PROCEDURES FOR SUBMITTAL OF OFFERS AND PROPOSAL EVALUATION
1. Overview
1.1. The purpose of this acquisition is to provide a readily available contract tool that will enable the Jacksonville District
Operations Department to proactively and responsively provide Design Build (DB) and General Construction, renovation, and repair requirements identified within the District. Task Orders placed under this MATOC include various types of construction, but not limited to new builds, demolition, renovation, and repairs related to civil works and military projects within U.S. Army Corps of Engineers (USACE), Jacksonville District (SAJ). The support for civil works projects will encompass all types of facilities such as commercial, industrial, military, logistical, or any other types where general construction trades and practices are typically used in the construction, renovation, expansion, and repairs. Facilities may be located within private lands, within federal, state, municipal, territorial/Indian Lands, within waterways and bodies of water, within the contiguous coastal zones to a depth of 12 feet, or on and around levees and water control features. The support for civil works projects will include environmental restoration, flood control, erosion control, bridges, paving and drainage, culvert work, grading, canals, levees and dams, industrial controls, waterway lock and spillway controls, geotechnical work to include piling and foundations, utility systems, and monitoring stations. Project sponsors may be military, other government agencies, organizations, or entities for whom USACE is assigned as the Construction Agent. Tasks may involve industrial process equipment, industrial ventilation systems, building and industrial controls, water control structures, and energy management systems. The Government intends to establish a Multiple Award Task Order Contract (MATOC) to a pool of contractors to provide General Construction and Design Build (DB) services as stated herein.
1.2. This contracting effort ensures that the Jacksonville District will be able to support its relevant construction needs over the next five (5) years. The Government will evaluate the proposals in accordance with the criteria described herein.
2. Basis For Award
2.1. This is a two-phase procurement, and the basis of award is the Best Value Trade-Off Process. Potential offerors are invited to submit the information described in this section for review and evaluation by the Government. Following completion of the evaluation of Phase I, up to a maximum of five most highly qualified offerors will be selected to participate in Phase II. It is the intent of the Government to award a target of five base IDIQ contracts as a result of this procurement. The Government is not obligated to award an IDIQ contract to all Offerors competing in Phase II.
2.2. The selected offerors for Phase II will be invited to submit the information described in Section 00100B, Procedures for Submittal of Offers for Phase II, for review and evaluation by the Government. Site visit information (if held) will be provided during Phase II.
2.3. Following completion of the Phase II evaluation, the Contracting Officer intends to award five IDIQ contracts to the responsible offerors whose proposals conform to the solicitation, are fair and reasonable, and offers the best overall value to the Government, all factors considered. It is anticipated that a seed project will also be awarded as a result of this solicitation. The Government reserves the right to accept other than the lowest priced offer or to reject all offers.
3. Submittal of Offers
3.1. Who May Submit. Any legally organized Small Business Offeror qualified and eligible to receive an award under applicable laws and regulations.
3.1.1. Contractor Team Arrangements.
W912EP24R0008 AM0003
3.1.1.1. Recognition of Contractor Teams. In accordance with FAR subpart 9.6, it is Government policy to recognize the integrity and validity of contractor team arrangements. For a teaming arrangement to be recognized for purposes of source selection evaluation and the application of non-price factors and sub-factors, there must be full disclosure of the teaming arrangement and company relationships in the team's proposal. The proposal must include a narrative that explains the major or critical aspects of the work to be performed by each team member. For joint venture teams, the proposal must also include an agreement that has been or will be executed prior to award between/among all team members.
3.1.1.2. Joint Venture Team Agreement. The teaming agreement submitted with the proposal will govern the performance of the work by the joint venture. The agreement must address the following items:
identification of team members, a delineation of roles and responsibilities of team members, the duration of the agreement, and the percentages of the participants including the controlling party. The timely submission of the executed teaming agreement prior to award shall be a precondition to a finding of responsibility.
