1.12 TIME EXTENSIONS FOR UNUSUALLY SEVERE WEATHER
(a) This provision specifies the procedure for determination of time extensions for unusually severe weather in accordance with the Contract Clause DEFAULT (FIXED-PRICE CONSTRUCTION). In order for the Contracting Officer to award a time extension under this clause, the following conditions must be satisfied:
(1) The weather experienced at the delivery order site during the Contract period must be found to be unusually severe, that is, more severe than the adverse weather anticipated for the delivery order location during any given month, except that the period of 01 December through 01 April is excluded from time extension consideration due to adverse weather (See Special Contract Requirements clause ADDITIONAL PHYSICAL DATA INFORMATION).
(2) The unusually severe weather must actually cause a delay to the completion of the delivery order. The delay must be beyond the control and without the fault or negligence of the Contractor.
(b) The following schedule of monthly anticipated adverse weather delays is based on National Oceanic and Atmospheric Administration (NOAA) or similar data for the delivery order location and will constitute the base line for monthly weather time evaluations. The Contractor's progress schedule must reflect these anticipated adverse weather delays in all weather dependent activities.
MONTHLY ANTICIPATED ADVERSE WEATHER DELAY
WORK DAYS BASED ON (7) DAY WORK WEEK
Jan Feb Mar Apr May Jun Jul Aug Sep Oct Nov Dec
(31) (28) (22) (13) (08) (09) (06) (07) (05) (08) (18) (31)
(c) Upon acknowledgment of the Notice to Proceed (NTP) and continuing throughout each delivery order, the Contractor will record on the daily Contractor's quality control report, the occurrence of adverse weather and resultant impact to normally scheduled work. Actual adverse weather delay days must prevent work on critical activities for 50 percent or more of the Contractor's scheduled work day. The number of actual adverse weather delay days shall include days impacted by actual adverse weather (even if adverse weather occurred in previous month), be calculated chronologically from the first to the last day of each month, and be recorded as full days. If the number of actual adverse weather delay days exceeds the number of days anticipated in paragraph (b), above, the Contracting Officer will convert any qualifying delays to calendar days, giving full consideration for equivalent fair weather work days, and issue a modification in accordance with the Contract Clause DEFAULT (FIXED-PRICE CONSTRUCTION).

1.15 IOWA SALES AND USE TAXES
Materials that are to be physically incorporated into real estate owned by the United States Government are exempt from Iowa sales and use taxes.
However, sales of tools, fuel, lumber for forms and other end use or consumption items which are not physically incorporated into real estate are taxable sales. The Government will provide the Contractor and its Subcontractors an exemption certificate/authorization letter, which may be used when purchasing materials to establish their tax-exempt status.
1.16 CONDITION OF EXISTING STRUCTURES, ROADWAYS, TRAILS, AND OTHER
FACILITIES
a. Pre-Construction Condition Survey - Prior to commencement of operations by the Contractor, make a detailed survey of all existing structures, Contractor staging and parking areas, roadways, trails, and other facilities that may be affected by the Contractor's operations.
Conduct the survey with the the Contracting Officer, and obtain signature from both parties. Survey sufficiently in scope to provide advance agreement among all concerned as to the condition of the existing structures, Contractor staging and parking areas, roadways, trails, and other facilities. Assume responsibility for full and active participation in such pre-construction condition survey of existing structures, Contractor staging and parking areas, roadways, trails, and other facilities as deemed necessary to permit determination and accurate assessment of any subsequent damage to existing structures, Contractor staging and parking areas, roadways, trails, and other facilities which may be incurred during the Contract.
