STATEMENT OF WORK
HERBICIDE APPLICATION
AT MISSISSIPPI RIVER LOCKS & DAMS, FOUNTAIN CITY SERVICE BASE,
EAU GALLE PROJECT, BLACKHAWK PARK AND
ONE RADIO TRANSMISSION SITE
1. GENERAL INFORMATION
1.1 This contract provides for the control and eradication of target vegetative growth, through the application of chemical herbicides on specified areas at thirteen locks and dams, the Fountain City Service Base, Eau Galle Project, Blackhawk Park, and one radio transmission site. Work shall consist of furnishing all necessary equipment, labor, materials and herbicides, necessary to accomplish the specified vegetative control and eradication.
The herbicide application shall be timed during the active growing season to achieve the optimum results, except in cases where the label recommends a dormant treatment. All herbicide applications shall be consistent with the product label instructions, manufacturer's guidance, and the requirements of this contract. Meeting the control objectives may require multiple visits to each of the various sites to meet all effective control prescriptions. The contractor may apply herbicides between 6:30 AM and 6:00 PM, Monday through Friday, excluding all Federal holidays, unless otherwise specified by the Contracting Officer.
1.2 Additionally, broadleaved invasive species such as leafy spurge, spotted knapweed, and buckthorn have been found and treated previously within brush control areas of lock and dams 1, 2, 5, 5A, 6, and 7. Leafy spurge has been observed last year (2021) at Lock and Dam #2, as well as leafy spurge and spotted knapweed and Lock and Dam #5A. The bid schedule includes CLINs for spot treatment, at locks and dams (L&D), of invasive species to be measured per acre of treatment.
Invasive species identified while work is performed shall be identified on map via submittal item #11. The contractor will be asked to be vigilant in locating concentrations of invasive species at all sites on this contract, and to recommend a herbicide and/or formulation and application time that will control these species as well. The contractor will provide a map of the invasives which identifies the plant(s), the locations, and the approximate acreage of impact to the Contracting Officer and Environmental Section POC. Government will make decision on whether to treat those areas for following bid option years.
Spot treatment of invasive species at L&D is separated into 3 zones on the bid schedule:
Zone 1: USAF, LSAF, and L&D 1-3.
Zone 2: L&D 4-7 Zone 3: L&D 8-10
1.3 The contractor will provide a summary report at the end of the contract period. This report will include a list of all chemicals used during the performance period; the corresponding active ingredient, and the total quantities used for each. This is not to be confused with the requirement to provide a Post-Application Document as explained in section 7.2 of this contract.

Notes:
a. The contractor may be required to rappel down the face of the crib wall in order to properly treat the wales.
Government shall assess site conditions and Contracting Officer shall provide notification to the contractor no later than May 15 (each year) with the determination of whether this work shall be required. This work is covered on the bid schedule via separate CLINs with description ‘L&D 1 treatment of vertical wall.’ Peregrine falcons (Falco peregrinus) nest at this site and the contractor will be required to delay work in this portion of the site until the falcons have fledged, generally the end of July. This applies only to the crib wall/wales area of Lock #1
b. These sites have had known infestations of leafy spurge (Euphorbia esula L.) or spotted knapweed (Centaurea maculosa L.). The contractor is expected to remain vigilant for any new infestations. Should these or any other highly invasive plant species be found where treatment is not currently required, the contractor is required to notify the Contracting Officer and Environmental Section POC. Treatment(s) shall be scheduled for the following year during the optimum time(s) for treating those species (e.g. when plants are bolting but not yet flowering for knapweed).
c. Eau Galle Brush Control areas will be selected annually by site staff and will be based on a cost per gallon of herbicide applied. The blue lines on the reference maps indicate likely spray areas and are predominately trails and the perimeter of mowed areas within the park. Access is a mix of ATV type vehicle and walk in only. Additional coordination may be required with the site manager to schedule treatments and possible trail closures during spraying. Contracting Officer shall notify the contractor no later than May 15 (each year) of the areas that require spraying under CLINs designated for Eau Galle Brush Control. Post-application documentation for brush control shall be generated separately of the similar documentation for total kill, in order to track the number of gallons payable.
