This acquisition is being competed in as a 100% Small Business Set-Aside.

This is a requirement to procure one (1) –Cantilever Manbasket for the U.S. Army Corps of Engineers, for use at Lower Monumental Dam.

This solicitation will result in a firm-fixed price award.

Instructions to Offerors:

Offerors are cautioned to clearly print prices for all line items. Be especially careful placing decimal points, as a mistake. Your quote must be good for 30 days. Please include shipping costs in the quoted price of each item.

Registration at www.sam.gov is required. If not registered, please do so. Step-by-step help information on how to register is detailed on the website, along with frequently asked questions (FAQs). Lack of registration in the SAM database may make an offeror ineligible for award.

Completion of the required FAR 52.212-3 Alt. I, Offeror Representations and Certifications – Commercial Items is required. When you complete your SAM registration, the link to complete your Reps and Certs is also available.

ADDENDUM TO FAR 52.212-1 INSTRUCTIONS TO OFFERORS – COMMERCIAL ITEMS

Submission of Price Quote – Contractor shall submit the following in 1 copy:

1. Signed and dated Standard Form 1449 (Solicitation/Contract/Order for Commercial Items)

2. Signed and dated Standard Form 30, if applicable, for any Amendments to the Solicitation

3. Completed schedule (pricing information) for all contract line item numbers

4. Completed Clause 52.212-3 and Alt I, “Offeror Representations and Certifications—Commercial Items” as noted above.

5. Any information required to evaluate the quote, as stated in FAR Clause 52.212-2.

BASIS FOR AWARD

The Government will award one contract resulting from this solicitation in accordance with FAR 13.106 to the responsible offeror meeting or exceeding all solicitation requirements based on price.

Bidder Inquiry:

All inquiries regarding this solicitation are to be submitted via Bidder Inquiry. Telephone and email inquiries will not be accepted. Bidder Inquiry is a web-site that allows bidders to post questions regarding the solicitation and view all questions by other bidders and responses by USACE. Bidder Inquiry can be accessed through ProjNet at (https://www.projnet.org)

To submit and review inquiry items, prospective vendors will need to use the Bidder Inquiry Key presented below and follow the instructions listed below the key for access. A prospective vendor who submits a comment /question will receive an acknowledgement of their comment/question via email. Another email to the same address will notify the prospective vendor once the reply is available for viewing.

The Government will make every effort to answer all bidder inquiries; however, the closer to the bid or proposal due date an inquiry is received, the less likely it is that a timely response can be provided.

STATEMENT OF WORK

TECHNICAL SPECIFICATIONS

LOWER MONUMENTAL LOCK AND DAM

CANTILEVER MANBASKET FOR NAVLOCK TAINTER VALVES

1.0 INTENT

The following specifications pertain to the purchase of one (1) cantilever manbasket for use at Lower Monumental Lock & Dam.

2.0 SCOPE

The successful bidder shall be required to deliver the manbasket and PE stamped drawings to Lower Monumental Dam by the date shown in Section 8.0 Shipment and Delivery.

3.0 CANTILEVER MANBASKET REQUIREMENTS

The cantilever manbasket shall be a Lifting Technologies model CW3-1000SWA “Or Approved Equal” (See Section 4.0 Submittals). The manbasket shall be designed and built in full compliance with OSHA 29 CFR Part 1926.1431, WAC 296-24-23533, WAC 296-155-54800, and ASME B30.23 requirements. The following is a list of salient features which are met by the above mentioned model and shall be required for any “Or Approved Equal” bids.

3.1. A complete turn-key system used to suspend personnel into hard-to-reach work areas.

3.2. Includes a detachable test weight (1250 lbs.) which evenly distributes test load over the platform frame and floor by means of easy-on/easy-off pins.

