Solicitation W912GY-16-T-0023- Rental of 2 each Bucket Loaders Q: Section 1.15 states “Equipment Maintenance: The contractor shall be responsible for equipment failure not arising out of abuse or negligence by the government. All labor, parts and maintenance shall be provided at no additional charge. The contractor shall be responsible for all maintenance, etc., except for daily checks of liquid levels.”

We have the following questions:

1) Since the Government will be modifying the equipment (per details given), what task(s) will the loaders be performing?

2) Does this include tires?

3) Does this include ground engaging components (i.e. cutting edges, teeth)?

4) What is the anticipated usage in hours per machine, per month? Per year?

Section 1.1 States “The contractor shall provide on a monthly basis to include pickup and delivery of 2 each CAT 980H or Equal Bucket Loaders w/3 welded bracket modification by the government as shown in the attachment photos….”. Section 1.1.1 states “...Must meet CA EPA standards.”

5) A CAT 980H does not meet current CA EPA Standards. What governs 980H or CA EPA Standards?

A:

1) & 4) They are used daily to push M1A1's Tanks around into storage locations out at Long Term Storage Division. Below is the current usage of each machine on an average 16 business day per month work schedule:

Monthly 98 hours average total 3163 Monthly 73 hours average total 9436

2) The contractor shall be responsible for all maintenance, etc., except for daily checks of liquid levels. Contractor maintenance will includes tires.

3) The contractor shall be responsible for equipment failure not arising out of abuse or negligence by the government. All labor, parts and maintenance shall be provided at no additional charge. This include ground engaging components (i.e. cutting edges, teeth).

5) What governs 980H? The end user placed this spec per the SOW as 980H or EQUAL bucket loader as this is a machine that they have used in the past. The requirement is not meant to solely solicit for that brand as there is no J&A to this solicitation. To be an acceptable offer the contractor must meet the minimum requirements that are listed on the SOW only.

CA EPA standards- Response from environmental division: “If we rent diesel off road equipment, just make sure it is being reported. This is done by insuring it has an engine identification (EIN). This is acquired by the owner. Now if it doesn't have one and we lease it and are going to have it for more than a year, the government is responsible for putting that number on it. “

"California. In most cases, federal non-road regulations also apply in California, whose authority to set emission standards for new non-road engines is limited. The federal Clean Air Act Amendments of 1990 (CAA) preempt California's authority to control emissions from new farm and construction equipment under 175 hp [CAA Section 209(e)(1)(A)] and require California to receive authorization from the federal EPA for controls over other off-road sources [CAA Section 209 (e)(2)(A)]."
