2) Offeror’s ADDRESS - Prospective Offeror’s should indicate in the quote, the address to which payment and/or correspondence should be mailed, if such address is different from that shown for the contractor on Standard Form 1449 Block 17a.

3) System for Award Management - By submission of a quote, the Offeror’s acknowledges the requirement that prospective awardees must be registered in the System for Award Management (SAM) database prior to award, during performance, and through final payment of any contract resulting from this quote. Lack of registration in the SAM database will make an Offeror ineligible for award. D. Basis of Award - The Government will award a contract, from this solicitation to the responsible Offeror’s whose quote conforming to the solicitation will be most advantageous to the Government based on Specifications and Evaluation Criteria listed in FAR Clause 52.212-2 of this solicitation.

This order will be evaluated to assure that orders are not provided to debarred contractors. In addition, contractors with known performance issues identified in determining the contractor's responsibility per FAR Part 9 will be brought to the attention of the Contracting Officer and may be considered in making the awards. FAR Part 9, Contractor Qualification, requires that purchases shall be made from, and contracts shall be awarded to, responsible contractors. Past failures to perform, apply sufficient tenacity to performance, failure to meet quality requirements, terminations for default and less than satisfactory ratings by the customer will be a significant factor in a determination of unsatisfactory performance.

E. How to submit Quote: To be considered for evaluation, all Contractors may submit an electronic quote to the following email address no later than the stated due date and time in block 8 of the SF 1449. Submit an electronic quote to LaTasha.N.Martin@usace.army.mil. Submission of quotes via fax will not be accepted.

F. Delivery Times - The following delivery times are established for contactors:

0700-4:00pm, M-F (Monday thru Friday) 0700-3:00pm, Friday

(UNLESS OTHERWISE INSTRUCTED)

No deliveries will be accepted on Federal holidays.

STATEMENT OF WORK/SPECIFICATIONS

1. GENERAL

1.1 Scope of Work. Work under this contract consists of the following items of work.

1.1.1 This work includes furnishing all labor, material, equipment, transportation and supervision, and performing all operations necessary to provide and deliver FOB, Dredge Shower inserts. **A site visit is recommended for this procurement.

1.1.2 Shower Insert Specification

The Contractor shall supply and install 32 shower acrylic inserts.

Shower inserts drains have to match current drain locations with a new drain cover Shower inserts must be white Neo-Angle Acrylic Flat shower Walls will be bent to fit between existing tile walls to minimize demolition Showers will have a corner shelf for soap, shampoos and a footrest Showers will have a 16” chrome shower curtain rod with heavy-duty curtain and rings Contractor shall provide and install a new delta single handle commercial grade valve, with built in cutoffs on a new valve body. New shower head with chrome trim kit.

Shower inserts are shaped like a diamond where the back sides are approximately 2’11’, Sides are approximately 1’3” and the door is approximately 2’5”.

2. SHIPMENT

All material listed above shall be delivered to EEY Dredge Hurley. Deliver to USACE, Ensley Engineering Yard, ATTN: Adrian Pirani or Michael Temple, 2915 Riverport Road, Memphis, TN 38109.

Delivery time: After receipt of award, five to six weeks for delivery and installation.

2.1. PLACE OF PERFORMANCE

Dredge Hurley 2915 Riverport Rd, Memphis TN 38109. Coordinate with Adrian Pirani 901- 490-0075 for delivery. Contact P.O.C for questions regarding specifications is Jeffrey Farmer by phone 901-333-3606.

2.2 PERIOD OF PERFORMANCE

The period of performance for this project is 30 calendar days from award date. Normal business hours are 0700 – 1530 Monday through Friday during daylight savings time and 0630-1700 Monday through Thursday the remainder of the year. If alternate hours are requested, this must be agreed upon by Contracting Officer’s Representative (COR) and contractor.

3. Safety

(1) “Material Safety Data Sheets. Furnish one copy of all MSDS (SDS) sheets to the Contracting Officer Representative prior to the start of work.

(2) Accident Prevention Program. Four copies of the Accident Prevention program shall be submitted to the Contracting Officer Representative for review and approval within 5 calendar days after award.

3.1 REQUIRED INSURANCE.

As required by the contract clause entitled “Insurance- Work on a Government Installation,” the Contractor shall furnish to the Contracting Officer prior to the commencement of work a certificate or written statement as evidence of the minimum insurance listed below. The Contractor shall procure and maintain such types and amounts of insurance during the entire period of his performance under this contract. The Contractor shall assure that the certificate or written statement is in accordance with the required wording in paragraph b of the aforementioned Contract Clause.

a. (1) Workmen’s compensation-- Amounts required by applicable jurisdictional statutes.