3.3. Platform built of 0.145” wall, 1.900” O.D. steel pipe, smoothed prior to painting.

3.4. Rated for 3 personnel, or 1000 lbs. max load.

3.5. Maximum empty weight of 3500 lbs. for complete assembly other than test weight.

3.6. Total platform outer dimensions: 30” width x 96” length x 42” guardrail height

3.7. Cantilever area outer dimensions: 30” width x 48” length x 42” height

3.8. Counterweight area (under slings) dimensions: 30” outer width x 48” outer length with overhead protection allowing for 79” of head room.

3.9. Includes bolt on counterweights at end and below sling area.

3.10. All sides enclosed with perforated steel plate from toe board to mid rail.

3.11. Includes a four-leg sling assembly with turnbuckles (dedicated for personnel hoisting only), of ½” 6 X 36

IWRC wire rope, secured to a master link and attached to platform with swage sockets and clevis pins. Cables protected by included nylon covers. Sling assembly also includes a 1/2” fifth leg for tie-off to loadline above overhaul ball (WA style).

3.12. Includes a guardrail system at 42” height complies with OSHA 29 CFR Part 1926.502, Subpart M.

3.13. Includes an inner grab rail installed inside entire perimeter of platform. Inner grab rail provides fall arrest anchorage that complies with OSHA 29 CFR Part 1926.502, Subpart M.

3.14. Access gate with grease zerks on hinges, opens inward only, with positive restraining device.

3.15. Floor has rubber mat over 19-W-4 bar grating, to comply with ASME B30.23.

3.16. Platform supported by W6X15 wide flange beam main frame.

3.17. Corrosion-resistant data plates stating weight of platform and its rated capacity.

3.18. Platform and suspension system designed by a qualified person competent in structural design and approved by a licensed Professional Engineer.

3.19. Platform fabricated using AWS certified welding procedures.

3.20. Apply zinc-enriched powder coat primer for added protection.

3.21. Electrostatic powder coat finish, in safety yellow and black, which provides high resistance to impact, abrasion, chemicals, and corrosion.

4.0 SUBMITTALS

The vendor shall provide cut sheets with dimensions, drawings, performance data, etc. with the proposal for the Government to review for technical acceptability. All proposal information will be sent with your quote to the Contracting Officer. Proposal shall be of sufficient detail to show conformance to the specifications. Failure to provide acceptable proof of conformance or failure to meet the requirement of the specifications may result in disqualification.

5.0 WARRANTY

The manbasket shall be covered by a minimum three-year warranty on all parts, labor, and workmanship from factory defects.

6.0 DRAWINGS

The contractor shall supply a complete set of As-Built drawings for the manbasket assembly. The drawings shall be delivered electronically on either a DVD, CD, or via email. Each drawing shall be delivered in PDF format for permanent record purposes. The PDF drawings shall be stamped by a registered professional engineer. Each drawing shall also be delivered in the native file type used to create it. If possible, Bentley, AutoDesk, or SolidWorks are the preferred software for the native file types, but any CADD file type will be accepted.

7.0 OPERATION AND MAINTENANCE MANUALS

Three complete paper copies and one electronic copy of the Operation and Maintenance Manual will be required for the manbasket. The manual shall include instructions on the operation, maintenance, repair, troubleshooting, warranty, and a list of recommended spare parts. They shall also include a copy of the As-Built drawings. Any product information pertaining to models or components not supplied under this contract shall be crossed out.

Also included shall be the name, phone and fax numbers, and email address of the contractor, manufacturer, and a distributor where spare parts can be purchased.

8.0 SHIPMENT AND DELIVERY

All items shall be delivered FOB to Lower Monumental Dam within 10 weeks of contract award. The contractor shall be responsible for packing and shipping the components in a manner that will ensure undamaged and complete arrival. No shipments are allowed other than normal business hours of Monday-Thursday 7:30AM-4PM, excluding federal holidays.

(a) Definitions. Inverted domestic corporation and subsidiary have the meaning given in the clause of this contract entitled Prohibition on Contracting with Inverted Domestic Corporations (52.209-10).

