INSTRUCTIONS TO OFFERORS
This requirement is to provide Tow Boat Services for the US Army Corps of Engineers, Walla Walla District.
Registration at www.sam.gov is required. If not registered, please do so. Step-by-step help information on how to register is detailed on the website, along with frequently asked questions (FAQs). Lack of registration in the SAM database will make an offeror ineligible for award. Also completion of the FAR 52.212-3, Offeror Representations and Certifications – Commercial Items is required and can be completed on the SAM website. Please contact the SAM website if you need assistance or have questions.
In accordance with FAR Part 29.3, State and Local Taxes, and per Title 4 of the US Code 104-107, the Government is exempt from paying local and state taxes. Exempt Tax Identification Number 91-0828090.
PROPOSAL SUBMISSION
Format
1. Pages containing text shall be consecutively numbered, single spaced, typewritten or typeset in 12-point or larger type, single sided, on 8 ½” x 11” paper with margins of at least one inch on all sides. Proposals shall not be permanently bound, in order to facilitate incorporation of the proposal into the final contract document. The proposal shall be submitted in two separate volumes, one containing the Technical information and the other containing the Price information. All information shall be confined to the appropriate volume. In order to reduce size, confine the volumes to recent and relevant information and documentation sufficient to provide an adequate basis for evaluation.
2. It is the offeror’s responsibility to insure that the proposal is complete prior to submittal. The evaluation panel for the Government may evaluate solely on the information provided in the proposal and will not assume that an offeror possesses any capability unless specified in the proposal
3. In order that evaluation may be accomplished on the merit of the material submitted, no dollar values are to be included in Volume I (Technical Proposal). The proposal shall not merely offer to perform the work in accordance with, or simply repeat, the statement of work, but shall reflect an understanding of the work environment, contract requirements, technical approaches, principles, and techniques. Repeating or restating the specifications without sufficient elaboration shall not be acceptable.
Volume I: Technical
The technical volume shall be submitted as a separate PDF document and include the following sections:
1. Technical Capabilities – Required documents listed under evaluation factors
2. Past Performance (Complete Attachment 3 and 4)

EVALUATION FACTORS
BASIS FOR CONTRACT AWARD: The award will be made based on the best overall proposal that is determined to be the most beneficial to the Government, with appropriate consideration given to the four evaluation factors. The Government will award a contract to the responsible Offeror whose offer conforms to the solicitation and is expected to result from selection of the technically acceptable proposal with the lowest evaluated price. To be technically acceptable, an Offeror must submit a proposal that clearly meets the minimum requirements of the solicitation.
The Government intends to award a contract without discussions with respective offers. The Government, however, reserves the right to conduct discussions if deemed in its best interest.
FACTORS AND SUB-FACTORS TO BE EVALUATED
Factor 1: Technical Expertise
Technical factors are to be rated on an acceptable or unacceptable rating. Proposals are to identify resources (equipment and personnel) sufficient to accomplish the tasks of performing towboat service to transport Government-owned barges for Walla Walla District, Corps of Engineers.
Subfactor A – Technical Capability: Identify staffing resources, including positions and experience that you have to dedicate toward performing this contract.
Subfactor B – Inventory of Equipment: Provide inventory and description of equipment that you have to dedicate toward performing this contract.
Subfactor C – Required Certifications and Licenses: Provide evidence that you have all required licenses (business license, coast guard vessel certificates, and registration numbers, etc.) required to perform under this contract.
Factor 2: Quality Control
Submission of the Quality Control Plan.
Quality Control Plan Submittal – Plan is complete and fully describes all personnel responsibilities for quality control, supervision, reporting, and correction of deficiencies.

A minimum satisfactory rating (Acceptable/ Unacceptable basis) will be made by references to the above subfactors on similar scope contracts in the previous five years. A rating of acceptable will be based on the offeror’s performance record; the Government has a reasonable expectation that the offeror will successfully perform the required services under this contract.
Past Performance subfactors are rated on the basis of returned Contractor Past Performance Questionnaire from previous customers. Past Performance Questionnaires shall address projects that are similar in size, scope, and complexity of contract and ratings to demonstrate a high level of performance.
In order to receive an “Acceptable” rating in Factor 3: Past Performance, to include all three subfactors, the contractor shall receive a minimum rating of “Acceptable” in the subfactors from the returned Past Performance Questionnaires. A rating of “Unacceptable” in any subfactor will cause the entire factor to be rated “Unacceptable”.
