PERFORMANCE WORK STATEMENT
GENERAL INFORMATION: This BASE YEAR + FOUR OPTION YEARS Service Contract provides Herbicide application services for various locations within the USACE Lucky Peak Dam & Lake boundary located in Ada, Boise and Elmore Counties, ID. The Contractor shall be responsible for all costs related to performing this contract and its successful completion.
WORK TO BE PERFORMED: The Contractor shall provide all personnel, equipment, tools, materials, supervision, and other items and services necessary to maintain the specified areas in a vegetation or weed free condition as defined in this performance work statement (PWS), unless specified otherwise, at Lucky Peak Dam and Lake. The Contractor shall perform to the standards in this contract. The estimated quantities of work are listed in the SPECIFIC TASKS section.
CONTRACT MANAGER: The Contractor shall provide a Contract Manager who shall be responsible for the performance of the work. The name of this person, and an alternate or alternates, who shall act for the Contractor when the manager is absent, shall be designated in writing to the Contracting Officer.
a. The Contract Manager or alternate(s) shall have full authority to act for the Contractor on all contract matters relating to daily operation of this contract.
b. The Contract Manager or alternate(s) shall be available during normal duty hours within 4 hours to discuss problem areas.
c. The Contract Manager and alternate(s) shall be able to read, write, speak, and understand English.
CONTRACTOR EMPLOYEES: The Contractor shall not employ persons for work on this contract if such employees are considered by the Contracting Officer to be a potential threat to the health, safety, security, general well-being, or operational mission.
a. The Contractor’s personnel shall present a neat appearance and be easily recognized as contractor employees.
b. The Contractor shall make sure employees have current and valid professional certifications necessary before starting work under this contract. Commercial driver’s licenses are required as determined by state and local regulations.
c. The Contractor shall not employ any person who is an employee of the U.S. Government if employing that person would create a conflict of interest.
CONTRACTOR QUALITY CONTROL PROGRAM: The Quality Control Program is the means by which the Contractor assures himself and the Contracting Officer’s Representative (COR) that adequate inspections of work performance are being conducted so that all work meets contract specifications. The Contractor’s Quality Control Program shall be established and maintained for all services included in the contract and shall include the surveillance required to meet all contract specifications regarding schedule compliance, proper equipment, materials, and work performance. The Contractor shall be responsible for controlling work quality through an effective quality control program involving management, training, and sufficient inspections of all work items to insure compliance with all contract requirements. QUALITY ASSURANCE: For tasks listed on the PRS (Technical Exhibit 1), the COR will follow the methods or surveillance specified in this contract. Government personnel will record all surveillance observations. When an observation indicated defective performance, the COR will require the Contract Manager or representative at the site to initial the observation. The initialing of the observation does not necessarily constitute concurrence with the observation, only acknowledgement that he or she has been made aware of the defective performance. Any action taken by the Contracting Officer as a result of surveillance will be in accordance with the terms of this contract.
a. The contractors quality control plan shall be submitted to the COR for approval prior to the start of work and shall include:
i. A description of the monitoring strategy and include frequency and location of inspections
ii. A description of the methods to be used for identifying and preventing defects in the quality of service performed
iii. A description of the records to be kept to document inspections and corrective or preventive actions taken
HOURS OF OPERATION: The normal business hours of the project office are 0730-1600 Monday thru Friday, excluding all federal holidays. Work on evenings, nights, weekends, is not allowed, unless authorized in advance by the COR. If scheduled work and public events within the recreation areas occur on the same day, the COR may request that the contractor reschedule work to avoid potential conflicts with the public.
WORK NOTIFICATION: The contractor shall notify the COR of all planned work activities a minimum of 1 business day prior to the work being completed. In addition the contractor must check in at the beginning of the work day at the Lucky Peak Lake Administrative Office before beginning each work day unless other arrangements have been made when notifying the COR.
USE OF WATER: Access to water for mixing of herbicides is available at the project office during normal business hours. The contractor shall coordinate with the COR to gain access to water. The contractor shall maintain an air gap when fill to prevent contamination of the source water. Any mixing of herbicides shall be in compliance with the IPMP.
PHYSICAL SECURITY: The Contractor shall be responsible for safeguarding all government property provided for contractor use. At the end of each work period, all government property, equipment and materials shall be secured.
a. The Contractor shall establish and implement methods of making sure all keys issued to the contractor are not lost or misplaced and are not used by unauthorized persons. The Contractor shall not duplicate any keys issued by the Government.
b. The Contractor shall immediately report to the COR any occurrences of lost or duplicated keys.
c. In the event keys, other than master keys, are lost or duplicated, the Contractor may be required, upon written direction from the Contracting Officer, to rekey or replace the affected lock or locks without cost to the Government. The Government may, however, at its option, replace the affected lock or locks or perform rekeying and deduct the cost of such from the monthly payment due the Contractor. If a master key is lost or duplicated, all locks and keys for that system will be replaced by the Government and the total cost deducted from the monthly payment due the Contractor.
d. The Contractor shall control access to all government provided lock combinations to preclude unauthorized entry.
PRE-SCREEN CANIDATES USING E-VERIFY: The Contractor must pre-screen Candidates using the E-verify Program (http://www.uscis.gov/e-verify) website to meet the established employment eligibility requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to enrollment to ensure the correct information is entered into the E-verify system. An initial list of verified/eligible Candidates must be provided to the COR no later than 3 business days after the initial contract award.
SPECIFIC TASKS: The Contractor shall provide herbicide services for both bare-ground and noxious weed treatments at various locations around Lucky Peak Dam and Lake including several boat-in accessible only areas. Bare-ground areas are predefined areas around the lake where the contractor shall maintain those areas in a weed free condition during the Base year performance period of April thru September and the Option year performance periods of April thru September. Noxious weed treatments could occur at any area around the lake and cannot be predetermined. The Contractor shall provide sufficient quality control checks throughout the performance period to document conditions are taken care of areas not meeting specifications. The Contractor shall comply with all applicable Federal, State, and Local laws pertaining to herbicide applications in addition to the requirements outlined in the Corps of Engineers Integrated Pest Management Program (IPMP).

