| Due to the location of the work, and the ongoing active conflict, many surety firms are either imposing greater limitations or alltogether unwilling to extend requisite bonding to support high risk OCONUS construction requirements. We are interested in understanding the expectations for securing specifically certified bonds, known as Department Circular 570 (or T-List), for the work to be expected in the region. Please discuss what, if any, SOFA or other requirement, is mandating up to 100% bonds on this work, and bonding expectations going forward. |
| We understand many US firms routinely perform construction and related work in contingent locations in support of USG clients and their programs; however, we rarely see requirements for OCONUS contingency construction to be 100% T-List bonded. Any information on what to expect, and the driving regulations or agreements, would be greatly appreciated. | Bonding must equal 100% of the contract price unless reduced by the Contracting Officer. Corporate bonding sureties must be in the Treasury's Listing of Approved Sureties (Treasury Circular 570). Acceptable sureties can be found in FAR Part 28 | |
| We respectfully urge the Government to consider the limitations that 100% T-listed bonding requirements will impose on Primes, particularly with respect to the overall value of the anticipated requirements and Primes' ability to carry the total requisite aggregates (i.e. ability to propose on and perform multiple simultaneous projects of high value), and potential to impact capacity of subcontracting. Many firms here interested in supporting this work, are also performing work elsewhere globally, and must take into consideration the balancing of portfolios (i.e. dividing bonding capacity) across multiple geographic locations, in addition to risk. Lowering bonding %, and or exploring alternative bonding options, will extend individual firms' capacities. | Bonding must equal 100% of the contract price unless reduced by the Contracting Officer. Corporate bonding sureties must be in the Treasury's Listing of Approved Sureties (Treasury Circular 570). Acceptable sureties can be found in FAR Part 28 | |