3.2. General Proposal Submission Requirements. To ensure timely and equitable evaluation of proposals, Offerors must follow the instructions contained herein. Offerors are required to meet all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors. The Offeror shall submit in the proposal all requested information specified in this section of the
Request for Proposal (RFP) solicitation at or before the exact time specified. Failure to meet a requirement will result in an offer being ineligible for award. Copies of the RFP are available by INTERNET ACCESS ONLY. All RFP documents will be made available for viewing at the Sam.gov website (https://sam.gov). All Solicitation Amendments will be made available for viewing in Sam.gov. It shall be the Offeror’s responsibility to check the website for any
Solicitation Amendments.
The Contracting Officer (KO or PCO) has determined there is a reasonable probability of adequate price competition in this acquisition. Upon examination of the initial offers, the KO will review this determination and if, in the KO's opinion, adequate price competition exists, no additional cost information will be requested and certification under
FAR 15.406-2 will not be required. However, if at any time during this competition, the KO determines that adequate price competition no longer exists, offerors may be required to submit information to the extent necessary for the KO to determine the reasonableness and affordability of the price. The Government will evaluate all proposals pursuant to FAR 15.305. Offerors are advised that, pursuant to FAR 15.306, the Government reserves the right to eliminate any or all offers from consideration for award at any time prior to award of the contract. Therefore, each initial offer should contain the Offeror’s best terms from a technical and price standpoint. The Government reserves the right to discuss aspects of proposals with Offerors in the competitive range, if a competitive range is deemed necessary, upon completion of the evaluation. Offerors are advised that the Government may make award without discussions, clarifications or any contact concerning the proposals received. Offerors shall not assume that they will be contacted or afforded an opportunity to clarify, discuss or revise their proposals.
If an Offeror believes that the requirements in these instructions contain an error, omission or are otherwise unsound, the Offeror shall immediately notify the Contracting Division by submission through ProjNet with supporting rationale. Questions or other Requests for Information (RFI) shall be submitted via ProjNet (See Section 2.2.1).
Offerors are cautioned that “parroting” of the Technical requirements with a statement of intent to perform does not reflect an understanding of the requirement or capability to perform. e) Role of firm; provide a description of type of work performed and percentage of work self-performed.
f) Dollar value of the project. List award and final including explanations for cost increases over 10%.
g) Award date, original Construction Completion Date (CCD) and explanations for schedule growth over 10%.
h) Whether the project was design/build (indicate designer of record) or design/bid/build.
i) Customer Primary Point of Contact and alternate POC (name, relationship to project, agency/firm affiliation, city, state, current and correct phone number, and current and correct email address).
In addition to the PPQ, the Offeror’s proposal shall include the Past Performance Questionnaire Summary
Sheet (Attachment 2) to provide a summary of the PPQs included and/or submitted to clients. The summary sheet shall include information for all columns.
If the offeror is a joint venture, the submitted projects may have been performed by the joint venture itself or by a member of the joint venture, subject to the requirements found in Sections 4.1.5 and 4.1.6.
Offerors are advised to submit projects wherein the Offeror, or proposed joint venture members, played a significant role and to clearly define those roles. NOTE: Offerors remain responsible to adhere to the minimum and maximum number of projects stated herein. The Government will review projects in the order they appear in the proposal, and those projects submitted beyond the maximum limitations specified in this factor will not be evaluated.
5.1.6. Mentor-Protégé Joint Ventures and Service-Disabled Veteran-Owned Joint Ventures: Offerors submitting a proposal as a Mentor-Protégé Joint Venture must demonstrate the partners to the joint venture in the aggregate have the ability to meet all minimum requirements set forth in the solicitation. All members of joint ventures submitting proposal portions must adhere to all requirements set forth in this factor including those in sections 4.1.1 and 4.1.5. However, if submitting a project for a Protégé and Service-Disabled Veteran members of approved joint ventures the following project relevancy requirements are in effect:
Projects submitted for the construction contractor (if a protégé firm) shall have an awarded value of at least $3,000,000 and meet all other requirements stated herein.
Projects submitted for the AE/DOR Firm of Record (if a protégé firm) must have an awarded value of at least $150,000 and meet all other requirements stated herein.
