SOURCE SELECTION PLAN

SOLICITATION PROVISIONS

A. BASIS FOR AWARD

This acquisition is a full and open, competitive procurement utilizing Lowest Price Technically Acceptable (LPTA) best value continuum source selection procedures in accordance with FAR 15.101-2.

A single award will be made to the Offeror who provides a technically acceptable proposal with the lowest evaluated price.

Proposed prices will be evaluated but not scored or otherwise combined with the other aspects of the proposal evaluation.

B. FACTORS TO BE EVALUATED

In order for an offeror to be considered for award, the proposal must receive an “Acceptable” rating in every non-price factor.

The Price Proposal consist of the following:

Signed SF1442 and Acknowledgement of Amendments Schedule of Prices Representations, Certifications, and other Solicitation, Offer and Award Documents Bid Guarantee (Bid Bonds) Joint Venture and/or Articles of Organization for LLC, if applicable Subcontracting Plan-FOR LARGE BUSINESSES ONLY

The Technical Proposal consists of the following:

Factor 1: Technical Approach

Factor 2: Construction Experience

Sub-Factor A: Experience

Sub-Factor B: Key Personnel

Factor 3: Past Performance

C. EVALUATION APPROACH

All proposals will be evaluated by the Source Selection Team (SST).

Price Proposal:

Price will be evaluated and considered but will not be scored or combined with other aspects of the proposal evaluation. Offerors shall complete and submit the Schedule of Prices with its proposal and include a price for each line item. Failure to do so will result in the proposal being rejected without further consideration. Offerors will be allowed one proposal submission.

An award will be made to the lowest priced, technically acceptable proposal. The lowest price will be determined by adding up all listed line items. Failure to submit a price for any of the required line items on the Schedule of Prices will render the Offeror’s proposal as ineligible for award.

The Source Selection Evaluation Board will evaluate each Offeror’s price and verify that unbalanced pricing is not present. The Contracting Officer will evaluate each Offeror’s price in accordance with FAR 15.404-1 to determine price reasonableness. Price reasonableness will be determined by comparing all proposed prices, the Independent Government Estimate, and pricing of previous work that is same or similar to the requirement.

The otherwise technically acceptable lowest priced Offeror may be required to confirm/validate their offered price. Certified cost and pricing data are not currently required; however, the Government reserves the right to request such data prior to award. The Schedule of Prices must be completed and returned.

Technical Proposal:

The Government will evaluate the Technical Proposal on an Acceptable/Unacceptable basis.

This factor identifies the minimum requirements that are imperative to successful contract performance.

a. Adequacy of Response. The proposal will be evaluated to determine whether the Offeror’s methods and approach have satisfied the requirements specified in the solicitation.

b. Feasibility of Approach. The proposal will be evaluated to determine the extent to which the proposed approach is workable and the end results achievable. The proposal will be evaluated to determine the extent to which the Offeror is expected to be able to successfully complete the proposed tasks and technical requirements within the required schedule.

The Source Selection Team will evaluate the Offeror’s proposal against the factors listed below to determine whether the technical proposal is Acceptable or Unacceptable. To be considered acceptable, all factors under the technical proposal must receive an acceptable rating. The adjectival rating depicts how well the offeror’s proposal meets the Technical Proposal factor requirements.

The Technical Approach factor evaluates the Offeror’s proposed work plan and schedule for the entire length of the contract. The Government will evaluate the Offeror’s proposed work plan

Technical Proposal Acceptable/Unacceptable Ratings

Rating Description

ACCEPTABLE Proposal meets the minimum requirements of the solicitation.

UNACCEPTABLE Proposal does not meet the minimum requirements of the solicitation.

and schedule to determine understanding of and compliance with the Government’s

The Offeror shall submit a Work Plan and schedule narrative that describes the overall plan of operations to complete the contract work. The Offeror is encouraged to provide descriptions and illustrations which show the contractor’s, subcontractor’s, and supplier’s qualifications and methodology to accomplish the work, including, but not limited to, descriptions of equipment, special fabrications, and specialized labor.

Minimum requirements for this factor include:

Proposed bridge span jacking plan, to include at a minimum: temporary cribbing system; measures to support electrical conduits, buses and other appurtenances;

disconnections between spans; and roller nest removal details.

Plan for lead based paint removal, containment and disposal.

