STATEMENT OF WORK
STATEMENT OF WORK
Woody Invasive Plant Control and Tree/Shrub Planting at the Lake Rebecca Park along the Upper Mississippi River in Hastings, MN
1 BACKGROUND
This statement of work describes a multi-year woody invasive (primarily common buckthorn) mechanical and chemical treatment and a tree/shrub planting project on four treatment areas totaling approximately 48.8 acres on US Army Corps of Engineers (USACE) owned land in Hastings, MN. The contract will be awarded as a base year plus two option years.
1.1 SITE DESCRIPTION
Lake Rebecca Park is located immediately south of the Lock and Dam 2 Spillway and in the uppermost section of Upper Mississippi River Pool 3. It encompasses part of the W1/2, Sec. 11, T115N R17W in in the City of Hastings, Dakota County, MN Approximate coordinates of the center of the project area are 92°52'5.28"W, 44°45'14.956"N. It is located in the City of Hastings, MN, owned by the USACE but managed under a recreational lease by the City of Hastings. All activities associated with this scope of work must adhere to all applicable policies for the USACE, and the City of Hastings.
Vicinity and site specific maps are attached. The site is accessible from the east via Lock and Dam Road in Hastings. Mechanized equipment, including ATVs for transport of materials, may be used but only in dry ground conditions. Access to the treatment areas crosses a paved City of Hastings recreational trail and the Contractor will be responsible for repair of any damage to that trail associated with implementation of this contract. Repair needs will be assessed by the City of Hastings and determination of any associated costs will be solely at their discretion. An active bald eagle (Haliaeetus leucocephalus) nest is present near the western boundary of the treatment area at the coordinates 92°52'13.298"W, 44°45'15.693"N. No treatments as part of this contract may occur within a 660 foot radius of this nest during the active nesting season from January 1- June 15.
1.1.1 VEGETATION
The majority of the project area is a multi-aged floodplain forest with a dominant cohort of larger diameter cottonwood in the canopy and one to multiple cohorts of smaller diameter silver maple in intermediate canopy positions. Woody invasives, primarily common buckthorn (Rhamnus cathartica), are prevalent in areas adjacent to the current treatment areas and have been treated in a previous contract. Within the current treatment area, woody invasives are generally scattered.
Other than hackberry, regeneration of other floodplain forest species is mostly absent.
The entire area is subject to spring flooding, though the northern portion appears to be subject to a higher level of flood stress, with some trees showing crown dieback.
The savanna area is a higher elevation location that does not flood. Vegetation in this area has established on poor quality historic dredge spoils. The canopy is dominated by small sawtimber sized cottonwood though it remains somewhat sparse. Eastern redcedar, bur oaks and red oaks are prevalent in the midstory. There is a substantial component of prickly ash, bush honeysuckle and common buckthorn in the understory, though a mulching and cut stump herbicide treatment was completed in the winter of 2020-21 to provide initial control of woody invasives. The long-term objective of this area is to establish open-canopy oak savanna habitat.
1.1.2 PRESCRIPTIONS
1.1.2.1 Woody Invasive Control
Implement initial control treatments for all woody invasive species. Common buckthorn is the most common woody invasive, though bush honeysuckles (Lonicera spp.), oriental bittersweet (Celastrus orbiculatus) and Japanese barberry (Berberis thunbergii) may also be present. Cut stump or basal bark treatments of all woody invasive stems shall be implemented between October 15, 2021 and September 30, 2022, though treatments within the eagle buffer may not occur between January 1 and June 15. One follow-up treatment shall be implemented between July 15 and September 30 of 2023 to control any resprouts or stems missed in the initial treatment. Follow-up treatment may be cut stump, basal bark, or foliar herbicide applications.
Foliar applications shall only be used on stems 6 feet tall or less. Tracked mechanical equipment may be used, though only if the site is dry. Given the generally scattered distribution of stems, hand tools are likely to be the more effective method of application. Herbicides used should be labeled for the application type; tricolopyr-based herbicides are preferred.
