SECTION II

SOLICITATION PROVISIONS

A. BASIS FOR AWARD

A single award will be made to the Offeror who provides a technically acceptable proposal with the overall lowest price.

Proposed prices will be evaluated but not scored or otherwise combined with the other aspects of the proposal evaluation.

B. FACTORS TO BE EVALUATED

In order for an Offeror to be considered for award, the proposal must receive an “Acceptable” rating in every non-price factor.

Factor 1: Technical: Certifications

Factor 2: Past Performance

Factor 3: Price

C. EVALUATION APPROACH

All proposals shall be subject to evaluation by the Source Selection Team (SST).

1. Factor 1: Technical:

The Government will evaluate the Technical Factor on an Acceptable/Unacceptable basis. This factor identifies the minimum requirements that are imperative to successful contract performance.

The Source Selection Team will evaluate the Offeror’s proposal against the factors listed below to determine whether the proposal is Acceptable or Unacceptable, using the ratings and descriptions outlined in Table A-1:

PROPOSAL THE GOVERNMENT WILL FILL-IN/COMPLETE THIS INFORMATION AT

THE

TIME OF AWARD AND/OR MODIFICATIONS. PLEASE SEE CLAUSE 52.211-8 FOR

MORE INFORMATION.

Certifications:

The Technical Factor shall include the following to be considered eligible for award:

The Offeror shall submit one (1) copy of the certifications listed below from the American Institute of Steel Construction (AISC) for all fabrication plants to be utilized for this project. The Offeror shall submit the currently held certification(s) as well as the past certifications to show certifications have been held continuously for the past five (5) years.

Intermediate Bridges certification with Supplemental Requirement F- Requirements for Fabricators of Bridges with Fracture-Critical Members

OR

Advanced Bridges certification with Supplemental Requirement F- Requirements for

AND

P3- Sophisticated Paint Endorsement –Outside

For proof that the certifications have been continuously held for the past five (5) years, bridge fabrication certifications since July 1, 2014 shall be the same certifications as listed above.

Bridge fabrication certifications prior to July 1, 2014 shall be:

Intermediate Bridges certification with Supplemental Requirement F- Requirements for

Advanced Bridges certification with Supplemental Requirement F- Requirements for

Major Steel Bridge CBR Certification with Fracture Critical Endorsement

Table A-1. Technical Acceptable/Unacceptable Ratings

Rating Description

ACCEPTABLE Proposal clearly meets the minimum requirements of the solicitation.

UNACCEPTABLE Proposal does not clearly meet the minimum requirements of the solicitation.

2. Factor 2: Past Performance:

The Government will evaluate the Past Performance portion on an Acceptable/Unacceptable basis utilizing the descriptions outlined in A-2. This factor identifies the minimum requirements that are key to successful contract performance. Offeror’s who are determined “Unacceptable” will not be eligible for award.

Table A-2. Past Performance Evaluation Ratings

Rating Description

ACCEPTABLE Based on the Offeror’s performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort, or the Offeror’s performance record is unknown.

UNACCEPTABLE Based on the Offeror’s performance record, the Government has no reasonable expectation that the Offeror will be able to successfully perform the required effort.

Note: In the case of an Offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the Offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305(a) (2) (iv)). Therefore, the Offeror shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered “Acceptable.”

Evaluations of past performance shall be in accordance with this plan while utilizing the Past Performance Questionnaires (PPQ) and forms in Appendix D, Enclosure 2. Offerors shall submit all Government and/or commercial contracts for the prime Offeror and each major subcontractor in performance or awarded during the past ten (10) years, from the issue date of this RFP, which are relevant to the efforts required by this solicitation. Data concerning the offeror shall be provided first, followed by each proposed major subcontractor, in alphabetical order. Past performance information shall be submitted as part of Volume II, “Past Performance,” of the proposal.