Details and/or techniques to be used for abrasive blasting and painting in areas with limited space, such as, lattice members, gusset plates with pack rust, etc.

Timing and considerations for work items to be coordinated with the Government, such as moving bulkheads, staging location of bulkhead trolley and service crane during abrasive blasting and painting operations.

Detailed work sequences for all major activities, including approximate durations and the reasoning for the timing of activities.

Mobilization timelines and locations.

The staging and flow of work and materials necessary to accomplish the contract

Identification of critical long-lead time materials and fabrications (if required).

The Government will evaluate the work plan and schedule based on the following:

Completeness of plan with respect to minimum requirements listed above.

Demonstration of thorough understanding and ability to comply with the project requirements.

Reasonableness of contractor sequencing in terms of site constraints and challenges associated with the work.

Consideration of lead times for major equipment/materials (if required).

Ability to mitigate construction and scheduling risks associated with project features.

Ability to minimize interference with locks and dam ongoing operations.

Acceptable: The proposed work plan and schedule clearly meets the minimum requirements listed for Factor 1. Based on the work plan and schedule proposed by the Offeror, the Government has a reasonable expectation that the Offeror will successfully perform the required effort.

Unacceptable: Offerors whose work plan and schedule do not meet the minimum requirements listed for Factor 1. Based on the work plan and schedule proposed by the Offeror, the Government does not have a reasonable expectation that the Offeror will successfully perform the required effort

Factor 2: Construction Experience

The Government will evaluate relevant construction experience of the Offeror as described in the following two (2) sub-factors.

Sub-factor A: Experience

Relevant experience is what an Offeror, and/or committed sub-contractor(s), has done on projects that are the same or similar in size, scope and complexity as the project in this solicitation.

The Offeror shall submit a minimum of three (3) projects which express experience similar to this requirement and have been substantially completed within the last ten (10) years prior to the issue date of the solicitation, utilizing Attachment 2, Construction Experience Information form. The project information must demonstrate relevancy to the project described in the solicitation and all information submitted must be accurate, current, and complete.

Substantially complete as defined for this solicitation: A project is considered substantially complete when the project is sufficient for the use of which it is intended, as of the closing date of this solicitation.

All project examples shall contain a Point of Contact (POC) as well as one alternate Point of Contact, to include the name, job title of the POC, address, telephone, and e-mail address.

The POC and alternate shall be familiar with the construction performance of the contractor and be a representative of the owner/customer/prime contractor, not affiliated with the contractor. The POC and alternate shall be able to verify the experience cited.

Minimum requirements for this factor include:

Offeror must have at least three (3) projects demonstrating experience with Floating Plant on Navigable Waterways.

Offeror must have at least two (2) projects demonstrating experience with working on a dam structure on Navigable Waterways.

Offeror must have at least two (2) projects demonstrating experience with lead based paint removal, containment and disposal; and painting of steel structures on Navigable Waterways.

Offeror must have at least one (1) project demonstrating experience with abrasive blasting and painting a truss bridge.

Offeror must have at least one (1) project demonstrating experience with jacking a truss bridge

Sub-factor B: Key Personnel

The Government will evaluate the Offeror’s organization and management effectiveness approach by considering the Offeror’s understanding and capability to successfully manage contract requirements to successfully complete the project.

Provide an organizational chart that clearly shows lines of authority and communication chain of the organization. Describe Offeror’s team members, their roles and responsibilities to include major sub-contractors. Identify the number of Project Manager(s), Construction Quality Control System Manager(s), Superintendent(s) and Site Safety and Health Officer(s) assigned to execute contract requirements. Explain how the Offeror will communicate and coordinate construction issues and other concerns identified by the Offeror throughout the construction period with major subcontractors and the Government.

If using a subcontractor as team members in demonstrating construction experience, describe the roles the prime contractor and subcontractors will play in the project and the percentage of any type each will perform. For the purpose of this requirement, subcontractors are defined as members of an Offeror’s overall team who are expected to perform ten (10%) percent or more of the proposed effort..

If using experience for work performed as a joint venture, the experience information must state in detail the nature of the work performed by both of the joint venture partners, the total percentage of the overall contract performed by both of the joint venture partners, and the total amount of work performed by both of the joint venture partners.

The subcontractors described as key personnel must be utilized on the project. Substitution of any proposed subcontractor will require prior approval of the Contracting Officer. Lack of adequate experience could impact mission requirements and may result in the entire proposal receiving an unfavorable rating and/or being eliminated from the competitive range.

