P00002 - RESPONSES TO RFIS

Leased Vehicle Support, Israel

Amendment 0001

Requests for Information (RFIs)/Questions

QUESTION RESPONSE

1 What is the final delivery address and is the

Contractor required to deliver it to the final destination as well?

Location for delivery of new vehicles: If the contractor does not have branch offices in Israel we would coordinate to have vehicles delivered to 22 Maskit St., Herzliya (9 sedans) and Shoket Junction Parking Lot (1 van + 6 Sedans). If the contractor has local branch offices in Israel, we would prefer to have vehicles delivered at the nearest branch office to these locations: Herzliya (5 sedans), Haifa (1 sedan), Jerusalem (1 sedan), Tel Nof (2 sedans), Be'er Sheva (1 van, 6 sedans).

2 Please can you advise as we can currently supply 2017 and 2018 model as we have them in stock

The requirements of the RFQ for 2019 model vehicles remains unchanged.

3 Please advise a VAN model as an example to help understand the requirement (Number of Seats, Size, Etc.)? 1.6 Liter or higher engine which provides fuel efficiency equal to 25 miles per gallon or greater. Is this the correct size engine for the requested van? How many passenger VAN?

Provide a minimum of 6 passenger van with a minimum of 1.6 liter engine which meets the 25 miles per gallon requirements.

4 Vehicles supplied should be with a maximum of 10,000 kilometers on the odometer. Please advise if this is a 100% must, or is it acceptable if several vehicles exceed this requirement by 5000=10000?

The requirements of the RFQ regarding the maximum of 10,000 kilometers at the time of initial delivery under the contract remains unchanged.

5 Please advise if all drivers are U.S. Citizens with a U.S Passport and do not hold a dual Israeli citizenship as well.

Driver pool consists of a mixture of US citizens (US Passports), Israeli citizens (Israeli Passports) or dual US-Israel citizens (Both US and Israeli Passports).

6 The required mileage under this solicitation is unlimited, do you have an approximate ranges of monthly mileage. It is imperative to know the average (mileage) kilometers driven (Monthly/Annually). This is an important aspect in order to calculate replacement vehicles when reaching 50,000 kilometers during the rental period (12 months).

Vehicle average kilometers/miles per month/year are as follows:

500/312.5 kilometers/miles to 1500/937.5 kilometers/miles per month

6000/3750 kilometers/miles to 18000/11250 kilometers/miles per year.

7 Is the Buy America Act applicable to this procurement?

No.

8 Would the vehicles drive to all areas including the Palestinians authorities?

The vehicles will not be permitted into Palestinian Authority areas.

9 If the contractor assigns a US Citizen direct support as the POC, would the US Government assist with a working visa requirement?

The Contractor may submit a request for assistance to the US Government regarding work visas, however the ultimate decision and process to obtain the work visa is done by the Israeli Government. The vehicle lease contract is being provided to USACE staff under the Israel Foreign Military Sales (FMS) – Construction Program which is administered by the Israel Ministry of Defense – Construction (IMoD-C).

Requests for work visas would be forwarded to the IMoD-C requesting their assistance.

10 Based on the submission and award timelines, new vehicles ordered at the notification of award may not be delivered by January 1. Will the awarded contractor be allowed to provide temporary sedans and vans from their current fleet until the ordered vehicles arrive provided those vehicles meet most of the requirements?

The offeror shall include in their proposal the projected date of the delivery of the 2019 model year vehicles. The US Government is agreeable to using temporary leased vehicles, on a case-by-case basis, which meet all the other Performance Work Statement requirements of the RFQ. Submitted price proposals shall be adjusted for the cost differential between the temporary vs. 2019 model vehicles.

11 “Price will be evaluated based on the lowest TOTAL added cost of one (1) vehicle per month for Base Year and Option Years 1-3” is listed in 52.212-2 but the price schedule states “Award will be made to the technically acceptable offeror with the lowest evaluated price for the Total cost of column 6 for the Base Year plus Option Years 1 thru 3 CLINs 0001 thru 0008.” Can you please confirm which will be used as the decision criteria?

The Price Schedule is the correct proposal evaluation criteria. FAR Clause 52.212-2 Evaluation – Commercial Items has been revised to refer to the Price Schedule.

12 “Full” coverage is not a quantifiable or legal term. Can the government provide specific insurance coverage expectations? As an example: Collision coverage up to the full value of the rented vehicle. Third party liability coverage of $1,000,000.00 combined single limit.

Refer to revised FAR Clause 52.228-10 Vehicular and General Public Liability Insurance.

13 Theft protection normally requires the reasonable care of the keys by the renting party. Theft coverage would be voided if the renter cannot provide the keys or a police report showing that the keys were stolen by force or from a secure storage location. Are these conditions acceptable?

These conditions are not acceptable. Reasonable care of the vehicle keys shall be taken by the vehicle operators. In case of vehicle theft a police report will be completed and a copy provided to the contractor by the COR.

