SECTION C-1 GENERAL INFORMATION

C-1.1 SCOPE OF WORK

The Contractor shall provide personnel, materials, supplies, equipment, transportation, supervision and other items and services necessary to perform weed control and soil fertilization throughout public use areas along the Lewiston Levee Parkway, located in and around Lewiston Idaho. This is a fixed-price, performance based service contract where desired outcomes are defined and measured while contractor methods are generally not constrained or directed.

C-1.2. CONTRACTOR PERSONNEL

C-1.2.1. The Contractor shall perform all work under this contract with his own forces except as provided in Paragraph, 1.2.2.2.Subcontracting. Employees who perform this work shall be qualified persons on the Contractor's own payroll. While the home office may be located elsewhere, the Contractor shall employ a qualified supervisor to ensure all scheduled work is performed and shall have written authority to represent the Contractor in dealing with the Government. The name, address and telephone number of the supervisor shall be furnished in writing to the Contracting Officer's Representative (COR) at the post-award work meeting. A work crew is defined as containing one or more persons performing work required by the contract.

C-1.2.1.1. The supervisor shall have full authority to act for the Contractor on all matters relating to daily operation of this contract.

C-1.2.1.2 The supervisor shall be able to fluently read, write, speak and understand English.

C-1.2.2. Contractor personnel and regular subcontractors shall maintain a neat and clean appearance and shall wear clothing marked with identifying name of the employee and the Contractor. All Contractor vehicles shall be readily identified with either permanent or magnetic signs that state the Company’s name. A logo with the Company’s name will be approved by the COR for use.

C-1.2.2.1. The Contractor employees shall be skilled in and capable of performing the work under this contract. All employees of the Contractor or subcontractors shall be 18 years of age or older.

C-1.2.2.2. Subcontracting. No work may be subcontracted without written approval of the COR. Compliance with the provisions of this contract by subcontractors shall be the responsibility of the Contractor.

C-1.2.2.3. Training. The Contractor shall ensure that all employees and subcontractors have current safety training covering safe work practices, personal protective equipment, proper house keeping and fire protection. The Contractor shall also ensure that all employees have necessary certificates as required by local, state and Federal laws. The Contractor shall apply risk management strategies to ensure personnel safety, and shall comply with safety requirements articulated in EM 385-1-1, the US Army Corps of Engineers Safety Manual. C-1.2.3. Security Requirements. The Contractor shall provide and ensure that all employees and subcontractors wear a current photo identification card at all times while providing work under this contract. Identification will include employee name, company name and the effective date of the identification card. Physical security at various project locations is subject to change with very little notice. When advised by the COR, the Contractor employees and subcontractors shall comply with any and all changing requirements. Such changes may reduce access to certain areas under this contract and may restrict the Contractor’s ability to drive across the dams.

C-1.2.3 AT-OPSEC Training Requirements

Pre-screen candidates using E-Verify Program: The Contractor must pre-screen Candidates using the E-verify Program (http://www.uscis.gov/e-verify) website to meet the established employment eligibility requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to enrollment to ensure the correct information is entered into the E-verify system. An initial list of verified/eligible Candidates must be provided to the COR no later than 3 business days after the initial contract award. *When contracts are with individuals, the individuals will be required to complete a Form I-9, Employment Eligibility Verification, with the designated Government representative. This Form will be provided to the Contracting Officer and shall become part of the official contract file.

C-1.3. QUALITY CONTROL

C-1.3.1 The Contractor shall provide the COR a quality control plan for acceptance at the pre-work conference. The COR will notify the Contractor of acceptance or required modifications to the plan before the contract start date. The Contractor shall make appropriate modifications and obtain acceptance of the plan by the COR before the work may begin. If the quality control plan is not approved prior to the contract start date, the plan will be considered a draft and may be used for routine work pending final approval. All work permitted, prior to approval of the quality control plan shall be authorized by the COR.

