ELECTRONIC PROPOSAL SUBMISSION IS REQUIRED THROUGH THE WEBSITE
LISTED BELOW. ELECTRONIC SUBMISSION SENT VIA EMAIL OR FACSIMILE WILL
NOT BE ACCEPTED. HAND CARRIED PROPOSAL SUBMISSION IS NOT
AUTHORIZED EXCEPT TO SUBMIT A BID BOND AS DISCUSSED BELOW.
DIRECTIONS FOR SUBMITTING PROPOSALS
In an effort to reduce paperwork and reduce cost, all proposals shall be submitted electronically. All submissions shall be in Adobe PDF format. The Price Proposal and Technical Proposal shall be submitted as “separate” single files. Offerors may use compressions utility software such as WinZip or PKZip to reduce file size and facilitate transmission.
Title the file(s) in the following format:
W912HN-16-R-0022_COMPANY NAME_VOLUME I
W912HN-16-R-0022_COMPANY NAME_VOLUME II
Submit the Price and Technical proposals electronically via the AMRDEC SAFE website at: https://safe.amrdec.army.mil/SAFE/ . At the AMRDEC SAFE website select the link:
I do not have a CAC or this machine is not configured to read my CAC and I would like to access SAFE as a Guest User, to register, access the site and submit your proposal(s). [Note: It has been reported that documents are more quickly uploaded into the AMRDEC SAFE website when using a Firefox web browser. The Government cannot verify that this is true and offers no guarantee that offerors will have more success utilizing any particular browser.] AMRDEC restricts file size to 1GB, so multiple file upload may be necessary.
When your proposal is submitted via the AMRDEC SAFE website, the website will provide notification of the submittal to the Government recipients. When completing the information for transmittal at the AMRDEC SAFE website, you will be required to enter email addresses for the recipients. For this solicitation, the recipients will be the Contracting Officer and Contract Specialist. The Contracting Officer for this project is Bruce A. Helms, whose e-mail address is Bruce.A.Helms@usace.army.mil. The Contract Specialist for this project receipt of proposals is Addison Layfield Brent Ingram, whose e-mail address is addison.g.layfield@usace.army.mil Brent.W.Ingram@usace.army.mil. These e-mail addresses are the ones you will enter as recipients.
In addition, after uploading your documents, you will be required to verify your email address before AMRDEC will send notification to the Government recipients. This is a very important step – even if you successfully upload your proposal to AMRDEC SAFE, notification will not be sent to the Government until you verify your email address, which may result in the rejection of your proposal for lateness. Follow the instructions on the AMRDEC website and confirmation emails you receive from AMRDEC.
Proposal Due Date and Time:
Request For Proposal No: W912HN-16-R-0022 Due Date of Proposal: 23 30 June 2016 Time by which Proposals are Due: 01:00 P.M. (E.T.)
Title of Project: DMCA 13A Dike Raising and Weir Improvements
The date and time of delivery will be established by the time of receipt of the e-mail notification to the Contract Specialist and Contracting Officer by the AMRDEC SAFE website, not by the date and time of uploading of the proposal into the AMRDEC SAFE website. Do not assume that electronic communication is instantaneous. Please make allowances for delays in transmittal. If an electronic submission is uploaded minutes before the deadline but notification is not actually received in the recipients’ e-mail inboxes until after the deadline, the submission will be considered late.
The Government will not be responsible for proposals delivered to any location or to anyone other than those designated to receive proposals on its behalf. Offerors are responsible for ensuring that proposals are submitted so as to reach the designated recipient of proposals. Offerors are responsible for allowing sufficient time for the proposal to be received in accordance with the information provided.
BID BONDS: An original Bid Bond must be delivered by the Proposal Due Date and Time established above. Bid Bonds may be delivered by Federal Express, United Parcel Service, U.S. Mail, or U.S. Express Mail.
For Bid Bonds delivered by Federal Express and United Parcel Service, the date and time of delivery established by these carriers is not the official time of receipt by the Government. Security Guards posted at the loading dock entry for the building do not receive bonds and will contact Mailroom personnel. Once Mailroom personnel are available, the bonds will be processed by the Security Guards using established security procedures and subsequently picked up by Mailroom personnel. After receipt by the Mailroom personnel, a record will be made of the receipt of the bonds. Completion of these actions will constitute delivery of the bond by the date and time designated for receipt of bonds. Bidders are responsible for allowing sufficient time for the bid bond to be processed for receipt and are cautioned that sufficient time may be as much as 24 hours prior to the date and time designated for receipt of Bid Bonds. Bonds sent by U.S. Mail or U.S. Express Mail are required to be sent to 100 West Oglethorpe Avenue, Savannah, Georgia 31401. Bidders that use U.S Mail or U.S. Express Mail must allow sufficient time for bids to be received by Mailroom personnel by the time specified for receipt of bonds.