2.4 Access: Access to the areas to be treated are controlled through fences and locked access gates. The contractor will contact the Lockmaster or the sites working supervisor to gain access to work areas. Access to segments of some of the dams is limited by water. These dam segments are isolated due to overflow spillway sections that prevent access by vehicle. Access limitations occur at Locks and Dams #'s 3, 5A, 6, 7, 8, 9 and 10. During periods of normal flow, the overflow spillways at 8 and 9 can be crossed by 4 wheel drive pickups.
Government floating plant consisting of 12 foot by 24 foot handy flat barges may be available for transportation of contractor equipment and to gain access to these areas. The maximum gross vehicle weight (GVW) shall not exceed 9000 pounds for vehicles transported via handy flat. A Corps of Engineers operator will operate the handy flat barge between the hours of 0730 1600, Monday through Friday only. The handy flat barge will not be available on Federal holidays. As a safety precaution, the handy flat barge will not be available on days with high river flows as determined by the Government. A 72-hour notice is required prior to use of the handy flat barge. Contractor shall coordinate with the Lockmasters when it is needed to ensure the required work can be accomplished within the required performance period. It is the contractor’s responsibility to check with a respective lockmaster to determine what, if any, assistance they can expect to receive in order to gain access to these sites.
3. TREATMENT AREAS, CONTROL GOALS AND HERBICIDES
3.1 General: Specific treatment areas are identified on the maps and drawings in Attachment A. The earth dikes are constructed of sand fill. The upstream slopes of the dikes are rip rapped or rock covered and are not conducive to equipment travel. The tops of the dikes are usually gravel-covered roadways approximately 10 to 12 feet in width.
The downstream slopes of dikes are sandy with a thin native grass cover, with broadleaved and woody vegetation.
These downstream slopes will not support pickups and other heavy vehicles due to sandy conditions. The contractor is encouraged to visit the sites to determine the type of equipment most suited for the work. The purpose of this treatment is to achieve the vegetation control goals described in the next paragraph and on the attached maps and drawings in Attachment A.
3.2 Vegetation Control Objectives: The following is a general summary of the vegetation control objectives for various structures or areas at the work locations. These goals range from spot treatment for individual species, to complete control of all vegetation, or complete control of woody species only; The primary goal is to prohibit growth of targeted vegetation types for the remainder of the growing season once the initial application has occurred. The growing season is considered to be from May 15th to September 15th. More detailed instructions are clearly shown on the attached maps and drawings in Attachment A. Definitions of the vegetative control categories used on the maps are explained below. The contractor is required to spray all sites included in this contract between May 15th and June 30th
a. Total Kill – Elimination of all vegetative growth is required. This is applicable at storage yards, roadways, tops of earth dams, radio sites, riprap on upstream side of dikes, and downstream riprap on some dikes. An herbicide specifically labeled for use over water will be required for applications over water such as the concrete and rip rapped portions of the overflow spillway sections.
b. Brush Control – Selective brush control shall be applied to the downstream slopes of the earth dams that are vegetated with grasses, forbs, brush, trees and other woody vegetation. Control and eradication of woody vegetation is required without damage to the grass cover and minimal or no damage to native forbs.
