About this file

This document is a Question and Answer (Q&A) tracker for Solicitation W912EK26RA004 issued by the USACE Rock Island District, concerning the procurement of typical sandbags and large air-liftable utility sandbags for flood fight operations. The Q&A addresses three key areas: maximum order limits, transportation expenses, and domestic preference requirements. Annual ordering quantities are specified as 8 million typical sandbags and 20,000 large sandbags, with transportation expenses to be reimbursed based on actual invoiced costs.

The solicitation seeks sandbags for use during flood events by the USACE National Flood Fight Material Center, with NAICS code 314910 and PSC 8305. Potential vendors must submit proposals to Contract Specialist Stanley L. Bolton via email, referencing attached documentation for detailed requirements. The Q&A tracker clarifies that transportation costs are cost-reimbursable and not part of price evaluation, and directs vendors to review Buy American Act compliance under FAR 52.225-1 and related contract terms and conditions for sourcing and manufacturing requirements.

Question and Answers for Solicitation W912EK26RA004

1. Maximum Order Limits The Solicitation details the estimated quantities for each ordering period (e.g., 4,000,000 Typical Sandbags per CLIN). However, the document also references a "maximum order limit" when describing delivery methods, which is not explicitly defined in terms of quantity (e.g., Section 3.2.b, c, d, e for Typical Sandbags, and Section 3.2.b, c, d, e for Large Sandbags).

Request: Could you please confirm the maximum quantity (maximum order limit) for a single, individual Delivery Order issued under this contract for both Typical Sandbags and Large Sandbags?

Response: Attachment 0003 posted to sam.gov along with the Solicitation has all the ordering quantities to include the guaranteed minimum and maximum.

NOTE: please use Attachment 00001 for your financial proposal. Do not deviate from what’s on the Proposal Pricing Worksheet.

The Annual order for Typical Sandbags is 8 million as stated in Attachment 0001 amendment 0001 The annual order for large sandbags is 20 thousand as stated in attachment 0001 amendment 0001.

2. Transportation Expense CLIN (e.g., CLIN 0001AE) The Continuation of Supplies or Services and Prices/Costs table lists a unit of "Each" for the Transportation Expense(e.g., CLIN 0001AE) with an Estimated Quantity of 85.

Request: Could you please clarify what the unit of "Each" represents for the Transportation Expense CLIN? Specifically, does "Each" represent: a) An individual Delivery Order (regardless of size)? b) A specific unit of measure (e.g., truckload, pallet, or container)? c) If it represents a dollar value (e.g., $85), how should we use this to enter our unit price for transportation, which is intended to be reimbursed based on actual cost per Section 3.2.g?

Response: Transportation will be reimbursed based on actual cost (when invoiced) Please refer to the legend on attachment 00002 which states that Transportation Expenses are cost reimbursable, estimated by the government, and will not be evaluated as part of the lowest price. You do not need to propose transport cost it’s given. Please refer to paragraph 4a, that requires know tariff cost be incorporated into the cost to the item.

3. Domestic Preference / Buy American Act (BAA) Compliance We did not find a specific clause addressing the Buy American Act or similar domestic preference requirements in the provided sections of the solicitation. Given the nature of this procurement, we must confirm the country of origin rules for the required materials.

Request: Could you please clarify the domestic preference requirements (such as the applicability of the Buy American Act or Trade Agreements Act) for the sandbags and shipping containers? Specifically: a) Is there a requirement for the sandbags (including the coated polypropylene fabric) to be manufactured or substantially transformed in the United States? b) Are we permitted to source the finished sandbags from a non-designated country, such as China, for this contract?

Your clarification on these points will be greatly appreciated and will help us submit a fully compliant and accurate proposal.

Response: Under 52.212-5 Contract Terms and Conditions you will find FAR 52.225-1 Buy American-Supplies and other clause that speak to your question.
