About this file

This document is a Brand Name Justification for a Firm Fixed Price contract to procure an ABB SF6 Breaker Overhaul Kit for the McNary Lock and Dam's generator circuit breakers. The McNary Dam has 14 generator circuit breakers that require an overhaul every 15 years, and the parts in the ABB overhaul kit are essential and not interchangeable with other brands. The justification cites the potential for catastrophic failure and significant financial loss if the overhaul is not completed using the OEM parts. The requirement will be solicited as a small business set-aside on SAM.gov, with the goal of obtaining a fair and reasonable price through competition. The solicitation number is W912EF24Q0033, and the work will be funded by FY24 operation and maintenance funds.

SINGLE BRAND DETERMINATION

Far Subpart 13.106-1(b)

1. CONTRACTING AGENCY: US Army Corps of Engineers (USACE), Walla Walla District, McNary Lock and Dam Project, 82925 Devore Road, Umatilla, OR 97882.

2. DESCRIPTION OF THE ACTION: This action is for a new Firm Fixed Price (FFP) contract to purchase ABB SF6 Breaker Overhaul Kit (1) for generator circuit breakers. This action meets the definition of a commercial item as defined in FAR 2.101. This action will be funded by FY24

McNary O&M funds.

3. DESCRIPTION OF THE SERVICES/SUPPLIES: This action is for a Brand Name requirement for procurement of McNary Lock and Dam’s ABB SF6 15 Year Rebuild Kit for use with ABB SF6 HGI-3 Vertical Generator Circuit Breakers.

FY24 O&M funds will be used for this procurement (HYDRO).

4. AUTHORITY CITED:

FAR 13.106-1 (b) Soliciting from a single source. (1) For purchases not exceeding the simplified acquisition threshold, contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).

FAR 11.105(a)(1), Items Particular to One Manufacturer. The particular brand name, product, or feature is essential to the Government ' s requirements, and market research indicates other companies ' similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency' s needs.

5. REASON FOR AUTHORITY CITED:

A. BACKGROUND: McNary Dam currently has fourteen (14), 80 Megawatt Generators in the

Powerhouse. Each generator has a Generator Circuit Breaker (GCB). These breakers are the operating devices between the generating units and the step-up transformers. Our GCBs, installed in 2003 and 2004, are SF6 gas filled breakers known locally as the XJ breakers. This XJ SF6 breaker requires an overhaul every 15-years. The parts listed above are required to complete the 15-year overhaul. The purchase of a brand name overhaul kit is necessary because our XJ SF6 breakers and controls are ABB and only ABB Overhaul Kits will work in these controllers. If these kits are not used to complete the 15-year overhaul, the breakers will just operate until failure. Failure could be both structurally and/or financially catastrophic and could potentially cost the Government in to replace/repair the entire SF6 circuit breaker, the breaker enclosure, and the Iso-

Phase bus. The current GCB has been obsolete from the manufacturer for over 10 years and

McNary does not currently have an operational spare. It would take several months to get funding, research new equipment, get the equipment approved, then have it built and installed at our location. Potential loss could cost the .

The cost of the overhaul kit and other listed parts combined is far less than the financial loss to just one damaged GCB.

B. JUSTIFICATION: Based on market research, the ABB SF6 breaker parts are not interchangeable with other brand products and are essential to the Government’s requirements.

Market research indicates other companies’ similar products, do not meet, or cannot be modified to meet, the agency’s needs. It is not possible to add other brands to this ABB XJ SF6 breaker, the equipment must be OEM equipment.

C. IMPACT: If these bushings and pins are not used to complete the 15-year overhaul, the breakers will just operate until failure. Failure could be both structurally and/or financially catastrophic and could potentially cost the Government in to replace/repair the entire SF6 circuit breaker, the breaker enclosure, and the Iso-Phase bus. It would take several months to get funding, research new equipment, get the equipment approved, then have it built and installed at our location. Potential loss could cost the

. The cost of bushings and pins is far less than the financial loss to just one damaged GCB.

D. ALTERNATIVES: The Government is unable to purchase brands that are equal to the requested brand due to the incompatibility issues with ABB Inc., GCB equipment.

6. DETERMINATION OF FAIR AND REASONABLE COSTS: The market for ABB SF6 overhaul kits is mature. Price competition should result in a fair and reasonable price. However, no contract will be made unless prices may be determined fair and reasonable.

7. EFFORTS TO OBTAIN COMPETITION: Since the District’s Blanket Purchase Agreement

(BPA) for Electrical Commodities is no longer an option, this requirement will be solicited on

SAM.gov as a small business set aside.

8. MARKET RESEARCH: Market Research shows ABB brand name products are the only identified products compatible with the existing generator circuit breakers. There is no alternative available with an equivalent product. Market Research demonstrates this action is best solicited as a small business set aside on SAM.gov in order to foster adequate competition amongst Small Business.

Technical Certification: I certify that the supporting data under my cognizance, which are included in the justification are accurate and complete to the best of my knowledge and belief.

DETERMINATION: In accordance with the authority of 10 U.S.C. 2304(c)(1), as implemented by FAR 13.106-1(b) and based upon the foregoing, I hereby determine that a brand name procurement is authorized and is in the best interest of the Government.
