CLARIFY QUESTIONS & ANSWERS
Please confirm that this Solicitation is 2 steps tender, and confirm that, up to bids due date (21.03.2016) the offerors will submit only Phase I docs, i.e.:
Factor One (1) – Experience Factor Two (2) – Past Performance Factor Three (3) – Management Approach Letter(s) of Commitment Joint Venture Agreement and the other support required documents.
Answer: Please see page 2 of 27 of Amendment 0001 under proposal submissions. “Only Phase I submittals (Factor 1, Factor 2 and Factor 3) are required to be submitted at the time and date directed by this Solicitation. Only those firms selected for Phase II will provide Phase II proposals at a later date.”
In order for a JV to receive a DUNS, first the JV should obtain the NCAGE from Romanian MoD, which takes 7-10 CD.
But prior to obtain a NCAGE, the JV should registrate as a new company (notarial papers, than Trade Register procedures – which officially takes at least 1 month), a lot of papers, legal procedures, costs, and time envolved.
Also, if SAM registration is required for the JV, the procedure itself takes officially 10-14 CD, after all previous steps were followed: Trade Register, NCAGE, DUNS.
Up to submission of Phase 1 – 21.03.2016 there is no physical time to make all these procedures.
Moreover, as MATOC FY16 Ro is 2 steps tender it is not sure that, after Phase 1 the JV will be selected for Phase 2, and also if it will be awarded after Phase 2.
Consequently, we propose that:
a) For Phase 1 for JV offerors to be required the „legally binding joint venture agreement” only
b) For Phase 2, each of JV members to have NCAGE, DUNS, SAM registration
c) All these procedures for JV’s such: Trade Register, NCAGE, DUNS, SAM to be required in case of award only, in a time frame agreed by you
d) If you do not agree with proposal c), at least part of these to be fulfilled, and the other in case of award, in a time frame agreed by you
Pls. confirm if our above-mentioned proposals are accepted or not, or which manner are accepted.
Answer: For Phase 1 a legally binding JV agreement must be included in your proposal.
Firms must be registered in SAM before award of a contract, which is after Phase 2 firms have been evaluated.
In the Attach 1. Experience Overview Sheet, and Attach 2. Experience Info Sheet
(pt. 5.a) is stated “Projects Performed in Romania or the EU” – pls. corelate the Attach with Section 00 21 00.
Answer: On page 7 and 8 of Amendment 0001 part 2, Letters “a“ and “f“ were updated to correspond to the attachments. Projects performed in Romania or the EU will be evaluated by the board, however, projects in Romania will be more relevant.
What about an activity which is not in the UPB? How shall we offer it when we receive a Task Order – shall we negotiate the unit rate?
Answer: Task orders will be negotiated individually.
Shall we include in Phase 1 Letter of commitments from Key personnel employed by Prime Contractor, and employed by Subcontractors, or shall we submit LoC’s only from Key personnel which are third parties (individuals who are not employed by Prime/Subcons)?
Answer: A Letter of Commitment is needed from personnel not employed by the Prime Contractor for Phase I. Various Sub-contractors and Key Personnel not employed by either Prime/Subcons that the Prime Contractor expects to utilize shall be submitted to allow the board to evalute Past Performance Information submitted for Key Subs or Key Personnel.
How can the proposer increase prices in future years through the use of their coefficients?
Answer: It is your business decision on how you price future years The pricing schedule is a spreadsheet that you may input your coefficients for the Base year and you must input your coefficient for each Option year, the numbers may be different. Pricing will be requested in Phase 2.
What should we do with pages 32-50/Section 00 45 00 – shall we fill-in handwriting the responses?
When shall submit these pages filled-in: together with Phase 1, or Phase 2 docs?
Answer: You may fill-in by hand the subject section. They shall be submitted with Phase 2.
The Questions no. 16.1 and 16.2 reffered to laws/regulations/norms/instructions for Contractors working within US Army Bases on Romanian territory, or working within Romanian military bases, under US Army Contracts from the point of view:
- access procedures of personnel
- access procedures with IT/video/photo equipment
- norms of conduct
- state/military secret, etc Would you be so kind and provide all these norms?
Answer: See attached Romania Security Implemention Arrangement and 00 73 16.03 01 Special Conditions for Projects in Romania.
If we do not have yet a “past performance information which can be retrieved through PPIRS and CPARS” should we present anyway the PPQ’s signed&completed by Client, up to submission due date?
Is it allowed to submit with the proposal the PPQ’s filled-in with all required info, but not signed and completed by the Clients, and after submission to submit all these PPQ’s signed by Clients – as many of Clients’ representatives which were envolved in Projects are currently travelling a lot outside Romania, or not available to sign in this period (relocated in/outside Romania, in hollidays, etc).
Answer: Firms shall submit Past Performance Information as required under the solicitation. If a firm has no Past Performance information they will receive a neutral rating for Past Performance. You shall submit PPQs first page information, but it may not give the evaluation board enough information. Once the proposal submission date has passed, we will not allow further information to be submitted.
