PROPOSAL CONTENT: The Government intends to make the award selection without discussions with the offeror. However, the Government reserves the right to hold discussions if necessary. The proposal must be complete and contain the offeror’s most favorable terms. The proposal shall address and contain the information listed below. The information will be used by the Source Selection Board to evaluate and rate each proposal. Offerors are advised that conciseness and relevance of the proposal is important. Proposals which provide only superficial coverage of the information required below may not receive additional consideration and may be excluded from the competitive range, if established.

Additionally, should the proposal include any standard company terms and conditions that conflict with the terms and conditions of the solicitation, the proposal may be determined to be “unacceptable” and thus ineligible for award. The following factors and sub-factors will be used to evaluate each proposal.

TAB A - VOLUME I – FACTOR 1 - TECHNICAL CAPABILITY

Evaluation Criteria

Technical - Acceptable/Unacceptable Ratings

Rating Description

Acceptable

The proposals satisfies/complies with all of the performance requirement of the solicitation, including production/output, dredging dept., mobility (self-propulsion while dredging).

Unacceptable

Proposal does not clearly meet the minimum requirements of the solicitation, and poses a high risk to the Government.

VOLUME I – FACTOR II – PAST PERFORMANCE

The Offeror must submit a list of a minimum of two (2); not more than five (5) projects rated acceptable, similar in size and scope of this requirement, and performed within the past 10 years. The Offeror will provide a “Past Performance Questionnaire” (see Attachment A) to the point of contact and/or the person that represents the owner’s opinion of the offeror’s past performance for each of the projects listed. The project point of contact for the listed references must complete the questionnaire and email it directly to Thomas E. Mercer, Contract Specialist, at thomas.e.mercer@usace.army.mil no later than the closing date for receipt of proposals stated in the RFP but preferably three (3) days in advance of the closing date. The offeror should address past performance for each project individually, as general contractor.

The Offeror is responsible for ensuring that the completed questionnaires are submitted by the date stated on Standard Form 1442 provided with this RFP. A sample transmittal letter and a copy of the questionnaire are included at the end of this section. The Government will evaluate the responses from the customers in the example projects identified by the Offeror and from which Past Performance Evaluation Questionnaires have been received. In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available, the Government will evaluate the offeror’s lack of past performance as Neutral. The Government may contact customers identified by Offeror to assure validity of the questionnaires received. The Government may also contact sources other than those provided by the Offeror to obtain information with respect to past performance evaluations in CCASS (Construction Contractor Appraisal Support System), telephone interviews, and personal knowledge of contractor performance capability obtained from Government personnel. The following sub-factor will be used by the Government to evaluate the General Contractor.

Evaluation Criteria

Past Performance - Acceptable/Unacceptable Ratings

Rating Description

Acceptable

Based on the Offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the Offeror’s performance record is unknown. Offeror must submit a minimum of 2 (two) projects rated acceptable, similar in size and scope of this requirement, and performed within the past 10 years

Unacceptable

Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.

A Past Performance evaluation assesses the probability an offeror will meet contract requirements should that offeror be awarded a contract. This rating results from the merging of assessment information on (a) the extent of relevance/recency of prior contracts, and (b) the quality of prior performance. Therefore, while relevance is a significant contributor to the final Past Performance Rating, it is not a formal Rating in and of itself. Use of the term "Rating" for relevance (Relevant or Not Relevant) means that each prior contract reviewed will be assessed, and a conclusion reached, as to the extent of prior contract relevance for the current contract. The resulting relevance assessment conclusions will then be combined, along with the assessed quality of performance on prior contracts, to arrive at a single rating for the Past Performance factor.

VOLUME 2 – FACTOR 3 - PRICE

The offeror shall provide unit prices and extended amounts for all items listed in bid schedule. Prices will be evaluated for reasonableness. The lowest price will be the total sum of all bid items. The offeror’s pricing shall be provided on the price proposal only, do not provide a list of prices with the technical portion of the proposal. The Offeror shall enter a price for each item listed in the base schedule plus all options years along with a grand total. Prices will be evaluated for reasonableness. The lowest price will be the total sum of all bid items.

a. Provide original and one (1) copy. This category consists of the following:

1) Representations and Certifications (Section 00600)

2) Proposal bonds

3) Completed Standard Form 1442.

The offer duly executed with an original signature by an official authorized to bind the company.

Acknowledgment of all amendments to the solicitation.

a. Price Proposal Information. Offeror shall complete all portions of the Price Proposal Schedule, as found in the bid schedule and furnish in a separate envelope, one original and one copy.

c. The Price Proposal schedule submitted in response to this solicitation will not be point scored but will be subjectively evaluated for reasonableness when compared to the Independent Government Estimate. The lowest price will be the total sum of all bid items, base and all option years.

d. If a supplemental bid schedule is submitted, it is considered backup documentation and the bid schedule take precedence.

Evaluation Criteria

Price

Rating Description

Not Rated

Price will not be rated or scored, but will be evaluated for completeness and reasonableness through the use of price analysis. The Price Team, using their expert judgment will evaluate the reasonableness of the price proposal. Offeror must submit the Price Proposal from Section 00010. The price schedule must be accompanied by the original signed Standard Form (SF) 1442 “Solicitation, Offer, and Award”. A price must be provided for all line items for base and all option years. All amendments must be acknowledged.

