78 Labor Rates – Group 2 Countries

As labor rates vary across the region in order to calculate a single labor rate for the Group 2 countries, it would be helpful to know the percentage of and type of work that the Government anticipates in the various countries. Is the Government able to estimate the number and type of projects in each country included in Group 2, and if so please provide as much information as possible?

No.

Group 2 was removed from the solicitation with the issuance of Amendment 0003.

The answer above applies to an inquiry for W912GB-15-R- 0030 when posted.

79 Labor Rates – Group 2 Countries

For the Group 2 cost proposal will the Government accept multiple prices for single labor categories to reflect the different labor costs for the various countries?

Offerors are to submit only one price for each personnel.

80 Page 63 of 138: Section C.4.14, first bulleted paragraph – In accordance with FAR 22.1802, Employment Eligibility Verification (E-verify) only applies to work performed in the U.S. As the locations identified under this contract are not in the U.S., we are assuming this paragraph is not applicable. Is this a correct assumption?

Correct. References to E- Verify have been removed.

83 Page 72-73 of 138. Item Number0015AF: Environmental Engineer, Senior - The SOW states: “This person must have a US. Professional registration.” This requirements will impose use of U.S.-based resources in a number of European countries (with the written exception of Germany and Italy), imposing certain limitations to the usage of qualified HN staff. Also, U.S. PE registration is usually not a recognized professional qualification in the majority of European countries. Please clarify whether this requirement of a U.S. PE can be waived.

This person must have a US or Host Nation-equivalent Professional registration, license, or certification.

84 Page 75 of 138. Item Number0015AV: Hazardous Waste Specialist. Please clarify whether this requirement can be waived via HN-specific training/certification.

This person must have a US or Host Nation-equivalent Hazardous Waste Management registration, license or certification.

85 Page 97 of 138. 52.000-4124 PRACTICES AND AFFILIATIONS IN BULGARIA (July 2008). The SOW states:

“3. Submittal Requirements: The offerors are required to submit the following, with their proposal, for each of the Prime Contractor entity (ies)” Is is our assumption that this requirement applies only to Group 2 and in case of Bulgarian Prime firms and/or Bulgarian Major subcontractor(s). Please clarify whether this clause is not applicable in case the Prime is not a Bulgarian entity or affiliate and no Bulgaria key subcontractor are engaged.

Correct.

This clause has been removed.

86 Page 118 of 138. FACTOR 2 - PAST PERFORMANCE Submission Requirements In relation to Past Performance Questionnaire (PPQ), the SOW states: “Offerors shall not incorporate by reference into their proposal PPQs previously submitted for other RFPs.” Our interpretation is that past projects used for past other proposals can be utilized provided a brand new PPQ for that project is attached to the proposal. Please confirm correctness of the assumption.

The SOW states: “Offerors may also include performance recognition documents received within the last six years, such as awards, award fee determinations, customer letters of commendation, and any other forms of performance recognition” Please confirm that the performance recognition documents are relative only to the five projects that are presented as past performance.

CURRENCY (OCT 2000). The clause states: “….all bids and/or proposals received from contractors located in the following eleven countries shall be submitted using the EURO (the new European Currency): Germany, France, Italy, Spain, Netherlands, Belgium, Austria, Portugal, Finland, Ireland, and Luxembourg.”.

in Euros. The requirement is not country specific.

88 Regarding the submittal time at the 21st May due date, please provide a time and the relative time zone.

Central European Summer Time

Due date changed with Amendment 0003.

89 Regarding the upload of the submittal documents the day before the due date, the RFP states 5:00 pm but does not provide the time zone. Please clarify which time zone 5 pm refers to.

This reference was removed in Amendment 0003.

90 Page 119 – Factor 3 – Management Approach, 3. The SOW states: “…and letters of commitments from additional personnel required to meet the minimum requirements of the contract;”. Please clarify whether the letter of commitment is required for all key personnel listed in the proposal or if it’s required for staff, outside subcontractors, that are planned to be hired specifically for the delivery of this contract.

The letter(s) of commitment are required for key personnel or key Subcontractor(s) not directly employed by the Prime Contractor or Prime Contractor JV.

91 Page 119 of 138 - FACTOR 3 – MANAGEMENT APPROACH.

The requirements for the document call for the minimum of 12 pitch font. ? Please clarify whether this minimum 12 pitch font applies to the text, graphics and tables or to the text only.

Also, please clarify:

a) whether the minimum 12 pitch font is required for Att. 2, Experience Information Sheet as well, since the font of this Government-provided attachment is 11.5 pitch; and

b) whether the minimum 12 pitch font is required for Att. 3 PPQ as well, since the font of this Government-provided attachment is smaller than 12 pitch.

