” within the terms of the Contract Clause referred to above.

1.6. PREPARATION

1.6.1. Transmittal Form

A transmittal form (ENG Form 4025-R) shall be used for submitting both Government approved and information only submittals in accordance with the instructions on the second page of the form. This form is included in the QCS module that the Contractor is required to use for this contract. Properly complete this form by filling out all the heading blank spaces and identifying each item submitted. Exercise special care to ensure proper listing of the specification paragraph and sheet number of the contract drawings pertinent to the data submitted for each item.

1.6.2. Electronic File Format

Provide submittals in electronic format, with the exception of material samples required for SD-04 Samples items. Compile the submittal file as a single, complete document, to include the Transmittal Form described within.

Electronic files must be of sufficient quality that all information is legible. Use PDF as the electronic format, unless otherwise specified or

SECTION 01 33 00 PAGE 6

directed by the Contracting Officer. Generate PDF files from original documents with bookmarks so that the text included in the PDF file is both searchable and can be copied. If documents are scanned, Optical Character Resolution (OCR) routines are required. Index and bookmark files exceeding 30 pages to allow efficient navigation of the file. Set PDF Document Properties for the Initial View, Navigation Tab to display "Bookmarks Panel and Page." When required, the electronic file must include a valid electronic signature, or scan of a signature.

Email electronic submittal documents fewer than 10MB to an email address as directed by the Contracting Officer. Provide electronic documents over 10MB through an electronic file sharing system such as the AMRDEC SAFE Web Application located at the following website:

https://safe.amrdec.army.mil/safe/. Follow local procedures for notifying, maintaining records, and transmitting records of all file transfers as directed by the Contracting Officer.

Up to 1 additional hard copy of any submittal may be requested at the discretion of the Contracting Officer, at no additional cost to the Government.

1.7. INFORMATION ONLY SUBMITTALS

Normally submittals for information only will not be returned. Approval of the Contracting Officer is not required on information only submittals. The Government reserves the right to require the Contractor to resubmit any item found not to comply with the contract. This does not relieve the Contractor from the obligation to furnish material conforming to the plans and specifications; will not prevent the Contracting Officer from requiring removal and replacement of nonconforming material incorporated in the work;

and does not relieve the Contractor of the requirement to furnish samples for testing by the Government laboratory or for check testing by the Government in those instances where the technical specifications so prescribe.

1.8. VARIATIONS