C-1.3.2. The Quality Control plan shall minimally include:

C-1.3.2.1. A description of the inspection system for all services listed in the Performance Work Statement (PWS). The description shall specify a monitoring strategy and include both the frequency and location of inspections, and the titles and organizational placement of the inspectors.

C-.1.3.2.2. A description of the methods to be used for identifying and preventing defects in the quality of service performed.

C-1.3.2.3. A description of the records to be kept to document inspections and corrective or preventive actions taken.

C-1.3.3 Records of Quality Control inspections shall be kept and made available to the COR, when required by schedule or request, throughout the contract performance period and for the period after contract completion until final settlement of any claims under this contract.

C-1.4. QUALITY ASSURANCE

The Government will evaluate the Contractor’s performance under this contract for those tasks listed on the Performance Work Statement (PWS). The COR or Quality Assurance (QA) evaluators will follow the methods of surveillance specified in the PRS; generally systematic random sampling will be employed. Government personnel will record all QA inspections, and the COR will retain such records.

C-1.5. MEETINGS & COMMENCEMENT

C-1.5.1. Pre-Work Meeting. Prior to commencement of work on this contract, the Contractor shall attend a pre-work meeting at a time and place mutually agreed to by the Contractor and the COR. At this meeting, the COR will establish lines of authority and Government procedures for contractual administrative and work issues. The schedule of required submittals and reports will also be discussed. The Government shall furnish a letter of record documenting pre-work conference discussions to attendees within one week following the meeting. The Contractor shall submit, in completed form, the following items at the pre-work conference: Certificate(s) of Insurance; a copy of the Idaho Pesticide Applicator’s License; Letter of Authority for the Contract Supervisor; Letter(s) Appointing Quality Control Personnel. The contractor shall submit in draft form, the following items at the pre-work meeting: Quality Control Plan;

Accident Reporting Plan; Accident Prevention Plan; Activity Hazardous Analysis Plan;

Hazardous Material Communication Plan; A list of any subcontractors; and a list of names and addresses of all employees who will be working for the Contractor, and a list of all vehicles, vessels and equipment to be used by the Contractor.

C-1.5.2. Commencement. The draft plans noted above shall be approved by the COR prior to commencement of work by the Contractor. Failure to complete plans approved by the COR will result in delays in notification to proceed which shall not be the basis of a Contractor claim.

C-1.5.3. Contract Meetings. As requested by the COR, the Contract Supervisor will meet with the COR to review performance and to discuss contract issues. The meetings will probably only be held during the spring and summer months when most of the weed control takes place. The meetings will be held at a time and location agreed to by the COR and the Contract Supervisor prior to the meeting. The Contractor shall submit a draft invoice for the month and a monthly work plan for the upcoming month no later than the last day of the month.

C-1.6 PHYSICAL SECURITY

C-1.6.1. The Contractor shall be responsible for safeguarding all Government facilities, property and materials provided for Contractor use. All Government facilities, property and materials shall be appropriately secured at all times. Specific security conditions may change based on threats to national defense, and based on the risk of specific facilities to these threats. The Contractor shall abide by these changing conditions at all times.

C-1.6.2. Key Control. The Contractor shall ensure all keys issued to the Contractor by the Government are not lost, stolen or duplicated and are not used by unauthorized persons.

C-1.6.2.1. The Contractor shall immediately report to the COR any occurrences of lost or stolen keys.

C-1.6.2.2. In the event keys, other than master keys are lost or stolen, the Contractor may be required, upon written direction of the COR, to re-key or replace the affected lock or locks without cost to the Government. The Government may, however, at its option, replace the affected lock or locks or perform re-keying and deduct the cost of such from the monthly payment due the Contractor. If a master key is lost or stolen, the Government may need to replace all locks and keys for that system. The total cost of such replacement will be deducted from the monthly payment due the Contractor.

C-1.6.2.3. The Contractor shall prohibit the use of keys issued by the Government by any persons other than the Contractor’s employees. The Contractor shall not facilitate access of secured areas to persons other than Contractor personnel or subcontractors engaged in performance of contract work requirements.