Acceptable: Offerors (in combination with experience of their Joint Venture (JV) partners or committed key subcontractors) who show experience meeting each element described in Factor 2 in the past ten (10) years will be determined to meet the minimum requirements of the contract and will be found Acceptable.

Unacceptable: Offerors (in combination with the experience of their JV partners or committed key subcontractors) failing to show experience meeting each element described for Factor 2 in the past ten (10) years will be found Unacceptable.

The Government will evaluate the Offeror’s record of past and current performance to ascertain the probability of successfully performing the required effort. Past Performance describes how well the Offeror performed on previous projects.

The Government will focus its inquiries on the Offeror’s (and major subcontractor’s) record of performance as it relates to all solicitation requirements, including cost, schedule, performance and management of subcontractors. For the purpose of this requirement, major subcontractors are defined as members of an Offeror’s overall team who are expected to perform ten (10%) percent or more of the proposed effort.

The Government may use data provided by the Offeror in its proposal and data obtained from other sources, including data in Government files or data obtained through interviews with personnel familiar with the contractor and their current and past performance under Federal, State or Local government or commercial contracts for same or similar services as compared to the North American Industry Classification System (NAICS) 237990. Data used in conducting performance risk assessments shall not extend past ten (10) years prior to the issue date of the solicitation, but may include performance data generated during the past ten (10) years without regard to the contract award date.

There are three (3) aspects to the past performance evaluation: recency, relevancy (including context of data), and quality (including general trends in contractor performance and source of information)

Recency. The first is to evaluate the recency of the offeror’s past performance. Recency is generally expressed as a time period during which past performance references are considered relevant, and is critical to establishing the relevancy of past performance information.

Relevancy: The recent past performance of the Offeror and its proposed major subcontractors will be evaluated to determine how relevant the scope of the past work was to the effort required.

Relevancy is not separately rated; however, the following criteria will be used to establish what is relevant: Relevant Past Performance shall include similarity of service/support, complexity;

dollar value, contract type, and degree of subcontract/teaming.

The third aspect of the past performance evaluation is to establish the overall quality of the Offeror’s past performance (see FAR 15.304(c)(2)).

The proposal must include three (3) but no more than five (5) projects representing the Offeror’s recent, relevant and quality past performance. Recent and relevant past performance shall include similarity of service/support, complexity; dollar value, contract type, and degree of subcontract/teaming and has been completed within the last ten (10) years.

Example projects that the Government did not consider relevant for the purposes of evaluating experience will not be considered relevant for the purposes of evaluating past performance.

The POC and alternate shall be able to verify the past performance cited. The Government will focus its inquiries, at a minimum, on the Offeror’s (and major subcontractor’s) record of performance as it relates to all solicitation requirements, including quality of products/services, timely performance, to include schedules and management.

Other sources may include, but are not limited to, past performance information retrieved through the Past Performance Information Retrieval System (PPIRS), including Contractor Performance Assessment Reporting System (CPARS), using all CAGE/DUNS numbers of team members (partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified in the Offeror’s proposal, inquiries of owner representative(s), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), and any other known sources not provided by the Offeror. While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror.

Acceptable: Based on the Offeror’s performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort, or the Offeror’s performance record is unknown. (See note below)

Unacceptable: Based on the Offeror’s performance record, the Government does not have a reasonable expectation that the Offeror will be able to successfully perform the required effort.

Note: In the case of an Offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305(a)(2)(iv)). Therefore, the Offeror shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered “acceptable.”

D. PROPOSAL SUBMISSION

The discussion sessions will take place by the method of the Government’s choosing and provided to the contractor in writing.

52.214-35 SUBMISSION OF OFFERS IN U.S. CURRENCY (APR 1991)

52.215-1 INSTRUCTIONS TO OFFERORS--COMPETITIVE ACQUISITION (JAN 2017)

(a) Definitions. As used in this provision--

“Discussions” are negotiations that occur after establishment of the competitive range that may, at the Contracting Officer's discretion, result in the offeror being allowed to revise its proposal.

“In writing or written” means any worded or numbered expression which can be read, reproduced, and later communicated, and includes electronically transmitted and stored information.

“Proposal modification” is a change made to a proposal before the solicitation's closing date and time, or made in response to an amendment, or made to correct a mistake at any time before award.