1.1.2.2 Seedling acquisition (CLINs 0002, 0003, 0006-0008)
Seedlings shall be supplied by the Contractor according to the size, seed zone and quantity specifications listed in Tables 1 and 2 below. Seedlings may be sourced from any nursery able to provide seedlings meeting the specifications and seed zone requirements in Table 1. Seed source may be from either the optimal or acceptable zones in the table and the Contractor but provide written confirmation that the seed source is from the acceptable zones. All seedlings shall be of native stock and no cultivars shall be planted.
Seedling invoice Proof of purchase of tree seedlings must be provided to the Government at least either 21 days following contract award (for fall 2021 planting) or 45 days prior to the beginning of the contracted on-site performance period for spring 2022 planting . This proof of purchase will generally be a nursery invoice. Because the Government must accept the seedlings, payment for seedling purchases will not be made until the seedlings have been planted and Contractor invoicing for the seedling cost should occur at the same time as invoicing for tree planting (see Section 2, Measurement and Payment, for more specific details). In the case of site limitations outside of the control of the Contractor that prohibit planting after the trees have been purchased, the Government will be responsible for the cost of the seedlings and may require the Contractor to coordinate delivery of seedlings to the Government.
Additional seedling size requirements Large, vigorous seedlings are critical for planting success in the floodplain. Thus, a minimum of 60% of the planted seedlings shall be greater than 24 inches tall. A minimum of 50% of seedlings shall have a root collar diameter of 0.375 inches or larger. Because large seedlings of some species are difficult to procure, this additional size requirement will be applied across all planted seedlings rather than for individual species.
Allowed variance in seedling quantities A +/- 10% variance is allowed for the total number of seedlings from any species without requiring authorization from the Government, though the total for all species combined shall be no less than 5,160 for the tree plantings (Underplanting 1 and Patch Openings) and 1,050 for the shrub planting (Underplanting 2). In the event that species are not available, the Contractor may substitute for the number of stems of up to 2 species by increasing the total number of stems of another species on the list to with written authorization from the Government. Substitutions of more than two species, or the addition of species not currently on the list, may be acceptable but the Contractor will be required to provide significant justification.

1.1.2.3 Tree and Shrub Planting (CLINs 0004, 0005, 0009-0011) Three distinct planting areas are outline in this contract. The patch openings area is located completely outside of the eagle zone. The two underplanting areas both occur partially within the eagle zone; 0.7 acres of the Underplanting 1 area and 1.5 acres of the Underplanting 2 area are within the eagle zone. Areas within the eagle zone must be planted between October and December 2021. Planting may occur within the patch openings area and in the Underplanting 1 and Underplanting 2 areas outside of the eagle zone any time between October 2021 and May 2022.
Underplanting 1 and Patch Openings This prescription covers parts of the lower elevation areas in the northeastern portion of the Lake Rebecca project area. The main objective is to increase tree species and age class diversity through underplanting of oaks and other species in areas with open canopies or with an ash-dominated canopy.
In fall of 2021 through spring of 2022 (depending on site conditions), an equal mix of large bareroot swamp white oak, silver maple and hackberry shall be planted in delineated areas with sparse canopies. Oak and hackberry should be distributed evenly throughout the areas, while silver maple should be planted in dense patches located where the canopy is most open. The planting of bareroots in these areas should be dense and average a spacing of about 6 x 6 feet, or 1,210 seedlings to the acre. Table 2 shows the numbers of seedlings required for each of the areas.

Underplanting 2 This prescription covers parts of the lower elevation areas in the northeastern portion of the Lake Rebecca project area. The main objective is to increase shrub diversity through establishment of flood tolerant native shrubs in patches with a sparse canopy and higher water tables.
In fall of 2021 through spring of 2022 (depending on site conditions), implement a planting within areas showing signs of canopy decline to establish desirable native shrubs. Planting should consist of primarily red-osier dogwood (Cornus sericea) but should also include gray dogwood (Cornus racemosa), winterberry (Ilex verticellata), buttonbush (Cephalnthus occidentalis) and bog birch (Betula pumila). Shrub species shall be mixed according to availability, but red-osier dogwood should make up at least 1/3 of the total planted stems and at least two additional species must make up at least 20 percent of the stems per species. Seedlings should be spaced at an average of 12 x 12 feet, or 302 stems per acre (1050 total stems within the eagle zone, 450 total stems outside the eagle zone), but spacing should be variable to capture appropriate sites. No seedlings should be planted less than 6 feet from an adjacent seedling. At least 75% of shrub seedlings must be 1 foot tall or greater, but there are no root collar diameter requirements.