Offerors’ past performance is a measure of the degree to which an Offeror was successful on projects of similar scope, size, and complexity, as measured by the level of past customer satisfaction. It is also a measure of the degree to which an Offeror has complied with Federal, State, and local laws and regulations. The Government will evaluate the past performance information provided by Offerors, as well as information from other sources, such as Government databases.

The past performance evaluation results is an assessment of the offeror’s probability of meeting the past performance requirements stated within the solicitation. This assessment is based on the offeror’s record of relevant and recent past performance information that pertains to the current requirement. There are two aspects to this past performance evaluation. The first is to evaluate whether the offeror’s past performance is relevant or not relevant to the effort required. This will establish what is recent and what is relevant such as an offeror’s contract history that provides the most confidence to satisfy the current requirement. The second is to determine how well the contractor performed.

Recency refers to the state or quality of being current. The more recent the contract, the greater the likelihood that the offeror has the capacity to perform in a like manner. Information regarding contract performance that is recent and has a logical connection with the requirement under consideration indicates relevancy.

The Offeror shall submit up to five (5) PPQs for work performed since 2007. Contracts shall be at least six (6) months old to be considered. Contracts with expiration dates prior to 2007 shall not be considered. Offerors should follow-up with clients/references to ensure timely submittal of questionnaires. The forms shall identify if the contract is active or complete, the contract was for Government (federal, state, local, etc.) or commercial, if the offeror was the prime contractor, a teaming partner, and/or joint venture. If more than five (5) are submitted, only the five (5) most recent projects will be considered. The past performance reference must have been a client, or client representative, with whom the Offeror/subcontractor had a contract, or subcontract (if applicable) for one or more projects. Past performance references must hold, or have held at the time, a senior position in the client organization with responsibilities for either contract administration, quality control, engineering, or technical supervision, or was otherwise in a position to evaluate the Offeror or sub-contractor’s performance in executing the contract or subcontract. The past performance reference must have first-hand knowledge of the performance. In the event an Offeror submits fewer than five

(5) PPQs, the Offeror must certify that additional past performance information is not available and provide an acceptable explanation as to why.

o All submitted PPQs shall be for Hydraulic Steel Structure Fabricated Projects.

In addition to the above, the Government may review any other sources of information for evaluating past performance. Other sources may include, but are not limited to, Past Performance Questionnaires (PPQs) submitted on prior RFPs, past performance information retrieved through the Past Performance Information Retrieval System (PPIRS), including Contractor Performance Assessment Reporting System (CPARS), using all CAGE/DUNS numbers of entities (partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified in the Offeror's proposal, Federal Awardee Performance and Integrity Information

System (FAPIIS), Electronic Subcontract Reporting System (eSRS), and any other known sources not provided by the Offeror.

If the Offeror is employing a recognized team arrangement, Past Performance Information must be completed for each team member by submitting one or more projects (performed individually or as part of the same team).

The Government reserves the right to evaluate the past performance of any subcontractor identified in the Offeror’s proposal as part of its assessment of the acceptability of that Offeror’s proposal.

3. Factor 3: Price:

Offerors shall complete and submit the Schedule of Prices with its proposal and include a price for each line item. Failure to do so will result in the proposal being rejected without further consideration. Offerors will be allowed one proposal submission.

An award will be made to the lowest priced, technically acceptable proposal. The lowest price will be determined by adding up all listed line items. Failure to submit a price for any of the required line items on the Schedule of Prices will render the Offeror’s proposal as ineligible for award.

The Source Selection Evaluation Board will evaluate each Offeror’s price and verify that unbalanced pricing is not present and performance risks are minimal. The Contracting Officer will evaluate each Offeror’s price in accordance with FAR 15.404-1 to determine price reasonableness. Price reasonableness will be determined by comparing all proposed prices, the Independent Government Estimate, and pricing of previous work that is same or similar to the requirement.

D. PROPOSAL SUBMISSION:

The Offeror’s proposal may be submitted as digital copies (pdf), as set forth below, to the Contract Specialist, Benjamin Kimbell, benjamin.j.kimbell@usace.army.mil.