C-1.7. HOURS OF OPERATION

C-1.7.1. Normal Hours of Operation. The Contractor will submit a work schedule to the COR for approval, indicating the hours that he and his employees will be on site working. The Contractor will perform the duties outlined in this contract every week day.

C-1.8. CONSERVATION OF RESOURCES

C-1.8.1. The Contractor shall ensure employees practice utility conservation. The Contractor is responsible for operating under conditions that prevent the waste of utilities to include:

C-1.8.2. Turning off lights when not necessary for work.

C-1.8.3. Turning off water faucets and valves when not in use.

C-1.8.5. Environmental and Hazardous Materials. The Contractor shall establish systems and controls to minimize use of hazardous materials and generation of hazardous wastes, maximize recycling of materials and comply with local, state and Federal guidelines for hazardous material and waste storage and disposal. The Contractor will furnish the Government with copies of all Safety Data Sheets (SDS) prior to using or storing such chemicals in Government facilities.

C-1.9. RECORDS

The Contractor is responsible for creating and providing reports and records that are specifically cited in the Performance Work Statement (PWS) or required by the provisions of a mandatory directive listed in section C-6, Applicable Publications and Forms. Timely communication of the following records are critically important: accident and incident reports, vandalism and property damage reports, pesticide application reports, contractor personnel safety exposure hours, security breaches, hazardous waste management and disposal and hazardous material spills. The Contractor shall comply with their approved plans. Refer to Technical Exhibit C-7.2, Required Reports.

SECTION C-2 DEFINITIONS

C-2.1. Acceptable Quality Level (AQL). A predetermined value selected and used by the Government Quality Assurance inspector to distinguish between satisfactory and unsatisfactory performance. For evaluation by random sampling, AQL’s are stated in percentages and have three parts: lot size, sample size and allowable reject level.

C-2.2. Contracting Officer (KO). “Contracting Officer” is the person executing this contract on behalf of the Government.

C-2.3. Contracting Officer’s Representative (COR). An individual designated in writing by the Contracting Officer responsible for administration of the contract.

C-2.4. Contractor. The term Contractor refers to the prime Contractor and all contractor employees and personnel. The prime Contractor shall be responsible for ensuring all subcontractors comply with the provisions of this contract.

C-2.5. Deduct Percentage. The percentage obtained when the price for providing a specific requirement for a billing cycle is diminished because the Observed Acceptance Rate (OAR) is below the Acceptable Quality Level (AQL).

C-2.6. Defective Service. A service or output that does not meet the standard of performance requirement specified in the contract for that service.

C-2.7. Lot. The total number of potential service outputs in a surveillance period.

C-2.8. Lot Size. Total number of required services per inspection period from which a sample is to be drawn. In statistical terms, this is the population.

C-2.9. Performance Requirement. The point that divides acceptable and unacceptable performance of a task according to the Performance Requirement Summary (PRS) and the Inspection of Services clause. It is the number of defects or maximum percentage of defects in the lot that is acceptable.

C-2.10. Quality Assurance. A planned and systematic pattern of all Government actions necessary to provide confidence that adequate technical requirements are established; products and services conform to established technical requirements; and satisfactory performance is achieved. For purposes of this contract, quality assurance refers to actions by the Government assurance functions for a contracted service.

C-2.11. Quality Assurance Representative (QAR). An individual designated to inspect the Contractor’s performance.

C-2.12. Quality Control. Those actions taken by a Contractor to control the production of outputs to ensure that they conform to the contract requirements.

C-2.13. Sample. A sample consists of one or more service outputs drawn from a lot for quality assurance surveillance.

C-2.14. Sample Size. The number of samples to be taken per lot size to ensure a statistically significant Observed Acceptance Rate (OAR) to be measured against the assigned AQL.

C-2.15. Statistical Random Sampling. A sampling method where each service output in a lot has an equal chance of being selected for quality assurance surveillance.

