3.0 GENERAL.
Descriptions, sizes, and quantities of the required contract supply work items shall be as specified herein.
4.0 PRE-AWARD SUBMITTALS.
Offers shall be evaluated IAW FAR Part 13 – Simplified Acquisition Procedures.
Offers will be evaluated using simplified acquisition procedures of FAR 13.106-
2. The Government will award a contract resulting from this solicitation to the responsible contractor whose offer, conforming to the solicitation, will be most advantageous to the Government, price and other factors considered. Award will be made to the lowest priced technically acceptable offer. Technical acceptability will be based on the contractor’s relevant experience, past performance, and proposed fabrication methods.
Offerors shall submit the following information with their quote:
4.1 Relevant Experience Information. Offerors shall submit documentation demonstrating the firm’s relevant experience in fabrication of valves similar in nature to those required under this contract.
Relevant experience may be provided for the offeror and/or major subcontractor(s). For each firm identified, Offerors shall provide three (3) examples of relevant projects (Similar rubber check valves defined as “duck-bill” style rubber check valves used for air delivery in underwater applications).
Relevant projects must be at least 50% physically complete and performed by the firm within the last three (3) calendar years. If more than one firm (i.e. subcontractor or joint venture/teaming partners) will perform a significant portion of the work for an element, the proposed firms must be identified and each firm must provide relevant project information, related to its role in this contract.
Submittal Requirements:
a) Offerors shall submit experience References for (3) projects performed by the Offeror within the past three (3) calendar years.
b) If more than three experience references are submitted, only the three most recent projects will be considered.
c.) Submit documentation showing Offeror has supplied (as a prime or sub contractor) similar rubber check valves on at least ten projects within the past five years.
4.2 Past Performance. Offeror’s past performance is a measure of the degree to which an Offeror was successful on projects, as measured by the level of past customer satisfaction. It is also a measure of the degree to which an Offeror has complied with Federal, State, and local laws and regulations. Past performance information is one indicator of an Offeror’s ability to perform the contract successfully.
Submittal Requirements:
a) Offerors shall submit Past Performance References for (2) projects performed by the Offeror within the past three (3) calendar years.
b) If more than two past performance references are submitted, only the two most recent projects will be considered. If less than two past performance references are submitted, the submitted project will be evaluated, and the lack of the requested number of projects will not affect the rating for this factor, provided the Offeror certifies that additional past performance information is not available and provides an acceptable explanation as to why additional past performance is not available.
c) In the case of an Offeror with no performance history, or for whom information on past performance is not available, the Offeror will be evaluated as neutral provided the Offeror certifies that additional past performance information is not available and provides an acceptable explanation as to why past performance information is not available.
d) The past performance reference must have been a client, or client representative, with whom the Offeror had a contract, or subcontract (if applicable) for one or more projects. The reference must hold, or have held at the time, a senior position in the client organization with responsibilities of contract administration, quality control, engineering, or technical supervision, or was otherwise in a position to evaluate the Offeror’s performance in executing the contract or subcontract. The past performance reference must have first-hand knowledge of the Offeror’s performance. The reference must have a current, valid phone number at which they can be reached during normal business hours, a fax number, and must be able to speak, read, and write in the English language.
The Government’s assessment of past performance will be based mainly on the Offeror’s reputations with customers and other sources. The Government will consider the currency and relevance of past performance information, source of the information, context of the data, and general trends in the contractor’s performance. The Government may contact any or all of the past performance references provided by the Offeror in response to this solicitation, and may also use information obtained from any other sources when evaluating past performance of the Offeror and major subcontractors. Other sources may include, but are not limited to, the Past Performance Information Retrieval System (PPIRS). While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance rests with the Offeror.
The evaluation will take into account relevant past performance information regarding predecessor companies or subcontractors that will perform major or critical aspects of the requirements when such information is available and relevant to the instant acquisition. If necessary during the evaluation process, any adverse information received regarding subcontractor past performance may be shared with Offerors during clarifications or discussions if held.
4.3 Fabrication Methods. Offeror shall submit a narrative plan describing the methods used to fabricate the complete rubber check valve assembly, to include rubber check valve, pipe nipple, adjustable band clamp and adapter bushing (if applicable).
