About this file

This is a Justification and Approval (J&A) document for other than full and open competition to allow the use of brand name Dormakaba LLCO 790 series with Best manual override lock keycard entry system for the VOLAR Barracks Renovation at Fort Stewart, Georgia under task order W912HN20F3009. The J&A is submitted by the U.S. Army Corps of Engineers, Savannah District for an estimated amount of $335,845.20 to standardize RFID keys and locks across four barracks facilities.

The justification cites that this specific system is required because it works with Fort Stewart Housing Software, while the initially designed VingCard Classic RFID system does not. The Dormakaba system is standardized across Fort Stewart to allow emergency and security personnel quick access to facilities using a single system. Market research indicated four companies in the commercial marketplace offer the required system, and competition will exist at the subcontracting level for suppliers and installers. A Notice of Intent and sources sought notice was posted on December 20, 2024. The contract modification is within scope of the original $41M contract that has already been awarded.

FAR Part 6 Justification and Approval for Other than

Full and Open Competition

1. Contracting Activity: U.S. Army Corps of Engineers (USACE), Savannah District, 100 W. Oglethorpe Ave, Savannah, GA 31401

2. Description of Action: USACE Savannah District is requesting approval for the usage of a brand name item to be incorporated into the renovation of the VOLAR Barracks at Fort Stewart; Dormakaba LLCO 790 series with Best manual override lock keycard entry system. The initial basis of design for this project used the Classic RFID by VingCard. However, those cannot be used with the Fort Stewart Housing Software. The Dormakaba LLCO 790 series with Best manual override lock keycard entry system does work with the Fort Stewart Housing Software and is standardized across Fort Stewart for both convenience of utilizing one system and for emergency personnel and security personnel to quickly gain access to Government facilities in the case of an emergency.

3. Description of Supplies/Services: USACE has a requirement to renovate four barracks facilities on Fort Stewart, GA under task order W912HN20F3009 with an approximate value of $41M. The contract has already been awarded but a modification is necessary to incorporate the standardization of RFID keys and locks. The estimated price of the locks required for the four barracks is $335,845.20. The labor for the locks has already been incorporated into the contract.

4. Authority Cited: The statutory authority permitting acquisition of the requirement by other than full and open competition is 10 U.S.C. 3204 (a)(1) as implemented by Federal Acquisition Regulation (FAR) 6.302-1(a)(2), FAR 6.302-1(c) Only one responsible source and no other supplies or services will satisfy agency requirements, and Defense Federal Acquisition Regulation Supplement (DFARS) 206.302-1(c)(2) and (S-70). This authority is applicable to a brand name justification in accordance with (IAW) FAR 6.302(c)(1).

5. Reason for Authority Cited: As described at FAR 6.302-1(a)(2), when the supplies or services required by the agency are available only from one responsible source, or for DoD, NASA and the Coast Guard, from only one or a limited number of responsible sources, and no other types of supplies or services will satisfy agency requirements, full and open competition need not be provided for. As further described in FAR 6.302-1(c), an acquisition or portion of an acquisition that uses a brand-name description or other purchase description to specify a particular brand-name, product, or feature of a product, peculiar to one manufacturer does not provide for full and open competition, regardless of the number of sources solicited; and shall be justified and approved in accordance with FAR 6.303 and 6.304.

a. Background: Due to post wide compatibility issues, Fort Stewart DPW has implemented the use of certain RFID locks and entry systems to be used on barracks projects.

b. Justification: In order to increase the ability of emergency and safety personnel to access systems, Fort Stewart DPW is requiring the use of “brand name” or equal RFID lock and key card systems. Like systems eliminates the need for emergency and safety personnel to carry and maintain multiple access cards and reduces the training required for personnel. Reducing the timeframe of emergency personnel to access barracks rooms is essential to the safety of Soldiers on Fort Stewart.

c. Alternatives: There is a wide range of RFID key card door lock systems on the commercial market. However, systems are rarely compatible with other systems and can create a significant impact to personnel gaining access.

Impact: If the J&A is not approved and different systems are used across Fort Stewart, there is a high likelihood that emergency and safety personnel will be delayed or unable to gain access to a barracks room in the event of a significant event. In these cases, loss of life and personal property would have a serious impact on unit readiness and morale.

6. Efforts to Obtain Competition: In accordance with DFARS 206.302-1(d) and DFARS PGI 206.302-1(d), a Notice of Intent (NOI) and sources sought notice was posted on 20 Dec 2024, with the results of this inquiry included below in Section 8 Market Research and Section 9 Interested Sources.

a. Effective Competition: The Dormakaba LLCO 790 series with Best manual override lock products are readily available from multiple authorized suppliers. Additionally, the type of lock used would not limit competition as the contract has already been awarded and the modification is within scope.

b. Subcontracting Competition: Multiple authorized suppliers will be available to compete to provide Dormakaba LLCO 790 series with Best manual override lock products at a subcontracting level. It is likely that the competition will exist for installers and suppliers.

7. Actions to Increase Competition: Based on Market Research (Section 8 of this document), there are four (4) companies in the commercial marketplace that offer the Dormakaba LLCO 790 series with Best manual override lock. It is apparent that there are adequate numbers of authorized suppliers available to provide the required item.

Due to this, there are no planned actions to increase competition for the requirement.

8. Market Research: As previously indicated, in accordance with DFARS 206.302-1(d) and DFARS PGI 206.302-1(d), a NOI and sources sought notice was posted on 20 Dec 2024. Market research indicated that competition for the brand name product, Dormakaba LLCO 790 series with Best manual override lock, will exist since they are readily available in the commercial marketplace and there are multiple companies that are licensed to sell the products. It is reasonable to expect that a fair and reasonable price will result from adequate competition at the subcontracting level. The equipment is installed based on drawings and specifications by the engineers and locksmiths.

9. Interested Sources: The results and the NOI and sources sought notice indicated availability of the required system in the commercial marketplace. Subcontracting will be available for these systems. This J&A will be posted with the issuance of the solicitation in accordance with FAR 5.102(a)(6).

10. Other Facts: Reasonable efforts were made to retrieve other facts from computer records, contract files, and other sources to support the use of other than full and open competition as follows:

A. Procurement history:

1) The competitive status of these actions: Full and Open.

2) Authority previously cited if less than full and open competition was used: Not Applicable.

B. Other facts: None known.

11. Technical Certification: I certify that the supporting data under my cognizance which are included in the justification are accurate and complete to the best of my knowledge and belief.