C-2.16. Weeds-Noxious: Class A weeds are mostly newcomers to Washington, and are generally rare. The goal is to completely eradicate them before they gain a foothold.

Landowners are required to completely eradicate Class A weeds. (Eradicating weeds means getting rid of the entire plant including the roots.) Class B Weeds are those that are widespread in some parts of the state, but rare or absent in other parts of the state. The goal with Class B weeds is to prevent them from spreading into new areas, and to contain or reduce their population in already infested areas. Your local County Weed Board can tell you which Class B weeds are designated for control in your area. Class C Weeds are typically common and widespread. Rather than requiring control of these plants, most County Weed Boards simply offer advice to landowners about the most effective control methods. A County Weed Board may, however, require landowners to control a Class C weed if it poses a threat to agriculture or natural resources.

C-2.17. Weeds-Common Lawn/Turf/Broadleaf: Lawn weeds are any plant type or vegetation that is not wanted in the lawn or turf areas, even if it is a grass variety. Broadleaf weeds such as the Dandelion, Chickweed, Clover or other weed types grab resources away from the turf and disrupt the lawn’s texture. Grassy weeds such as Crabgrass, Goose Grass, Foxtail and other weed types cause a lawn to look uneven and remove resources from the preferable grass.

C-2.18. Weeds: Consists of an invasive or non-desirable herbaceous plant that has leaves and stems that die down at the end of the growing season to the soil level. They have no persistent woody stem above ground. Herbaceous plants may be annuals, biennials or perennials (included but not limited to broadleaf plants and grasses).

SECTION C-3 GOVERNMENT FURNISHED SERVICES

Utility services (electrical power, water services) required in the performance of the contract can be obtained where available from Government sources within the contract areas or from other sources approved by the COR.

SECTION C-4 CONTRACTOR-FURNISHED ITEMS AND SERVICES

Except for those items or services specifically stated in Section C-3, the Contractor shall furnish everything necessary to perform this contract according to all its terms. The Contractor shall provide all training to Contractor employees required by applicable safety, health or licensing requirements.

SECTION C-5 PERFORMANCE WORK STATEMENT

C-5.1. GENERAL INFORMATION

The Contractor shall provide personnel, materials, supplies, equipment, transportation, supervision and other items and services necessary to perform weed control and soil fertilization in public use areas as defined in this Performance Work Statement (PWS). Specific quantities are listed in C-7.4 FACILITY INVENTORY.

C-5.2. WEED CONTROL DESIGNATED AREAS

C-5.2.1. The Contractor shall control noxious and broadleaf weeds throughout developed public use areas and operational facilities as listed. The Contractor must refer to and follow the current guidelines of the Pest Management Program, U.S. Army Corps of Engineers, Walla Walla District Managed Lands.

Public use areas include all earthen features; public parking areas; Corps managed roads to operational or public use facilities, grassed areas and fields within the bounds of developed parks, access roads and parking lots (see map sections #1-#9a and #17-#27). Controlling noxious and broadleaf weeds means killing them by chemical, mechanical or hand control methods to prevent seed production.

C-5.2.1.2. As part of this requirement the Contractor shall also control noxious and broad leaf weeds in approximately 34.54 acres of irrigated and non-irrigated lawn and field areas (see map sections #1 -#9a and #17-#27). This requirement is to include the Lindsey Creek Area (map section #31).

NOTE: The following areas ARE NOT maintained by the U.S. Army Corps of Engineers.

Area along the West Lewiston Levee (Refer to map sections #3-#7) public use areas and irrigated lawns between the toe of the levee and Snake River Avenue are maintained by another entity including the area north of the cement plant. Boundary lines are indicated on these maps.

Public use area from the Southway boat ramp to the south end of the parking lot (Refer to map sections #9-#9a) is maintained by another entity. Boundary lines are indicated on these maps.

Area between the south-end of the Southway boat ramp parking lot to the pedestrian tunnel (Refer to map sections #9a-#10) is maintained by another entity. Boundary lines are indicated on these maps.