Offeror shall provide catalog cuts and a cutaway drawing or sketch showing the complete rubber check valve assembly. Provide relevant dimensions, label each component and indicate materials.
5.0 POST-AWARD SUBMITTALS.
The Contractor shall submit the information outlined in Paragraph 4.1 within 30 days after contract award. The Government will review the submittals and provide comments and/or approval. Any review comments and/or approval will be provided within 10 days of shop drawing receipt. The Contractor shall provide revised shop drawings (incorporating comment changes) within 10 days from receiving comments. No item shall be shipped without approved shop drawings.
The shop drawings shall clearly show the material and sizes proposed for all components. The submittal package shall be submitted prior to the first delivery only. Subsequent deliveries will not require a submittal package unless there is a change to any component of the rubber check valve assembly.
In the event of a change from the original submittals, the Contractor will be required to coordinate a new set of submittals with the Government.
5.1 Submittal Requirements. The manufacturer shall include the following documents for review and approval.
a. Dimensional drawings and catalog cuts of the rubber check valve, pipe nipple and the fully assembled product.
b. Certified flow versus headloss curves.
c. Product sheet for the banding/adjustable clamp showing material grade, dimensions and torque capacity.
5.2 Samples. A sample/prototype of the proposed rubber check valve fully assembled with the pipe nipple and clamp shall be submitted for approval along with the submittal package outlined in Paragraph 4.1 Submittal Requirements.
6.0 MATERIALS.
6.1 Pipe Nipples. Pipe nipples shall be schedule 40, Type 316 stainless steel pipe, 1/2-inch nominal diameter by 3 inches in length. One end shall be NPT threaded to connect to the existing bubbler pipe thread-o-lets. The opposite end shall be threaded or barbed and inserted into the rubber check valve.
6.1.1 The use of an adapter bushing to step up the outer diameter of the pipe nipple to match the inner diameter of the rubber check valve is allowed. The adapter bushing shall be Type 316 stainless steel. Adapter bushing shall have internal straight threads and be connected to one of the NPT threaded ends of the pipe nipple. The outer diameter of the adapter bushing shall be threaded or barbed and inserted into the rubber check valve.
6.2 Rubber Check Valves. Rubber check valve shall be a manufacturer’s standard product. The contractor shall provide a sample for approval before manufacturing the initial required quantity. Rubber check valves shall be similar to Red Valve Air Diffuser Check Valves manufactured specifically for lock and dam applications. The check valves shall be capable of discharging air at the design conditions and also prevent the backflow of liquid and debris into the unit and air distribution piping. The Government shall indicate the quantity of valves required for each delivery.
6.2.1 Rubber check valves shall be a “duck bill” type design. Each valve shall be fabricated from compression molded Buna Nitrile elastomer with enough resiliency to open by hand. Rubber check valves shall open with approximately 1/2 psig air pressure. Positive differential pressure shall open the valves.
Reverse pressure on the outside of the valve shall seal the valve preventing any backflow.
6.2.2 Each rubber check valve shall be factory banded to a pipe nipple. The adjustable banding clamp used in this connection shall be Type 316 stainless steel. Rubber check valves shall utilize an interference fit over the threads/barbs of the 1/2-inch pipe nipples. A 1/2-inch pipe nipple has an outside diameter of 0.840 inches. The actual amount of interference between the rubber check valve and the pipe nipple shall be coordinated with the Government at the shop drawing review stage and as part of the submittal sample.
6.2.3 Design Parameters. Rubber check valves shall be capable of operating in the following system:
Operating Pressure [psig]
Air Flow Rate
[ACFM]
Max Head Loss [in.
of H20]
12 12 to 24 9
7.0 PACKAGING AND MARKING.

CLAUSES INCORPORATED BY FULL TEXT
52.204-7 CENTRAL CONTRACTOR REGISTRATION (DEC 2012)
(a) Definitions. As used in this provision--
Central Contractor Registration (CCR) database means the primary Government repository for Contractor information required for the conduct of business with the Government.
Data Universal Numbering System (DUNS) number means the 9-digit number assigned by Dun and Bradstreet, Inc.
(D&B) to identify unique business entities.
Data Universal Numbering System +4 (DUNS+4) number means the DUNS number assigned by D&B plus a 4-character suffix that may be assigned by a business concern. (D&B has no affiliation with this 4-character suffix.)
