For this factor, offerors must demonstrate proof that they are licensed to do business in Iraq. Offerors must present an active and valid business license demonstrating their ability to operate legally in Iraq. This license must either be in the prime contractor offeror’s name as listed in the System for Award Management (SAM) or in the name of one of the Joint Venture (JV) partners (as listed in SAM) if the offeror is a JV. A translated copy of the license must be provided if the license is in any language other than English.
If the business license is in the name of a JV partner, a JV certificate confirming that the JV is a legal partnership must be submitted.
In addition to providing a business license as described above, offerors must demonstrate that they are registered in the Joint Contingency Contractor System (JCCS). Offerors must provide evidence of an active JCCS registration, which is current as of the date of proposal receipt in order to be evaluated for award. Offerors must have an active JCCS registration and determined to be base access eligible by the contract award date to be considered for award.
EVALUATION PROCEDURES
The Government will review the business license (and other documents required for Iraq only) provided by the offeror to ensure that it is a valid and active license, in good standing as of the date of proposal receipt.
Offerors must be registered in the Joint Contingency Contracting System (JCCS) to be considered eligible for award.
In addition to providing the offeror’s business license for Iraq, the offeror must also provide proof of active registration with base access in JCCS. Information on JCCS registration is available at the following website:
https://www.jccs.gov.
The Offeror must provide proof of registration in the JCCS and must provide its Company JCCS Identification (ID) number. The Government may choose to search the JCCS database using the JCCS Company ID number supplied by the vendor to verify eligibility. There are two elements in this factor. Offerors must satisfy the requirements for each element to receive an “Acceptable” rating for this factor.
SUBMISSION REQUIREMENTS:
Element 1: Schedule
For this factor, offerors shall submit a high-level schedule (containing no more than 100 activities) to demonstrate that they have an adequate understanding of the contract requirements described in the SOW for the individual delivery orders. The schedule shall address the minimum following items:

The Offeror shall also include evidence that the fabricator of the specified equipment has a minimum of five years’ experience in designing and fabrication of the specified equipment. Evidence may be in the form of self-certification and/or citation of sample projects in which their equipment was used.
The Government shall evaluate each offeror’s proposed equipment system and compare the information submitted with the requirements in the statement of work.
EVALUATION PROCEDURES:
Element 1: Schedule
Proposals will be evaluated to determine if the offeror’s proposed schedule is realistic, uses sound logic and activity relationships, and includes realistic activity durations. The schedule will be compared with the delivery order SOW associated with the designated country of performance to ensure the project will be completed within the required period of performance. Offerors that offer unrealistic, incomplete, and/or inadequate schedules (when compared to the required period of performance) or those that do not convey an adequate understanding of the project SOW shall be given an “Unacceptable” rating.
Element 2: Salient Features
In evaluating the proposal, the Government will compare the information presented by the offeror to the requirements listed in the statement of work.
The offeror SHALL submit information in their proposal to address all the technical requirements and all the salient features as described in the statement of work. The offeror must meet ALL the technical requirements and ALL of the SALIENT FEATURE’S criteria in order to be given an “Acceptable” rating for this factor.

Factor 2: Technical Approach
Acceptable Proposal clearly meets the minimum requirements of the solicitation.
Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.
FACTOR 3: PAST PERFORMANCE
The Past Performance evaluation includes an assessment of the relevancy of an offeror’s recent experience as it relates to the solicitation project. This factor will also evaluate the quality of the work performed.
For this evaluation:
A “recent” project is defined as a project which has been completed within the six (6) years immediately preceding the RFP issuance Date, or for an ongoing contract, for which at least 70% of the work has been completed as of the RFP issuance Date.
A “relevant” project is defined as a project that includes, the procurement, shipping, and installation of similar equipment as required by this solicitation, with a contract value equal to or greater than $5M in magnitude. At minimum, Offerors must provide one project performed in Iraq and one additional project performed within the
United States Central Command (CENTCOM) Area of Responsibility (AOR).
The quality of the past performance will be evaluated by reviewing Past Performance Questionnaires (PPQs) or official Government ratings for the projects submitted for consideration. The offeror must submit a PPQ or official Government rating document for each project submitted for consideration, in accordance with the guidance below.
SUBMISSION REQUIREMENTS
Offerors shall submit at least one project performed in Iraq and one project performed in the CENTCOM AOR, but no more than three projects for consideration which meet the above listed definition of recent and relevant. Additional projects submitted that exceed the three-project limit will not be considered for evaluation.
An offeror may submit for evaluation projects that it performed as a prime contractor, as part of a joint venture, or as a subcontractor so long as the offeror’s role in the project involves relevant work as described above.