C-5.2.2. To quantify unit equivalencies under different methods for chemical treatment, the following apply:

1 hour chemical = 1 acres of boom spraying with an agricultural spray boom system 1 hour chemical = 1 backpack sprayer worth of spot application 1 hour chemical = 1 hours mechanical treatment 2 hours chemical = 1 hour of mechanical tree removal

C-5.2.3. The following is a list of the noxious weeds found occurring on and around the Lewiston Levee Parkway (recreation trail connected to park areas). The list is provided for informational purposes only and may change from year to year (*priority weeds).

C-5.2.4. To ensure compliance with regulations and to facilitate quality assurance, the Contractor shall, within 48 hours, provide the COR detailed reports establishing target-species, locations, application personnel, environmental conditions, materials used, methods and rates of each application of any pesticide. The Contractor must refer to and follow the current guidelines of the Pest Management Program, U.S. Army Corps of Engineers, Walla Walla District Managed Lands, subtitle Anticipated Use and Actual Use Forms and Data using the NWW Form 178, Pesticide Application Report. The contractor shall also provide the COR an annual summary report of pesticide use after each growing season. Controls shall minimize threats to all non-target species, including persons, and shall strictly comply with all local, state and Federal environmental protection and occupational health and safety laws. Because of the risk of liability associated with pesticide use, any failure by the Contractor in this requirement may result in immediate termination of the contract for default.

C-5.2.5. The Contractor shall be responsible for insuring the security of chemicals while on Government land.

C-5.2.6. The Contractor shall provide Pesticide Application Notice signs and will be responsible for posting and maintaining posted signs according to pesticide labels. These signs measure 4.5" x 5" and provide space where the Contractor will list the commercial or trade-names of the chemical used, date and time of application, location treated and the Contractor business name and telephone number. The Contractor shall post the signs a minimum of 24 hours before applying chemicals in areas of frequent public use. The Contractor will recommend posting locations for approval by the COR who may require the Contractor to increase or decrease sign numbers or change recommended locations. The Contractor shall supply necessary signposts or other mounting devices and all hardware. Signs will not be fastened to trees. The COR may allow use of some existing signposts. The Contractor shall remove the signs and post only after contamination hazard to the using public in the area treated has diminished to an acceptable level as determined by label information of the product.

C-5.4. WEED CONTROL DESIGNATED AREAS – LEVEE BANKS

C-5.4.1. To preserve the structural strength of the Lewiston Levees System, this item requires spraying to control noxious and broadleaf weeds and all new invading sprouts, and re-sprouting previously cut woody-stemmed vegetation on both sides of the levee between the toe of the levee and the top, including the rock riprap to the water’s edge. The levee areas include:

The West Lewiston Levee, which is approximately 3 miles long and averages 10 feet between the top of the riprap and the top of the slope on the river side and 45 feet on the dry side, with the riprap protected portion of the levee averaging 15 – 20 feet. This area starts at the Confluence Interpretive Center and extends to the Southway Boat Ramp (map sections #1-#8).

The East Lewiston Levee, which is approximately 4 miles long and averages 10 feet between the top of the riprap and the top of the slope on the river side and 150 feet on the dry side, with the riprap protected portion of the levee averaging 20 – 25 feet. It starts at the Confluence Interpretive Center and extends to the end of the riprap located at the Potlatch Administrative building (map sections #1 and #17-#39).

The North Lewiston Levee, which is approximately 2.3 miles long and averages 10 feet between the top of the riprap and the top of the slope on the river side and 40 feet on the dry side, with the riprap protected portion of the levee averaging 20 – 25 feet. Grasses and herbaceous broadleaf plants will be allowed to grow in this area. This area starts at the Clearwater Boat Ramp and extends west to the end of the riprap (approximately 0.2 miles) to the west side of the Pump Plant A (map sections #41-#53).

