Each offer submitted will be evaluated separately.
(f) Late submissions, modifications, revisions, and withdrawals of offers:
(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.
(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--

Government, will be considered at any time it is received and may be accepted.
(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent
Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers.
Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.
(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.
(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.

Evaluation-Commercial Items (NOV 2021)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors in the addendum below shall be used to evaluate offers:
This Addendum to FAR Clause 52.212-2 Evaluation – Commercial Items Identifies the Informal Source
Selection Criteria for this Solicitation.
Procurement of Facility Equipment, Machinery, and Parts
Case EG-B-HDF Ras El Tin Naval Base Alexandria, Egypt
United States Army Corps of Engineers Transatlantic Division, Middle East District W912ER23R0017
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.
The following factors shall be used to evaluate offers:
1. ELIGIBILITY FOR CONTRACT AWARD
http://www.sam.gov/
In accordance with the Federal Acquisition Regulation (FAR), no contract shall be entered into unless the
Contracting Officer ensures that all requirements of law, Executive Orders, regulations, and all other applicable procedures, including clearances and approvals, have been met. Additionally, the Contracting Officer shall make an affirmative determination of a proposal’s responsiveness. To be determined responsive, the proposals shall meet the requirements set forth in the solicitation. A proposal that is determined to be non-responsive will not be evaluated or considered for a contract award.
2. LOWEST PRICE TECHNICALLY ACCEPTABLE
This Request for Proposal (RFP) will utilize FAR Part 13.5 Simplified Procedures for Certain Commercial Items and be evaluated by Lowest Price Technically Acceptable (LPTA) when compared to the Statement of Work
(SOW). Price proposals will be evaluated for completeness and reasonableness. The Government will perform its price evaluation by comparing an offeror’s proposed prices against the Government’s estimate as well as against the prices proposed by other offerors. Technical proposals will be evaluated by reviewing the technical specification sheets, data sheets, and other applicable technical elements for compliance with the solicitation requirement. See below Basis of Award.
The Government will award a contract to the LPTA offeror without discussions; however, the Government reserves the right to hold discussions if deemed necessary. All proposals will be technically evaluated compared to the SOW.
The technical evaluation will include a comparison of the required documentation as it relates to the SOW.
3. BASIS OF AWARD
Subject to the provisions contained herein, award of a contract will be made to one offeror that is deemed responsible in accordance with the FAR, conforms to the solicitation requirements, and whose proposal, judged by an overall assessment of the evaluation criteria and other considerations specified in this solicitation, represents the lowest priced technically acceptable proposal. The proposals will be evaluated on two evaluation factors:
3.1 FACTOR 1 TECHNICAL CAPABILITY:
Offerors shall provide the required information with their proposal to demonstrate compliance with Appendix A attachment to the SOW. Compliance includes each subpart of this paragraph. Documentation should include, but not be limited to, catalog cut-sheets, sketches or drawings, and product data sheets. Each document shall be highlighted to specifically show the item(s) proposed by the offeror to ensure it is clear as to what options if any are being offered in the price proposal. The required spare parts and equipment for technical acceptance are listed in Appendix
A attachment to the the SOW. See the SOW and Appendix A for more information.
To be considered for an award the offeror MUST submit the above documentation and the documentation must comply with the requirements of the SOW (12-page limit). Variations to the technical requirements of the SOW may not be accepted and could cause the offeror to NOT be considered acceptable for award. In addition, the offeror shall provide a schedule for delivery that meets the required delivery date.
Offerors that fail to provide the submittals identified above will be deemed non-responsive and the proposal will not be evaluated.
Technical submittals required (Volume I):
• Parts and Equipment: The proposal shall contain a description including part number and title for each item listed in the solicitation to allow the Government to verify that the quoted parts match the requirements listed in the schedule. Indicate country of product origin. If the offeror deems more information is necessary, the following may be included in the offer: Catalog sheets, Data cut-sheets, product data sheets, sketches, and/or drawings. (Product data must explicitly identify what is required by the SOW to be deemed acceptable).
• Delivery Schedule: Provide a best-estimated delivery date (within 14 calendar days of award) for all items to the freight forwarding location. Delivery date(s) for all items must be on or before the time indicated in the solicitation.
• Quality Control: Describe how the items and equipment will remain undamaged until they are inspected and accepted at the point of delivery.
3.2 FACTOR 2 PRICE:
Offerors MUST provide a price for each line item in Appendix A and Price Proposals must be broken down and prices shown for each of the Contract Line-Item Numbers (CLINs) listed above. Price proposals must be in U.S.
Dollars (USD) and all aspects of price must be completed. In Appendix A, offerors must provide a total price for the stated quantity of each item, and include any discount terms. Offeror’s point of contact (POC) shall include the POC for warranty information to include name, telephone number, and email address.
4. PROPOSAL FORMAT AND PROPOSAL SUBMISSION
The Government will not make assumptions concerning intent, capabilities, or experience. Clear identification of proposal details shall be the sole responsibility of the offeror. The proposal shall meet the following basic requirements:
a. The Proposal shall be typed, submitted in English, in 12 point font, and single spaced.
b. Proposal shall be organized, concise, and submitted electronically in two volumes. Volumes shall be clearly identified and tabbed. Each factor shall be described in a separate tabbed section.
c. Each volume shall be identified by the solicitation number, volume number, and name, address, and telephone number of the prime offeror on the cover.
d. Volume I: Offerors shall submit technical (non-price) proposals and verify that the information for all forms submitted is current, correct, and complete, including names of the points-of-contact, email addresses, and telephone numbers. The Technical Proposal, Factor 1 Technical Capability, has a 12 page-limit. A page is defined as a single sheet of paper with text on one side. The Government will not evaluate any material that exceeds the page limits specified within this evaluation factor.
e. Volume II: The Price proposal shall be completed in full. Volume II shall include verification of the offeror’s intent to be bound by the solicitation, all amendments, which it must verify it has received.
f. Each offeror shall submit an electronic copy of each Volume, including the Price Proposal.
g. Proposals shall completely and adequately address the requirements of this solicitation. Offerors are reminded that elaborate corporate marketing information, formatting, special reproduction techniques, etc., are not necessary.
h. Contractors are cautioned against submitting conditional proposals. All questions and concerns shall be addressed, in writing, to the Contracting Officer and Contracting Specialist prior to the closing date of the solicitation, providing adequate time for the Contracting Officer to answer the concerns. Conditions on proposals and exceptions to requirements or standards set forth in the solicitation will, at the Government’s discretion, form the basis for a proposal to be rejected, with or without evaluation. Further, all such conditions and exceptions shall be deemed rejected such that the Government may make award notwithstanding conditions on proposals and/or exceptions to requirements or standards set forth in the solicitation and any such conditions and/or exceptions shall not form part of the awarded contract and shall not affect the awardee’s obligation to perform all requirements of the solicitation and other contract documents.
i. Failing to submit attachments or failing to complete the proposal properly, may result in rejection of the offer without further evaluation. Therefore, offerors are urged to follow instructions and speak with the Contracting
Officer and Contracting Specialist if instructions are not understood.
j. The RFP does not commit the Government to pay any costs incurred in the preparation and submission of a proposal or for any other costs incurred by any firm submitting a proposal in response to this solicitation. All offerors submitting proposals for this solicitation must be actively registered in the System for Award Management
(SAM) at the time of proposal submittal. Proposals of offerors that are not actively registered in SAM will be considered unacceptable.