If an offeror is a partnership or Joint Venture, the offeror may submit projects for evaluation performed by the partnership or Joint Venture; and projects performed by entities that comprise the partnership or Joint Venture. The Government will consider a submitted project performed by a partner or coventurer, if: (a) for that project, the offeror’s proposal describes the role of the partner or co-venturer; and (b) the offeror’s proposal clearly identifies how the role of the partner or co-venturer on the submitted project is relevant to the role the partner or co-venturer will be performing on the solicitation project.
If a prime contractor submits past performance information for a subcontractor, an unequivocal letter of commitment for that subcontractor must be included in the proposal.
An offeror shall provide a separate Past Performance Overview Sheet (Attachment 1), Project Summary Form (Attachment 2), and Past Performance Questionnaire (PPQ) (Attachment 3) for each project submitted.
The offeror shall include a project description on the Project Summary Form that includes the project scope and cost magnitude, and which is detailed enough to permit an evaluation of project recency and relevance. It is the responsibility of the offeror to convincingly demonstrate that the projects that they submit meet the definition of recency and relevancy, and the Government will not be responsible to make assumptions regarding the recency, scope, or magnitude of any project submitted for consideration.
Also, on the Project Summary Form, the offeror shall provide the name and contact information of English-speaking references who have first-hand knowledge of the offeror’s past performance, and who are independent and willing and available to answer questions. References should be knowledgeable personnel within the contracting agency or entity that administers the contract such as the agent, owner, or Government representative. References may be asked to comment on specific aspects of the offeror’s performance, including quality, timeliness, management of the work, subcontractor management including timely payment to subcontractors or suppliers, safety, relations between owner and designer or contractor, level of support for such elements as as-built documentation, Operations and Maintenance (O&M) manuals, training, correcting errors, and warranty work. The offeror should notify the reference that he/she may be contacted for the purposes of the evaluation.
An offeror shall attempt to obtain a client-completed Past Performance Questionnaire (PPQ) (Attachment 3) for each project submitted. If the offeror is unable to obtain a client completed PPQ before the proposal closing date, the offeror shall complete and submit with its proposal the first page of the PPQ (including blocks 5 and 6). If the client requests, completed PPQs may be submitted directly to the Government’s point-of-contact, William Mahon (William.J.Mahon@usace.army.mil) prior to the proposal closing date. Offerors may submit PPQs for submitted projects which were previously filled out by clients and used in previous proposal submissions for other projects.
However, offerors shall not merely incorporate these PPQs into their proposals by reference.
In addition to the PPQs, the offeror is encouraged to submit DD Form 2626 (Performance Evaluation (Construction)) forms and/or Contractor Performance Assessment Reports (CPARS) for the projects submitted.
Past performance information such as awards, certificates, customer letters of commendation, and any other forms of performance recognition shall not be submitted, as this information will not be evaluated.
FALSIFIED PAST PERFORMANCE INFORMATION (INCLUDING PPQs) MAY BE GROUNDS FOR
DISQUALIFICATION OF AN OFFEROR’S PROPOSAL, REFERRAL OF THE OFFEROR FOR
SUSPENSION OR DEBARMENT, AND REFERRAL OF THE OFFEROR TO THE APPROPRIATE
CRIMINAL AUTHORITIES.
While the Government is under no obligation to obtain past performance information not included in the offeror’s Past Performance proposal, the Government reserves the right to contact and interview references and clients submitted by an offeror, and to use any other means available to verify past performance information. The Government reserves the right to obtain and use in its evaluation any past performance information, including information for projects not submitted by the offeror. The Government may obtain past performance information by reviewing relevant Government databases, other DoD or Government appraisal systems, or other sources. Other sources may include, but are not limited to, past performance information retrieved through the Past Performance Information Retrieval System (PPIRS) using all CAGE/DUNS numbers of team members (partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified in an offeror’s proposal; inquiries of owner representative(s); Federal Awardees Performance and Integrity Information System (FAPIIS); Electronic Subcontract Reporting System (eSRS);
interviews with Government personnel; and any other known sources not provided by the offeror.

1) Recent and Relevant Experience: That the offeror has experience performing at least two (2) projects which are considered recent and relevant per the definitions in this factor.
2) Quality: That the offeror performed acceptably on the projects presented for consideration, and the Government does not uncover a history of regular or routine below average performance for the offeror in general.
The Government will review the past performance information for those projects submitted by the offeror, in addition to any other projects considered by the Government and make an overall determination as to whether the offeror has typically performed acceptably on past projects. For this acquisition, an offeror will have been considered to have performed acceptably on a project if all ratings are Satisfactory (or equivalent) in all rating categories. Offerors may still be considered to have performed acceptably if a small number of categories have below average ratings (e.g., “Marginal”) if the Government feels they are balanced out by higher ratings in other categories or are not indicative of a pattern of poor performance. Any documented evidence of severely negative ratings such as Unacceptable or Unsatisfactory, shall result in an “Unacceptable” rating for past performance.