3.3 River Levels and the Impact on Treatment Areas – River levels (referred to as pool and tailwater elevations) vary depending on time of year and precipitation. There is some probability of high water occurring during the active growing season between May 15th and September 15th. Should this condition occur, some treatment areas could be partially or completely under water. The contractor is strongly encouraged to visit NOAA’s North Central
River Forecast Center at www.crh.noaa.gov/ncrfc and/or www.rivergages.com for river gage information. The local lockmaster can also be contacted for more localized information if needed. The NOAA site details current and forecasted gage readings. If it is not feasible to delay treatment, the contractor will treat all specified areas that are not underwater. If water levels are rising or expected to rise within one week of the time an area is to be treated, the contractor will be prohibited from treating those areas that are expected to be underwater. The contractor will maintain contact with the lockmaster to determine when pool and tailwater levels return to normal. The contractor will return and treat those areas not previously treated, and retreat any other areas as required.
3.4 Herbicide Selection Procedure: The contractor is responsible for proposing the specific herbicides to be used to accomplish the vegetation control goals at each location, and will request prior approval from the Contracting Officer for use of these herbicides in accordance with Paragraph 7.1. These herbicides will be categorized by the Environmental Protection Agency (EPA) as “general use”, and will be appropriately labeled for specific application (i.e. aquatic label for use directly over water). At a minimum, herbicides must be registered for ditch bank applications. Herbicides used where spray mist could make contact with water must be registered for aquatic use.
No restricted use herbicides are allowed. No herbicides can be used on Corps of Engineers property without prior approval from the Contracting Officer. In addition, all carriers, adjutants, and surfactants, or other additives must be non-toxic and registered for aquatic applications. To further increase rain-fastness and enhance performance, a surfactant shall be added per label instructions to all herbicide mixtures. The following list of herbicides are those that have been used successfully in the past. Bidders must note that while not required to use only herbicides listed below, in accordance with FAR clause 52.211-6 BRAND NAME OR EQUAL (AUG 1999), herbicide proposals must be patented, proprietary branded products or equal. 3.5 Alternative Herbicides: At any time during the contract period, the contractor may submit a written request to apply alternative herbicides to those submitted in the initial proposal. The Contracting Officer must receive submission of such a request a minimum of 15 working days in advance of the desired application date. This submission shall be electronic and shall include but not limited to, hyperlinks to an EPA product label, manufacturer’s catalog sheet or specification data sheet and safety data sheets (SDS), area to be treated, target pest, and reason for the choice must be submitted with the request. The request will be reviewed considering, as a minimum, relative effectiveness compared to the currently specified herbicide, toxicity and costs.
3.6 Minimizing Impacts to Non-Target Species: No broadcast spraying shall be performed when wind speeds exceed specifications listed on the herbicide label, or wind directions are likely to result in drift to surface water or high public use areas. There will be zero tolerance for direct spray or drift of herbicides into bodies of surface water. A drift retardant is required where applications are adjacent to water and it is recommended in areas where drift could adversely affect adjacent non-target vegetation.
Due to the highly permeable nature of riprap and the embankments, herbicide applications will not be allowed prior to precipitation that could facilitate rapid leaching of herbicides to the water table. If a forecast is for rains that could increase the potential for leaching from the targeted site, application shall not be made. The Contracting Officer or his designated representative shall have the right to make these determinations and terminate any planned herbicide applications based on available weather forecasts and current conditions.
Conversely, excessively dry conditions that can negatively affect herbicide performance should also be avoided.
4. NOTIFICATION OF TREATMENT
The contractor will provide advance notification to the appropriate lockmaster or site supervisor a minimum of 72 hours before arriving at the site locations for herbicide treatment work. Additional planning may be required prior to performing work at the Eau Galle and Blackhawk Park sites due to potential public use conflicts with areas needing treatment. The contractor shall coordinate with site supervisors to provide maximum availability of treatment areas. The advance notification requirement will ensure that Corps staff is available to operate marine equipment, if required, and also to participate in any contract inspections that may be conducted. The telephone numbers for these offices are listed along with the office addresses in Attachment C. The contractor will also provide the Contracting Officer a working schedule and at least weekly updates as work commences.