An Offeror without a record of relevant past performance or for whom information on past performance is not available; the offeror may not be evaluated favorably or unfavorably on past performance and will receive an “Acceptable” rating.
Past Performance Evaluation Ratings
Rating Description
Acceptable Based on the offeror’s performance record (for previous 5 years), the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.
Unacceptable Based on the offeror’s performance record (for previous 5 years), the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.
Factor 4: Price
Offeror(s) shall provide a complete price proposal to include a complete price schedule. Offers will be evaluated for completeness and reasonableness. The objective is to determine if the overall price offered is fair and reasonable. To be complete, the Offeror must provide all data that is requested and necessary to evaluate the prices. The Government will assess the extent to which the proposed prices comply with the content and format requirements set forth in this solicitation.
The Offeror’s proposal is evaluated through price analysis techniques described in FAR Subpart 15.305(a)(1).
For a price to be reasonable, it must represent a price that provides best value to the Government when consideration is given to prices in the market, technical and functional capabilities of the Offeror. The Offeror’s proposed price will be evaluated to determine if any are unreasonably high or low in relation to the anticipated work under the contract.
Award will be made on the basis of the Lowest Price Technically Acceptable (LPTA) offer.
PERFORMANCE WORK STATEMENT
This contract is a firm fixed price for rental of four towboats with staff to transport Government-owned fish barges in support of the Juvenile Fish Transport Program. The contract term is for a base year and one option year.
1. SAFETY REQUIREMENTS. The towboats, barges, and any other equipment provided by the Contractor shall meet all safety requirements of Coast Guard Regulations, OSHA, and the latest updated version of the Corps of Engineers' Safety and Health Requirements Manual (EM 385-1-1, 30 November 2014). Updates to the Corps’ safety manual are posted at the following website:

The Contractor shall have all towboats inspected by a marine surveyor or marine architect prior to beginning work on this contract. The marine surveyor/architect will determine seaworthiness, capability of meeting contract requirements, and that towboats provided are safe to operate under weather, wind, and flow conditions prevalent on the Columbia and Snake rivers during the contract period.
Towboats or other equipment which do not pass the safety inspections must be modified to meet the requirements before commencing service, or replaced with equipment that meets the requirements. Complete inspection reports shall be provided to and approved by the Contracting Officer’s Representative prior to the use of any towboat on this contract. See the attached INSPECTION CHECKLIST for power, propulsion, propeller, stability, and other requirements.
2. LOCATION AND EXTENT OF WORK. Work will be performed on the Snake and Columbia rivers in the area between Lower Granite Reservoir (near Lewiston, ID) and Portland, OR. The Contractor shall provide equipment and perform services for the following operations:
2.1. JUVENILE FISH BARGE TRANSPORT PROGRAM - The Contractor shall provide four towboats, each staffed with crews for 24-hour per day operation, to transport Government-owned fish barges from Lower Granite Juvenile Fish Facility to fish release areas below Bonneville Dam (see map - Attachment). Stops will be made at Little Goose and Lower Monumental dams to load additional fish or to pick up an additional fish barge for transport to the release site. The initiation of barging operations is based on runoff and fish outmigration projections. During years when runoff is forecasted to be near or above normal or average runoff, barging of fish could begin as late as May 2. During low flow or drought years, barging of fish may begin as early as 21 April. Transporting of fish by barge from Snake River dams will therefore begin sometime between April 21 and May 2, as directed by the Contracting Officer or Contracting Officer’s Representative, and should last through August 14 or 15, but could end earlier depending on fish collection numbers. Unlike past contracts, no provisions are included for the transport of fish from McNary Dam.
Early in the season, Towboat 1 (Item numbers 0001, 1001,) and Towboat 2 (Item numbers 0002, 1002) will alternate, leaving Lower Granite Dam every-other-day for the trip downriver. As fish numbers increase, Towboat 3 (Item numbers 0003, 1003) and Towboat 4 (Item numbers 0004, 1004) will be placed in service so that a towboat and barge leave Lower Granite Dam daily. Later, when numbers of fish decrease, the program will return to the every-other-day operation. Since every-other-day or daily barge operations begin April 21 or later at Snake River dams, the Corps may direct Towboat 1 (Item numbers 0006, 1006) to barge fish once a week from Lower Granite Dam in support of fish research. The weekly transport of research fish may begin as early as April 4 and will cease at the direction of the Corps or when every-other-day or daily barge operations are in progress. During part or all of the daily Snake River fish barging operation, the Government will be direct-loading fish barges at Little Goose Dam.