ADJECTIVE RATINGS AND DEFINITIONS TO BE USED TO BEST REFLECT YOUR

EVALUATION OF THE CONTRACTOR’S PERFORMANCE

Form PPQ -0

RATING DEFINITION NOTE

(E) Exceptional

Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with few minor problems for which corrective actions taken by the contractor was highly effective.

An Exceptional rating is appropriate when the Contractor successfully performed multiple significant events that were of benefit to the Government/Owner. A singular benefit, however, could be of such magnitude that it alone constitutes an Exceptional rating. Also, there should have been NO significant weaknesses identified.

(VG) Very Good

Performance meets contractual requirements and exceeds some to the Government’s/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with some minor problems for which corrective actions taken by the contractor were effective.

A Very Good rating is appropriate when the Contractor successfully performed a significant event that was a benefit to the Government/Owner. There should have been no significant weaknesses identified.

(S) Satisfactory

Performance meets minimum contractual requirements. The contractual performance of the element or sub-element contains some minor problems for which corrective actions taken by the contractor appear or were satisfactory.

A Satisfactory rating is appropriate when there were only minor problems, or major problems that the contractor recovered from without impact to the contract. There should have been NO significant weaknesses identified. Per DOD policy, a fundamental principle of assigning ratings is that contractors will not be assessed a rating lower than Satisfactory solely for not performing beyond the requirements of the contract.

(M) Marginal

Performance does not meet some contractual requirements. The contractual performance of the element or sub-element being assessed reflects a serious problem for which the contractor has not yet identified corrective actions. The contractor's proposed actions appear only marginally effective or were not fully implemented.

A Marginal is appropriate when a significant event occurred that the contractor had trouble overcoming which impacted the Government/Owner.

(U) Unsatisfactory

Performance does not meet most contractual requirements and recovery is not likely in a timely manner. The contractual performance of the element or sub-element contains serious problem(s) for which the contractor's corrective actions appear or were ineffective.

An Unsatisfactory rating is appropriate when multiple significant events occurred that the contractor had trouble overcoming and which impacted the Government/Owner. A singular problem, however, could be of such serious magnitude that it alone constitutes an unsatisfactory rating.

52.246-2 INSPECTION OF SUPPLIES--FIXED-PRICE (AUG 1996)

(a) Definition. "Supplies," as used in this clause, includes but is not limited to raw materials, components, intermediate assemblies, end products, and lots of supplies.

(b) The Contractor shall provide and maintain an inspection system acceptable to the Government covering supplies under this contract and shall tender to the Government for acceptance only supplies that have been inspected in accordance with the inspection system and have been found by the Contractor to be in conformity with contract requirements. As part of the system, the Contractor shall prepare records evidencing all inspections made under the system and the outcome. These records shall be kept complete and made available to the Government during contract performance and for as long afterwards as the contract requires. The Government may perform reviews and evaluations as reasonably necessary to ascertain compliance with this paragraph. These reviews and evaluations shall be conducted in a manner that will not unduly delay the contract work. The right of review, whether exercised or not, does not relieve the Contractor of the obligations under the contract.

(c) The Government has the right to inspect and test all supplies called for by the contract, to the extent practicable, at all places and times, including the period of manufacture, and in any event before acceptance. The Government shall perform inspections and tests in a manner that will not unduly delay the work. The Government assumes no contractual obligation to perform any inspection and test for the benefit of the Contractor unless specifically set forth elsewhere in this contract.

(d) If the Government performs inspection or test on the premises of the Contractor or a subcontractor, the Contractor shall furnish, and shall require subcontractors to furnish, at no increase in contract price, all reasonable facilities and assistance for the safe and convenient performance of these duties. Except as otherwise provided in the contract, the Government shall bear the expense of Government inspections or tests made at other than the Contractor's or subcontractor's premises; provided, that in case of rejection, the Government shall not be liable for any reduction in the value of inspection or test samples.