NOTES:

--Joint Ventures: An offeror that is part of a Joint Venture must submit a legally binding joint venture agreement. The Government will not evaluate the capability of any Offerors that are not included in the Joint Venture agreement. Joint Ventures must include a copy of the legal joint venture agreement signed by an authorized officer from each of the firms comprising the

Joint Ventures in Paragraph 3.0 above.

--Key Subcontractors: If an offeror wishes to be credited with the experience of a key subcontractor or supplier (i.e. a firm that is not the prime contractor part of the Joint Venture) a letter of commitment signed by the Key Subcontractor and prime contractor shall be submitted with Volume II. See detailed instructions regarding Key Subcontractors in Paragraph 3.0 above.

If a letter of commitment is not submitted, the experience will not be considered.

-- An offer may be rejected if an offeror objects to any of the terms of this RFP, including any part of the specifications. The Government plans to award the contract without discussions, so an offeror may not have an opportunity to withdraw any objections that the offeror has made, or provide any of the items of information described above, after the date and time that offers must be delivered to the Government. Therefore, the Government urges the offeror to speak to the

Government POC before objecting to any of the terms of this RFP, and to submit all of the items of information described above.

SOURCE SELECTION-PROPOSAL EVALUATION AND BASIS OF AWARD

1.0 INFORMAL SOURCE SELECTION PROCESS

All offers received in response to this solicitation will be evaluated in accordance with informal source selection procedures. The principal objective of this process is to select a responsible offeror who submits the Lowest Price Technically Acceptable (LTPA) offer. The process is designed to ensure the impartial, equitable, and comprehensive evaluation of all technically acceptable, responsible proposals received in response to this particular solicitation.

(1) Source Selection Team

The Source Selection Team is established as a separate organization and management chain of command whose only purpose is to accomplish the objective above. The organization consists of a Source Selection

Authority (SSA) and a Source Selection Evaluation Board (SSEB). The SSEB is comprised of separate

Technical and Price teams. The organization is designed to ensure active ongoing involvement of appropriate contracting, technical, logistics, legal, price analysis, small business, and other functional staff management expertise.

(2) Source Selection Procedure

The source selection procedures will begin with an initial review of proposals and continue with a technical and price evaluation conducted by the SSEB. The SSEB shall evaluate the proposals based solely on the evaluation criteria identified above. The results of the SSEB evaluations will be presented to the SSA, who will make the final source selection decision or determine whether it is appropriate to engage in clarifications or communications prior to the establishment of a competitive range, or to establish a competitive range and conduct discussions with those offerors that are included in the competitive range. The Government intends to award without discussions. All communications leading to establishment of the competitive range will be conducted in accordance with FAR Part 15.306(b).

If a competitive range is established, discussions will be conducted with offerors who are included in the competitive range. After conclusion of discussions and receipt of final revised proposals (if applicable), the SSEB will complete the evaluation and establish the final weighted technical ratings and present them to the SSA. The SSA will then review the proposals based on the Lowest Price Technically Acceptable

(LPTA) to the Government, and other factors considered, and make the final source selection decision.

The proposals received in response to this solicitation will be evaluated individually to select the most advantageous proposal. To be considered acceptable, each offeror shall specifically address each of the evaluation factors listed above. Sufficient detail shall be provided, citing specific data as may be required, such that the proposal may be adequately evaluated. The proposal must show clearly that the offeror has an understanding of the work tasks required and has the capability and responsibility to accomplish the work.

The Government is not responsible for information overlooked during the evaluation which is not located in the appropriate proposal section. To ensure the evaluation credit is appropriately received for proposal material submitted, do not incorporate by reference documents not contained in the proposal. References to sections of the proposal shall be by specific paragraph number (and name, if applicable), page number, and section.

2.0 FACTORS TO BE EVALUATED

The following evaluation factors will be used to evaluate each proposal: Award will be made based upon an integrated assessment of the evaluation factors listed below.

1. FACTOR I – Volume I: Technical Capability

2. FACTOR II – Volume I: Past Performance

3. FACTOR III – Volume II: Price

3.0 BASIS FOR AWARD

The Government intends to select, without discussions, the responsible offeror for contract award whose proposal conforms to this solicitation and is determined to be the lowest priced, technically acceptable proposal (LPTA). Award will be made to the offeror with a (1) Technically Acceptable proposal, (2) acceptable Past Performance and (3) the lowest evaluated cost or price, which is deemed responsible relating to an offeror’s record of acceptable performance, integrity, financial and resource capability, and ability to perform the contract in accordance with FAR 9.104.

Each technical factor will receive one of two ratings: Acceptable or Unacceptable. Offerors receiving one

Unacceptable rating will be deemed overall Unacceptable and will not be considered for award. Offerors must receive Acceptable on all technical factors and subfactors to be considered for award.

Price will be evaluated by the Price Team (PT). Proposal prices must be entered for all items in the

Proposal Schedule. The PT will evaluate the price proposals for completeness and reasonableness.