The Contractor will routinely transport a loaded fish barge from Lower Granite Dam, stop and pick up a loaded fish barge at Little Goose Dam, and then continue on the trip downstream to the release site. On return trips back to Lower Granite Dam, one of the empty barges will be left at Little Goose Dam. Direct loading of fish at Little Goose Dam may also take place during part of the every-other-day barging operation. Barging may continue until approximately mid-August when fish numbers decline to where trucks will be used for their transport.
3. TOWBOAT REQUIREMENTS.
3.1. TOWBOAT INSPECTIONS. As stated in paragraph 1 above, the Contractor is responsible for having a marine surveyor or marine architect inspect all towboats considered for use under this contract, including all towboats that may be used as spare towboats. The marine surveyor/architect shall complete the inspection checklist for each towboat and shall certify that each boat proposed for use under this contract satisfies all requirements of this contract including stability, horsepower, propulsion, and other requirements. All towboats or other equipment which do not pass the safety inspections must be modified to meet the requirements. Towboats that do not meet the requirements of this contract may not be used by the Contractor for work performed under this contract. Certified inspections shall be provided to the Contracting Officer’s Representative by March 29 of the first contract work (base) year. The Contractor must complete all modifications to towboats to correct deficiencies noted in inspections and provide written notice of those modifications to the Contracting Officer’s Representative prior to towboats going into service under this contract. Inspection reports and correction of deficiencies must be approved by the Contracting Officer’s Representative prior to the use of any towboat on this contract. Certified inspections for each towboat may be resubmitted in subsequent option years under this contract. However, if a vessel has been modified, repowered, or have been involved in an accident or incident resulting in damage to the towboat since the initial certification, then another inspection and recertification will be required. Re-inspection results and re-certification documentation must be provided to and reviewed by the Contracting Officer’s Representative prior to the vessel returning to service.
3.2. BARGE PUSHING REQUIREMENTS. For work under paragraph 2.1 above, each towboat provided shall have a minimum total of 1,350 shaft horsepower, be equipped with at least two engines and two propellers, have watertight hatches on main decks, and meet or exceed requirements on the attached Inspection Checklist. Each towboat shall be capable of routinely moving two to four fully loaded Government owned fish-hauling barges, in any combination of sizes, downstream simultaneously as well as moving up to four empty barges upstream. Other combinations of up to four barges may be moved to and from moorage spaces or to and from dams within the contract area as requested by the Contracting Officer’s Representative.
3.3. FISH BARGE TRANSPORT. For work under paragraph 2.1 above, the towboats shall be capable of maintaining a round trip time from Lower Granite Dam to the release site below Bonneville Dam (Skamania Light/Warrendale area) and back with fish barges not to exceed 79 hours total time. This 79 hour turnaround time shall include 3 hours loading time at Little Goose Dam and 3 hours at Lower Monumental Dam.
Deducting loading time allows 73 hours to progress downstream through seven reservoirs and seven navigation locks to the release site below Bonneville Dam, unload fish, and to return back upstream to Lower Granite Dam.
Fish releases will be made at dusk or after sunset in order to minimize exposure to avian predation. In addition to total turn-around time, the contractor must complete the downstream run from Lower Granite Dam to Little Goose Dam in 5 hours or less and from Little Goose Dam to Lower Monumental Dam in 4 hours or less. The Contractor must consider the fact that substantial river flows, high flow velocities, inclement weather, and strong winds can be anticipated during the contract period. Any delays caused by flow or weather conditions are to be reported immediately to the Contracting Officer's Representative or their designee the barge rider. Lock operators at all Corps dams in the contract area will be notified that fish-hauling barges shall receive first priority when using the various navigation locks. Lockage, fueling, and crew replacement times are to be considered in the 79 hour transit time.