(e)(1) When supplies are not ready at the time specified by the Contractor for inspection or test, the Contracting Officer may charge to the Contractor the additional cost of inspection or test.

(2) The Contracting Officer may also charge the Contractor for any additional cost of inspection or test when prior rejection makes reinspection or retest necessary.

(f) The Government has the right either to reject or to require correction of nonconforming supplies. Supplies are nonconforming when they are defective in material or workmanship or are otherwise not in conformity with contract requirements. The Government may reject nonconforming supplies with or without disposition instructions.

(g) The Contractor shall remove supplies rejected or required to be corrected. However, the Contracting Officer may require or permit correction in place, promptly after notice, by and at the expense of the Contractor. The Contractor shall not tender for acceptance corrected or rejected supplies without disclosing the former rejection or requirement for correction, and, when required, shall disclose the corrective action taken.

(h) If the Contractor fails to promptly remove, replace, or correct rejected supplies that are required to be removed or to be replaced or corrected, the Government may either (1) by contract or otherwise, remove, replace, or correct the supplies and charge the cost to the Contractor or (2) terminate the contract for default. Unless the Contractor corrects or replaces the supplies within the delivery schedule, the Contracting Officer may require their delivery and make an equitable price reduction. Failure to agree to a price reduction shall be a dispute.

(i)(1) If this contract provides for the performance of Government quality assurance at source, and if requested by the Government, the Contractor shall furnish advance notification of the time (i) when Contractor inspection or tests will be performed in accordance with the terms and conditions of the contract and (ii) when the supplies will be ready for Government inspection.

(2) The Government's request shall specify the period and method of the advance notification and the Government representative to whom it shall be furnished. Requests shall not require more than 2 workdays of advance notification if the Government representative is in residence in the Contractor's plant, nor more than 7 workdays in other instances.

(j) The Government shall accept or reject supplies as promptly as practicable after delivery, unless otherwise provided in the contract. Government failure to inspect and accept or reject the supplies shall not relieve the Contractor from responsibility, nor impose liability on the Government, for nonconforming supplies.

(k) Inspections and tests by the Government do not relieve the Contractor of responsibility for defects or other failures to meet contract requirements discovered before acceptance. Acceptance shall be conclusive, except for latent defects, fraud, gross mistakes amounting to fraud, or as otherwise provided in the contract.

(l) If acceptance is not conclusive for any of the reasons in paragraph (k) hereof, the Government, in addition to any other rights and remedies provided by law, or under other provisions of this contract, shall have the right to require the Contractor (1) at no increase in contract price, to correct or replace the defective or nonconforming supplies at the original point of delivery or at the Contractor's plant at the Contracting Officer's election, and in accordance with a reasonable delivery schedule as may be agreed upon between the Contractor and the Contracting Officer;

provided, that the Contracting Officer may require a reduction in contract price if the Contractor fails to meet such delivery schedule, or (2) within a reasonable time after receipt by the Contractor of notice of defects or nonconformance, to repay such portion of the contract as is equitable under the circumstances if the Contracting Officer elects not to require correction or replacement. When supplies are returned to the Contractor, the Contractor shall bear the transportation cost from the original point of delivery to the Contractor's plant and return to the original point when that point is not the Contractor's plant. If the Contractor fails to perform or act as required in (1) or (2) above and does not cure such failure within a period of 10 days (or such longer period as the Contracting Officer may authorize in writing) after receipt of notice from the Contracting Officer specifying such failure, the Government shall have the right by contract or otherwise to replace or correct such supplies and charge to the Contractor the cost occasioned the Government thereby.

(a) Definitions.

As used in this clause--

New means composed of previously unused components, whether manufactured from virgin material, recovered material in the form of raw material, or materials and by-products generated from, and reused within, an original manufacturing process; provided that the supplies meet contract requirements, including but not limited to, performance, reliability, and life expectancy.

Reconditioned means restored to the original normal operating condition by readjustments and material replacement.

