BASIS OF CONTACT AWARD
A. BASIS FOR AWARD
This acquisition is a 100% 8(a) small disadvantaged business set-aside utilizing Lowest Price Technically Acceptable (LPTA) best value continuum source selection procedures in accordance with FAR 12.303; 15.101-2.
A single award will be made to the lowest price technically acceptable offer in response to the solicitation.
Proposed prices will be evaluated but not scored or otherwise combined with the other aspects of the proposal evaluation.
Offerors shall submit proposals in two volumes:
Volume I – Past Performance Proposal (limit 15 pages, not including questionnaires) Volume II – Price Proposal (limit 2 pages)
B. FACTORS TO BE EVALUATE
In order for an offeror to be considered for award, the proposal must receive an “Acceptable” rating in every non-price factor. The evaluation factors are listed below:
Volume I: Technical. The Technical Factors consist of:
Factor 1: Key Personnel Factor 2: Past Performance
Volume II: Price.
It is intended that proposals be evaluated, and an award made without discussions with the Offerors. If necessary, the Government may contact Offerors for the purpose of minor clarifications(s). If discussions are determined to be necessary, discussions will occur with all Offerors within the competitive range in accordance with FAR 15.306(d).
If discussions are conducted, the Contracting Officer will schedule the discussion sessions, and each offeror will be notified of the time and place prior to their discussion session. The Contracting Officer will provide additional instructions with the notification. The discussion sessions will take place by the method of the Government’s choosing and provided to the contractor in writing.
Failure to submit mandatory information for a factor, indicated by the word “shall” or “must”, will result in a rating of “unacceptable” for that factor, and the Offeror will be ineligible for award unless the Contracting Officer decides to hold discussions, and includes the Offeror in the competitive range. Technical evaluation factors (Factor I: Key Personnel, Part IV: Past Performance) will be evaluated first.
Price will be evaluated last.
An offeror that wishes to submit a proposal must propose on all of the work. Award will be made on an “All or None” basis to the lowest priced, technically acceptable proposal. Each non-price evaluation factor must be found to be technically acceptable in order for the proposal to be found technically acceptable. Proposals will not be technically ranked. Only one (1) technical proposal will be evaluated for each offeror.
C. EVALUATION APPROACH
All proposals shall be subject to evaluation by the Source Selection Team (SST).
Volume I: Technical:
The Government will evaluate the Technical Factors on an Acceptable/Unacceptable basis. Each factor identifies the minimum requirements that are imperative to successful contract performance.
The Source Selection Team will evaluate the Offeror’s proposal against the factors listed below to determine whether the proposal is Acceptable or Unacceptable, using the ratings and descriptions outlined in Table A-1:
Table A-1. Technical Acceptable/Unacceptable Ratings
Rating Description
ACCEPTABLE Proposal clearly meets the minimum requirements of the solicitation.
UNACCEPTABLE Proposal does not clearly meet the minimum requirements of the solicitation.
Factor 1: Key Personnel Submittal Requirements: Key personnel are defined as the offeror’s proposed full-time employees and/or subcontractor employees responsible for directing property accountability, small package and freight shipping, and logistics processes in the receiving warehouse.
Offerors shall submit a one-page resume for each of the three (3) key personnel listed below:
Table A-1. Technical Acceptable/Unacceptable Ratings Rating Description
• Fueling Services Driver. The Fueling Services driver shall have a commercial drivers license with endorsements for 1) Hazardous Materials (H); and 2) Tank (N) to transport and distribute fuel.
• Contractor Quality Control/Site Project Superintendent: The on‐site Project Superintendent shall have experience as aProject Superintendent on projects similar in monetary size and/or scope to the project described in this solicitation. This person shall also demonstrate having completed a thirty (30) hour OSHA course certification Resumes indicating contractor is able to staff the project with individuals with relevant certifications is required.
If personnel presented here are later replaced for the execution of this project, replacement personnel must have equal or better qualifications as those proposed and must be approved by the Contracting Officer before they perform work at the project site.
The Key Personnel factor will receive a rating of “acceptable” or “unacceptable” based on its entirety. In order to receive an “acceptable” rating, the proposal must demonstrate that all key personnel proposed comply with the minimum requirements stated in the specifications and have sufficient relevant experience and education to indicate that they have the knowledge and capability to successfully perform their assigned roles. Missing, incomplete, or ambiguous information could result in a rating of “unacceptable”.
Factor 2: Past Performance The Government will evaluate Offeror’s Past Performance on an Acceptable/Unacceptable basis.
This factor identifies the minimum requirements that are key to successful contract performance.
Offerors who are determined “unacceptable” will not be eligible for award. An Offeror will be Determined Acceptable/Unacceptable based on the descriptions outlined in Table A-2.