14 In order to effectively maintain and replace vehicles that hit the 30,000 mile threshold, will the government provide the contractor with monthly updates of mileage so new vehicles can

Monthly mileage usage reports shall be provided.

be appropriately ordered and required maintenance can be scheduled?

15 Clause 2, page 44: this provision states that COR will be the USACE’s “designated assignee” for each vehicle and the vehicle will be registered in his/her name. Israeli regulatory requirements appear to require the information for the driver to be included on the rental agreement. Can this issue be further explored to verify the ability to legally comply with the request?

Because vehicles can be used by any authorized USACE staff in Israel, assigning a vehicle to different individuals is not possible. The COR has therefore been identified as the designated assignee for the leasing company. Any issues with accidents, traffic violations, etc. are to be provided to the COR and the Contracting Officer.

16 Clause 3(D)(1), page 45: Can the term “vehicle manufacturer date”, be modified to “vehicle registration date”, as the “manufacturer date” is not a detail that appears on the car license?

The intent is for the vehicles to be provided after award are 2019 models. When submitting the required technical information with the proposal, confirm the model year to be provided will be 2019 year models.

17 Performance Work Statement, Section 3: Offerors are to provide 16 safe and operational vehicles (15 sedans and 1 van). Are Offerors permitted to provide SUVs in lieu of sedans as long as all other vehicle specifications and restrictions are met?

The requirement of the RFQ for sedans remains unchanged. Sport Utility Vehicles (SUVs) are not acceptable.

18 Please kindly advise if 2017 and 2018 can be used.

The requirements of the RFQ for 2019 model year vehicles remains unchanged.

19 Hertz, Budget, Avis and Eldan rent a car all have millage restrictions on leased and rental vehicles.

I highly recommend that there will be an overage clause added to the RFQ.

All previous USACE Israel Vehicle Lease contracts to include the current contract have unlimited mileage being provided by the Contractor. The requirements of the RFQ for the Contractor to provide vehicles with unlimited mileage remains unchanged. Price proposals shall account for the unlimited mileage requirements.

20 Can you considering accepting a 1.8 CC engine capacity, it could mean higher cost savings to the US Government.

The requirement for a minimum 2.0 liter engine for the sedans remains unchanged.

SECTION SF 1449 - CONTINUATION SHEET

The following have been modified:

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the RFQ will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(i) Capability of the item offered to meet the Government requirements of the

Performance Work Statement (PWS);

(ii) Price.

Price will be evaluated based on the requirements provided in the Price Schedule.

Offeror’s capability to meet the requirements of the PWS shall be evaluated on an “acceptable” or “unacceptable” basis in accordance with the following minimum criteria:

Offerors are requested to provide a narrative demonstrating your company’s ability to meet the following requirements:

(1) Identify the vehicle lease company in Israel you are affiliated with, if any;

(2) Whether vehicles would be imported or already available in Israel;

(3) Your acknowledgement that the US has tax exemption status under the Status of Forces Agreement, of Israeli import customs procedures and Israeli Value Added Tax (VAT) requirements and reimbursement procedures;

(4) Service call capabilities with names and phone numbers of local authorized personnel to respond to problem calls on a 24 hours a day, 7 days a week basis to include Road Side Assistance support capabilities and prompt response time.

(5) Statement with supporting documentation the Offeror can provide and support the vehicles per the specifications/requirement of the PWS.

The basis of evaluation shall be Lowest Price Technically Acceptable (LPTA). Quotations shall be evaluated to determine whether they meet the minimum requirements, as listed above. Failure to meet one or more of these requirements for the vehicles shall be rated as “unacceptable” and will not be considered for award and shall be excluded from further consideration. Those quotes that meet the minimum acceptability requirements shall be rated as ‘acceptable’. Award shall be made to the lowest priced, technically acceptable Offeror.

Failure to provide this information may result in non-responsive offer and removal from award consideration.

Required Registration: The System for Award Management (SAM) is the official U.S. government system for contractor registration. All Offerors are required to be actively registered in SAM to be eligible for award. There is NO fee to register for SAM. If you used any of the previous systems, you should now go to www.sam.gov to update your information. SAM training tools and quick-start guides are available on both the SAM and Federal Service Desk websites, located at www.sam.gov and www.fsd.gov . Please provide your DUNS and Cage Code within your quotation submission.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(End of provision)

52.228-10 VEHICULAR AND GENERAL PUBLIC LIABILITY INSURANCE (APR 1984)

(a) The Contractor, at the Contractor's expense, agrees to maintain, during the continuance of this contract, vehicular liability and general public liability insurance with limits of liability for (1) bodily injury of not less than $200,00.00 for each person and $500,00.00 for each occurrence, and (2) property damage of not less than $20,000.00 for each accident and $40,000.00 in the aggregate.

(b) The Contractor also agrees to maintain workers' compensation and other legally required insurance with respect to the Contractor's own employees and agents.

(c) Contractor, at the Contractor’s expense, shall provide collision coverage up to full value of the leased vehicle.
