SECTION SF 30 BLOCK 14 CONTINUATION PAGE

SUMMARY OF CHANGES

(End of Summary of Changes)

1. Section 00 73 16.03, SPECIAL CONDITIONS FOR PROJECTS IN ROMANIA AND

BULGARIA, section 3.1.1 states “The contractor shall have no recourse as to costs or time extensions for any delays resulting in changes to access and/or security requirements." This conflicts with FAR Clause 52.249-8 which clearly states “the Contractor shall not be liable for any excess costs if the failure to perform the contract arises from causes beyond the control and without the fault or negligence of the Contractor”. In accordance with FAR 52.215-8, Order of

Precedence – Uniform Contract Format, the FAR clause would take precedence. Will the

Government consider deleting 3.1.1?

A: This specification will not be revised. While, per the specification, the contractor is not entitled to compensable delays for base access issues, there may be circumstances where the

Government may authorize an excusable delay to performance. The Host Nation (HN) controls access to the installations and it is the contractor's responsibility to comply with these requirements. Thus, the Government will not compensate the Contractor for the actions of the

HN or for the Contractor’s inability to comply with HN requirements.

2. Factor III – Management Approach Sections L and M do not align and ask for different components. Section M evaluates items that are not mentioned in Section L. Are Sections L and

M complete as shown in the solicitation? Can you please clarify what will be evaluated in Factor

III?

A: Factor III will be evaluated utilizing Section M. The management approach by your company will need to be a comprehensive, reasonable and logical plan to include, but not be limited to the information contained in both Sections L and M.

3. PG. 35 Item 0007: Groundwater Sampling and Purging. This can involve different techniques such as Fixed volume purge and sampling as well as low flow purge and sampling. Can the

Government indicate which technique is required: Fixed volume purge and sampling or low flow purge and sampling?

A: Prior to sampling, the water elevation will be measured (meters above mean sea level).

Groundwater sampling will be performed in accordance with the technical specifications of DIN

38402 /4/ and DWA-A 909 /5/. At least two well volumes (submerged casing and gravel pack) will be extracted from each well prior to sampling using low-flow sampling techniques. After each half-well volume, the electrical conductivity, pH, redox potential, dissolved oxygen, and temperature of the discharge water will be measured and be recorded in the sampling protocol.

The pH meter and electrical conductivity meter will be calibrated on a daily basis during multi-day sampling events. A sample will be collected only when the measurement parameters have stabilized. Stabilization is reached if the variance of the electrical conductivity, temperature and pH within 5 minutes is less than the following values:

electrical conductivity: 1% of its value

Temperature: 1 °C pH: 0.1 of the pH-value

4: How can we quote this if the “The specific requirements are site and contaminant dependent;

they are defined during site investigations site assessments, remedial investigations, feasibility studies, and/or scoping and may require prompt action due to mission, legal, environmental, or health protection issues.”?

A: Offerors are not providing a “quote” they are providing price proposals. These price proposals are not for a specific project. An offerors price proposal is for line items in the pricing schedule (see Volume II - Price) and used as an evaluation factor.

5. Page 10: “GEOGRAPHICAL LOCATION: The awarded contracts shall be in the following geographic locations: Germany, Romania, Georgia, Ukraine, Hungary, Bulgaria, Czech

Republic, Slovenia, Estonia, Lithuania, Latvia, Turkey, Kosovo, Moldova, Bosnia-Herzegovina, and Serbia.”

Germany is included?

A: No.

6: Page 97 “Identify whether the key personnel is employed by the prime contractor or subcontractor “

It is a must that the key personnel must be employed by the prime contractor or subcontractor?

Because some of the experts could not be employed at this moment?

A: See Section C.5 Personnel, "The Contractor must identify in the organization chart the key personnel described below to be assigned to the Contract by name, position, and firm (if other than prime contractor) with address where the firm is located. The resumes of the key management personnel will be evaluated to determine whether the individuals meet the minimum qualifications and experience necessary to perform their roles and responsibilities under this Contract." See also Section c. Factor III - Management Approach, "Offerors shall propose who the key personnel will be. The offeror shall submit a detailed resume and personnel description profile". If offerors intend to utilize key personnel employed by a subcontractor, the offerors must include a letter of commitment signed by BOTH parties.

7: Page 97: the minimum requirements for the personnel are the requirements mentioned starting with page 32?

A: For evaluation purposes, the key personnel must meet the requirements on pp. 109-111 to be considered acceptable. They should also meet the requirements in para. C5, and it will be a requriement under the contract that all key personnel meet the minimum requirements in para.

C5.

8: Page 53: 4. All contractors are required to register with the appropriate Bulgarian authorities for reimbursement of taxes.

After contract awarding or before submittal?

A: When to register with the appropriate Bulgarian authorities is up to the Contractors discretion.

Paragraph 4 is stating that it is the Contractor’s responsibility to register with the proper

Bulgarian authorities and that the exception of VAT does not automatically accompany contract award.

9. Please let us know if the similar experience could be accepted: as a contract performed in Iraq by a Romanian company, with Romanian employees.

A: No, Please see the submission requirements in section L for Factor 1 Experience.