5. HANDLING, MIXING, APPLICATION RATES AND METHODS
5.1 Handling and Mixing: All herbicides will be handled and stored in accordance with instructions on the EPA registration label. All herbicides shall be mixed in accordance with the label instructions so that the desired rate of application can be attained with the contractor's application equipment. Mixing water is available at all lock and dam sites, Fountain City Service Base, Eau Galle Recreation Area, and Blackhawk Park. Some spray locations are not located immediately adjacent to the lock structure; the chemical mix would need to be prepared before arriving at spray location, which can be up to 20 miles traveling distance from the nearest lock structure. No potable water is available at the Alma Tower Relay Site. The contractor is required to provide a secondary containment system around their herbicide mixing area when herbicides are mixed on government property. This containment system must be constructed of impervious materials. In addition, the contractor will ensure that no contamination of any water source occurs and that emergency spill containment equipment is at the worksite and is capable of containing all potential herbicide spills from contractor vehicles/equipment. Unused, mixed pesticides will be disposed of in accordance with local, state and EPA guidelines. Spray equipment cleaning will also be accomplished in accordance with these guidelines. Prior to leaving a worksite for the day, the contractor shall remove all equipment and unused materials, any waste materials, oil, empty herbicide containers and litter resulting from contract activities on government property.
5.2 Equipment: The equipment used by the contractor shall be land-based, designed for such work, fully functional and operated in a safe manner. The equipment will be capable of accurately delivering a predetermined rate per acre dosage of herbicide.
5.3 Rates and Method of Application: Application rates will be determined by the contractor and are to be based on the type and density of vegetative growth, the labeling and manufacturer's suggested rate tables, and the required results identified in paragraph 3. Generally, the types of vegetation present range from common grasses to large woody plants such as maple, willow, elm, and green ash seedlings. In some cases the very large woody vegetation has been cut and new growth has occurred from the stumps. Further, not all the surface area proposed for treatment has a vegetative growth. The contractor shall use discretion and professional judgment in determining the rate and extent of treatment necessary to achieve the treatment objective. The treatment objective is to prohibit growth of targeted vegetation types, from the time of initial treatment until the end of the growing season. If the contractor chooses to not treat some areas because no growth is present at the time of application, the growing season guarantee cited in Paragraph 3.2 will be invoked should new growth occur. This may require subsequent herbicide treatments to achieve the specified results and will be considered equivalent to a retreat area by the Government.
6. SAFETY AND CERTIFICATION
6.1 Safety Manual: Notwithstanding any other provisions of this contract, the Contractor shall comply with all with all safety and health requirements as outlined in the Corps of Engineers Safety and Health Requirements Manual (EM 385 1 1) and OSHA Safety Standards to ensure the safe working conditions for his employees and government workers. In addition, a license for right-of-way as well as aquatic applications is required. Evidence of such licensing shall be submitted with the "Application Plan" as outlined in Paragraph 7. 1. Department of Labor as well as Wisconsin, Minnesota and Iowa state regulations regarding employment of youth shall be observed.
6.4 Public Safety: Public safety must be ensured when spraying or using pesticides. In application areas where there is potential for use by the public, the contractor must place appropriate warning signs in the work zone until the reentry time period has been met according to the product label(s). Signs are required at these locations and the contractor shall contact the lock/project personnel in order to determine if other specific areas to be signed.

Should the required total kill or brush control results not be achieved, the contractor will, at no additional cost to the Government, reapply herbicide to those areas where targeted vegetative growth continues or recurs. The determination as to the acceptable performance of the contractor and the need to reapply the herbicides will rest solely with the Contracting Officer or his authorized representative. A request to retreat will be in writing and it will specify the area(s) that need additional work. The required results to be achieved are a 95% stand reduction of the target pest without damage to the desired vegetation.
10.2 The contractor shall be responsible for restoring any area that does not satisfy the warranty requirements at no additional cost to the Government. Areas will be retreated within the time specified by the Contracting Officer’s notice to the Contractor.