This 4-character suffix may be assigned at the discretion of the business concern to establish additional CCR records for identifying alternative Electronic Funds Transfer (EFT) accounts (see the FAR at Subpart 32.11) for the same parent concern.
Registered in the CCR database means that--
(1) The Offeror has entered all mandatory information, including the DUNS number or the DUNS+4 number, as well as data required by the Federal Funding Accountability and Transparency Act of 2006 (see subpart 4.14), into the CCR database; and
(2) The Government has validated all mandatory data fields, to include validation of the Taxpayer Identification Number (TIN) with the Internal Revenue Service (IRS), and has marked the record ``Active''. The Offeror will be required to provide consent for TIN validation to the Government as a part of the CCR registration process.
(b)(1) By submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the CCR database prior to award, during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation.
(2) The offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation “DUNS” or “DUNS +4” followed by the DUNS or DUNS +4 number that identifies the offeror's name and address exactly as stated in the offer. The DUNS number will be used by the Contracting Officer to verify that the offeror is registered in the CCR database.
(c) If the offeror does not have a DUNS number, it should contact Dun and Bradstreet directly to obtain one.
(1) An offeror may obtain a DUNS number--
(i) Via the Internet at http://fedgov.dnb.com/webform or if the offeror does not have internet access, it may call Dun and Bradstreet at 1-866-705-5711 if located within the United States; or
(ii) If located outside the United States, by contacting the local Dun and Bradstreet office. The offeror should indicate that it is an offeror for a U.S. Government contract when contacting the local Dun and Bradstreet office.
(2) The offeror should be prepared to provide the following information:
(i) Company legal business.
(ii) Tradestyle, doing business, or other name by which your entity is commonly recognized.
(iii) Company Physical Street Address, City, State, and Zip Code.
(iv) Company Mailing Address, City, State and Zip Code (if separate from physical).
(v) Company Telephone Number.
(vi) Date the company was started.
(vii) Number of employees at your location.
(viii) Chief executive officer/key manager.
(ix) Line of business (industry).
(x) Company Headquarters name and address (reporting relationship within your entity).
(d) If the Offeror does not become registered in the CCR database in the time prescribed by the Contracting Officer, the Contracting Officer will proceed to award to the next otherwise successful registered Offeror.
(e) Processing time, which normally takes 48 hours, should be taken into consideration when registering. Offerors who are not registered should consider applying for registration immediately upon receipt of this solicitation.
(f) Offerors may obtain information on registration at https://www.acquisition.gov.
(End of clause)
52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (FEB 2012)
(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.
(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show--
(1) The solicitation number;
(2) The time specified in the solicitation for receipt of offers;
(3) The name, address, and telephone number of the offeror;
(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;
(5) Terms of any express warranty;
(6) Price and any discount terms;
(7) "Remit to" address, if different than mailing address;
(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);
(9) Acknowledgment of Solicitation Amendments;
(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and
(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.
(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.
(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.
(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions or commercial items for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.
(f) Late submissions, modifications, revisions, and withdrawals of offers:
(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.
(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--
(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or
(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or
(C) If this solicitation is a request for proposals, it was the only proposal received.
(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.
(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers.
Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.
(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.
(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.
(i) Availability of requirements documents cited in the solicitation. (1)(i) The GSA Index of Federal Specifications, Standards and Commercial Item Descriptions, FPMR Part 101-29, and copies of specifications, standards, and commercial item descriptions cited in this solicitation may be obtained for a fee by submitting a request to--GSA Federal Supply Service Specifications Section, Suite 8100, 470 East L'Enfant Plaza, SW, Washington, DC 20407, Telephone (202) 619-8925, Facsimile (202) 619-8978.
(ii) If the General Services Administration, Department of Agriculture, or Department of Veterans Affairs issued this solicitation, a single copy of specifications, standards, and commercial item descriptions cited in this solicitation may be obtained free of charge by submitting a request to the addressee in paragraph (i)(1)(i) of this provision.
Additional copies will be issued for a fee.
(2) Most unclassified Defense specifications and standards may be downloaded from the following ASSIST websites:
(i) ASSIST (http://assist.daps.dla.mil).