Pitch font other than 12 is acceptable in figures, tables, graphics and attachments so long the text is clear and legible.

92 The RFP/SOW requirements ask for resume of the six key personnel. Please clarify whether it is possible, for each Group, to present two or more resumes for each of the six key personnel or it is one resume for each key personnel only.

One resume will be reviewed and evaluated.

93 Page 2 of Attachment 2 – Experience Information Sheet – Item c.

: Please confirm that item c. needs to be filled out only if the offeror delivered part of the work as Key Subcontractor.

Confirmed.

94 Page 2 of Attachment 2 – Experience Information Sheet – Item e.

Confirmed.

95 Section C.4.11 Management Plan states: “After award of the base Yes.

contract, the successful Contractor shall submit an overall management plan for execution of work under this contract. This plan may be the same one that was prepared for the solicitation effort. The plan will be subject to limited Government comments which will be supplied within 30 days of receipt. A final management plan shall be submitted by the Contractor within 30 days of receiving comments.” Please clarify whether the Factor 3

– Management Approach document indicated elsewhere in the RFP/SOW is the same as the Management Plan indicated in Section C.4.11 above.

96 The SOW indicates the Contractor Project Manager as an important role, even if it’s not listed as Key Personnel. However, it is our opinion that a Contractor Program Manager for this contract could be a Key Personnel with regards the comprehensive management of the contract, its requirements and the coordination of the EUD Client, the technical key personnel, the Task Order Project Managers and the subcontractors, ensuring consistency in the overall delivery of all the TOs within the contract. The Contractor Program Manager was a key personnel in the previous contract (as well as in other contracts).

Would the Europe District consider to include a Contract Program Manager as a Key Personnel and amend the RFP/SOW accordingly?

No.

97 Reference page 121. DFARs Clause 252.215-7009 Proposal Adequacy Checklist (Jan 2014) has been included which identifies the Proposal Adequacy Checklist. Our understanding is that this DFARs Clause and the subsequent Proposal Adequacy Checklist is required only when certified cost and pricing data is required as part of the offeror’s proposal. Does the Government require offerors to submit certified cost or pricing data and include a completed Proposal Adequacy Checklist as part of our proposal submission?

See the answer to question 73.

98 there occurred one question regarding the proposal layout instructions for solicitation W912GB-15-R- 0016, mentioned on page 115 buttom (original quote):

The contractor is to submit pricing on the excel Price Schedule, not Section B Contract Line Item (CLIN) Schedule.

137 - At the beginning of doc. 1 Solicitation p. 28 there are the requirements for the personnel. (Project manager, contracting manager, engineers etc.). Are we required to provide such personnel for each country (Bulgaria, Romania, Georgia, Ukraine etc.) or is it sufficient to have one team for all listed countries or it is sufficient to have only one team in this moment?

At this time, only the six key personnel are require.

Personnel will be evaluated on the minimum requirements. It is not a requirement to provide personnel for each country.

138 - The requirements for the personnel are very serious. For example, the solicitation requires the senior environmental engineer to have U.S. professional registration (p.73). If we have to find an entire team of engineers from each Host Nation, please let us know ASAP, with those requirements it will be a difficult and time consuming task.

See RFI #83.

139 Regarding Experience and Past Performance: Must the successful offeror have a). qualifying experience and past performance which would be applicable to all three geographical areas, OR b).

in each of the three geographical areas that it bids, or c). in each Host Nation (HN)??

Fully relevant experience and past performance would include each geographical area that is being bid on.

Relevant experience is that which is similar in nature to that requested under the solicitation. This includes the geographical locations identified in the solicitation.

140 page 83 - Permits and responsabilities: Considering that it is Permits and Responsibilities unknown the exact types of works foreseen, does the time needed for obtaining the necessary licences and permits from Host Nation for the specific project is deducted from the execution time? It will be enough time?

will be addressed at the task order level.

141 page 1 - paragraph 13: How many days are considered in a "prompt payment" statement?

Prompt Payment due dates are determined in accordance with FAR 32.904. Prompt Payment for services is 30 calendar days. Please refer to FAR Clause 52.232-8.

142 page 124 - cost elements: Based on the unknown field situation and the amplitude/scale of the works neccesary also the mitigation factors, then a consolidated summary of materials could not be issued in this moment,or shall include raw materials for ALL types of contamination factors and for all air, groundwater, soil, etc.?

Please see the answer to question 73.

143 Topographical measurements: it is necessary that the reference system of measurements to be in projection plane of each country or WGS84 projection system?

WGS84 (where applicable)

146 If we use in this step some subcontractors and after awarding we will use or need other subcontractors it will be accepted?

Other subcontractors may be accepted by the Contracting Officer on a per task order basis.