FELONY CONVICTION UNDER ANY FEDERAL LAW (FEB 2016)

(a) As required by sections 744 and 745 of Division E of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L. 113-235), and similar provisions, if contained in subsequent appropriations acts, the Government will not enter into a contract with any corporation that--

(1) Has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, where the awarding agency is aware of the unpaid tax liability, unless an agency has considered suspension or debarment of the corporation and made a determination that suspension or debarment is not necessary to protect the interests of the Government; or

(2) Was convicted of a felony criminal violation under any Federal law within the preceding 24 months, where the awarding agency is aware of the conviction, unless an agency has considered suspension or debarment of the corporation and made a determination that this action is not necessary to protect the interests of the Government.

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (OCT 2018)

ALTERNATE I (OCT 2014)

The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (u)) of this provision.

(a) Definitions. As used in this provision--

“Economically disadvantaged women-owned small business (EDWOSB) concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.

“Forced or indentured child labor” means all work or service—

(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or

(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.

“Highest-level owner” means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.

“Immediate owner” means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.

“Inverted domestic corporation,” means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).

“Manufactured end product” means any end product in product and service codes (PSCs) 1000-9999, except—

(1) PSC 5510, Lumber and Related Basic Wood Materials;

(2) Product or Service Group (PSG) 87, Agricultural Supplies;

(3) PSG 88, Live Animals;

(4) PSG 89, Subsistence;

(5) PSC 9410, Crude Grades of Plant Materials;

(6) PSC 9430, Miscellaneous Crude Animal Products, Inedible;

(7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products;

(8) PSC 9610, Ores;

(9) PSC 9620, Minerals, Natural and Synthetic; and

(10) PSC 9630, Additive Metal Materials.

“Place of manufacture” means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.

“Restricted business operations” means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—

(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;

(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;

(3) Consist of providing goods or services to marginalized populations of Sudan;

(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;

(5) Consist of providing goods or services that are used only to promote health or education; or

(6) Have been voluntarily suspended.

“Sensitive technology”—

(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically—

(i) To restrict the free flow of unbiased information in Iran; or

(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and

(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)).

“Service-disabled veteran-owned small business concern”—

(1) Means a small business concern—

(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and

(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.

(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).

“Small business concern” means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and size standards in this solicitation.

“Small disadvantaged business concern, consistent with 13 CFR 124.1002,” means a small business concern under the size standard applicable to the acquisition, that--

(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by--

(i) One or more socially disadvantaged (as defined at 13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States; and

(ii) Each individual claiming economic disadvantage has a net worth not exceeding $750,000 after taking into account the applicable exclusions set forth at 13 CFR 124.104(c)(2); and

(2) The management and daily business operations of which are controlled (as defined at 13.CFR 124.106) by individuals, who meet the criteria in paragraphs (1)(i) and (ii) of this definition.

“Subsidiary” means an entity in which more than 50 percent of the entity is owned—

(1) Directly by a parent corporation; or

(2) Through another subsidiary of a parent corporation.

“Veteran-owned small business concern” means a small business concern—

(1) Not less than 51 percent of which is owned by one or more veterans(as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and

(2) The management and daily business operations of which are controlled by one or more veterans.

“Women-owned business concern” means a concern which is at least 51 percent owned by one or more women; or in the case of any publicly owned business, at least 51 percent of the its stock is owned by one or more women; and whose management and daily business operations are controlled by one or more women.

“Women-owned small business concern” means a small business concern --

(1) That is at least 51 percent owned by one or more women or, in the case of any publicly owned business, at least 51 percent of the stock of which is owned by one or more women; and

(2) Whose management and daily business operations are controlled by one or more women.

“Women-owned small business (WOSB) concern eligible under the WOSB Program (in accordance with 13 CFR part 127),” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States.

(A) The taxpayer has received a statutory notice of deficiency, under I.R.C. §6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability.