b. Post-Construction Condition Survey - After completion of the work, and prior to final acceptance of the work, make a detailed post-construction condition survey of the same structures, Contractor staging and parking areas, roadways, trails, and other facilities previously surveyed with the Contracting Officer, and obtain signature from both parties. Survey sufficiently in scope to provide for agreement among all concerned as to the post-project condition of the existing structures, Contractor staging and parking areas, roadways, trails, and other facilities. Assume responsibility for full and active participation in such post-construction condition survey as deemed necessary to permit determination and accurate assessment of any damage to existing structures, Contractor staging and parking areas, roadways, trails, and other facilities which have been incurred during the Contract.
c. Include, but do not limit the surveys to, photographs, videos, sketches, and written descriptions. Assume responsibility and expenses
DOCUMENT 00 73 05 Page 9 for all materials and personnel required for accomplishment of the above surveys. Submit all documentation to each party involved.
d. If it is determined by the post-construction condition survey that damage has occurred to structures, Contractor staging and parking areas, roadways, trails, and other facilities, then repair such damage to a condition equal to the pre-Contract conditions, as approved by the Contracting Officer, at the Contractor's expense.
1.17 BARRICADES AND WARNING SIGNS
Provide and maintain barricades, danger and warning signs, and suitable and efficient lights at all points of entry to the section or sections of roadway/parking areas to be closed to public travel during construction operations under the Contract. Furnish flagmen and watchmen to warn and direct traffic or to prevent travel on any portion of roadways during the periods in which operations under the Contract are performed as may be required to ensure safety and prevent accidents. Furnish facilities as prescribed by local highway authorities and subject to approval by the Contracting Officer. Separate payment will not be made for any costs incurred by the Contractor to comply with the provisions of this paragraph;
costs therefore will be considered as a subsidiary obligation of the Contractor and included in the Contract price for other Contract items as applicable.
1.18 UNDERGROUND UTILITY LINES
Prior to excavation, coordinate with the Contracting Officer to locate underground utility lines.
1.19 ELECTRICAL POWER LINES
Study the Contract drawings and site and know in detail all locations of power lines within the rights-of-way. Prior to performing any construction operation adjacent to power lines, provide appropriate danger signs where any equipment scheduled for use on the site is capable of contacting such lines. To confirm the location of underground lines, coordinate with the Contracting Officer. Either shut off aerial power lines and prevent the lines from being energized, or maintain clearances required by USACE EM 385-1-1 paragraph 11.F.04. Do not proceed working into dangerous areas without assigning additional Contractor employees to the crew to watch the movements of other personnel and equipment. Ensure that designated clearances are maintained.
1.20 AVAILABILITY AND USE OF UTILITY SERVICES
a. The Government will make available all reasonably required amounts of utilities available to the Contractor from existing outlets and supplies. Unless otherwise provided in the Contract, the amount of each utility service consumed must be charged to or paid for by the Contractor at prevailing rates charged to the Government or, where the utility is produced by the Government, at reasonable rates determined by the Contracting Officer. Carefully conserve Government-furnished utilities without incurring additional cost to the Government.

c. Annotate insurance certificates with the Contract name and number.
1.22 EQUIPMENT OWNERSHIP AND OPERATING EXPENSE SCHEDULE
a. This special Contract requirement does not apply to terminations. See EP 1110-1-8 and FAR Part 49.
b. Base allowable cost for construction and equipment in sound workable condition owned or controlled and furnished by a Contractor or subcontractor at any tier on actual cost data for each piece of equipment or groups of similar serial and series for which the Government can determine both ownership and operating costs from the Contractor's accounting records. When both ownership and operating costs cannot be determined for any piece of equipment or groups of similar serial or series equipment from the Contractor's accounting records, base costs for that equipment upon the applicable provisions of EP 1110-1-8, Region II. Consider working conditions to be average for determining equipment rates using the schedule unless specified otherwise by the Contracting Officer. For equipment not included in the schedule, rates for comparable pieces of equipment may be used or a rate may be developed using the formula provided in the schedule. For forward pricing, the schedule in effect at the time of negotiations applies. For retroactive pricing, the schedule in effect at the time the work was performed applies.