Towboat captains are to request priority lockage on all fish-hauling trips. Any delays in movement of towboats and fish barges caused by the Government will not be charged to the 79-hour turn-around time. Partial trips may be necessary when transiting to Lower Granite Dam from the contractor home point of origin when beginning service ("Deadhead" or not in tow), transitioning to home point of origin upon completion of service ("Deadhead" when not in tow), or when directed to move or transfer barges to a designated moorage location before going out of service. If the duration of the operation is less than 40 hours, then the government shall be invoiced at half the rate of a single trip. If the operation takes 40 hours or more to complete, then the government may be billed for a single trip. The government shall not be invoiced for partial trips resulting from contractor negligence or equipment failure or for circumstances beyond government control such as inclement weather. A partial trip may also result from special purpose barge movement for repairs or for a special run to return barges to Lower Granite Dam.
3.4. REPLACEMENT TOWBOATS. In the event that the Contractor's towboats are not meeting the maximum turn-around times, the Government reserves the right to require the Contractor to provide alternate towboat(s) that meet the minimum requirements specified in this contract. If the Contractor cannot supply satisfactory replacement towboat(s), the Government reserves the right to supply a replacement and deduct the cost from moneys due to the Contractor.
3.5. TOWBOAT LIVING ACCOMMODATIONS. Under paragraph 2.1, each towboat shall have fully equipped sleeping, cooking, and dining facilities adequate to house a full operating crew and one assigned representative of the Government (barge rider). Towboats shall be equipped with both hot and cold potable water for showering, washing hands in restrooms, cooking, drinking, and washing dishes. The Government representative (barge rider) shall have a private stateroom or bunk room to ensure privacy. The Contractor shall also be responsible for providing all meals for the Government representatives (barge riders) on the towboats. It is acceptable to add temporary living space for the Government representative provided that the living space is secure from weather and elements, securely fastened to the deck, heated and air-conditioned, and not exposed to any more noise and fumes than would be encountered in the boat's normal crew quarters. Research or news media personnel may accompany some transport trips however, they would not require overnight accommodations because they would be onboard for less than a day.
3.6. COMMUNICATIONS EQUIPMENT. Towboats shall be equipped with adequate communications equipment, including cellular telephones, to ensure contact with the Government representative onboard, navigation locks, and emergency services at all points along the river in the contract area.
3.7. ELECTRICAL AND COMPRESSED AIR REQUIREMENTS FOR TOWBOATS. Towboats are required to supply 120 volt AC power to the barges for running navigation lights, cabin lights, and engine alarms. All towboats must have correct wiring (polarity) as indicated by checking with an approved circuit tester made by a company such as Hubbell, Ideal, or Leviton. Towboats shall provide compressed air to the barges on an as needed basis if required for operating the fish hold opening mechanisms.
4. COMMENCEMENT, PROSECUTION, AND COMPLETION.
4.1. COMMENCEMENT. This contract shall become effective on the date of award and shall continue in full force and effect to and including August 15 of the contract year, unless otherwise provided. Commencement and effective term of the contract shall be the same for any option year if the Government elects to exercise that option.
4.2. PROSECUTION. The Contracting Officer’s Representative shall give the Contractor not less than 3 days (72 hours) notice to provide Towboat 1 at Lower Granite Dam, or other location as specified by the Contracting Officer’s Representative, for the beginning of the juvenile fish transportation program or research operations (Item numbers 0001, 0006, 1001 and 1006). Once the operation has started, additional towboats (Item numbers 0002, 0003, 0004, 1002, 1003 and 1004) shall be provided at Lower Granite Dam within 2 days (48 hours) after notification by the Contracting Officer’s Representative. Deadhead rates as specified in paragraph 6.6 shall be paid for the travel of towboats to where they will connect to Government-owned fish barges.
4.3. COMPLETION. Primary towboat services (Item numbers 0001, 0002, 0003, 0004, 0006, 1001, 1002, 1003, 1004 and 1006) shall be paid at rates shown from the time and date the Contractor's towboat connects to a Government-owned fish barge. Service shall cease when the barge(s) are returned from the fish transportation operation to location(s) specified by the Contracting Officer’s Representative. Demobilized barges shall be returned to Lower Granite Lock and Dam or to other sites as specified by the Contracting Officer’s Representative arriving between 0800 hours and 1300 hours Monday through Thursday to ensure sufficient project staff are available to coordinate end of the season moorage. When barges are returned to Lower Granite Dam, they shall be moored at the project mooring facility, fully fueled, in the orientation and position specified by project personnel. Deadhead rates as specified in paragraph 6.5 shall be paid for the return of towboats to home ports.