5.1.7. Additional consideration may be given for projects that demonstrate experience with any of the following elements:
a) Design/Build projects. For the seed task order, vertical construction and ICC 500 storm shelter design experience is desired.
b) Established, working relationship with the proposed DOR Firm of Record (or Prime /
Construction Offeror in the case of the A-E DOR Firm of Record) on prior Design/Build projects.
c) Above Satisfactory Performance Record on Very Relevant projects
d) Relevant experience with Federal (e.g., DoD, VA, USACE) Design/Build Criteria (i.e., AT/FP, UFC, Specs Intact, United Facilities Guide Specifications)
e) Additional consideration may be given to offerors who self-perform.
5.1.8. Other Sources. In addition to the above, the Government may review any other sources other than those provided by the Offeror for evaluating past performance and experience. These other sources may include but are not limited to, past performance and experience information retrieved through the Past Performance
Information Retrieval System (PPIRS), including Contractor Performance Assessment Reporting System
(CPARS), using all CAGE/UEI numbers identified in the proposal on the Proposal Data Sheet, inquiries of owner representative(s), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), and any other known sources not provided by the Offeror.
5.1.9. While the Government may elect to consider data from other sources, the offeror must provide detailed, current, accurate and complete past performance information for evaluation by the Government.
5.1.10. The Government will only consider past performance of affiliates of the Offeror and those entities in a teaming agreement, whether a predecessor company, affiliated company, subsidiary (including wholly owned subsidiaries), or subcontractors if the resources of those affiliates will have a direct impact on the performance of this contract. If relying on affiliate past performance, it is the Offeror’s responsibility to clearly demonstrate any such direct impact on performance. For the Past Performance factor only, the Government will consider projects submitted for the DOR Firm of Record if a letter of commitment (Attachment 7), or teaming arrangement, is provided with the proposal.
5.2. Evaluation Criteria
5.2.1. Past Performance Evaluation: The past performance and experience evaluation results in an assessment of the
Government’s confidence in the ability of the Offeror to meet the solicitation requirements. The past performance evaluation considers each Offeror’s demonstrated record of performance and experience on recent and relevant projects that involve a similar scope and magnitude of effort and complexities as this solicitation requires. One performance confidence assessment rating is assigned for each Offeror after evaluating the
Offeror’s recent past performance and experience, focusing on performance and experience that is relevant to the contract requirements.
5.2.2. Recency and Relevancy Evaluation: In assessing recency and relevancy, the SSA will first determine whether the project was completed within five seven years of the date of the solicitation. If it is, the project will be considered recent. In assessing relevance, the SSA will compare the scope, magnitude, and complexity of the submitted projects against that of the scope of work in this statement of work. The SSA will assign a rating of either Very Relevant, Relevant, Somewhat Relevant, or Not Relevant, to each project, according to the definitions in Table 1, below.
Table 1. Past Performance Relevancy Method
Adjectival Rating Description
Very Relevant Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.
Relevant Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.
Somewhat Relevant Present/past performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires.
Not Relevant Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.
5.2.2.1. Offerors may increase the Source Selection Evaluation Board’s (SSEB) level of confidence by demonstrating previous projects where the Offeror and the design firm(s) proposed in this factor worked together to complete a project with at least satisfactory results.
5.2.3. Confidence Assessment:
5.2.3.1. After assessing the recency and relevancy of the offeror’s submitted projects, the SSA will evaluate the quality of the Offeror’s performance on those projects. It will do this via multiple methods, including verifying the performance ratings on the submitted PPQs; reviewing information contained in the CPARs and other Government Databases, and utilizing any other source of information about the offerors performance that is permitted by this solicitation.
5.2.3.2. A combined assessment of the recency, relevance, and quality of the offeror’s submitted projects will result in a performance confidence rating according to the definitions noted in Table 2 below.