(ii) Quick Search (http://assist.daps.dla.mil/quicksearch).
(iii) ASSISTdocs.com (http://assistdocs.com).
(3) Documents not available from ASSIST may be ordered from the Department of Defense Single Stock Point (DoDSSP) by--
(i) Using the ASSIST Shopping Wizard (http://assist.daps.dla.mil/wizard);
(ii) Phoning the DoDSSP Customer Service Desk (215) 697-2179, Mon-Fri, 0730 to 1600 EST; or
(iii) Ordering from DoDSSP, Building 4, Section D, 700 Robbins Avenue, Philadelphia, PA 19111-5094, Telephone (215) 697-2667/2179, Facsimile (215) 697-1462.
(4) Nongovernment (voluntary) standards must be obtained from the organization responsible for their preparation, publication, or maintenance.
(j) Data Universal Numbering System (DUNS) Number. (Applies to all offers exceeding $3,000, and offers of $3,000 or less if the solicitation requires the Contractor to be registered in the Central Contractor Registration (CCR) database. The offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation “DUNS” or “DUNS +4” followed by the DUNS or DUNS +4 number that identifies the offeror's name and address. The DUNS +4 is the DUNS number plus a 4-character suffix that may be assigned at the discretion of the offeror to establish additional CCR records for identifying alternative Electronic Funds Transfer (EFT) accounts (see FAR Subpart 32.11) for the same concern. If the offeror does not have a DUNS number, it should contact Dun and Bradstreet directly to obtain one. An offeror within the United States may contact Dun and Bradstreet by calling 1-866-705-5711 or via the internet at http://fedgov.dnb.com/webform. An offeror located outside the United States must contact the local Dun and Bradstreet office for a DUNS number. 52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)
Evaluation of Offers
Offers shall be evaluated IAW FAR Part 13 – Simplified Acquisition Procedures. Offers will be evaluated using simplified acquisition procedures of FAR 13.106-2. The Government will award a contract resulting from this solicitation to the responsible contractor whose offer, conforming to the solicitation, will be most advantageous to the Government, price and other factors considered. Award will be made to the lowest priced technically acceptable offer.
The following factors will be used to evaluate offers:
(i) Technical capability of the items and service quoted to meet the Government’s requirement; and
(ii) Price inclusive of options (the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement; evaluation of options shall not obligate the Government to exercise the option(s)) if applicable.
In order for the offer to be considered technically acceptable, the Government will make a determination of technical acceptability by evaluating the the contractor’s relevant experience, past performance, and proposed fabrication methods:
Offerors shall submit the following information with their quote:
(i) Relevant experience information:
Offerors shall submit documentation demonstrating the firms relevant experience in fabrication of valves similar in nature to those required under this contract.
(ii) Past Performance
(iii) Fabrication Methods
Offeror shall submit a narrative plan describing the methods used to fabricate the complete rubber check valve assembly, to include rubber check valve, pipe nipple, adjustable band clamp and adapter bushing (if applicable).
Offeror shall provide catalog cuts and a cutaway drawing or sketch showing the complete rubber check valve assembly. Provide relevant dimensions, label each component and indicate materials.

1. The Contractor shall provide the standard commercial warranty or the warranty terms the Contractor offers to its most favorable customers, whichever is greater; however, the minimum warranty shall be one year. This excludes acts of Government negligence, acts of war and acts of nature. Any warranty offered shall be incorporated into the contract. The warranty shall include all parts, labor, transportation, and installation.
2. The contractor shall ensure each warranty includes details of the warranty duration and warranty coverage. Repairs required during the warranty period that are covered under the terms of the express warranty shall be the responsibility of the contractor providing the warranty. The Contractor and its suppliers may offer extended warranties in its quote, which may be accepted at the Government’s discretion and included in the contract award. However, the offer of additional warranties will not affect technical acceptability or favor one contractor over another.
3. The contractor’s terms of express warranty shall be incorporated into the contract award.
Exchanges with Offerors after Receipt of Offers/Quotes/Proposals
Contractors may be asked to clarify certain aspects of their offer/quote/proposal. Clarification conducted to resolve minor or clerical errors will not constitute discussions and the Contracting Officer reserves the right to award a contract without the opportunity for revision.