Table A-2. Past Performance Evaluation Ratings
Rating Description
ACCEPTABLE Based on the Offeror’s performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort, or the Offeror’s performance record is unknown.
UNACCEPTABLE Based on the Offeror’s performance record, the Government has no reasonable expectation that the Offeror will be able to successfully perform the required effort.
Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305(a)(2)(iv)), provided the Offeror certifies that additional past performance information is not available and provides an acceptable explanation as to why additional past performance is not available. Such an offeror shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered “acceptable.”
Past Performance Submittal Requirements: Offerors shall provide past performance information for at least (3) projects for completed work by the Offeror within the past thirty-six
(36) months that are similar in scope and specifications of this requirement. If the offeror submits more than three references, the Government will only review and consider the first three listed in the proposal. For each project, offerors shall provide the following information:
• Reference (Name, title, company, phone, email)
• Project Title and Description
• Contract or Subcontract number
• Date of Award
• Contract Value
The offeror shall also describe their effort in the project and its relevance to the solicited task. A list of subcontractors and their past performance history is required if the prime contractor is performing less than 20% of the work.
The past performance reference must have been a client, or client representative, with whom the Offeror had a contract, or subcontract (if applicable) for one or more projects. The reference must hold, or have held at the time, a senior position in the client organization with responsibilities of contract administration, quality control, engineering, or technical supervision, or was otherwise in a position to evaluate the Offeror’s performance in executing the contract or subcontract. The past performance reference must have first-hand knowledge of the Offeror’s performance. The reference must have a current, valid phone number at which they can be reached during normal business hours, a fax number, and must be able to speak, read, and write in the English language.
The offeror shall furnish the attached Past Performance Questionnaire for completion to the points of contact for the referenced projects. Submission of the Past Performance Questionnaires shall be sent directly to the Contract Specialist at Amy.L.Starks@usace.army.mil and Contracting Officer at Monica.A.Moody@usace.army.mil.
Questionnaires are due no later than 4:00 PM CST on Friday, November 11, 2016, and will only be accepted via email. The submission of the questionnaire must come directly to the Government from the point of contact for the referenced project.
The Government’s assessment of past performance will be based mainly on the Offeror’s reputations with customers and other sources. The Government will consider the currency and relevance of past performance information, source of the information, context of the data, and general trends in the contractor’s performance. The Government may contact any or all of the past performance references provided by the Offeror in response to this solicitation, and may also use information obtained from any other sources when evaluating past performance of the Offeror and major subcontractors. Other sources may include, but are not limited to, the Past Performance Information Retrieval System (PPIRS). While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance rests with the Offeror.
The evaluation will take into account relevant past performance information regarding predecessor companies or subcontractors that will perform major or critical aspects of the requirements when such information is available and relevant to the instant acquisition. If necessary during the evaluation process, any adverse information received regarding subcontractor past performance may be shared with Offerors during clarifications or discussions if held.
2. Volume 2: Price:
Price Submittal Requirements: Offerors shall complete and submit the bid schedule in Section 00010 with its proposal and include a price for each line item, including subtotals and totals.
Contract Line Item prices will be evaluated to determine whether the estimated proposed prices are fair and reasonable for the work to be performed; reflect a clear understanding of the requirements; and are consistent with the offeror's technical proposal.
The Government will evaluate price based on the total proposed price. The Contracting Officer, or the Contracting Officer’s designee, will evaluate the Offeror’s price for unbalancing and other potential performance risks. Price reasonableness will be determined in accordance with FAR 15.404-1. In this context, reasonableness may be determined by comparing offered prices to one another, to the government estimate, and to pricing for previous work of a similar nature.
It is the Offeror’s responsibility to ensure the completeness of the proposal. The Government may evaluate solely on the information provided in the initial proposal and not assume that an Offeror possesses any capability that is not specifically identified in the proposal.
Failure to submit mandatory information for a factor, indicated by the word “shall”, will result in a rating of “unacceptable” for that factor, and the Offeror will be ineligible for award unless the Contracting Officer decides to hold discussions, and includes the Offeror in the competitive range.
D. EVALUATION PROCESS
1. After receipt of proposals, the Contract Specialist will separate the Technical Proposals from the Price Proposals. Technical Proposals will be provided to the technical evaluation team.
2. The technical evaluation team will convene and independently evaluate the submitted proposals according to the evaluation factors. After concluding the evaluations, the technical evaluation team will provide the evaluation worksheets documenting their evaluation to the Source Selection Authority (SSA). The technical evaluation team will make no recommendation as to which firm should receive the award and additionally shall not establish a rank order or order of merit list pertaining to the offers being evaluated.
