SCOPE OF WORK

FRENCH LAKE CULVERT VEGETATION DEBRIS REMOVAL CONTRACT

I. Location. French Lake culvert is in the southeast corner of Lake Onalaska on the Lock and Dam 7 embankment (see map attached).

a. Directions from I-90; get off on Exit #2 head north on County Rd B approximately ¼ mile to Fanta Reed Road, turn left on Fanta Reed Road going West to the stop sign, take a right at the stop sign (Lakeshore Drive) heading north to Spillway Drive, take a left on Spillway drive to Bay shore drive, take a left on Bay shore drive then and immediate right into the public access where the culvert is.

II. The purpose of this culvert is to provide aerated water from Lake Onalaska to French Lake, located on the downstream side of the Lock and Dam 7 embankment. The intake gets plugged by aquatic vegetation and woody debris, greatly reducing water flow through the culvert. Should this condition persist into the winter, hypoxic conditions are likely to develop within French Lake, resulting in a winterkill of fish there.

III. Background. Vegetation and other debris floats into the culvert intake area throughout the open water season (April – December). Over time this material gets hung up on the trash rack, plugs the culvert, and limits the amount of water flow passing into French Lake. The trash rack protecting the intake area is in standing water, and water depths common in the immediate vicinity are 2’ to 4’ in depth. Hip boots or chest waders are usually required by workers to stay dry during the cleaning of the rack. The vegetation build-up can become so severe that it completely prevents water from passing through the culvert. The performance period for this contract will begin with the award for 2022, and any future options would run April 1 until approximately December 15th. Bid line items will include the full month of December, but the actual conclusion will be determined based upon ice buildup at the intake. The Government will determine when sufficient ice buildup has occurred, and the site has reached the winter setting. The contractor will be paid on a pro-rated basis for the number of days (if any) worked during December.

IV. Basic Work Description. The contractor shall furnish all labor, materials, equipment and supplies necessary to ensure that the trash rack is at least 80 percent clear of vegetation and other debris during the performance period of this contract. The government will inspect the culvert to determine the number of days per month this specification was met. Acceptance of a billing invoice will reflect the inspection results. The trash rack should be cleared in a manner that allows water to pass through the culvert, and normally consists of working vegetation out of the trash rack, removing woody debris, and freeing the rack of any other natural or man-made debris that floats into the intake. Traditionally, cleaning the trash rack has been completed using either basic landscaping tools (e.g., rake, shovel) or by hand while standing in the water next to it. In addition, the contractor shall also ensure that a radius of 75 feet from the trash rack is clear of aquatic vegetation and other debris during the duration of this contract. The contractor will be required to cut and remove all aquatic vegetation within this 75’ radius at least one time per month during the months of June, July, and August. Any other debris within this area shall be removed as well. After each vegetation and debris removal or cleaning, all vegetation and debris must be hauled away and disposed of off-site (non-Corps of Engineers property). Aquatic vegetation begins to die off and float into the area beginning in September. The contractor will be required to clear the 75’ radius of all floating vegetation and other debris at least once a month during the months of September, October, and November. Although it is highly variable, aquatic vegetation ranges from a few inches to a few feet thick during these months. Again, all vegetation and debris must be hauled away and disposed of off-site (non-Corps of Engineers property). Vegetation and other debris removal will require a mechanical means to meet the terms and conditions of this contract. In summary, the mechanical removal portion of the contract will be required to occur once each month during the months of June, July, August, September, October, and November. After each vegetation and debris removal or cleaning, all vegetation and debris must be hauled away and disposed of off-site (non-Corps of Engineers property).

Flushing of vegetation through the trash rack is also an acceptable method for maintaining the 80% clearance requirement. Piling of vegetation or debris in the space between the radius line and the rip rap embankment is not allowed (i.e., space between the intake and rip rap).

V. There may be times when the gov’t may request the contractor to perform additional cleanings of the 75’ radius area in addition to the requirements outlined above. Payment for these removal requests will be based upon removal of a cubic yard of dewatered materials. We will provide an area for materials to be piled for drying/dewatering for a short time (i.e., 1 week) prior to being loaded and hauled away by the contractor. Such requests could occur following a high-water event or extended high wind occurrence that may bring in additional debris.

VI. Measurement and Payment. The contractor must submit an invoice after each month of work. Payment will be based upon the performance standards as outline above and the number of days per month that met the flow specifications.

VII. Safety. The Contractor shall comply with all safety and health requirements as outlined in the Corps of Engineers Safety and Health Requirements Manual (EM 385-1-1) and OSHA Safety Standards to ensure the safe working conditions for his employees and other workers at the site. VIII. Government Liability. The Government assumes no liability from the contractor's performance of the contract work. The contractor shall hold and save the Government harmless from any and all liability arising from the performance of the contract.

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. (d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph

(d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records--Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days.

52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within 5; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 15 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 5 years.
