NOTES TO BIDDERS

Note 1: In order to be considered for award, the offeror must submit a coefficient for each line item above. The Government uses these multipliers to determine the price of work for each task on individual delivery orders. The prices established in the RS MEANS® (current year) database bare costs (which means no markup for overhead and profit (O&P)) column, will be multiplied by the City Cost Index Weighted Average Total for the closest city, and the coefficient to arrive at the actual price for a unit of work. The coefficients shall be represented as"net", a "decrease from" or an "increase to" the prices listed in the RS MEANS®. An offer of "net" would be represented as "1.0." An example of a decrease from the prices in RS MEANS® would be "0.98." An example of an increase above the prices listed in the RS MEANS® would be "1.10."

Note 2: If the Government directs a work schedule during nonstandard hours, then the coefficients entered for the nonstandard hours, as appropriate, shall be applied against those items of work, which will be performed during the nonstandard hours. The price for the remaining items of work is calculated using the coefficients entered for standard hour work, as appropriate. The term "nonstandard working hours" is not to be interpreted as "overtime."

THE FOLLOWING APPLIES TO ALL GENERAL DECISIONS

Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).

The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is union or non-union.

Union Identifiers

An identifier enclosed in dotted lines beginning with characters other than "SU" denotes that the union classification and rate have found to be prevailing for that classification. Example: PLUM0198-005 07/01/2011. The first four letters , PLUM, indicate the international union and the four-digit number, 0198, that follows indicates the local union number or district council number where applicable , i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. The date, 07/01/2011, following these characters is the effective date of the most current negotiated rate/collective bargaining agreement which would be July 1, 2011 in the above example.

Union prevailing wage rates will be updated to reflect any changes in the collective bargaining agreements governing the rate.

Non-Union Identifiers

Classifications listed under an "SU" identifier were derived from survey data by computing average rates and are not union rates; however, the data used in computing these rates may include both union and non-union data. Example: SULA2004-007 5/13/2010. SU indicates the rates are not union rates, LA indicates the State of Louisiana; 2004 is the year of the survey; and 007 is an internal number used in producing the wage determination. A 1993 or later date, 5/13/2010, indicates the classifications and rates under that identifier were issued as a General Wage Determination on that date.

Survey wage rates will remain in effect and will not change until a new survey is conducted.

WAGE DETERMINATION APPEALS PROCESS

1.) Has there been an initial decision in the matter? This can be:

* an existing published wage determination

* a survey underlying a wage determination

* a Wage and Hour Division letter setting forth a position on a wage determination matter

* a conformance (additional classification and rate) ruling

On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)

and 3.) should be followed.

With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:

Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:

Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.

3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:

Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

4.) All decisions by the Administrative Review Board are final.

00120 EVALUATION FACTORS

SECTION 00120 – EVALUATION FACTORS FOR AWARD

1. GOVERNMENT INTENT RELATING TO AWARD. It is the Government’s intent to award a single Indefinite Delivery/Indefinite Quantity (IDIQ) Job Order Contract (JOC) pursuant to this solicitation.

1.1. BASIS FOR AWARD

1.1.1. Evaluation and Selection Procedures. The tradeoff process has been determined as appropriate for this acquisition. In accordance with the Federal Acquisition Regulations (FAR), the Government may award the resulting contract to other than the lowest priced or highest technically rated offer.

1.1.2. The Government intends to evaluate proposals and award a contract without conducting discussions with offerors. Therefore, Offerors are reminded to include their best technical and price terms in their initial offer and not to automatically assume there will be an opportunity to participate in discussions or submit a revised offer.

Exception to the contractual terms and conditions of the solicitation (e.g., standard company terms and conditions) may result in rejection of a proposal.

1.1.3. Proposals must meet the criteria stated in the RFP in order to be eligible for award, to include responsiveness and technical acceptability. The evaluation of technical capability will be accomplished without reference to cost. If no award on initial offers is made under the authority of the Clause entitled, “Instructions To Offerors – Competitive Acquisition ” of this solicitation, then the procedures of FAR Subpart 15.3-Source Selection and DOD Source Selection Procedures will be followed in making a recommendation for award which will be provided to the Contracting Officer as a basis for final determination. Offerors are advised that subjective judgment on the part of the Government evaluators is implicit in the entire process.

1.1.4. The Government reserves the right to conduct discussions if the Contracting Officer deems it necessary. In addition, if the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals. Should a competitive range be established, the Government will conduct discussions in accordance with FAR 15.306.

1.1.5. Award will be made to the offeror whom the Government determines will be able to accomplish the necessary work in the manner most advantageous to the Government and whose offer represents the best value to the Government, as determined by the Source Selection Authority (SSA) after considering all factors. Best value means the expected outcome of an acquisition that, in the Government’s estimation, provides the greatest overall benefit in response to the requirement.

1.1.6. The Government reserves the right to accept other than the lowest priced offer(s), and to reject any and all offers.

2. TECHNICAL EVALUATION FACTORS. The technical factors being evaluated are listed below. All offeror’s proposals will be evaluated for technical quality and assigned an adjectival rating based upon the criteria set forth herein. Past Performance will be assigned a Performance confidence assessment.
