STATEMENT OF WORK
STATEMENT OF WORK
Tree Planting and Vegetation Control at Three Locations in the Mississippi River Floodplain in
La Crosse County, Wisconsin and Allamakee County, Iowa
1 BACKGROUND
This statement of work describes treatments to plant 1,600 bareroot and 300 3-gallon containerized tree seedlings, install tree protectors on 1,300 seedlings, and implement follow up mechanical and chemical vegetation control Goose Island County Park and Mormon Slough sites in La Crosse County, Wisconsin and at the Swift Slough Site in Allamakee County, Iowa. The Goose Island County Park and Mormon Slough plantings are demonstration plantings to assess the effectiveness of various management actions on tree seedling establishment.
1.1 SITE DESCRIPTION
Goose Island County Park The Goose Island project area is a large island complex just south of La Crosse, WI. A large area of the island is outgranted to the La Crosse County Parks Department. The planting area in this contract is located within the eastern edge of the campground. The planting area has been maintained as lawn as part of campground management so vegetation is composed almost exclusively of turf grass.
County Road GI bisects the site from east to west as well as north to south, with an additional paved road running north from the middle of the site. This planting area is a narrow 0.58 acre strip located on the west side of the County Road GI between the road and the Goose Island County Park Campground. There are currently pockets of red pine to the west of the planting area and these trees make up the western boundary of the planting area where they occur. A cable fence on the east makes up the eastern boundary where it occurs. A rarely used gravel drive bisects the south end of the area and this drive will not be included in the tree planting. Cover within the planting area is currently mowed grass. There is a depression in the northern portion of the planting area that holds water after large rain events. Most of the soils along the road are loamy sand or loamy fine sand with sand 4-18 in below A horizon. There is a slight uphill slope that goes up from the road approximately 30% slope over 5ft.
Mormon Slough Mormon Slough consists of a number of islands between the Mississippi River main channel and the Goose Island complex in Pool 8. The islands contain a range of habitats, with mosaics of emergent aquatic vegetation, reed canarygrass-dominated wet meadow, and scattered patches of forest.
The tree planting area in this contract is located on a large island within the Mormon Slough Complex that is less than 1,000 feet from the north boat landing in Goose Island County Park.
The planting area is currently completely dominated by dense reed canarygrass.
Access to this site is by boat only. Water depths between the boat landing and the planting site are reliably a minimum of 4 to 5 feet deep or deeper.
Swift Slough The Swift Slough site primarily comprises the natural levee and part of the first bottom just west of the main Mississippi River channel and just south of the Upper Iowa River. The nearest towns are Victory, WI to the northeast and Lansing, IA to the southwest. The Mississippi River main channel makes up the entire eastern boundary of the site. The northern boundary generally follows Little Slough, and Big Slough makes up the western boundary. The mouth of Swift Slough is at the southeast corner of the site, and the southern boundary of the site follows the USACE/USFWS ownership boundary.
The site is generally higher in elevation, especially on the natural levee adjacent to the main channel, south of Little Slough, and north of Swift Slough.
The site is dominated by maple and maple-ash-elm forest community types, with maple-ash-elm more common towards the main channel and maple heavily dominant in the lower elevation areas. There are numerous pockets of relatively open canopy within the site, and basal area averages just under 100 square feet per acre. At least one-third of inventory plots are below 100 square feet basal area, and these generally are closer to the main channel.
Regeneration is mostly absent on the site and, where it is present, green ash is the dominant regeneration species.
Herbaceous vegetation is primarily a mix of wood nettle and stinging nettle with dense pockets of reed canarygrass in more open areas.
1.2 PRESCRIPTIONS
1.2.1 Prescriptions
Each of the plantings in the current contract include planting of large bareroot seedlings and follow up mechanical and/or chemical vegetation control. The Mormon Slough and Swift Slough plantings also include planting 3-gallon containerized trees and installation of tree protectors.
Both tree seedlings and tree protectors will be provided to the contractor by the USACE; a total of 1,600 large bareroot tree seedlings and 300 3-gallon containerized seedlings will be planted, and 1,300 tree protectors will be installed.
1.2.1.1 Goose Island County Park
The objective of the planting is to test the effectiveness of deer fence and PlantSkydd deer repellant on growth and survival of swamp white oak and river birch seedlings; however, deer fence installation and PlantSkydd application will be conducted in-house by the Government and are not included as work in this contract.