147 We should provide resumes for 1 group of personal as minimum requirement?

See RFI #137 http://www.hubbellpowersystems.com/literature/anchoring/04-7504.pdf http://www.hubbellpowersystems.com/literature/anchoring/04-7504.pdf http://www.hubbellpowersystems.com/literature/anchoring/04-7504.pdf

148 Considering no amendments have been issued to date in response to RFIs that have been submitted and the short time period before the submittal due date (not later than 5:00 p.m. one working day prior to the date specified for receipt of offers [May 21], per RFP Page 114), would the Government consider granting an extension of two weeks to the proposal submittal date?

Due date extensions are incorporated.

149 DBA Insurance (Q.11) Answer states that DBA insurance is not a separately priced item and should be included in accordance with your standard business procedures.

This contradicts instructions in previous RFPs that DBA insurance should be included as a separate line item in task order proposals.

The cost of DBA insurance is variable depending on provided and annual adjustments Please clarify this requirement?

DBA insurance is not to be a separately priced line item.

150 The questions and answers indicate that the Proposal Adequacy Checklist should be submitted as part of Volume 2; however, the revised Section L no longer includes the checklist. Is the completed form still a requirement?

Please see the answer to question 73.

151 Please explain the formula for ‘Group Base Year Total’ is it a sum which comprises what prices?

All prices.

152 Labor Rates Base Year the prices should be made per hour or per total of hours?

Per hour

153 RFP Section K, Page 106 under 52.000-4091, requests a “Certificato d’ Iscrizione al Casellario Giudiziale” for each member of the company. Are we correct in assuming that the certificate is needed for only for the managers or employees named in the Certificate of the Chamber of Commerce (typically the President, CEO and 2 Technical Directors) and not for “each member of the company”?

This requirement was removed with Amendment 0003.

154 RFP Section H, Page 91 request to submit the Antimafia Declaration (http://servizi.confindustria.toscana.it/gruppo/imprese-pubblica-amministrazione/certificazione-antimafia-informazione-2013-richiesta-rilasci). There is a new Italian Law that regulates this request (Legislative Decree. 15 November 2012, n. 218). The one mentioned in the RFP is no longer in effect. The certification is released by the Prefecture and no longer by the Chamber of Commerce. Below specific thresholds the certification is not even required (self-certification is sufficient). Are we requested to comply with the above mentioned Legislative Decree? If so, does the Government require an “antimafia communication” or an “antimafia information”?

This requirement was removed with Amendment 0003.

155 Can you please clarify the following costing questions:

(1) Should ODC be presented with or without G&A applied?

Without

156 (2) Should the drilling meter prices be presented with core With http://servizi.confindustria.toscana.it/gruppo/imprese-pubblica-amministrazione/certificazione-antimafia-informazione-2013-richiesta-rilasci http://servizi.confindustria.toscana.it/gruppo/imprese-pubblica-amministrazione/certificazione-antimafia-informazione-2013-richiesta-rilasci http://servizi.confindustria.toscana.it/gruppo/imprese-pubblica-amministrazione/certificazione-antimafia-informazione-2013-richiesta-rilasci storage boxes (Kernkisten) or without?

157 (3) Define the difference between “Percussion Drilling” and “Sondier Boring”. Perhaps the full German terms would help to alleviate some confusion.

Percussion (perkussionsbohrung)

Sondier boring (Sondier Bohrung)

158 Is Section K in Amendment No. 0003 (starting at page 89 of the amendment) in addition to or in replacement of the original Section K (starting at page 106 of the original solicitation)?

Should offerors complete both?

Please complete Section K from the original solicitation and clause 52.222-22 from Amendment 0003.

159 Please clarify if the Proposal Adequacy Checklist will only be required for task orders under this contract.

Please see the answer to question 131.

160 Please clarify if the Government is requesting “information other than cost or pricing data” rather than certified cost or pricing data since the pricing agreed upon will be based on adequate price competition.

The Government is not requesting certified cost and pricing data or other than certified cost and pricing data.

These items may be required at the task order level and will be addressed in the Task Order’s Request for Proposal.

161 If the Government requires the Proposal Adequacy Checklist, will the Government revise the submission requirements for Factor 4 – Price in Section L of amendment 0003? Currently, this section only requires completion of Section B, Price Schedule. Submission of the Proposal Adequacy Checklist would require the submission of additional information not currently requested for Factor 4 - Price.

Please see the answer to question 73.

162 The response to Question 45 in amendment 0003 states that one resume per discipline per geographic grouping will be reviewed and evaluated. Are Germany and Poland considered separate geographic groupings?

No. Germany and Poland are not separate.