Seedling storage All seedlings shall be handled and stored in an appropriate manner to minimize seedling stress prior to planting. Seedlings shall be kept in a cooler at or below 40 degrees Fahrenheit until the day of planting. In the field, seedlings shall be stored in full shade with roots well moistened.
While being transported from the field storage location to the planting hole, trees shall be carried in planting bags or other containers to prevent desiccation of roots. Trees shall not be held outside of a container for more than one minute. The Contractor shall provide the Government with a brief cold storage plan documenting procedures for following the storage specifications described here as part of their quote. This plan should explicitly state what facilities or equipment will be used to ensure that seedlings are stored at the appropriate temperature prior to the day of planting.
Seedling handling and planting Quality hardwood tree seedlings often have large root systems, and stems may be as large as 2-3 feet tall. Large seedling size shall be accounted for in determining planting tools to use.
Seedlings may be root pruned at the time of planting to down to a minimum of 12 inches, measured from the root collar. First order lateral roots shall not be removed in this process but may be trimmed back.
The Contractor shall prepare a planting hole or slit that is wide enough to fully suspend the roots of the plant material. The Contractor shall suspend the root system near the center of the planting hole or slit, with roots in a near natural arrangement, at a depth at which the top of the root system is covered by approximately one inch of top soil after filling, packing and leveling. A “near-natural arrangement” means that roots approximate the position they would have when growing in nature or in the nursery, and are not twisted, tangled, compacted, curled, or bent relative to a position that is perpendicular to the ground surface. Root collars shall not be visible but shall be below the soil surface. Each plant shall be set firmly in the ground, with moist soil filled in and placed firmly around the roots. The Contractor shall level the soil near the plant after planting and firming so there are no depressions or mounds near the stem.
The Government Inspector may also specify where certain plant species or associations of plant species are to be planted within the project area. Plant material planted in inappropriate places will be subject to rejection by the Government Inspector during inspections.
The Contracting Officer may suspend planting work if weather conditions could damage plant material, even if the material is handled in accordance with this agreement. The Contracting Officer may also suspend planting work at any time if the Contracting Officer determines that the Contractor is not handling plants or planting in accordance with this agreement.
The Government reserves the right to inspect the operation at time of planting and may levy a payment penalty up to and including the total cost of seedling acquisition and planting for failures to follow proper seedling storage, handling or planting requirements. The Government also reserves the right to stop planting operations at any time that it determines that these guidelines are not being followed.
Excess and waste material shall be removed and properly disposed of off-site. Areas that have been damaged by planting operations shall be restored to original condition at the Contractor’s expense.
1.1.2.4 Deer repellant (CLINs 0012, 0013, 1001 and 1002)
All tree seedlings for all prescriptions shall be treated with PlantSkydd deer repellant in June of 2022 and June of 2023; PlantSkydd will not be applied to the shrub seedlings in Underplanting 2.
PlantSkydd should be applied at the dilution rates for fully leafed out seedlings as per the manufacturer’s recommendation. This treatment is considered part of the tree planting action and should be included in the cost estimate for the tree planting actions.
1.1.2.5 Savanna (CLINs 0014, 2001)
Two follow-up woody invasive treatments should be implemented in this area in mid- to late-summer of 2022 and 2024. Treatments will consist of foliar, cut stump and/or basal spraying of resprouts of all woody invasives listed in the target species table. If foliar sprays are used, they must be implemented while buckthorn and honeysuckle leaves are green and photosynthesizing and should only be applied on stems <6 feet tall. Treatments may be implemented by hand or using a tractor or ATV-mounted sprayer.
1.1.2.6 Treatment Schedule
Treatments must be completed within time windows that will maximize treatment effectiveness.
