SCOPE OF WORK

SCOPE OF WORK

SIERRA ARMY DEPOT (SIAD) PAINT REQUIREMENT

1. ORDERING PROCEDURE:

The contractor shall have a representative who will work on-site with the local Paint Shop point of contact (POC) and the Government Logistic Representative in order to create and establish standards and thresholds for correct amounts of paint to maintain on-hand in an on-site inventory. A document will be created by the SIAD Paint Shops POC and the Government Logistic Representative, with recommendations from the contractor taken into consideration in order to create an official ordering document (See Attachment A – Paint Requirements SIAD).

Upon award of contract, the Contractor will be issued an order to cover five weeks of estimated paint usage to be delivered to SIAD and contractor will provide an itemized invoice for the initial order. Orders will generally be issued on a monthly basis with monthly delivery requirements.

Paint Orders will be placed by issuance of Delivery Orders from the Contracting Officer. The Delivery Schedule will be specified in the Delivery Order.

Listings of all initial items that may or may not be required to be stocked at the HAZMAT storage locker in conjunction with this agreement are listed below. Lists will include National Stock Number (NSN), Manufacture Part number(MANP) if any, nomenclature, unit of issue, part number, Military Specification, and demand history (if available).

2. SHIPPING TERMS:

As required in the Hazardous Chemical Information Act of June, 1984, all contractors supplying any materials that may be defined as hazardous must provide Safety Data Sheets (SDS) for those products. Any chemical product should be considered hazardous if it has a caution warning on the label relating to a potential physical or health hazard, if it is known to be present in the work place, and if employees may be exposed under normal conditions or in any foreseeable emergency situation.

The Government will issued a delivery order for each individual order and will include a delivery date with each order.

3. DELIVERY:

Deliveries will be sent to the SIAD Receiving department to be inspected by Quality Assurance and receipted in.

This will take no more than two business days from the time the delivery is received. If process is going to take more than two business days the Government Logistic Representative will notify the contractor.

The contractor will arrive at SIAD on the third business day after the material is delivered. Upon arrival, the Contractor will check in with the Administrative Assistant of the Paint Shop, who will notify the Paint Shop Supervisor and/or Work Leader on duty so that the Contractor can gain access to the specified HAZ bin area during scheduled operating hours to put the up the delivery.

During this time, both the Paint Shop Supervisor and the Contractor will conduct inspections, perform periodic stock checks. Access will only be made to Contractor with direct supervision of the Paint Shop Supervisor and/or Work Leaders during normal business hours Monday through Thursday from 7:30AM to 4:00PM. Upon delivery, Contractor will rotate and/or exchange paint inventory if it is not being utilized as ordered and/or is within three (3) months of its expiration date.

Upon every delivery, all hazardous inventory received shall have safety data sheet (SDS) documents (CDRL A001) attached to assure that the most recent and up to date SDS is on hand for the paint shop.

Upon each delivery, current paint inventory will be maintained and monitored by the Contractor and discussed with local Paint Shop POC or secondary POC.

All non-stock paint will be delivered no later than one (1) month after the order. Contractor will maintain monthly supply level, replenishing every other Tuesday by 0800 in accordance with (IAW) weekly stock list. Paint with less than six (6) months shelf life will not be accepted to complete an order for the SIAD Paint Shop.

Upon delivery, all paint will be inspected and if found to be defective or if it fails in any way to meet the specifications as indicated in this contract, it may be rejected. All rejected material or shortages shall be replaced by the supplier within five (5) working days at the Contractors own expense.

In the event of an unforeseeable situation that the paint is unusable, the Paint Shop Supervisor and/or Work Leader will notify the Government Logistic Representative who will in turn reach out to Contracting Officer who will work directly with the Contractor in order to reach a mutual understanding and in order to provide the Contractor the opportunity to make a correction. This will then be articulated to the Government Logistic Representative and the Paint Shop Supervisor and/or Work Leader of this agreement to satisfy this situation. (i.e. Paint received from Contractor may be mislabeled or an entirely incorrect order delivered to the Contractor by their supplier and this could not be realized until the inventory product is actually opened at SIAD).

4. DELIVERY SOURCE:

The Contractor shall not employ Government personnel (military or civilian) for performance of any work under this contract.

The Contractor shall be responsible for obtaining installation access as required for all Contractor personnel authorized to work at SIAD. Any Government-furnished identification shall be returned to the Government when the employee no longer works for the Contractor at this installation. The Contractor shall contact the Contracting Officer for appropriate documentation.

All paint for this contract shall contain no lead or mercury products unless prior approval from the Contracting Officer must be obtained, in writing, if the contractor feels a deviation from this requirement is necessary.

The Contractor shall supply color charts for their paints and paint specification, at no charge.

The manufacturer’s standard printed label shall be affixed to each container. Manufacturer, trade name or brand, catalog number, color and complete directions for use shall be printed on the label. The trade name or brand and catalog number must be the same product proposed for this contract list of paint.

All paints under this contract shall be manufactured and labeled to comply with all latest OSHA requirements and Federal Air Quality Control Standards Act. All paints supplied must meet California State OTC-VOC regulations.

Each color or tinted paint delivered under this contract shall be the specific tint, shade and color in accordance with the terms of the contract. Any paint that does not match or meet these specifications shall be returned and replaced by the Contractor within five (5) working days at the Contractors own expense for the correct and specific tint, shade and/or color.

6. PRODUCT SUBSTITUTION:

All paint delivered during the life of the contract shall be of the same type and manufacture as specified within the standard order.

Any substitution request from the Contractor shall not be permitted to any paint covered by this Contract without prior written approval and submission of written specifications and product evaluation to the Contracting Officer.

Any substitution due to discontinuation of paints from any manufacturer will require at least three (3) months notification from the Contractor prior to discontinuation.

Any substitution due to discontinuation of paints from any manufacturer will require the Contractor to provide a listing of comparable items and samples for replacement of discontinuation of paints to the Contracting Officer.

This space will be used for the storage and issuing of items furnished under this contract. The warehouse facility shall be used only to fulfill the requirements of this Contract, and shall not be used for temporary storage for any type of overstocking whatsoever. There will be no warehousing costs charged to the Contractor.

The Contractor shall establish and have available upon request, all supplier qualifications on record.

Upon request the Contractor shall describe and/or provide contingency plans to lower and reduce risk of stock shortages and methods for identifying and preventing problems before the level of performance becomes unacceptable.

The Contractor shall provide electronically the usage and location report for Emergency Planning Community Right-to-Know Act (EPCRA) requirement to the POC at the Paint Shop who will in turn provide monthly reports to the Environmental Office of SIAD and copy the Government Logistic Representative.

Contractor will provide electronic monthly (CDRL A002) and annual usage (CDRL A003) report which will identify trends and actual financial and product usage data. Information will include usage by paint color, type, etc.