Bidders are responsible for allowing sufficient time for the bonds to be processed for receipt and are cautioned that sufficient time may be as much as 24 hours prior to the date and time designated for receipt of proposals.
Bidders are responsible for allowing sufficient time for the bonds to be physically received and processed by Mailroom personnel in accordance with the information provided.
The Government will not be responsible for bonds delivered to any location or to anyone other than those designated to receive bonds on its behalf. Bidders are responsible for ensuring bonds are submitted so as to reach the location designated for receipt of bonds.

TECHNICAL MATTERS: Submit technical inquiries and questions relating to this solicitation via Bidder Inquiry in ProjNet at (https://www.projnet.org) at least 10 calendar days prior to the date established in the RFP for receipt of proposals. Payment will be made by:
U.S. Army Corps of Engineers Finance Center

4. CONTRACTOR-PREPARED NETWORK ANALYSIS SYSTEM
The progress chart to be prepared by the contractor pursuant to FAR 52.236-15, Schedules for Construction Contracts, shall utilize the Critical Path Method (CPM) of network calculation.
5. EQUIPMENT OWNERSHIP AND OPERATING EXPENSE SCHEDULE
(a) This clause does not apply to terminations. See 52.249-5000, Basis for Settlement of Proposals and FAR Part
49.
(b) Allowable cost for construction and marine plant and equipment in sound workable condition owned or controlled and furnished by a contractor or subcontractor at any tier shall be based on actual cost data for each piece of equipment or groups of similar serial and series for which the Government can determine both ownership and operating costs from the contractor's accounting records. When both ownership and operating costs cannot be determined for any piece of equipment or groups of similar serial or series equipment from the contractor's accounting records, costs for that equipment shall be based upon the applicable provisions of EP 1110-1-8, Construction Equipment Ownership and Operating Expense Schedule, Region III. Working conditions shall be considered to be average for determining equipment rates using the schedule unless specified otherwise by the contracting officer. For equipment not included in the schedule, rates for comparable pieces of equipment may be used or a rate may be developed using the formula provided in the schedule. For forward pricing, the schedule in effect at the time of negotiations shall apply. For retroactive pricing, the schedule in effect at the time the work was performed shall apply.
(c) Equipment rental costs are allowable, subject to the provisions of FAR 31.105(d)(ii) and FAR 31.205-36. Rates for equipment rented from an organization under common control, lease-purchase arrangements, and sale-leaseback arrangements, will be determined using the schedule, except that actual rates will be used for equipment leased from an organization under common control that has an established practice of leasing the same or similar equipment to unaffiliated lessees.
(d) When actual equipment costs are proposed and the total amount of the pricing action exceeds the small purchase threshold, the contracting officer shall request the contractor to submit either certified cost or pricing data, or partial/limited data, as appropriate. The data shall be submitted on Standard Form 1411, Contract Pricing Proposal Cover Sheet.
6. BASIS FOR SETTLEMENT OF PROPOSALS
Actual costs will be used to determine equipment costs for a settlement proposal submitted on the total cost basis under FAR 49.206-2(b). In evaluating a terminations settlement proposal using the total cost basis, the following principles will be applied to determine allowable equipment costs:
(1) Actual costs for each piece of equipment, or groups of similar serial or series equipment, need not be available in the contractor's accounting records to determine total actual equipment costs.
(2) If equipment costs have been allocated to a contract using predetermined rates, those charges will be adjusted to actual costs.
(3) Recorded job costs adjusted for unallowable expenses will be used to determine equipment operating expenses.
(4) Ownership costs (depreciation) will be determined using the contractor's depreciation schedule (subject to the provisions of FAR 31.205-11).
(5) License, taxes, storage and insurance costs are normally recovered as an indirect expense and unless the contractor charges these costs directly to contracts, they will be recovered through the indirect expense rate.