Tree Planting (CLIN 0001AA) The site will be planted at a 6 x 6 spacing in spring of 2022 with a mix of 400 swamp white oak (WI DNR nursery 2-0 seedlings) and 200 river birch (WI DNR nursery 1-0 seedlings). Trees will be planted in rows oriented perpendicular to the road and will be planted in a pattern with two rows of swamp white oak followed by a third row of river birch. Government staff will place pin flags to designate each tree location prior to initiation of contract work.
Follow-up Vegetation Control (CLINs 0001AB, 1001, 2001) The tree locations will be sprayed with a broad spectrum herbicide between May 15 and June 30, 2022, 2023 and 2024 to create a 2 foot radius weed free zone around each planted tree.
Applications should be conducted in a manner that prevents damage to the tree seedlings.
1.2.1.2 Mormon Slough
The objective of this planting is to test various seedling stock sizes and vegetation control techniques for floodplain forest tree planting. In addition, broad control of reed canarygrass will be used to determine whether chemical site prep alone would be sufficient to allow for the establishment of natural tree regeneration. Tree planting will be implanted in this contract in the MOSL 2022 planting zones (see Att 01, Planting Maps). Follow up vegetation control will occur in both of those zones as well as in a zone between the two zones that was planted with 123 3-gallon containerized swamp white oak in fall of 2021 (MOSL 2021 Woody Warehouse Zone).
Site Prep Mowing, Marking Planting Locations, and Planting (CLINs 0002AA – 0002AD) In spring of 2022, USACE will mark with pin flags the planting locations for 500 trees in the planting area. Prior to planting, the contractor shall mow or weedwhack a 4 foot radius circle at each marked planting location. Between April 1 and May 31, 400 large bareroot swamp white oak and river birch seedlings at a spacing of approximately 10 x 10 ft will be planted in the
MOSL 2022 Bareroot area (see Att 01, Planting Maps) and 100 containerized (3 gallon) swamp white oak from Forest Keeling Nursery will be planted at a 16 x 16 foot spacing in the MOSL 2022 Forest Keeling area. Spring 2022 planting locations shall be marked and mowed prior to or at the time of planting. Bareroot seedlings will be in a range of sizes; 100 swamp white oak will be 1-2 seedlings that are 3-5 feet tall, 100 of the swamp white oak will be 3-0 seedlings that are 2-4 feet tall, 100 of the river birch will be 1-2 seedlings that are 3-4 feet tall and 100 of the river birch will be 2-0 seedlings that are 2-4 feet tall. The containerized seedlings will range from 3 to 6 feet tall and have fibrous root systems in pots. ALL SEEDLINGS WILL HAVE LARGE
ROOT SYSTEMS AND PLANTING TOOLS SHOULD BE ABLE TO ACCOUNT FOR
THESE LARGE ROOT SYSTEMS.
A 3 foot tall Plantra tree tube or spiral wrap shall be installed on each tree seedling at the time of planting. Seedlings greater than 3 feet tall should be protected with a tree tube, while shorter seedlings should be protected with spiral wrap. Bamboo stakes should be used to support tubes if the trees are shorter than the tube or otherwise unable to support the tube.
Follow-up Vegetation Control - Chemical (CLINs 0002AF, 0002AH, 1002AA, 2002AA) Vegetation control zones will be marked in the field prior to the initiation of the first CLIN in June of 2022. Herbicide zones will be marked with pink flagging, mowing zones will be marked with blue flagging, and the no vegetation control zones will be marked with orange flagging.
Between June 1 and June 15 of 2022, all areas with the herbicide zones will broadcast sprayed with a broad-spectrum herbicide, including spraying around all planted seedlings. Broadcast spraying should be conducted in a way that does not damage planted seedlings. All sprayed areas will be broadcast sprayed a second time in late summer of 2022. In late May of 2023, a third broadcast spraying will be implemented in the herbicide zone; this spraying must occur prior to seed drop of native trees. If high water prevents a May herbicide application, the site should be sprayed instead in early to mid-June with a spot spraying only to create a 2-foot radius circle around each planted tree. Herbicide treatments should result in trees being in a free to grow condition following herbicide application. In early to mid-June of 2024, a final spot herbicide application will be implemented around each planted tree in the spray area.
