DESCRIPTION OF WORK

Furnish all labor, material, equipment, incidentals, supervision and transportation for work necessary to provide Dredged Material Containment Area Rock Revetment Repair. The proposed project includes the installation of rock revetment on three eroded areas along the Savannah River shoreline. These areas are adjacent to Disposal Areas 13B, 14A and 14B. The approximate size of each area is as follows: area near 13B is approximately 500 linear feet, area in 14A is approximately 550 linear feet and area near 14B is approximately 250 linear feet. The total length of repair is estimated at 1,300 linear feet. The new shoreline protection will need to smoothly and uniformly tie into existing sections of shoreline protection previously placed. The material to be used for erosion protection will be graded granite aggregate, intermediate and armor stone placed to a top elevation of +13 feet mean lower low water (MLLW). Contractor shall work and complete one section at a time. More specific information regarding these repairs is included on the provided plans.

The Dredged Material Containment Area’s shoreline is under a state of constant erosion and shifting due to the tides, wind and waves. As a result, the Contract survey may not reflect the current site conditions. The disparity does not constitute a changed or differing site condition.

Adjust the stone shoreline protection alignment to the shoreline conditions existing at the time of stone placements, as necessary, without additional cost to the Government. The toe of the stone shoreline protection shall not extend more than 50 feet past the current toe of the eroding bluff.

Earthwork for stone placement, maintenance of haul roads, grassing of lay down areas, and any other miscellaneous construction activities required for stone placement shall be incidental cost.

The project also incorporates the protection and restoration planting of existing shoreline marsh areas where damaged by construction. Contractor shall coordinate with the Savannah District for erosion control, staging areas required to perform the work, coordination of stockpile areas for rock or other protection materials, maintenance of onsite access routes, and all other requirements necessary to complete the work.

All work shall be performed in accordance with the contract specifications, the provided plans, manufacturer’s recommendations, and state codes. Work performed under this contract shall comply with all contract specifications. Submittals shall be approved prior to work commencement and rock gradation shall be approved prior to delivery. Areas that are disturbed during rock embankment repairs, to include stock pile areas, shall be smoothly and uniformly dressed and grassed during close out of contract. This cost is considered as incidental. All dirt work, to include benching if needed or minor dike repair/realignment, shall be considered incidental to rock installation cost. Haul routes shall be discussed and outlined in preconstruction meeting. Where conflicts arise between publications, the most stringent requirements shall apply.

(c) Transportation Facilities. Railway facilities are available at Savannah, Georgia. Areas of work are accessible by barge through the Atlantic Intracoastal Waterway and the Savannah Harbor. Access to the area is controlled by an entrance gate. This gate shall be managed by the Contractor and closed at all times during operations, unless an employee mans the gate during daily operations.

(d) Other Information: Location. The location of the work is within the limits of the Savannah Harbor, Georgia and Jasper County, South Carolina. The project consists of erosion protection on the river bank north of the Savannah River along Disposal Areas 13B, 14A and 14B.

Local Conditions.

Local Tide Conditions. The areas of work are subject to severe wave action and exposure to severe storm is slight.

The mean tidal range is 7.2 feet and the spring range is 8.4 feet. Current velocities in the Ship Channel average 3 to 4 feet per second with maximum of 5 feet per second. The working season lasts throughout the year.

Condition of the Ship Channels. The tide gates in Back River have been taken out of operation are not expected to be in operation during the course of this contract.

Channel Traffic. Work consists of towboats, barges and various small craft. The traffic that may be expected to use the channel during the progress of the work consists of ocean going vessels, towboats, barges and various small craft.

According to Waterborne Commerce Statistics, in 1989 about 7,760 vessel trips were made in and out of Savannah Harbor. Navigation traffic will be using the existing channels at all hours during construction of the project.

Obstruction of Channel. The Government will not undertake to keep the channel free from vessels or other obstructions, except to the extent of such regulations, if any, as may be prescribed by the Secretary of the Army, in accordance with the provisions of Section 7 of the River and Harbor Act approved 8 August 1917. The Contractor will be required to conduct the work in such a manner as to obstruct navigation as little as possible, and in case the Contractor’s plant so obstructs the channel as to make difficult or endanger the passage of vessels, said plant shall be promptly moved on the approach of any vessel to such an extent as may be necessary to afford a practicable passage. Upon completion of the work the Contractor shall promptly remove his plant, including ranges, buoys, piles and other markers placed by him under the contract in navigable waters or on the shore.

(A) The Contractor shall promptly, and before the conditions are disturbed, give a written notice, within 3 days, to the Contracting Officer of

• (1) physical conditions at the site which differ materially from those indicated in this contract, or

• (2) unknown physical conditions at the site, of an unusual nature, which differ materially from those ordinarily encountered and generally recognized as inherent in work of the character provided for in the contract.

(B) The Contracting Officer shall investigate the site conditions promptly after receiving the notice. If the conditions do materially so differ and cause an increase or decrease in the Contractor’s cost of, or the time required for, performing any part of the work under this contract, whether or not changed as a result of the conditions, an equitable adjustment shall be made under this clause and the contract modified in writing accordingly.

(C) No request by the Contractor for an equitable adjustment to the contract under this clause shall be allowed, unless the Contractor has given the written notice required; provided, that the time prescribed in (i)(A) above for giving written notice may be extended by the Contracting Officer.

(D) No request by the Contractor for an equitable adjustment to the contract for differing site conditions shall be allowed if made after final payment under this contract. (FAR 52.236-2 DIFFERING SITE CONDITIONS.)

(E) The Contractor acknowledges that he has taken steps reasonably necessary to ascertain the nature and location of the work, and that he has investigated and satisfied himself as to the general and local conditions which can affect the work or its cost, including but not limited to (1) conditions bearing upon transportation, disposal, handling, and storage of materials; (2) the availability of labor, water, electric power, and roads; (3) uncertainties of weather, river stages, tides, or similar physical conditions at the site; (4) the conformation and conditions of the ground; and (5) the character of equipment and facilities needed preliminary to and during work performance. The Contractor also acknowledges that he has satisfied himself as to the character, quality, and quantity of surface and subsurface materials or obstacles to be encountered insofar as this information is reasonably ascertainable from an inspection of the site, including all exploratory work done by the Government, as well as from the drawings and specifications made a part of this contract. Any failure of the Contractor to take the actions described and acknowledged in this paragraph will not relieve the Contractor from responsibility for estimating properly the difficulty and cost of successfully performing the work, or for proceeding to successfully perform the work without additional expense to the Government.

Union Rate Identifiers

A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or "UAVG" denotes that the union classification and rate were prevailing for that classification in the survey. Example: PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.

Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.

Survey Rate Identifiers

Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.

Survey wage rates are not updated and remain in effect until a new survey is conducted.

Union Average Rate Identifiers

Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.

A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.

WAGE DETERMINATION APPEALS PROCESS

1.) Has there been an initial decision in the matter? This can be:

* an existing published wage determination

* a survey underlying a wage determination

* a Wage and Hour Division letter setting forth a position on a wage determination matter

* a conformance (additional classification and rate) ruling

On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.) and 3.) should be followed.

With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:

Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7).

Write to:

Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.

3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:

Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

4.) All decisions by the Administrative Review Board are final.
