About this file
This document contains a brand justification and federal contract opportunity for the procurement of an X-ray fluorescence (XRF) analyzer. The U.S. Army Corps of Engineers seeks to purchase one Thermo Fisher Scientific Niton XL2 980+ Alloy Analyzer with soils and lead paint modes, along with required accessories and a two-year warranty. The brand justification cites existing use of and training on Niton units, compatibility with current data collection and analysis procedures, and regulatory compliance needs as reasons for restricting the procurement to the Thermo Fisher Scientific brand. Offerors must be registered in SAM and quotes are due by the date and time specified in the corresponding federal business opportunity posting on SAM.gov. The contract award will provide the requested analyzer and accessories to the Corps of Engineers St. Paul District for use in environmental sampling and analysis in support of Superfund cleanup activities.

BRAND NAME JUSTIFICATION FOR
ACQUISITIONS UNDER THE SIMPLIFIED ACQUISITION THRESHOLD
1. In accordance with Federal Acquisition Regulation (FAR) 13.106-l(b)(l), I hereby determine that the proc Niton XLS XRF unit listed on W912ES24Q0034 is available from one source and competition is precluded for the reasons indicated below. There are no substitutes available.
2. This Acquisition is restricted to the following source:
Company:
Company Address:
Company Point of Contact:
Company Phone Number:
Thermo Scientific Portable Analytical Instruments Inc 2 Radcliff Rd., Tewksbury, MA 01876 Ritch Vernon
(314) 346-1911
3. The procurement cost for one Niton XLS Plus XRF analyzer with required software and accessories is estimated to cost $
4. Specific characteristics of the procurement that limits the availability to sole source are:
• Multiple districts within MVD currently possess Niton XL2 units. Standard Operating Procedures have been developed for these units and would be applicable for newly procured Niton units. Procurement of units from a different manufacturer would require new SOPs to be developed.
• Technical requirements must meet the cleanup objectives for USEPA Superfund cleanup at residential properties. This procurement requires instrumentation for analysis of environmental samples and shall be held to the strict federal and state standards for testing. The Niton XLS XRF meets remedial requirements.
• CEMVP personnel have completed formal training for operating Niton units.
• Specialized safety training is required for operation given the radioactive source contained within XRF units. Procurement of different units would require additional training for any USACE personnel using these units.
• USACE Personnel in the Mississippi Valley Division (MVD) have over S years' experience operating and maintaining Niton XRF units. This will enable internal sharing of best practices and troubleshooting of problems.
• Manufacturers have not standardized software and therefore personnel would be required to learn new systems should an alternate brand be procured.
• Niton XL2 unit software allows data to be downloaded to a media that cannot be altered:
o Ensures the contractor is reporting correct data.
o Data that is unaltered becomes more legally defensible.
5. Check and fill in all that are applicable:
IZI The material or service must be compatible in all aspects (form, fit, and function) with existing systems presently installed. The current equipment is Niton XL2 XRF units and the new item/service must coordinate, connect, or interface with the existing system by using identical interfaces for data input and output to minimize user training time, maximize efficiency of maintenance, and ensure data results are replicable.