5. BARGES.
5.1. FISH BARGES. The Government owns eight barges that will be used for transporting fish during the course of this contract. Two of the barges (SOCKEYE barge number 2127 and BLUEBACK barge number 2817) have a fish carrying capacity of 23,000 pounds and are double bottom three-compartment steel barges, approximately 130 feet long, 30 feet wide, with three diesel-driven pumps and attendant equipment. They weigh approximately 165 tons empty. Two barges (STEELHEAD barge number 4382 and COHO barge number 4394) have a fish carrying capacity of 50,000 pounds and are four-compartment steel barges, approximately 150 feet long, 35 feet wide, with three diesel-driven pumps, and weigh approximately 250 tons empty. The other four barges (CHINOOK barge number 8105, KING SALMON barge number 8106, and barges 8107 and 8108) each have a fish carrying capacity of 75,000 pounds and are six-compartment steel barges, approximately 196 feet long, 40 feet wide, with four diesel-driven pumps, and weigh approximately 450 tons empty. All of the barges draft approximately 2 feet when empty and 5 feet when loaded. Pushing knees have been installed on the bow and sterns of all barges to facilitate hooking barges together. The Contractor shall provide pushing protection on the towboat(s) to prevent any damage to the barge(s) while being pushed. The Contractor will be required to provide protection to structural members inside the barge(s) if necessary. The Government furnished fish barges are supplied with wire rope on winches and mooring ropes (poly) for lashing barges to each other or to the towboat.
5.2. BARGE ACCESS. Any required walkways or handrails from the towboat(s) to barge(s) shall be furnished and installed by the Contractor. This shall include adequate provisions at the crossover point between the towboats and barges to afford safe passage for the Government barge rider. Safe access to the barge is needed at all hours of the day or night and under all weather conditions. The Contractor may be required to provide assistance such as having a crew member present during crossovers by the Government barge rider.
5.3. BARGE OPERATION. The Contractor shall provide a mechanic or deckhand to assist the Government representative on board the barge(s) in operation and maintenance of the barge engines and/or pumps, if requested.
This shall include starting up and shutting down the diesel pump engines, minor lubrication, and any maintenance of the pump engines, shafts, and machinery on the barges during fish transport and the return trip upriver. The towboat operators shall assist the Government representative on board the barge(s) in monitoring the engines, gages, alarm systems, and subsequent notification of the towboat(s) mechanics in the event abnormal conditions are displayed. If mechanical problems with barge engines and/or pumps are beyond the Contractor's immediate capabilities, the Contracting Officer's Representative shall be notified. Cost of mechanical services incurred by the Contractor shall be included in Item numbers 0001, 0002, 0003, 0004, 0006, 1001, 1002, 1003, 1004 and 1006.
5.4 BARGE FUELING. The Contractor shall provide all diesel fuel for operation of the diesel-engine driven pumps on the Government-owned fish barges. The Contractor shall refuel towboats and barges on the return trips from the release site back to Lower Granite Dam. In April, May and June, the barges shall be refueled on each return trip or on an alternate schedule if it is approved by the Contracting Officer’s Representative. In subsequent months (July and August), barges shall be filled every other trip or on an alternate schedule provided to and approved by the Contracting Officer’s Representative. All barges shall be completely refueled (“topped off”) on the return trip to Lower Granite Dam when being taken out of service for the season (as required under section 4.3 COMPLETION).
The 23,000 pound capacity barges have a fuel holding capacity of 500 gallons, the 50,000 pound capacity barges have a fuel holding capacity of 750 gallons, and the 75,000 pound capacity barges have a fuel holding capacity of 1,650 gallons. After refueling a barge, the Contractor shall inform the Government representative on board the towboat of the number of gallons of diesel fuel added to each fish barge. Cost of fuel and fueling service incurred by the Contractor shall be included in Item numbers 0005 and 1005.
6. PAYMENTS.
6.1. INVOICES. The Contractor shall submit itemized invoices to the addresses shown below. The invoices shall show the number by type of trip and by each towboat made, the number of gallons of diesel fuel added to each fish barge daily, separate line items for each CLIN. In addition, copies of fuel invoices for fueling the barges will be included with the itemized invoices. Invoices should cover the towboat cost and fish barge fuel for the same periods of time. The original and copies of all invoices shall be provided to:

6.2. RATES. Services of the towboat(s) Contractor furnished barge and moorage be included in Item numbers 0001, 0002, 0003, 0004, 0006, 1001, 1002, 1003, 1004 and 1006.
