PERFORMANCE WORK STATEMENT
DWORSHAK HELICOPTER FOR WINTER WILDLIFE SURVEY
Part 1 – General Information
1. General: This is a non-personal services contract to provide helicopter with pilot service at U.S. Army Corps of Engineers, Dworshak Dam and Reservoir, Ahsahka, Idaho (Dworshak Project). The Government will not exercise any supervision or control over Contractor employees performing the services herein. Such Contract employees shall be accountable solely to the Contractor, who in turn is responsible to the Government.
1.1 Background:
1.1.1 The National Mid-winter Bald Eagle Survey is conducted annually all across the United States within a select timeframe to minimize duplicate observations. Dworshak Project has been participating in the survey as part of its fish and wildlife mission for over 20 years and will continue this effort in the foreseeable future.
1.1.2 The survey at Dworshak Reservoir consists of trained personnel counting and identifying to age groups all eagles observed during a flight over the Dworshak Reservoir and its tributaries.
1.1.3 Subsequent to dam installation, the Dworshak Project is charged with mitigating elk habitat loss along the North Fork Clearwater River. Recent (winter 2022) surveys across the Dworshak Zone indicate elk population estimates are approximately 25% and 66% below the lowest population objective threshold for cows and bulls, respectively.
1.1.4 To address elk mitigation requirements, the Grandad Elk Mitigation Area was established. This area is made up of approximately 6,900 contiguous acres at the confluence of the North Forth and Little North Fork of the Clearwater Rivers.
1.1.5 An aerial survey for wintering big game, particularly elk, use on Dworshak Project has not been undertaken to-date and is needed to evaluate Dworshak’s historic and current mitigation efforts. These data will be shared with Idaho Department of Fish and Game to collaboratively develop holistic approaches to identify and evaluate elk population needs and appropriate management actions.
1.2 Objectives: The objective of this contract is to provide safe and effective aerial surveillance of wintering wildlife, including bald eagles and elk.
1.3 Scope: The Contractor shall provide a DoD Approved Rotary Wing Air Carrier (helicopter) and pilot to transport up to three passengers over Dworshak Reservoir for the purpose of conducting a winter wildlife survey.
The primary survey objectives will be to conduct the annual mid-winter bald eagle survey, as well as document location, number, and composition of wintering elk. Other wildlife species use will be documented when encountered. Both surveys can occur simultaneously. The flight, from takeoff at Dworshak Dam or Orofino municipal airport with Government personnel aboard to landing in the same location at Dworshak Dam, will be not more than seven hours.
1.4 General Information:
1.4.1 Period of Performance. The period of performance for the contract shall be as follows:
Base Period Award through December 31, 2023 Option 1 January 1, 2024, through December 31, 2024 Option 2 January 1, 2025, through December 31, 2025 Option 3 January 1, 2026, through December 31, 2026 Option 4 January 1, 2027, through January 31, 2027
The target date for these wildlife surveys will reflect the National Mid-winter Bald Eagle Survey protocol.
This survey is generally the second Friday of January each year (see paragraph 2.2 for details). The Government may deobligate any excess funds at any time following payment of the Contractor’s invoice each year.
1.4.2 Place of Performance. The work will be performed at Dworshak Reservoir, on Dworshak Project and adjacent land ownerships.
1.4.2.1 The bald eagle survey will cover the entire Reservoir up to the normal high-water mark in all tributaries, except for the main stem North Fork Clearwater River, which will include surveying through to Thompson Creek.
1.4.2.2 The elk survey will occur on all Dworshak Project lands, with a primary emphasis on the Grandad Elk Mitigation Area. To evaluate known elk home ranges during the winter (15 square miles).
The elk survey may extend up to 15 miles off Project lands, including adjacent land ownerships, depending on flight time and fuel availability during the survey.
1.4.3 Contractor Personnel. The Contractor shall provide a DoD Approved helicopter and pilot.
1.5 Safety Requirements:
1.5.1 Safety Standards. The Contractor shall comply with all applicable OSHA and FAA safety requirements, as well as the requirements of the latest version of the U.S. Army Corps of Engineers Safety and Health Requirements Manual, EM 385-1-1, Section 32B. A PDF version of EM 385-1-1 may be accessed at:
http://www.publications.usace.army.mil/Portals/76/Publications/EngineerManuals/EM_385-1-1.pdf.
1.5.2 Accident Prevention Plan (APP). The contractor must develop and submit an APP. The APP must include the minimum requirements described in EM 385-1-1, Appendix A, Minimum basic Outline for an
APP.
1.5.3 Activity Hazard Analysis. The Contractor shall prepare an Activity Hazard Analysis (AHA) that meets the standard of EM 385-1-1, Section 01.A.14, for the work to be performed under this contract. The AHA shall address the hazards for the activities to be performed and present mitigation actions to reduce or eliminate the hazard. A template containing all required elements will be provided to the Contractor upon request.