Begin and end Dates for each treatment in each area are provided in the Bid Schedule Items table in the measurement and payment section below. No treatments may begin prior to the Begin Date and all treatments must be completed by the End Date for any given area. The Contractor may select any date between those two dates to perform work, given that site conditions are appropriate and that the Government has given approval to proceed. In addition, upon contract award, the Contractor shall submit to the COR a tentative work schedule for the contract period.
The Contractor submitted work schedule is not binding and may be updated as needed but is intended to allow the Government to plan according to the Contractor’s work schedule. The Contractor’s tentative work schedule shall in no way supersede the dates provided in this contract.
1.1.2.7 Quality Assessment
Tree and Shrub Plantings
- 95% of Government sampled planted trees meet the minimum size specifications for each species in table 2, and, of those, 60% are > 2 feet tall
- 50% of seedlings have a root collar diameter of at least 0.375 inches
- 95% of Government sampled planted trees are within +/- 2 feet of target spacing
- Percent of trees of each species within Government samples is within +/- 10% of the target above, unless a wider variation has been approved by the Government
- 95% of trees stay in the ground following the “tug test” (a light pull on the seedling does not dislodge it from the ground), with no roots or root collar visible at the soil surface Up to 5% of planted seedlings will be sampled in initial quality assessments by the Government.
If, based on the initial sample, planting quality appears to be below contract standards, an additional 5% will be sample to reach a total of a 10% sample. Any performance penalties will be assessed on the proportions of seedlings falling outside of specifications in the 10% sample;
this proportion will be assumed to be representative of the planting as a whole and may be applied to the entire pay request associated with the quality assessment.
Woody Invasive Control Work will be inspected periodically for conformance with these specifications for timeliness, safety and results achieved. Performance inspections will consist of initial visual surveys to determine treatment effectiveness and adherence to specifications. If it appears that work has not been completed according to specifications, the Government may spot check up to 10% of the treatment areas with a minimum of 20 sampling points for Quality Assurance (QA). 1/100th acre fixed-area plot samples will be measured in which the number of treated and non-treated target stems will be tallied. The sample will be considered to be representative of the entire treatment, and any rework or performance penalties will be calculated for the entire treatment based on the average percent of target stems treated and on the average number of non-target stems damaged.
The government will consider 90% or more of target stems treated as described in the sections above and 5% or less of non-target stems damaged to be acceptable. Any percentage outside of this range will be considered unacceptable and will necessitate re-work or a payment penalty.
Payment penalties will be the sum of the total % unacceptable (e.g. 87% target stems treated and 8% non-target stems damaged = 6% payment penalty). Re-work may include either a percent corresponding to the percent unacceptable or may include government designation of unacceptable areas, up to and including the entire treatment area.
2 MEASUREMENT AND PAYMENT
Payment for this work will be based on the schedule of items below.
The Contractor must submit invoices to the Contracting Officer’s Representative (COR) to initiate payments.
All invoices shall be sent via e-mail or mail to the COR. Invoices with errors or that are not acceptable per FAR Clause 52.212-4 will be returned and a new invoice with a new date must be submitted for payment. Failure to do so may cause a delay in payment to the Contractor.
The Contractor may submit invoice(s) for payment on each work Contract Line Item (CLIN) listed below upon completion of Government Quality Assurance checks and acceptance of the work OR 10 business days following the completion of the work by the Contractor, whichever is sooner. In this contract, seedling acquisition will not be considered complete until tree seedlings have been planted on the site and the Government has completed Quality Assurance check to determine that seedling size and quality is acceptable. Therefore, the tree seedling purchase invoice must be submitted along with the respective tree planting invoices once all planting is completed. A copy of the nursery receipt must be also be submitted for all purchased plant material. For all CLINs requiring herbicide application, the post-application documentation form should be submitted prior to invoicing or with the invoice. Invoices for CLINs requiring post-application documentation forms WILL NOT be considered acceptable invoices without the post-application documentation form and no payment will be made until the post-application documentation forms have been submitted.
Payment on this contract will be based on the Contract Line Items (CLINs) and only for the total amounts for each CLIN. Following the completion of each CLIN, the Contractor may submit an invoice for payment with the exception of the tree seedling purchase.
