QUOTE INSTRUCTIONS

1. DESCRIPTION OF WORK: This is a Total Small Business Set-Aside to supply 2,250 tons of crushed stone.

2. TYPE OF CONTRACT: The Government intends to award one Firm-Fixed Price supply contract.

3. BASIS FOR SELECTION OF AWARD: Award shall be made to the contractor whose offer conforming to the solicitation will be most advantageous to the Government based on Technical Capability, Price, and Past Performance. See Evaluation Criteria specified in FAR 52.212-2 of this solicitation.

4. PLACE OF DELIVERY: Ensley Engineering Yard, 2915, Riverport Rd. Memphis, TN, 38109

5. PERIOD OF PERFORMANCE: All items shall be delivered no later than 30 calendar days after award.

6. POC FOR COMMUNICATIONS: Any communications regarding this procurement before award must be made in writing to the Contracting Branch, Attn: Ariel “Ari” Wilkins at email Ariel.S.Wilkins@usace.army.mil. Inquiries must identify the solicitation number, the requestor’s company name, address, email address, and telephone number to include area code.

7. QUESTIONS: Questions must be submitted to Ariel “Ari” Wilkins via email at Ariel.S.Wilkins@usace.army.mil by November 25, 2020 at 10:00 a.m. Central Time. Phone calls or requests to arrange meetings at the Memphis District during the solicitation period to discuss project requirements or company’s capabilities are highly discouraged and will not be allowed.

SCOPE OF WORK

Scope: The Contractor shall supply 2,250 tons of crushed stone.

Service Required, Location: The Contractor will be responsible for the supply and delivery of crushed stone to Ensley Engineer Yard, 2915 Riverport Road, Memphis, TN 38109. Any load fees shall be included in the price per ton of crushed stone. Any additional fees or surcharges for longer haul distances, truck fees, fuel surcharge and/or standby fees shall be included in the price per ton of crushed stone.

All contractor and all associated sub-contractors employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). The contractor shall also provide all information required for background checks to meet installation/facility access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office.

Contractor workforce must comply with all personal identity verification requirements (FAR clause 52.204-9, Personal Identity Verification of Contractor Personnel) as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any installation or facility change, the Government may require changes in contractor security matters or processes.

All contract employees, including subcontractor employees who are not in possession of the appropriate security clearance or access privileges, will be escorted in areas where they may be exposed to classified and/or sensitive materials and/or sensitive or restricted areas.

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

All quotes submitted will be evaluated for (1) Technical Acceptability, (2) Satisfactory Past Performance &

(3) Price. The government will issue award to the offeror whose proposal is the Lowest Price of those determined to meet at least the minimum requirements to be determined Technically Acceptable & Demonstrates Satisfactory Past Performance.

(1) Technical Acceptability: Is defined as the capability to provide the items as specified in this Solicitation and the Scope-of-Work (SOW), and the ability to meet or exceed the specified delivery schedule. To be determined Technically Acceptable Offerors Shall Submit the following with their quote package; Evidence of the Capability to provide the items specified, such as a product description, technical specification sheets, product drawings and/or any other documentation necessary for the government to make a determination of technical acceptability of the item quoted.

(2) Satisfactory Past Performance: To demonstrate satisfactory past performance the offeror shall provide documentation of satisfactory performance on past or current contracts of a similar type, size, scope and complexity, as well as, provide references, including names and contact information of references who can verify their past performance. Past performance information of key personnel and crew may be provided if the company has limited or no past performance. In the case of an offeror without a record of relevant past performance or for whom

(3) Price: Price quotes will be examined to determine the extent to which proposed prices are comparable with the Government estimates, and previous procurement history and a determination made of Price Reasonableness. The Government may reject any quote that is determined to be Not Fair and Reasonable, unrealistically high or low in price when compared to Government estimates, or are unbalanced, such that the quote is deemed to reflect an inherent lack of competence or failure to comprehend the requirements. All quotes will be evaluated and a determination made of lowest price, from prices presented on the Bidding Schedule, based on the Total of all line items.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph

(d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records--Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