Follow-up Vegetation Control - Mechanical (CLINs 0002AE, 0002AG, 1002AB, 1002AC, 2002AB, 2002AC)
Trees in the delineated mowing area shall be mowed twice in the summers of 2022, 2023 and 2024, once in mid-June and again in late July or early August. The mowing should be implemented in a 4-foot radius circle around each planted seedling and, following mowing, vegetation should be no more than 6 inches tall from the soil surface within the mowing area.
1.2.1.3 Swift Slough
The current prescription is the first of a series of prescriptions in this area and will focus on establishment of hard mast species at higher elevations along the main channel in areas with partially open canopies (approximately 25 to 40% canopy closure). These trees are intended to provide a future seed source and are not intended to fully capture the site, so they will be planted at a relatively wide spacing of roughly 16 x 16 feet (170 tpa). There are multiple active bald eagle nests within the planting zone, and no planting activity may occur within 660 feet of any active eagle nest unless USFWS determines either that the nest is not active or that hand planting disturbance will be minimal and not result is adverse impacts to nesting. Eagle buffers will be flagged in the field prior to planting, but the contractor will select actual planting locations.
Tree Planting (CLINs 0003AA – 0003AC) The spring 2022 planting will consist of 200 containerized RPM swamp white oak seedlings from the Forest Keeling Nursery (3-gallon, 3-6 foot tall), 400 2-0 bareroot southern pin oak (Quercus palustris) seedlings and 200 2-0 bareroot northern red oak seedlings, both from the WI DNR nursery. Trees will be planted in April or May of 2022, and a 3 foot tall Plantra tree tube or spiral wrap shall be installed on each tree seedling at the time of planting. Seedlings greater than 3 feet tall should be protected with a tree tube, while shorter seedlings should be protected with spiral wrap. Plantra tubes should be staked with a 4 foot or larger bamboo stake or any other biodegradable stake material that will support the tube for at least three growing seasons.
Follow-up Vegetation Control (CLINs 0003AD, 1003, 2003) In June of 2022, 2023 and 2024, a four foot radius circle should be sprayed around each tree planting location with a broad-spectrum herbicide to create a vegetation free zone around each tree. Herbicide should be applied in a manner that does not result in damage to the planted tree.
Acceptable equipment Planting on the Goose Island County Park site must be conducted by hand, using dibble bars, shovels, or other hand planting tools. Due to the potential for disturbance of cultural resources, the planting should aim to minimize soil disturbance and not create holes larger than are necessary for planting trees. Herbicide application on the Goose Island site must be conducted using backpack sprayers; no mechanical equipment will be allowed.
On the Mormon Slough site planting may be conducted using dibble bars, shovels, or other hand planting tools. Gas powered equipment for planting and vegetation control may also be used, though all equipment must be brought to the site by boat.
Due to the presence of eagle nests at Swift Slough, hand equipment only may be used on this planting site.
1.2.1.4 Tree Seedling Specifications
Tree seedling supply USACE staff will pick up seedlings from the nursery and the contractor will be required to take possession of the seedlings from the USACE within 48 hours of notification that the seedlings have been picked up from the nursery. The contractor may pick up the seedlings at the USACE Mississippi River Environmental Section office in La Crescent, MN. The contractor assumes all responsibility for storage of seedlings from the time they take possession of the seedlings and may be held responsible for the cost of the seedlings if they are not properly stored prior to planting.
Tree seedling, storage, handling and planting All seedlings shall be handled and stored in an appropriate manner to minimize seedling stress prior to outplanting. Bareroot seedlings shall be kept in a cool environment at or below 40 degrees F until the day of planting. In no case shall bareroot seedlings be kept outside of cold storage for more than two days (48 hours). Containerized seedlings may be stored outdoors in a cool shaded area, but should be watered at least 3 times per week until planted. Both bareroot and containerized seedlings may only be transported in a covered trailer or truck; they shall not bet transported in an open truck bed or in any other situation that would lead to desiccation from wind while being transported.
In the field, bareroot seedlings shall be stored in full shade or in coolers with roots well moistened. Bareroots shall be stored in planting bags or other containers to prevent desiccation of roots while being transported to individual planting locations. Bareroots shall not be held outside of a container for more than one minute.
Containerized seedlings shall be transported to the planting site in pots. Once to the planting site, they shall remain in pots until they are carried to the individual planting locations. At this time, pots may be removed and soil may be removed from the root ball to facilitate movement of trees, but in no case should roots be exposed for more than five minutes.