3. After receiving the evaluation documentation, the SSA, independently exercising prudent business judgment, will make a source selection decision on the basis of the lowest priced proposal meeting or exceeding the acceptability standards for non-price factors. While the SSA may use reports and analyses prepared by others, the source selection decision shall represent the SSA's independent judgment. The source selection decision shall be documented, and the documentation shall include the rationale for any business judgments made or relied on by the
SSA.
4. If, during the evaluation process, any Offerors are eliminated from the competitive range, the Offerors excluded from the competitive range shall be promptly notified in writing. The notice shall state the basis for the determination and that a proposal revision will not be considered.
The contracting officer shall award a contract to the successful Offeror by furnishing the executed contract or other notice of the award to that Offeror. Each Offeror whose proposal was in the competitive range, but was not selected for award, will be notified in writing within three
(3) days after the date of the contract Debriefings will be provided to unsuccessful Offerors who submit timely requests.

1.2.14 Ensure all parcels/packages that are not delivered to the end user by 3:00 p.m. on the day of receipt are secured in a locked storage area not later than 4:00 PM on the day of receipt.
1.2.15 Maintain a log of deliveries for all goods with an acquisition cost of more than one hundred dollars. The Contractor will use a log to document the vendors name, the name of the individual that the item(s) were shipped to, a description of the item(s) to be delivered, the number of items, barcode number (when applicable), date of delivery, and the printed name and signature of the individual accepting delivery. All non‐accountable supplies and equipment (FEDEX Air Log type items) not requiring a PR&C shall be delivered to the requestor within one
(1) working day of receipt.
1.2.16 Verify daily the automated payment system with the daily shipping log and verify monthly statements in the automated payment system. Once verified in the system, forward to the COR or his/her designated representative for certification.
1.2.17 Contractor shall organize and print the monthly billing statement from the freight payment system. Access CEFMS distribution screen to review income from PR&C from customer based on bill. Additionally, if customer PR&C and bill have a discrepancy the contractor shall research information to reconcile bill.
1.2.18 When the Shipping Request identifies that Personal Property items are to be shipped, ensure that an Accountable Property Barcode, Serial Number, item description, manufacturer and model number are documented on the form.
1.2.19 View the PR&C in CEFMS to ensure funding is available. Customers normally load funding two to three months in advance for expenditures. If the funding is short for payment, the Project Manager will alert the customer of the shortage through e‐mail.
1.2.20 The Automated Payment System transactions are to be verified daily against the shipping log to ensure the PR&C and system payment are a match.
1.2.21 Paper and/or ground bills are received for all packages throughout the month. They are paid in freight payment system and disbursement made in CEFMS through a similar process.
1.3 Surplus Equipment. Serve as the central receiver for all supplies and equipment identified as surplus to the needs of ERDC. The Contractor shall be held accountable as the custodian for all surplus supplies and equipment until all items are turned in to the Defense Reutilization and Marketing Office (DRMO), transferred to another organization, or disposed locally.
1.3.1 Receive, store, and secure all equipment and supplies inside the Surplus Equipment Facility. In certain cases, receive equipment and supplies at locations specified by a Hand Receipt Holder, and transfer the items to the Surplus Equipment Facility, for storage and security.
1.3.2 When accepting surplus supplies and equipment, the Contractor, along with the Government representative, shall inspect the ENG Form 4900‐R to ensure that the portion of the form that the Hand Receipt Holder or the Hand Receipt Holder’s representative must fill in is complete and accurate. Only after the Hand Receipt Holder’s portion of the ENG Form 4900‐R is complete and accurate, the COR shall fill in the block titled “Print/Type: Name/Office Symbol/Vendor Removing or Receiving Property:” and sign and date the adjacent block titled “Signature and Date.” By this action the Contractor acknowledges receipt of the property, and assumes the responsibility for the physical security of the property until which time it is redistributed, shipped, transferred, or disposed locally. The Contractor shall deliver to the Government the original copy of the ENG Form 4900‐R, with the location of equipment clearly identified. The method chosen by the Contractor to locate, store, and secure supplies and equipment must support the Government’s record‐keeping audit trail. Contractor shall ensure the disassembly of such items as IT racks and other similar equipment prior to pick‐up, turn‐in, or redistribution.
1.3.3 When automated data processing equipment is received, the Contractor shall ensure that an ENG Form 6E (Turn‐in Of Automated Information System (AIS) Equipment) is received with every Central Processing Unit (CPU). Ensure that a Hard Drive Removal Certificate is attached to every CPU. Inspect each ENG Form 6E and Hard Drive Removal Certificate to ensure accuracy and completeness.