1.5.4 Accident Reporting. The Contractor shall notify the COR immediately of damage to Government or private property and injury to any person resulting from Contractor operations. In the event that an accident or injury should occur on Government lands, the Contractor shall first notify the appropriate local emergency service organization and then the COR.
1.5.5 Safety Equipment. The Contractor should, at a minimum, supply noise cancelling communication headsets for each Government passenger.
1.6 Security Requirements:
1.6.1 General security requirements and guidance. The security requirements described below apply to all contract personnel (including employees of the prime Contractor (“Contractor”) and all subcontractor employees) supporting the performance requirements of this contract. The Contractor is responsible for compliance with these security requirements. Questions regarding security matters shall be addressed to the designated Government representative (e.g., Contracting Officer Representative (COR), Requiring Activity (RA) representative, or Contracting Officer (if a COR or other RA representative is not appointed)). Contract personnel are critical to the overall security and safety of US Army Corps of Engineers (USACE)installations, facilities and activities, and security awareness training contributes to those efforts. The Department of Defense (DoD) and Army security training requirements specified below, if applicable, are performance requirements; all applicable contract personnel shall complete initial training within 30 days of contract award or the date new contract personnel begin performance on the contract. Within five business days from the completion of training, the Contractor shall provide written documentation (e.g., email or memorandum) to the Government representative. The documentation shall include the names of contract personnel trained and which training they completed; the Contractor shall maintain training records as part of their contract files and be prepared to provide copies of training certificates to the Government representative. Contractor personnel and vehicles are subject to search when entering federal installations. Additionally, all contract personnel shall comply with Force Protection Condition (FPCON) measures, Random Antiterrorism Measures (commonly referred to as “RAMs”), and Health Protection Condition (HPCON) measures. The Contractor is responsible for meeting performance requirements during elevated FPCON and/or HPCON levels in accordance with applicable RA plans and procedures --this includes identifying mission essential and non-mission essential personnel. In addition to the changes otherwise authorized by the changes clause of this contract, should the FPCON or HPCON levels at any individual facility or installation change, the Government may implement security changes that affect contract personnel. The Contractor shall ensure all contract personnel are aware of their security responsibilities, including any site-specific requirements identified in local policies or procedures.
1.6.2 Physical security and access control requirements: All contract personnel requiring physical access to a federal installation or facility shall comply with the access control procedures of that location. Contract personnel requiring unescorted access to meet contract performance requirements on a DoD installation in the US shall be vetted by the installation/facility Provost Marshal/Directorate of Emergency Services/Security Office using the National Crime Information Center-Interstate Identification Index (commonly referred to as “NCIC-III”) and Terrorist Screening Database (commonly referred to as “TSDB”). Contract personnel shall comply with all personal identity verification requirements specified in installation/facility policies and procedures. Contract personnel who do not meet requirements for unescorted access to USACE facilities shall coordinate escorted access with the Government representative, as needed. Contract personnel who receive keys, access cards, or lock combinations that provide access to government-owned property shall comply with key and lock control procedures of the RA.
1.6.3 Pre‐screen candidates using E‐Verify Program. The Contractor must pre-screen Candidates using the E-verify Program (http://www.uscis.gov/e-verify) website to meet the established employment eligibility requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to enrollment to ensure the correct information is entered into the E-verify system. An initial list of verified/eligible Candidates must be provided to the COR no later than January 5th after the initial contract award.
Part 2 – Specific Tasks – Dworshak Winter Wildlife Flight: Mid-winter Bald Eagle and Elk Use and Composition Aerial Survey
2.1 Helicopter and Pilot: The Contractor shall provide a DoD-Approved helicopter and pilot to safely transport the pilot and up to three passengers over Dworshak Reservoir for a survey flight of not more than four hours.
2.2 Scheduling:
2.2.1 Flight Date: The target date of performance for the Base Period is Friday, January 13, 2023. In subsequent years, the target date will generally be the second Friday each January. The Government will notify the Contractor of the official target date as soon as possible after it is published each year (normally before December 15). The piloted helicopter must be available on this day each year.
2.2.2 Rescheduling: If circumstances occur that prevent the flight on target date and time (generally due to poor weather conditions), the Contractor must also be able to adjust its schedule within the month of January to accommodate an alternate date and time. In this case, the Contractor will coordinate with the Contracting Officer’s Representative (COR) to ensure availability of Contractor and Government personnel.
2.2.3 Pickup/Drop: The Contractor shall coordinate with the Government to pickup and drop off Government passengers at either the Orofino municipal airport or the Dworshak Project helipad.
2.2.4 Flight Time: The Government’s intent is to begin the survey at first light. The Contractor shall coordinate with the Government to meet this intent, weather permitting.
2.3 Safety Briefing: The Contractor’s pilot shall provide a pre-flight safety briefing for passengers that, at a minimum, includes explanation of communications equipment, requirements for passenger PPE, and emergency procedures.