The government reserves the right to inspect the operation at time of planting and may levy a payment penalty up to and including the total cost of seedling acquisition and planting for failures to follow proper seedling handling requirements. The government also reserves the right to stop planting operations at any time that it determines that these guidelines are not being followed.
Bareroot seedlings may be root pruned at the time of planting to remove fine roots down to a minimum of 12 inches, measured from the root collar. First order lateral roots shall not be removed in this process but may be trimmed back, removing a maximum of 1/3 of the total root length.
Root balls of containerized seedlings should be pulled apart prior to planting to encourage new root development. This may be done by breaking through the outer layer of fine roots in three or four locations with a planting too, cutting through the outer layer of roots with a knife, or manually pulling roots apart. The entire root ball of containerized seedlings shall be covered with soil from the planting hole and none of the root ball should be visible once planted. However, the root collar of the planted seedlings should not be more than ½ inch below the soil surface.
The Contractor shall follow guidelines in USDA-Forest Service Handbook 247 for hand planting or machine planting1. Any seedlings planted outside of these specifications (e.g. exposed root collars, j-rooting, poor tamping of holes) may result in a performance penalty.
The Government Inspector may also specify where certain plant species or associations of plant species are to be planted within the project area. Plant material planted in inappropriate places will be subject to rejection by the Government Inspector during inspections.
The Contracting Officer may suspend planting work if weather conditions could damage plant material, even if the material is handled in accordance with this agreement. The Contracting Officer may also suspend planting work at any time if the Contracting Officer determines that the contractor is not handling plants or planting in accordance with this agreement.
Excess and waste material shall be removed and properly disposed of off-site. Areas that have been damaged by planting operations shall be restored to original condition at the Contractor’s expense.
1.2.1.5 Tree Planting Quality Assessment
Tree planting shall be considered acceptable if the following are true:
- 95% of trees stay in the ground following the “tug test” (a light pull on the seedling does not dislodge it from the ground), with no roots or root collar visible at the soil surface
- 95% of trees when excavated show by QA personnel show no sign of j-rooting or other indications that the tree was forced into too small of a planting slit or hole
- 99% of trees are properly placed within a seedling protector as specified above and the protector is securely fastened to a stake that meets size specifications.
Herbicide applications shall be considered acceptable if the following are true:
1 See pages 29-31 of the handbook, available online at: https://rngr.net/publications/forest-planting-practice-in-the-united-states/forest-planting-practice-in-the-united-states-1963
- 95% of herbicide application zones are 90% or more free of competing vegetation two weeks following herbicide application
- 99% of planted tree seedlings show no evidence of damage two week following herbicide application
Mowing and weedwhacking shall be considered acceptable if the following are true:
- 95% of mowing locations have been mowed according to specifications
- 99% of tree seedlings show no evidence of damage from mowing operations
Up to 5% of planted trees will be sampled in initial quality assessments by the government. If, based on the initial sample, quality of work appears to be below contract standards, an additional 5% will be sample to reach a total of a 10% sample of gaps.
Any performance penalties will be assessed on the proportions of gaps falling outside of specifications in the 10% sample; this proportion will be assumed to be representative of the treatment as a whole and may be applied to the entire pay request associated with the quality assessment.
1.2.2 Treatment Schedule
Treatments must be completed within time windows that will maximize treatment effectiveness.
Begin and End Dates for each treatment in each area and in the Base and Option Years are provided in the Bid Schedule Items table in Error! Reference source not found. below. No treatments may begin prior to the Begin Date and all treatments must be completed by the End Date for any given area. The contractor may select any date between those two dates to perform work, given that site conditions are appropriate and that the Government has given approval to proceed. In addition, upon contract award, the contractor shall submit to the Government point of contact (POC, Section 4 below) a tentative work schedule for the contract period. The Contractor submitted work schedule is not binding and may be updated as needed, but is intended to allow the Government to plan according to the contractor’s work schedule. The Contractor’s tentative work schedule shall in no way supersede the Begin and End Dates provided in this contract.
2 MEASUREMENT AND PAYMENT
Payment for this work will be based on the bid schedule below. Acreage provided by the Government in this solicitation are Government estimates only, based on GIS area calculations.
It is the Contractor’s responsibility to verify these acreages in the field. Following the completion of each bid schedule item below, the Contractor may submit for payment. Invoices shall not be submitted until the entire bid schedule item is completed.

2.1 Pre-Bid Site Tour
Contractors are encouraged to inspect/view the sites where the work will be performed before quoting. All questions shall be directed to the contract specialist, via email at
John.P.Riederer@usace.army.mil .