6.3. BREAKDOWN. No payment will be made for a towboat idled by breakdown of Contractor's equipment when the breakdown exceeds 12 hours. If a towboat breakdown exceeds 12 hours the Contractor shall replace the disabled towboat with a towboat meeting minimum contract requirements. The replacement towboat shall meet all safety and performance requirements of the original towboats (the Contractor may want to have one or more extra towboats certified at the beginning of the contract). In the event the Contractor cannot supply a replacement towboat for the disabled towboat, the Government will replace the disabled towboat with a similar towboat obtained from others.
The cost of the replacement towboat will be deducted from the proceeds due the Contractor, until the Contractor can again provide a towboat meeting minimum requirements acceptable to the Contracting Officer’s Representative.
6.4. MEALS. Meals for barge riders are to be included in towboat rates. Barge riders will be present on all fish transport trips.
6.5. DEADHEAD RATES. All costs connected with movement of Contractor's equipment without tow will be paid at the deadhead rates shown in the contract. These rates are applicable when towboats are required to travel from the Portland, Oregon area (or equivalent distance) to the location where Government-owned barges are picked up for the start of fish-hauling operations. Deadhead rates will also apply if barges are moored at any upstream point at end of operation and towboats are required to return to Portland area with no tow. Deadheading from points more distant than the U.S. Government moorings at Portland, Oregon will be at Contractor's expense. Deadhead rate (Item numbers 0001AD, 0002AD, 0003AD, 0004AD, 1001AD, 1002AD, 1003AD, 1004AD), shall be paid from Portland, OR or equivalent distance to Lower Granite or Bonneville Dam to the point where the contractor begins providing primary towboat service.
6.6. MISCELLANEOUS COSTS. The Contractor shall assume expenses and miscellaneous costs for fish barges that must be moored for discontinued or intermittent service, or for scheduling purposes to make the best use of towboats and barges.
6.7. TOWBOAT CREWS. A "Full-Operating Crew" for the towboats pushing fish barges is defined as the number of personnel necessary, under U.S. Coast Guard and other industry regulations, to operate the towboat on a 24-hour basis, including at a minimum two ship operators and two deck hands (four people). Two deck hands must be present during all barge tie-ups and departures from fish loading facilities. Government personnel assigned to the barges will not participate in handling lines or any other operation associated with barge tie-up or departure. A "Minimum-Operating Crew" is defined as the number of personnel required to maintain the towboat in a standby status to permit full operation on 24 hours’ notice. All towboat crew changes, replenishment of supplies, and towboat refueling shall be made on upstream bound trips. Towboat crew changes and replenishments of supplies shall be made within a 1.5 hour time period, if separate from refueling operations.
6.9. FUEL. The Contractor shall provide all diesel fuel for operation of the towboats and diesel-engine pumps on the Government owned fish barges (Item numbers 0005 and 1005). Cost of fuel for the towboat incurred by the Contractor shall be included in cost of Item numbers 0001AA, 0001AB, 0001AC, 0002AA, 0002AB, 0002AC, 0003AA, 0003AB, 0003AC, 0004AA, 0004AB, 0004AC, 0006AA, 0006AB, 0006AC, 0006AD, 1001AA, 1001AB, 1001AC, 1002AA, 1002AB, 1002AC, 1003AA, 1003AB, 1003AC, 1004AA, 1004AB, 1004AC, 1006AA, 1006AB, 1006AC, and 1006AD. The Contractor shall provide itemized billing for the fish barge fuel and shall list date, fuel invoice number, barge number, number of gallons, wholesale price, sales tax, and total cost the for each fish barge on a daily basis.
7. TIMEKEEPING.
7.1. RECORD KEEPING. The Contracting Officer’s Representative will be responsible for keeping the official record of operation of the Contractor's equipment and approve the Contractor's invoices for payment.
7.2. LOG BOOKS. The Contracting Officer’s Representative, or his authorized representative (barge rider), will certify the Contractor's log (Captains log book) of trip details including arrival and departure times, fish release times, delays encountered, and barge refueling.
8. GOVERNMENT PERSONNEL. The Government will have one representative on board each barge during fish loading and transportation operations. It shall be the responsibility of the Government representative to monitor the condition of the fish. Additional Government personnel or authorized visitors may also be on the barge periodically to assist in loading operations, ride along as observers, or for training.