C.l GENERAL C.1.1 General Information - The objective of the contract is to provide Firm Fixed Priced (FFP), Indefinite Delivery, Indefinite Quantity (IDIQ), Multiple Award Remediation Contracts (MARCs) for Environmental Remediation and Contaminant Mitigation Services in support of the U.S. Army Corps of Engineers, Europe District (CENAU) Environmental Branch. They would provide environmental support to CENAU's current and potential clients. Generally, work will be performed where U.S. Army Europe (USAREUR) installations are located. However, this could be extended to areas covered by other Department of Defense agencies and/or other U.S. Government agencies or partners. These contracts will include FFP features for a wide range of environmental remediation services at various known or suspected contaminated sites. It will also be used to perform other contamination mitigation actions including excavation and/or removal of contaminated soil. Work may be executed under a prescriptive, task by task Statement of Work (SOW) or under a Performance-Based Acquisition (PBA) Task Order (TO) using Performance Work Statements (PWSs). Furthermore, our primary customer, U.S. Army Environmental Center (USAEC), requires a comprehensive environmental remediation services contract to support the Army Environmental Cleanup Strategy (AECS) in Europe. The Compliance Cleanup (CC) Program implements the AECS pursuant to DOD Instruction 4715.08, Remediation of Environmental Contamination Outside the United States. A key metric for the CC Program is to maximize the number of sites achieving ‘response complete’ by September 2018 and 2021. Response complete is a distinct milestone reached when the selected remedy has achieved remedial action objectives specified in an Army approved Decision Document. Many of the USAEC efforts will be through PBAs.

C.1.2 Guarantee - The awarded contracts shall have a total guarantee minimum amount of $5,000 for the base period. There are no minimum guarantees for option years that are exercised by the Government.

The guaranteed minimum may be met with the obligation of a TO meeting or exceeding the guarantee amount and shall be de-obligated when the obligation occurs.

C.1.3 Location – The awarded contracts shall be in geographic groupings as follows: Germany, Poland C.1.4 Scope of Remediation and Contamination Mitigation Measures - Contractors will be responsible for fully executing required environmental remediation and contaminant mitigation services for a variety of media including but not limited to groundwater, soil, surface water, drinking water, air, and buildings, techniques for remediation and mitigation also vary; they include but are not limited to in-situ methods; ex-situ methods; removal; natural attenuation; physical, chemical, or biological processes; or any combination thereof. The specific requirements are site and contaminant dependent; they are defined during site investigations site assessments, remedial investigations, feasibility studies, and/or scoping and may require prompt action due to mission, legal, environmental, or health protection issues.

Work that might be tasked under this contract includes, but is not limited to, the following (for a more detailed list of efforts see Section C.2.2:

Surveys, assessments and plans:

• Performing environmental assessments to include sampling and/or testing of any media (including geotechnical testing);

• Consulting services such as providing recommendations and reporting remediation results;

Studies and Reports:

• Corrective Measures Study (CMS) and Remedial Investigation /Feasibility Study (RI/FS);

• Related efforts to include: risk assessments, pilot tests, fate and transport analyses, groundwater modeling or other techniques;

• Studies related to contamination mitigation requirements such as radon, asbestos, etc.

In situ/ex situ cleanup:

• Monitoring by sampling groundwater, surface water, sediment, soil, and/or air;

• Installing and/or operating equipment for standard and/or state of the art remediation systems. To include enhancing or continuing pilot tests of existing systems;

• Removing and/or disposing of contaminated media (contamination mitigation);

Other Mitigation and Environmental Services

• Emergency Spill Response and Assessment of spill areas;

• Protecting/repairing eroded (or potentially eroding) areas;

• Conducting topographic surveys and other elevation and location measurements;

• Removing/Mitigating asbestos, lead and radon;

• Non-hazardous, toxic, chemical, and radioactive environmental projects;

• Conducting site surveys and evaluations of Unexploded Ordinance (UXO);

C.1.5 Conduct of Work - The Contractor, the Contractor's subcontractors and the Contractor's suppliers shall perform all work while respecting Host Nation (HN) and U.S. environmental laws, DODI 4715.08 (for remediation efforts), and in compliance with an approved management plan. The Contractor shall be responsible for acquiring the latest version of applicable laws, regulations and regulatory agency guidance and the referenced documents cited within this solicitation and/or subsequent TOs issued after award of the Contract, unless otherwise specified.

C.1.6 Performance Based Contract Task Orders- Work will generally fall under task orders using performance Work Statements (PWSs). A performance work statement structures all aspects of an acquisition around the purpose of the work to be performed and does not dictate how the work is to be accomplished. It is written to ensure that contractors are given the freedom to determine how to meet the Government's performance objectives and provides for payment only when the results meet or exceed these objectives. It maximizes contractor control of work processes and allows for innovation in approaching various work requirements.