7. TIME EXTENSIONS FOR UNUSUALLY SEVERE WEATHER
(a) This provision specifies the procedure for the determination of time extensions for unusually severe weather in accordance with the contract clause entitled DEFAULT (FIXED PRICE CONSTRUCTION). In order for the Contracting Officer to award a time extension under this clause, the following conditions must be satisfied:
(1) The weather experienced at the project site during the contract period must be found to be unusually severe, that is, more severe than the adverse weather anticipated for the project location during any given month.
(2) The unusually severe weather must actually cause a delay to the completion of the project. The delay must be beyond the control and without the fault or negligence of the Contractor.
(b) The following schedule of monthly anticipated adverse weather delays is based on National Oceanic and Atmospheric Administration (NOAA) or similar data for the project location and will constitute the base line for monthly weather time evaluations. The Contractor's progress schedule must reflect these anticipated adverse weather delays in all weather dependent activities.
MONTHLY ANTICIPATED ADVERSE WEATHER DELAY
WORKDAYS BASED ON 5-DAY WORK WEEK
JAN FEB MAR APR MAY JUN JUL AUG SEP OCT NOV DEC
6 6 5 4 5 7 7 8 5 2 3 6
(c) Upon acknowledgment of the Notice to Proceed and continuing through-out the contract, the Contractor will record on the daily Contractor Quality Control report the occurrence of adverse weather and resultant impact to normally scheduled work. Actual adverse weather delay days must prevent work on critical activities for 50 percent or more of the Contractor's scheduled workday. The number of actual adverse weather delay days shall include days impacted by actual adverse weather (even if adverse weather occurred in previous month), be calculated chronologically from the first to the last day in each month, and be recorded as full days. If the number of actual adverse weather delay days exceeds the number of days anticipated in paragraph (b) above, the Contracting Officer will convert any qualifying delays to calendar days, giving full consideration for equivalent fair weather workdays, and issue a modification in accordance with the contract clause entitled
DEFAULT (FIXED PRICE CONSTRUCTION).
8. UNAUTHORIZED INSTRUCTIONS FROM GOVERNMENT OR OTHER PERSONNEL
The Contractor shall not accept any instructions issued by any person, employed by the Government or otherwise, other than the Contracting Officer or the Contracting Officer’s Representative (COR) acting within the limits of the COR’s Authority. See the Contracting Officer’s Representative clause of this contract.
9. VARIATIONS IN ESTIMATED QUANTITIES — SUBDIVIDED ITEMS (MAR 1995)

(a) Variation from the estimated quantity in the actual work performed under any second or subsequent sub-item or elimination of all work under such a second or subsequent sub-item will not be the basis for an adjustment in contract unit price.
(b) Where the actual quantity of work performed for items Nos. 0001AA, 0002AA, 0003AA, 0004AA, 0005AA, 0008AA, and 0011AA 0001, 0002, 0003, 0004, 0005, 0008, and 0011 is less than 85% of the quantity of the first sub-item listed under such item, the contractor will be paid at the contract unit price for that sub-item for the actual quantity of work performed and, in addition, an equitable adjustment shall be made in accordance with the clause FAR 52.212-11, Variation in Estimated Quantities.
(c) If the actual quantity of work performed under Items Nos. 0001AA, 0002AA, 0003AA, 0004AA, 0005AA, 0008AA, or 0011AA 0001, 0002, 0003, 0004, 0005, 0008, and 0011 exceeds 115% or is less than 85% of the total estimated quantity of the sub-item under that item and/or if the quantity of the work performed under the second sub-item or any subsequent sub-item under Items Nos. 0001AB, 0002AB, 0003AB, 0004AB, 0005AB, 0008AB, or 0011AB exceeds 115% or is less than 85% of the estimated quantity of any such sub-item, and if such variation causes an increase or a decrease in the time required for performance of this contract the contract completion time will be adjusted in accordance with the clause FAR 52.211-18, Variation in Estimated Quantities.
10. Veterans Employment Emphasis for U.S. Army Corps of Engineers Contracts
In addition to complying with the requirements outlined in FAR Part 22.13, FAR Provision 52.222- 38, FAR Clause 52.222-35, FAR Clause 52.222-37, DFARS 222.13 and Department of Labor regulations, U.S. Army Corps of Engineers (USACE) contractors and subcontractors at all tiers are encouraged to promote the training and employment of U.S. veterans while performing under a USACE contract.