5.2.3.3. Offerors may increase the SSEB’s level of confidence if they are able to demonstrate successful performance in a wide variety of work as described in this RFP. Conversely, the SSEB may have a decreased level of confidence in Offerors whose past performance is limited amongst the project types described in this RFP. Offerors may increase the SSEB’s level of confidence if they submit more than three Design-Build projects.
5.2.3.4. The Government will evaluate the Offeror's past performance and experience using the sources available to it including, but not limited to, the example projects identified by the Offeror and submitted on the
PPQs and any additional information received from references and CPARS or other sources. Offerors may be provided an opportunity to address any negative past performance information about which the
Offeror has not previously had an opportunity to respond if such information is determined to impact the rating to be assessed.
5.2.3.5. If no recent/relevant performance record is available or the Offeror’s performance record and experience is so sparse that no meaningful confidence assessment rating can be reasonably assigned this factor will be assigned a rating of “Unknown Confidence” (Neutral).
Table 2. Past Performance Confidence Ratings
Adjectival Rating Description
Substantial Confidence Based on the offeror’s recent/relevant performance record, the Government has a high expectation that the offeror will successfully perform the required effort.
Satisfactory Confidence Based on the offeror’s recent/relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.
Neutral Confidence
No recent/relevant performance record is available, or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned.
The offeror may not be evaluated favorably or unfavorably on the factor of past performance.
Limited Confidence Based on the offeror’s recent/relevant performance record, the Government has a low expectation that the offeror will successfully perform the required effort.
No Confidence Based on the offeror’s recent/relevant performance record, the Government has no expectation that the offeror will be able to successfully perform the required effort.
6. Phase I – VOLUME II – Tab H – FACTOR 2: Technical Approach for Design Build
6.1. Submission Requirements
6.1.1. Provide a narrative that describes the offeror’s philosophy and intended technical approach for executing design-build projects. Increased consideration is given for design-build, ICC 500 storm shelter design and construction, and industrial system design and construction. Clearly and concisely describe the offeror’s Design-Build team, and how the team will work collaboratively to ensure timely, quality completion of the project. The Technical
Approach narrative shall address the information described in paragraphs 6.1.1.1. & 6.1.1.2. below:
6.1.1.1. Roles and Responsibilities: Describe the roles and responsibilities of the offeror’s Design-Build team and how their resources will be utilized in order to deliver a design-build project. Describe the proposed management structure for the Design-Build team (i.e., key members), explaining how the design and construction process will be managed throughout the entirety of the project life cycle (e.g., Design -
Review Process, Fast Track, etc.), Construction – Subcontractor Management, Commissioning, etc., Close-out – As Built, O&M Manuals, etc.
6.1.1.2. Communication Plan: Describe interactions and communications both within the Design-Build team and with the Corps of Engineers throughout the entirety of the project life cycle.
NOTE: There is a page limit of twenty (20) single-sided, 8.5” x 11” pages, using a minimum font size of 12 and a minimum margin of one-half inch on all sides, for the Technical Approach for Design/Build Factor.
6.2. Evaluation Criteria:
6.2.1. The Government will review and identify the strengths, weaknesses, and any deficiencies in the proposal. The
Government will evaluate the proposal based on the offeror’s understanding of the USACE Design/Build process and how well it has demonstrated its ability to successfully execute design-build projects. Offerors are encouraged to tailor their proposal to demonstrate their approach for successfully completing work under this
MATOC.
6.2.2. The Government will evaluate the offeror’s understanding of the design process and the roles of the designers of record, construction firm, and the Government reviewers. The evaluation will be based on how well the offeror demonstrates their organizational (i.e., the structure and staffing) ability to execute design/build projects, to include the integration of the design and construction firms during design and construction. Proposals demonstrating that construction personnel will be actively involved in the design process may be viewed more favorably by the SSEB. The Government will evaluate the role of the designer in maintaining design integrity throughout the process, including its key roles during construction.
6.2.3. The Government will evaluate the offeror’s capabilities and understanding of the contractually required quality control processes for both design and construction, as well as the strength of the offeror’s proposed approach to control and track revisions to the design. The Government places value upon continued participation by the designers of record during the construction quality control process.
