Control No. SAS 18-01 v4, 5 Jan 2015; previous version obsolete

SOLE SOURCE JUSTIFICATION

(Simplified Acquisition Procedures under FAR Part 13 Not Exceeding $700K)

1. Agency/Contracting Activity: U.S. Army Engineer District, Savannah, 100 West Oglethorpe Avenue, Savannah, GA 31401

2. Description of Action:

Nature: New Requirement Follow-on Requirement

Mod to Existing Purchase Order/Contract Number

Pricing: Firm-Fixed Price Time & Materials Funds: OMA Other Funds: SEPA Preference Customer Funds

Name of Proposed Contractor(s): McNaughton McKay Electric Co.

Street Address: 35 Old Mill Road City, State, Zip: Greenville, SC 29607 Phone: (864) 281-0572

3. Description of Services or Supplies:

The total estimated value of the proposed action is $194,150

4. Authority:

Action using simplified acquisition procedures (select one):

FAR 13.106-1(b)(1): For purchases not exceeding the simplified acquisition threshold (SAT), contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g. urgency, exclusive licensing agreements, brand name, or industrial mobilization)

1. This request is for the procurement of 22 (Each) Allen Bradley 1756-L82E ControlLogix 5580 Programmable Logic Controllers (PLC) and 22 (Each) 1784-SD2 SD Storage Cards.

2. This procurement is to upgrade existing Allen Bradley PLCs installed in governors under contracts DACW21-98-C-0072 and DACW21-03-B-0005. Allen Bradley processors are necessary since no other brand processor is a direct replacement to the installed PLC equipment in use for the governor system. The estimated period of performance is 30 days. The estimated cost of procurement for this equipment is $194,150.

FAR 13.501(a)(1): For actions for commercial supplies or services greater than the SAT but not exceeding $7M, the requirements of FAR 13.501(a) apply to sole-source acquisitions conducted pursuant to Subpart 13.5 (Reference: FAR 13.106-1(b)(2)).

5. Reasons for Authority Cited: (Utilize as much space as is necessary to fully annotate the reason/rationale. All applicable areas shall be completed in sufficient detail. Before finalizing, remove the bulleted info.

Previous contract No. W912HN-17-P-0011 required the delivery of L82E and SD2 PLC equipment to be purchased under this new action, however the vendor was not an approved regional distributor/seller of Allen Bradley equipment and was unable to provide them. This has increased cost to the Government as well as placed unacceptable delays to the Government with regard to the completion if the installation of this equipment, which is a pre-requisite to ongoing plans to modernize and remotely operate the Savannah River Hydropower Plants. A generator outage is scheduled for Russell Power Plant in January 2018 to begin the installation and commissioning of the last and final phase of Savannah District’s Remote Operations effort. All of the PLC equipment being purchased under this action must be installed before January 2018 to prevent delays in the Russell installation because controllers must be programmed and commissioned, which will require a minimum of 15 weeks to complete. This is a $14.98M Federal Power Customer funded project that is being tracked up through Command at SAD.

Allen Bradley PLC equipment is required as a direct replacement of existing equipment and no other brand of equipment will meet the need due to proprietary design of equipment. McNaughton McKay of Greenville is the only reasonable supplier of this equipment because they are the only Allen Bradley distributor authorized by Allen Bradley to sell Allen Bradley equipment in the geographical region of Thurmond Power Plant where the equipment is being delivered.

6. Actions to Increase Competition:

7. Market Research:

8. Procurement History:

Previous Purchase Order(s) or Contract(s): Yes No

If "Yes", for each purchase order or contract provide:

Purchase order or contract number: See Below in Appendix A Was action competed? Yes No

If action was not competed, state the cited authority, summarize rationale: As stated in Part 6.

McNaughton McKay and no other vendor can meet the need of this requirement due to the sales model that Rockwell Automation has utilizing approved regional distributors/sellers of their equipment.

Purchase of this equipment was competed already under a different contract action. The vendor could not fulfil the contract requirement. There were other interested vendors for the previous contract action, but they were rejected because Allen Bradley/Rockwell Automation sanctioned distributors are based on the regional location of Thurmond Dam and the other vendors were not sanctioned distributors. McNaughton McKay is the only vendor that can meet this requirement. McNaughton McKay is unable to sell individuals/companies/brokers for the purpose of resale of the Allen Bradley/Rockwell Automation equipment due to a binding contractual agreement between Rockwell Automation and McNaughton McKay.

As stated in Part 6. McNaughton McKay and no other vendor can meet the need of this requirement due to the sales model that Rockwell Automation has utilizing approved regional distributors/sellers of their equipment.