2.2 Invoices
The contractor must submit invoices to the Government POC to initiate payments.
Al l invoices shall be sent via e-mail or mail to the Government POC. Invoices with errors or that are not acceptable per FAR Clause 52.212-4 will be returned and a new invoice with a new date must be submitted for payment. Failure to do so may cause a delay in payment to the contractor.
3 POST-AWARD MEETING
A post-award meeting must be scheduled within 10 days after contract award and will be held by conference call. An on-site meeting will be discussed at that time; the on-site meeting must occur prior to work starting on the contract. Government inspection procedures will be reviewed at that time. The Contractor will be notified by the Government POC of the meeting time.
4 GOVERNMENT POINT OF CONTACT
Government Point of Contact information will be given to awardee.
5 HERBICIDE
5.1 Herbicide Handling
All herbicides must be transported to the site in closed containers with a clear product label indicating the herbicide or herbicides within the container and the mix rates as appropriate. All containers should be stored in a secondary containment vessel that to prevent spillage of chemical if the primary container leaks. If possible, herbicide mixing should occur off site.
However, if mixing does occur on site, all mixing must occur within a secondary containment container that will prevent spillage of any chemical onto the site. The Government reserves the right to stop contract operations if herbicide is observed to be being handled inappropriately.
5.2 Herbicide Plan
The Contractor shall submit a general written plan that addresses their recommended herbicides, application rates, timing, and spray methods proposed to achieve the contract goal of vegetation control at the management area, target pest and reason for choice as part of their bid. Only herbicide formulations in the Government list (Attachment 03) shall be used; if the contractor wishes to use an alternative herbicide, a request must be made to the Government POC no less than twenty (20) working days prior to anticipated application. The request will require submission for environmental review and the contractor should not assume that approval will be granted. If appropriate, surfactants shall be added per label instructions to appropriate herbicide mixtures. All carriers and adjuvants must be non-toxic.
The herbicide plan shall detail the carriers, adjuvants and surfactants to be used. Also include application rates, where mixing will occur, and plans for environmental protection if mixing is to occur on government property. EPA product labels and material safety data sheets (MSDSs) for all proposed products (website links are acceptable) shall be submitted with the herbicide plan.
The Government POC must receive submission of this plan a minimum of five (5) working days in advance of the desired application date. The request will be reviewed, considering as a minimum, for relative effectiveness and toxicity. The contractor shall also submit a tentative application schedule to the contracting officer a minimum of five (5) working days prior to initiating any work on this contract.
All treatments must be conducted during a period when target species are susceptible to the herbicide being used. All herbicides used shall be labeled for application in aquatic areas. No broadcast spraying shall be performed when wind speeds exceed specifications listed on the herbicide label, or wind directions are likely to result in drift to surface water or non-project lands. To protect groundwater resources, herbicide applications will not be allowed prior to precipitation that could facilitate rapid leaching of herbicide to the water table. At a minimum, herbicide(s) cannot be applied when the forecast indicates a high probability of significant precipitation during the next 24 hours, unless the herbicide label clearly states that the herbicide is rain fast in a shorter period of time than 24 hours. The Contracting Officer shall have the right to make these determinations and terminate any planned herbicide applications based on available weather forecasts and current conditions. Additionally, excessively dry conditions that can negatively affect herbicide performance should also be avoided. The Contractor is to notify the Government POC of any planned herbicide applications and receive prior approval before completing the planned application.
Herbicides shall be applied to the project areas in accordance with the weed control goals stated above. The Contractor shall take particular care to not exceed per acre limits according to the product label for basal bark applications.
5.3 Licensing
The Contractor, all of their employees, any subcontractors or other individuals performing herbicide work under this contract shall possess a valid state commercial herbicide applicator's license with certification for either Forestry (Category 2.0) or Rights-of-Way & Natural Areas (Category 6.0) for Wisconsin AND for Forestry (Category 2) in Iowa (or have completed requirements necessary for license reciprocity in Wisconsin and/or Iowa) and shall comply with all Federal, State, and local laws and regulations applicable to the contract work and to the products and materials used by the Contractor in performing that work. Contractors shall submit with their quote a list of anticipated pesticide applicators in their employ and a copy of the applicable credentials for each individual. Additional individuals may be added to this list after contract award upon receipt of their applicator’s credential. A least one individual must be in the employ of the Contractor upon submission of quote with the proper credentials; a quote that does not include documentation of a licensed applicator will not be considered a complete quote.