(2) Employer’s Liability Insurance-- $100,000.00

(3) Comprehensive General Liability Insurance – (No property damage liability insurance is required) Bodily Injury -- $500,000.00 per occurrence

(4) Comprehensive Automobile Insurance Bodily Injury -- $200,000.00 each person $500,000.00 each accident

3.2 WARRANTY. All items furnished under this contract shall be warranted to be free from defect in workmanship and materials for a minimum period of one (1) year after date of installation.

4.0 PRESERVATION/PACKAGING/PACKING

4.1 Preservation packaging and packing for shipment of all items shall be in accordance with commercial practice and adequate for safe transportation.

4.2 The Contractor shall prepare and load all components for shipment. This preparation shall be in such a manner as to protect them from damage in transit, and the Contractor shall be responsible for and make good any and all damage until all deliveries are completed.

Weatherproof covers shall be provided to protect the components during shipment. Finished surfaces shall be secure to avoid damage during loading, transit or unloading.

5. INSPECTIONS

5.1 Parts Inspection. The Contracting Officer shall have the right to have his authorized representative inspect parts that have been furnished.

5.2 ACCEPTANCE. Final inspection and acceptance of equipment furnished by the Contractor will be at point of destination.

Security All contractor and all associated sub-contractors employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). The contractor shall also provide all information required for background checks to meet installation/facility access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office. Contractor workforce must comply with all personal identity verification requirements (FAR clause 52.204-9, Personal Identity Verification of Contractor Personnel) as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any installation or facility change, the Government may require changes in contractor security matters or processes.

Contractor and all associated sub-contractors employees shall comply with adjudication standards and procedures using the National Crime Information Center Interstate Identification Index (NCIC-III) and Terrorist Screening Database (TSDB) (Army Directive 2014-05 / AR 190- 13), applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative, as NCIC and TSDB are available), or, at OCONUS locations, in accordance with status of forces agreements and other theater regulations.

The Contractor must pre-screen Candidates using the E-verify Program (http://www.uscis.gov/e-verify) website to meet the established employment eligibility requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to enrollment to ensure the correct information is entered into the E-verify system. An initial list of verified/eligible Candidates must be provided to the COR no later than 3 business days after the initial contract award."

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

Basis of Award: The Government will award a contract resulting from this solicitation to the responsible offeror whose quote conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

All quotes submitted will be evaluated for (1) Technical Acceptability, (2) Satisfactory Past Performance & (3) Price. The government will issue award to the offeror whose proposal is the Lowest Price of those determined to meet at least the minimum requirements to be determined Technically Acceptable & Demonstrates Satisfactory Past Performance.

Technical Acceptability- is defined as the capability to PROVIDE THE ITEMS as specified in this Solicitation and the attached Scope-of-Work (SOW), and the ability to meet or exceed the specified delivery schedule.

To be determined Technically Acceptable Offerors Shall Submit the following with their quote package;

Evidence of the Capability to provide the items specified, such as a product description, technical specification sheets, product drawings and/or any other documentation necessary for the government to make a determination of technical acceptability of the item quoted.

Offerors Shall Submit, with their quote a project delivery schedule/date and certify with their quote that they are capable of completing delivery on or before 6 weeks ARO.

Satisfactory Past Performance- A review of past performance will be conducted on this requirement. The quality and delivery classifications identified for a supplier in the Past Performance Information Retrieval System‐‐ Statistical Reporting (PPIRS‐SR) application (http://www.ppirs.gov/) will be used by the contracting officer to evaluate a supplier's past performance. In the case of a supplier without a record of relevant past performance history in PPIRS‐SR for the FSC or PSC of the supplies being purchased, the supplier may not be evaluated favorably or unfavorably for its past performance history.

Price - Price quotes will be examined to determine the extent to which proposed prices are comparable with the Government estimates, and previous procurement history and a determination made of Price Reasonableness. The Government may reject any proposal that is determined to be Not Fair and Reasonable, unrealistically high or low in price when compared to Government estimates, or are unbalanced, such that the proposal is deemed to reflect an inherent lack of competence or failure to comprehend the requirements.

(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph

(d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records--Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