| AB. | Asphalt area crack treatment. Maintain all cracks, curbs, and any areas where weeds can grow. Asphalt conditions vary and there is not an estimate of the linear length of cracks. The area of the asphalt areas is provided to give an approximate size of the area, but is not the total area being maintained, only treat cracks not the entire area. | AE. | Dam surface spot treatment. One time treatment of any weeds growing on the downstream rock surface of the dam. There are currently several areas of weeds growing on the dam. The estimated area is for the total possible treatment area however treatment will be limited to spot treatment of visible weeds. See attached table and maps for locations. | ||

| AF. | Noxious weed treatments. Target species are all listed noxious weed species listed by the state of Idaho. The contractor will identify areas of noxious weeds that would benefit from herbicide treatments. A work plan shall be submitted to the COR for approval detailing the target species, types and quantities of herbicides expected to be used and an estimate of the number of man hours expected to be used per treatment area. | ||

AG. Lawn – Broadleaf areas. Maintain lawn areas in a weed free condition. Target species are all weeds commonly found in lawns in the Boise area. Due to proximity to water, portions of lawn areas at Robie Creek may only be able to be spot sprayed, and a smaller area of lawn may require aquatically labeled herbicides.

INTEGRATEDE PEST MANAGEMENT PLAN: The IPMP provides implementation instructions for herbicide activities on federally administered lands at Lucky Peak. These instructions outline chemical control methods and record keeping for managing vegetation on federal lands. The requirements set forth in this document are in addition to all other applicable laws, rules, and regulations.
MAPS AND ACERAGE ESTIMATE TABLE: A detailed list map of all defined areas to treat weeds is available electronically using Google Earth. A KMZ file will be provided as the basis of treatment areas and buffer zones from the water. Printed maps are a responsibility of the contractor. The KMZ file corresponds to the table of treatment areas using the Map ID column. Area estimates were calculated using Google Earth using either a polygon measuring tool in the case of road shoulders a line length times the desired width, see the table for specific widths.
HERBICIDE APPLIATOR LICENCE: All herbicide applications shall be performed by licensed applicators in accordance with the IPMP. Prior to the start of work, copies of any applicable herbicide applicators shall be submitted.
BOAT OPERATORS: Any boat operators shall be required to complete a safe boating course approved by the Idaho Department of Parks and Recreation. Information on these courses can be obtained at http://parksandrecreation.idaho.gov/activities/boating. Copies of certificates shall be submitted prior to any on-water work.
ACTIVITY HAZARD ANALYSIS: The Contractor shall submit an Activity Hazard Analysis on all phases of the work to be performed prior to the start of service. A sample format can found in EM 385-1-1 via web link at http://www.usace.army.mil/Safety-and-Occupational-Health/Activity-Hazard-Analysis/.
INSURANCE: A submittal showing a certificate of liability insurance shall be submitted to the Park Manager prior to the commencement of work.
PEST CONTROL APPLICATION RECORD: All applications of herbicide shall be reported using the attached Pest Control Application Record within 7 days of application. Any issues regarding the form or its submission can be directed to the COR. Instructions for completing the form are contained in the IPMP instructions. The most current IPMP and application record forms can be found at http://www.nww.usace.army.mil/Missions/Projects/Pest-Management/.
SAFETY EXPOSURE REPORT: The Contractor shall submit a Safety Exposure Report to the Park Manager with each invoice documenting work-hours accrued, work-related injuries, illnesses and fatalities sustained by Contractor employees while providing services at Lucky Peak Dam & Lake over the invoice period. Failure to submit a Safety Exposure Report with the invoice will delay payment for services performed.
SAFETY AND HEALTH CODES: The Contractor will comply with all pertinent provisions of the Corps of Engineers Manual, EM 38511, Safety and Health Requirement Manual, the Idaho State Health Code, OSHA, and Ada, Boise and Elmore County Codes.
UNSAFE CONDITIONS: Work will be halted by the Contracting Officer or his representative if an unsafe condition exists or will develop if work continues. The Contractor will have no basis for compensation should such a work stoppage cost the Contractor damages. Work will not resume until the condition is corrected.
PUBLIC NOTIFICATION: Signs shall be placed at the access points to all areas during herbicide applications. Signs shall be removed after the herbicide mixture is dry. Signs need not be specific other than to notify the public entering the area that herbicides are currently being applied. If an herbicide requires the application area to be closed during application the contractor shall coordinate with the COR prior to scheduling the work.