Department of Labor as well as state regulations regarding employment of youth shall be observed.
5.4 EPA Registration Label
All work shall be performed in accordance with the instructions on the EPA registration label of the chemical herbicide used. All safety instructions featured on the label shall be strictly adhered to.
5.5 Post-Application Documentation
The Contractor shall submit completed copies of the ‘Post-Application Documentation Form’ for each day’s herbicide work and for each herbicide used. A sample form is provided in Attachment 02 and may be reproduced. The Contractor may use his or her own form if it contains all information included on the Corps form. Scanned or digital copies of this form may be submitted electronically or hard copies may be mailed to the address of the government POC within five working days of each application or at the time of invoice submission, whichever is earlier. No payment will be made for services until post-application documentation has been supplied to the Government POC.
5.6 Herbicide Warranty
The Contractor shall exercise his/her professional judgment as to the application rate, time and extent of application of the herbicides. The Contractor warrants that:
Should the desired results not be achieved, the Contractor will, at no additional cost to the Government, reapply the herbicide to those areas where targeted vegetative growth continues or recurs. The determination as to the acceptable performance of the Contractor and the need to reapply the herbicides will rest solely with the Contracting Officer. If performance is determined to be unacceptable, the Government may require re-treatment of an area. If the Government determines that re-treatment will be required, written notice will be provided to the contractor by email. Treatments will be considered effective if 90% of stems in Government Quality Assurance (QA) plots show evidence of the treatment prescribed for the area in section 1.2 above.
5.7 Site Restoration
The Contractor shall be responsible for restoring any area that does not satisfy the warranty requirements at no additional cost to the Government. Areas will be retreated within the time specified by the Contracting Officer’s or Government POC’s notice to the Contractor. The Contractor is responsible for damages to persons or property, including unreasonable or unnecessary damages to non-target vegetation, within and outside the treatment areas resulting from the performance of the contract work. Reseeding of non-target native vegetation damaged in this way may be necessary and will be at the Contractor’s expense. Excess and waste material shall be removed and properly disposed of off-site. Areas that have been damaged by spraying operations shall be restored to original condition at the Contractor’s expense.
5.8 Material Safety Data Sheets
The Contractor shall make MSDSs for all herbicides, adjuvants and other products used at the site readily available to all affected contract employees.
6 ENVIRONMENTAL PROTECTION
Should a spill of petroleum, pesticide, or other contaminant occur, the Contractor's immediate response shall be to proceed with measures to limit the further spread of contamination.
Immediately following this initial response, the Contractor shall notify the local Fire Department, Contracting Officer, and appropriate local, state, and federal officials. This may include the National Response Center (1-800-424-8802) and/or the Wisconsin Department of Agriculture, Trade and Consumer Protection (1-800-943-0003) for spills occurring in Wisconsin and/or the Iowa Department of Natural Resources, Environmental Service Division (515-725-8694) for spills occurring in Iowa . There is someone on duty at this number 24 hours a day.
Subsequent to these actions, the Contractor shall take actions to clean up the spill as recommended by the Contracting Officer and at no cost to the government. Should a personnel contamination occur, the Contractor shall take immediate actions as prescribed by chemical manufacturer so as to protect the safety and health of the contaminated individual(s).
7 SAFETY
Notwithstanding any other provisions of this contract, the Contractor shall comply with all safety and health requirements as outlined in the Corps of Engineers Safety and Health Requirements Manual (EM 385-1-1) and OSHA Safety Standards to ensure the safe working conditions for his employees and government workers. Instructions for accessing the manual are available online at:

Work will be inspected periodically for conformance with these specifications for timeliness, safety and results achieved.
9 LIABILITY OF AND DAMAGES TO THE GOVERNMENT
9.1 Insurance
The contractor will carry liability insurance that will cover the application of herbicides as defined in this specification. This coverage will include as a minimum drift, run-off, and pollution (sudden and accidental) for all contract operations. The amount of coverage this insurance will provide will not be less than $1,000,000 per incident. A Certificate of Insurance form signed by the insuring agency shall be provided to the contracting officer within 10 working days after award of the contract. The insurance must provide coverage for the entire contract period. The insurance policy shall state that it cannot be cancelled without 30 days written notice to the Contracting Officer. Failure to secure and maintain insurance may be grounds for termination during the performance period of this contract.
