BRAND NAME DETERMINATION
Far Subpart 13.106-1(b)
1. CONTRACTING AGENCY: U.S. Army Corps of Engineers, (USACE), Walla Walla District, 201 N Third Avenue, Walla Walla, WA 99362-1876.
2. DESCRIPTION OF THE ACTION: This action is for a new firm-fixed price, commercial brand name requirement for the procurement of Allen-Bradley PLC equipment and components for Lower Granite Lock and Dam, Pomeroy, WA.
3. DESCRIPTION OF THE SERVICES/SUPPLIES: The US Army Corps of Engineers, Lower Granite Dam has a requirement for specific part numbers of Allen-Bradley brand equipment as direct replacement of existing equipment on the Juvenile Bypass System (JBS) as spare warehouse stock.
4. AUTHORITY CITED: 10 U.S.C. 2304 (c)(1) and Far 13.106-1(b) Soliciting from a single source. For purchases not exceeding the simplified acquisition threshold, contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonable available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).

5. REASON FOR AUTHORITY CITED:
a. BACKGROUND: Lower Granite currently has existing Allen-Bradley PLCs, HMIs, and other associated components installed at various locations throughout the system. Timely in-kind replacement of any failed components is important to minimize downtime and maintain reliable operation.
b. JUSTIFICATION: Lower Allen-Bradley equipment to monitor, control and operate this important juvenile fish transportation system. By the very nature of electronic technology, as time goes by the equipment becomes difficult to replace and can become long-lead items and therefore requires warehouse stock to be on-hand for continued reliable operation of the JBS.
This requirement cannot be met by any other manufacturer due to both hardware and software incompatibility issues.
c. IMPACT:
Lower Granite. If the JBS experiences an outage due to failure of parts or components, the
, the Endangered Species Act (ESA) listed fish, will be negatively impacted. The JBS supports the Endangered Species Act (ESA) regulations and is Lower Granite would fail in this mission.

6. EFFORTS TO OBTAIN COMPETITION: See item 8.
7. DETERMINATION OF FAIR AND REASONABLE COSTS: The market for Allen- Bradley equipment is mature and competitive among other manufacturers of similar equipment.
Therefore, price competition should result in a fair and reasonable price; however, determination of fair and reasonable cost will be determined at time of award.
