About this file
This document is a justification for a brand name determination on a federal contract opportunity for replacement starter units and breakers for existing motor control centers at Ice Harbor Lock and Dam. The U.S. Army Corps of Engineers, Walla Walla District is seeking to award a firm fixed price contract to purchase new 480V breakers and buckets from Eaton, as Eaton is the only manufacturer that offers rotary handles compatible with the original equipment installed by Hatch, Inc. Replacement of failing or inadequately sized equipment in the motor control centers is necessary to maintain reliability of power supply to generator auxiliary systems and other critical powerhouse equipment. Retrofitting with non-Eaton components was considered but deemed unfeasible due to lack of compatible rotary handles to fit the existing Hatch buckets.

BRAND NAME DETERMINATION
FAR 13.106-1(b) and FAR 11.105(a)(1)
1. CONTRACTING AGENCY: U.S. Army Corps of Engineers, (USACE), Walla Walla District (CENWW-
CT), 201 North 3rd, Walla Walla, WA 99362.
2. DESCRIPTION OF THE ACTION: This action is for a new Firm Fixed Price (FFP) contract to purchase new buckets and breakers to replace failing or inadequately sized equipment in existing Motor Control Centers (MCCs) for generating unit 5 at Ice Harbor. This action meets the definition of a commercial item as defined in FAR 2.101. The type of funds to be used are Small Cap funds.
3. DESCRIPTION OF THE SERVICES/SUPPLIES: This action is for the procurement of complete 480V
MCC breakers and buckets having the salient characteristics indicated in the Bid Item List uploaded in the PCF Cabinet. All items must be purchased from the same manufacturer and multiple quantity items must be purchased at the same time.
The estimated total value of this action is below the simplified acquisition threshold (SAT).
4. AUTHORITY CITED:
FAR 13.106-1 (b) Soliciting from a single source. (1) For purchases not exceeding the simplified acquisition threshold, contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).
FAR 11.105(a)(1), Items Particular to One Manufacturer. The particular brand name, product, or feature is essential to the Government's requirements, and market research indicates other companies' similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency's needs.
5. REASON FOR AUTHORITY CITED:
A. JUSTIFICATION:
The original Hatch, Inc. 480V MCCs for generating unit 5 were installed when Ice Harbor Lock and Dam was built. These MCCs consist of starter and feeder units (buckets) which supply power to generator auxiliary systems and other Powerhouse equipment. Hatch, Inc. is no longer in business and replacement/retrofit buckets are not available. Eaton is the only manufacturer that offers rotary handles that fit the Hatch bucket doors and Eaton breakers are the only breakers that work with the existing and new rotary handles.
B. IMPACT:
Ice Harbor Project requests approval for a brand name contract to purchase replacement starter units and breakers with rotary handles for our existing Hatch MCCs. The equipment fed by these buckets are mission critical.
. Generators cannot be out of service for extended periods of time. Also, the old breakers may not trip if a high short circuit current is encountered during an arc flash event causing damage to other equipment and creating a safety hazard for personnel working on equipment.
C. ALTERNATIVES:
Retrofitting existing buckets with components from other manufacturers was considered. However, rotary handles which fit a Hatch, Inc. bucket could not be located from a manufacturer other than Eaton. Eaton is the only manufacturer of breakers that work with this type of handle and fits in the existing location of the old breaker.