The Government may seek and obtain past performance information pertaining to an offeror from Governmental and non-Government sources and databases. In addition, the Government may consider negative past performance discovered on projects which do not strictly meet definition of recent and relevant; for example, the Government may consider negative performance on on-going contracts that have not yet reached completion, or for contracts with a somewhat dissimilar scope or smaller magnitude than the solicitation project. The Government may determine that this evidence of negative performance is indicative of a history of regular or routine below average performance, and as a result may choose to assign an “Unacceptable” rating to this factor.
In accordance with FAR 15.305(a)(2)(iv), in the case of an offeror for which the quality of their past performance is not available, the offeror may not be evaluated favorably or unfavorably on the quality portion of the past performance factor. In this case, the offeror’s past performance is unknown and only the requirements to demonstrate three recent and relevant projects will be used to determine if an “Acceptable” rating will be assigned to this factor.
FACTOR 3: RATINGS AND DEFINITIONS
Factor 3: Past Performance
Acceptable The offeror provided evidence that they have sufficient recent and relevant experience, and that they performed acceptably on those projects. In addition, the Government did not uncover any evidence of regular or routinely poor past performance for the offeror in general.
Unacceptable The offeror did not provide evidence that they have sufficient recent and relevant experience, or there is evidence that the offeror did not perform acceptably on those projects, or the Government uncovered evidence of regular or routinely poor past performance for the offeror in general.
FACTOR 4 – PRICE:
SUBMISSION REQUIREMENTS:
Offerors shall submit a price proposal for all the CLINs of the solicitation. All price evaluation related to this solicitation will be based on the prices submitted.
The pricing proposal shall include the following:
a. Signed Solicitation, Offer, and Award (SF 1449), including acknowledgement of all amendments, as applicable.
b. Completed proposal schedule and cost breakdown sheet in Excel format, with all CLINs filled out completely.
This information may be used to aid the Government in determining the fairness and reasonableness of an offeror’s proposed price. The total price reflected on the proposal schedule and cost breakdown sheet should correspond to the price submitted on the CLIN schedule. Any discrepancies could be considered a deficiency and result in an incomplete proposal evaluation.
c. All other items required under Volume II – Price Proposal, in the “Proposal Submission” section of the solicitation. This includes the offeror’s DBA quotation.
EVALUATION PROCEDURES:
The Government will evaluate the offeror’s price proposal to identify risks to the Government based upon demonstration that:
1. The price proposal is complete. To be complete, the offeror shall provide all data that is requested to evaluate the price. The Government will assess the extent to which the proposed prices comply with the content and format requirements set forth in this solicitation.
2. The price proposal is balanced. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly over or understated. An offeror’s proposal may be unacceptable if it is determined that the lack of balance poses an unacceptable risk to the Government.
3. The price proposal is reasonable. For a price to be reasonable, it shall represent a price that provides an acceptable value to the Government when consideration is given based upon comparison with the Independent Government Cost Estimate (IGCE) and to prices in the market (market conditions may be evidenced by other competitive proposals). Consideration is also given to the technical and functional capabilities of the offeror as compared to its price.
Price will not be rated or scored. The Government reserves the right to seek an explanation of price breakdowns.
Any such request for explanation will constitute clarification or communication under FAR 15.306. Offerors will not be permitted to change proposed prices unless the Government conducts discussions. If deemed necessary, the supplemental price breakdown information will be used to assist the Government in performing the price evaluations described above.
If an offeror’s prices are deemed to be unreasonable, unbalanced, or incomplete in any respect, the offeror may be considered ineligible for a contract award. Offerors are cautioned to make all accompanying written descriptions complete and clear. The Government will not be responsible for any misunderstandings concerning the basis for pricing proposed by an offeror that results from that offeror’s failure to provide written descriptions that are complete and easily understood.
The Government will award the contract associated with this solicitation based on the lowest price received, provided that:
a. The price proposal submitted is determined to be complete, balanced, and reasonable.
b. The offeror has received “Acceptable” ratings for each of the three technical (non-pricing) factors.
For the purposes of evaluation, the Government will consider the sum of the base prices plus any options in determining the lowest priced offeror.
The DBA quotation is a required submittal to verify that the offeror understands the requirement and has received valid DBA quotations from an insurance company that will allow the offeror to execute its DBA policy within the time frames required under this solicitation, if awarded a contract. Proposals submitted without a DBA quote will be considered not complete and will not be considered eligible for award.