“Proposal revision” is a change to a proposal made after the solicitation closing date, at the request of or as allowed by a Contracting Officer as the result of negotiations.

“Time”, if stated as a number of days, is calculated using calendar days, unless otherwise specified, and will include Saturdays, Sundays, and legal holidays. However, if the last day falls on a Saturday, Sunday, or legal holiday, then the period shall include the next working day.

(b) Amendments to solicitations. If this solicitation is amended, all terms and conditions that are not amended remain unchanged. Offerors shall acknowledge receipt of any amendment to this solicitation by the date and time specified in the amendment(s).

(c) Submission, modification, revision, and withdrawal of proposals. (1) Unless other methods (e.g., electronic commerce or facsimile) are permitted in the solicitation, proposals and modifications to proposals shall be submitted in paper media in sealed envelopes or packages (i) addressed to the office specified in the solicitation, and (ii) showing the time and date specified for receipt, the solicitation number, and the name and address of the offeror.

Offerors using commercial carriers should ensure that the proposal is marked on the outermost wrapper with the information in paragraphs (c)(1)(i) and (c)(1)(ii) of this provision.

(2) The first page of the proposal must show--

(i) The solicitation number;

(ii) The name, address, and telephone and facsimile numbers of the offeror (and electronic address if available);

(iii) A statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation and agreement to furnish any or all items upon which prices are offered at the price set opposite each item;

(iv) Names, titles, and telephone and facsimile numbers (and electronic addresses if available) of persons authorized to negotiate on the offeror's behalf with the Government in connection with this solicitation; and

(v) Name, title, and signature of person authorized to sign the proposal. Proposals signed by an agent shall be accompanied by evidence of that agent's authority, unless that evidence has been previously furnished to the issuing office.

(3) Submission, modification, or revision, of proposals.

(i) Offerors are responsible for submitting proposals, and any modifications, or revisions, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that proposal or revision is due.

(ii)(A) Any proposal, modification, or revision received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--

(1) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of proposals; or

(2) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or

(3) It is the only proposal received.

(B) However, a late modification of an otherwise successful proposal that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(iii) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the proposal wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(iv) If an emergency or unanticipated event interrupts normal Government processes so that proposals cannot be received at the office designated for receipt of proposals by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation, the time specified for receipt of proposals will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(v) Proposals may be withdrawn by written notice received at any time before award. Oral proposals in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile proposals, proposals may be withdrawn via facsimile received at any time before award, subject to the conditions specified in the provision at 52.215-5, Facsimile Proposals. Proposals may be withdrawn in person by an offeror or an authorized representative, if the identity of the person requesting withdrawal is established and the person signs a receipt for the proposal before award.

(4) Unless otherwise specified in the solicitation, the offeror may propose to provide any item or combination of items.

(5) Offerors shall submit proposals in response to this solicitation in English, unless otherwise permitted by the solicitation, and in U.S. dollars, unless the provision at FAR 52.225-17, Evaluation of Foreign Currency Offers, is included in the solicitation.

(6) Offerors may submit modifications to their proposals at any time before the solicitation closing date and time, and may submit modifications in response to an amendment, or to correct a mistake at any time before award.

(7) Offerors may submit revised proposals only if requested or allowed by the Contracting Officer.

(8) Proposals may be withdrawn at any time before award. Withdrawals are effective upon receipt of notice by the Contracting Officer.

(d) Offer expiration date. Proposals in response to this solicitation will be valid for the number of days specified on the solicitation cover sheet (unless a different period is proposed by the offeror).

(e) Restriction on disclosure and use of data. Offerors that include in their proposals data that they do not want disclosed to the public for any purpose, or used by the Government except for evaluation purposes, shall--

(1) Mark the title page with the following legend: This proposal includes data that shall not be disclosed outside the Government and shall not be duplicated, used, or disclosed--in whole or in part--for any purpose other than to evaluate this proposal. If, however, a contract is awarded to this offeror as a result of--or in connection with-- the submission of this data, the Government shall have the right to duplicate, use, or disclose the data to the extent provided in the resulting contract. This restriction does not limit the Government's right to use information contained in this data if it is obtained from another source without restriction. The data subject to this restriction are contained in sheets [insert numbers or other identification of sheets]; and

(2) Mark each sheet of data it wishes to restrict with the following legend: Use or disclosure of data contained on this sheet is subject to the restriction on the title page of this proposal.