9. CREW ASSIST. In the event the Government personnel require assistance on the fish barge(s), towboat personnel may be called upon to render such assistance as necessary. Crews may also be needed during fish loading to help with loading line set up. If a fish barge is moored at a site other than a fish loading facility and the towboat released from service, the Contractor will be responsible for transporting the Government personnel on board to lodging, specified by the Contracting Officer's Representative or their designee, in Cascade Locks, Oregon or at a mutually agreed upon location. Cost of these services incurred by the Contractor shall be included in Schedule Item numbers 0001AA, 0002AA, 0003AA, 0004AA, 0006AA, 1001AA, 1002AA, 1003AA, 1004AA and 1006AA.
10. PERMITS AND RESPONSIBILITIES.
10.1. CONTRACTOR RESPONSIBILITY. The Contractor shall, without additional expense to the Government, be responsible for obtaining any necessary licenses and permits, and for complying with any applicable Federal, State, and municipal laws, codes, and regulations in connection with the prosecution of the work, including all applicable oil spill contingency plans and training. The contractor shall be similarly responsible for all damages to persons or property that occur as a result of contractor’s fault or negligence. They shall take proper safety and health precautions to protect the work, the workers, the public, and the property of others. Failure to obtain necessary permits and licenses shall be cause for termination.
10.2. EXCLUSION. The Contractor shall have no duties with regard to the care and health of the fish during performance of the contract.
11. FUEL, OPERATING SUPPLIES, LUBRICATION, ETC. All fuel, lubrication, operating supplies, etc., necessary for the operation of the towboat(s) shall be the responsibility of the Contractor. The Contractor shall also provide all diesel fuel for the diesel-powered pumps on the Government-owned fish barges. Lubricants and other operating supplies for the diesel-powered pumps on the Government-owned fish barges will be provided by the Government.
12. MISPLACED MATERIAL. Should the Contractor, during the progress of the work, lose, dump, throw overboard, sink, or misplace any material, plant, machinery, or appliance, which in the opinion of the Contracting Officer’s Representative may be dangerous to or obstruct navigation, the Contractor shall recover and remove the same with the utmost dispatch. The Contractor shall give immediate notice, with description and location of such obstructions, to the Contracting Officer’s Representative or inspector, and when required shall mark or buoy such obstructions until the same are removed. Should he refuse, neglect, or delay compliance with the above requirements, such obstructions may be removed by the Contracting Officer, and the cost of such removal may be deducted from any money due or to become due the Contractor. The liability of the Contractor for the removal of a vessel wrecked or sunk without fault or negligence shall be limited to that provided in Section 15, 19, and 20 of the River and Harbor Act of 1899 March 03. (33 U.S.C. 410 et seq.).
13. MARINE RISK. The Contractor shall assume all usual risk, including all risks or liability for breach of law or statues for damage caused to other vessels, persons or property.
14. SIGNAL LIGHTS (2014 JAN.). The Contractor shall display signal lights and conduct his operations in accordance with the General Regulations of the Department of the Army and of the Coast Guard governing lights and day signals to be displaced by towing vessels with tows on which no signals can be displayed, vessels working on wrecks, dredges, and vessels engaged in laying cables or pipe or in submarine or bank protection operations, lights to be displaced on dredged pipelines, and day signals to be displaced by vessels of more than 65 feet in length moored or anchored in a fairway or channel, and the passing by other vessels of floating plant working in navigable channels, as approved by the Secretary of the Army (33 C.F.R. 207.718) and the commandant, U.S. Coast Guard, Homeland Security (33 C.F.R.83.20 - 84.24).
15. PRE-TRANSPORT MEETING. The Contractor shall attend a pre-transport meeting at a location agreed to with the Contracting Officer’s Representative to ensure that all parties involved are aware of the safety requirements and fish transport procedures. This meeting will be held prior to the start of the transport operations at a date each year to be decided.
16. GOVERNMENT-FURNISHED PROPERTY. The Government will furnish to the Contractor the following property. The Contractor shall check the quantity and condition of such Government-furnished property when delivered and shall acknowledge receipt thereof in writing to the Contracting Officer, and, in case of damage to or loss of such property, the Contractor shall, within 24 hours, report in writing such damages and/or loss to the Contracting Officer. At the conclusion of the contract, the Contractor shall return these items to the Government.

The acquisition cost shall not be included by the Contractor in the contract proposed prices.