Recovered material means waste materials and by-products recovered or diverted from solid waste, but the term does not include those materials and by-products generated from, and commonly reused within, an original manufacturing process.

Remanufactured means factory rebuilt to original specifications.

Virgin material means--

(1) Previously unused raw material, including previously unused copper, aluminum, lead, zinc, iron, other metal or metal ore; or

(2) Any undeveloped resource that is, or with new technology will become, a source of raw materials.

(b) Unless this contract otherwise requires virgin material or supplies composed of or manufactured from virgin material, the Contractor shall provide supplies that are new, reconditioned, or remanufactured, as defined in this clause.

(c) A proposal to provide unused former Government surplus property shall include a complete description of the material, the quantity, the name of the Government agency from which acquired, and the date of acquisition.

(d) A proposal to provide used, reconditioned, or remanufactured supplies shall include a detailed description of such supplies and shall be submitted to the Contracting Officer for approval.

52.211-8 TIME OF DELIVERY (JUN 1997)

(a) The Government requires delivery to be made according to the following schedule:

The contract base CLIN performance period is 940 days.

Option A and B may be awarded within 365 days of award.

Option C and D may be awarded within 730 days of the award.

Each awarded Option (A B C D) extend the contract by 210 days.

The Government will evaluate equally, as regards time of delivery, offers that propose delivery of each quantity within the applicable delivery period specified above. Offers that propose delivery that will not clearly fall within the applicable required delivery period specified above, will be considered nonresponsive and rejected. The Government reserves the right to award under either the required delivery schedule or the proposed delivery schedule, when an offeror offers an earlier delivery schedule than required above. If the offeror proposes no other delivery schedule, the required delivery schedule above will apply.

OFFEROR'S PROPOSED DELIVERY SCHEDULE

Within Days

After Date

Item No. Quantity of Contract

(b) Attention is directed to the Contract Award provision of the solicitation that provides that a written award or acceptance of offer mailed, or otherwise furnished to the successful offeror, results in a binding contract. The Government will mail or otherwise furnish to the offeror an award or notice of award not later than the day award is dated. Therefore, the offeror should compute the time available for performance beginning with the actual date of award, rather than the date the written notice of award is received from the Contracting Officer through the ordinary mails. However, the Government will evaluate an offer that proposes delivery based on the Contractor's date of receipt of the contract or notice of award by adding (1) five calendar days for delivery of the award through the ordinary mails, or (2) one working day if the solicitation states that the contract or notice of award will be transmitted electronically. (The term "working day" excludes weekends and U.S. Federal holidays.) If, as so computed, the offered delivery date is later than the required delivery date, the offer will be considered nonresponsive and rejected.

The Government shall not be liable for any delivery, storage, demurrage, accessorial, or other charges involved before the actual delivery (or "constructive placement" as defined in carrier tariffs) of the supplies to the destination, unless such charges are caused by an act or order of the Government acting in its contractual capacity. If rail carrier is used, supplies shall be delivered to the specified unloading platform of the consignee. If motor carrier (including "piggyback") is used, supplies shall be delivered to truck tailgate at the unloading platform of the consignee, except when the supplies delivered meet the requirements of Item 568 of the National Motor Freight Classification for "heavy or bulky freight." When supplies meeting the requirements of the referenced Item 568 are delivered, unloading (including movement to the tailgate) shall be performed by the consignee, with assistance from the truck driver, if requested. If the contractor uses rail carrier or freight forwarded for less than carload shipments, the contractor shall ensure that the carrier will furnish tailgate delivery, when required, if transfer to truck is required to complete delivery to consignee.

(ii) In the absence of specifications, prepare the shipment in conformance with carrier requirements;

(2) Prepare and distribute commercial bills of lading;

The Contractor shall perform such details as if fully and correctly set forth and described in the drawings and specifications.

(e) The work shall conform to the specifications and the contract drawings as listed on drawing sheet with title

“INDEX OF DRAWINGS.”