(f) Contract award.

(1) The Government intends to award a contract or contracts resulting from this solicitation to the responsible offeror(s) whose proposal(s) represents the best value after evaluation in accordance with the factors and subfactors in the solicitation.

(2) The Government may reject any or all proposals if such action is in the Government's interest.

(3) The Government may waive informalities and minor irregularities in proposals received.

(4) The Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a)). Therefore, the offeror's initial proposal should contain the offeror's best terms from a cost or price and technical standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. If the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.

(5) The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit cost or prices offered, unless the offeror specifies otherwise in the proposal.

(6) The Government reserves the right to make multiple awards if, after considering the additional administrative costs, it is in the Government's best interest to do so.

(7) Exchanges with offerors after receipt of a proposal do not constitute a rejection or counteroffer by the Government.

(8) The Government may determine that a proposal is unacceptable if the prices proposed are materially unbalanced between line items or subline items. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more line items is significantly overstated or understated as indicated by the application of cost or price analysis techniques. A proposal may be rejected if the Contracting Officer determines that the lack of balance poses an unacceptable risk to the Government.

(9) If a cost realism analysis is performed, cost realism may be considered by the source selection authority in evaluating performance or schedule risk.

(10) A written award or acceptance of proposal mailed or otherwise furnished to the successful offeror within the time specified in the proposal shall result in a binding contract without further action by either party.

(11) If a post-award debriefing is given to requesting offerors, the Government shall disclose the following information, if applicable:

(i) The agency's evaluation of the significant weak or deficient factors in the debriefed offeror's offer.

(ii) The overall evaluated cost or price and technical rating of the successful and the debriefed offeror and past performance information on the debriefed offeror.

(iii) The overall ranking of all offerors, when any ranking was developed by the agency during source selection.

(iv) A summary of the rationale for award.

(v) For acquisitions of commercial items, the make and model of the item to be delivered by the successful offeror.

(vi) Reasonable responses to relevant questions posed by the debriefed offeror as to whether source-selection procedures set forth in the solicitation, applicable regulations, and other applicable authorities were followed by the agency.

52.216-1 TYPE OF CONTRACT (APR 1984)

The Government contemplates award of a firm fixed price construction contract resulting from this solicitation.

52.217-5 EVALUATION OF OPTIONS (JUL 1990)

Except when it is determined in accordance with FAR 17.206(b) not to be in the Government's best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s).

52.222-5 CONSTRUCTION WAGE RATE REQUIREMENTS--SECONDARY SITE OF THE WORK (MAY

2014)

(a)(1) The offeror shall notify the Government if the offeror intends to perform work at any secondary site of the work, as defined in paragraph (a)(1)(ii) of the FAR clause at 52.222-6, Construction Wage Rate Requirements,of this solicitation.

(2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.

(b)(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the Contracting Officer.

(2) The due date for receipt of offers will not be extended as a result of an offeror's request for a wage determination for a secondary site of the work.

52.222-23 NOTICE OF REQUIREMENT FOR AFFIRMATIVE ACTION TO ENSURE EQUAL

EMPLOYMENT OPPORTUNITY FOR CONSTRUCTION (FEB 1999)

(a) The offeror's attention is called to the Equal Opportunity clause and the Affirmative Action Compliance Requirements for Construction clause of this solicitation.

(b) The goals for minority and female participation, expressed in percentage terms for the Contractor's aggregate workforce in each trade on all construction work in the covered area, are as follows:

Goals for minority participation for each trade Goals for female participation for each trade

4.6% 6.9%

These goals are applicable to all the Contractor's construction work performed in the covered area. If the Contractor performs construction work in a geographical area located outside of the covered area, the Contractor shall apply the goals established for the geographical area where the work is actually performed. Goals are published periodically in the Federal Register in notice form, and these notices may be obtained from any Office of Federal Contract Compliance Programs office.

(c) The Contractor's compliance with Executive Order 11246, as amended, and the regulations in 41 CFR 60-4 shall be based on (1) its implementation of the Equal Opportunity clause, (2) specific affirmative action obligations required by the clause entitled "Affirmative Action Compliance Requirements for Construction,'' and (3) its efforts to meet the goals. The hours of minority and female employment and training must be substantially uniform throughout the length of the contract, and in each trade. The Contractor shall make a good faith effort to employ minorities and women evenly on each of its projects.