The North Lewiston Levee – Upriver, which covers both sides of the trail is approximately 2 miles long and averages 10 feet on the dry side from the asphalt edge and 100 feet on the riverside from the asphalt edge. This area starts at the Clearwater Boat Ramp and extends east to the City of Lewiston Intake Pump Station (map sections #53-#64).

C-5.6.1. Due to the high variability of need, this item will be done only upon request by the COR. Fertilization will be applied ONLY to the grassed green areas (total of 25 acres of lawn grass) which will include lawn areas and areas between the toe of the levees to the top of the levees; and NOT to include non-irrigated areas and the Lindsey Creek Area. Fertilization shall be within the West Lewiston Levee (map section #1-#9) and the East Lewiston Levee (map sections #9-#26). Refer to the current guidelines of the Pest Management Program, U.S. Army Corps of Engineers, Walla Walla District Managed Lands for the requirement type of fertilizer to be used in these areas.

SECTION C-7 TECHNICAL EXHIBITS

C-7.2 REQUIRED REPORTS

The Contractor is required to generate, complete and submit reports to the Government. The following is a list of reports, information to be furnished on each report and a time or frequency requirement for each report. Individual report deadlines for periodic reports will be negotiated with the Contractor prior to award.

Incident/Accident Report: An accident constitutes an incident or act involving the

Contractor, which may or may not have caused obvious damage to persons or property. This includes injuries to Contractor employees, members of the public, or damage to Government or personal property. The Contractor shall notify the COR by telephone within 30 minutes of any incident or accident, followed by a written report. These reports shall include, but are not limited to, location, nature of the injury or accident, authorities notified and the action taken along with any other pertinent information such as who was injured and how it may have happened. These reports shall be accompanied by sketches, graphs, drawings, and photographs, as needed, and forwarded to the COR within 1 working day following the injury or accident.

Contractor Quality Control Report: Completed by Contractor Quality Control personnel.

This report details Contractor surveillance of work, records performance achieved, deficiencies observed and corrective action taken. This report shall be submitted daily for the previous day.

Employee Exposure Hours: A total of person-hours worked by Contractor employees during the month. This report shall be submitted monthly.

Pesticide Application Reports: The Contractor shall complete an NPW Form 178 (Pesticide Application Record) or equivalent at the completion of daily spraying activities (Refer to the current version of Pest Management Program, U.S. Army Corps of Engineers, Walla Walla District Managed Lands. Each application record shall have date and time of application, names of the herbicide and surfactants applied (EPA reg. #, Trade Name, Company), application rates, weather conditions (temperature, wind direction and speed), quantity of herbicide concentrate applied, applicator information (include applicator license #), application equipment listing (backpack, boom sprayer), number of acres treated, and location of application. This report is to be submitted within 48 hours. An annual summary of all pesticides used shall also be submitted to the COR no later than December 1 of each year.

C-7.3 MAPS

General location maps are available at the site visit (Lewiston Levee overview map with numbered map sections). These maps are intended to give the Contractor a general idea of the location of some facilities within recreation areas, etc. The level of detail in the provided maps, combined with the facility inventory, should be sufficient for the Contractor to determine overall logistics of his operation.

C-7.4 FACILITY INVENTORY

The facility inventory listed below is the best approximation available as of December 2015.

C-7.5. DEDUCTIONS

Deductions will be made on a monthly basis during the billing cycle when the Allowable Reject Level (ARL) fails to meet Acceptable Quality Levels (AQL’s). The contractor shall be given 8 hours after notification to correct any unacceptable performance. If not corrected, deductions will be made to specific line items in the following manner: a 10% line item deduction will be made when the ARL is within 5% below the AQL for that specific line item; a 20% deduction will be made when the ARL falls 6-10% below the line item AQL; a 50% deduction will be made when performance falls 11-25% below the line item AQL; and a 100% deduction will be made when performance falls 26% or below the line item AQL. ARL deduction calculations will always be rounded up to the nearest percentage point. Deductions are result from services not rendered, are non-negotiable and approved by the CO. Anytime an AQL is not met, it will represent failure on the part of the Contractor to meet requirements, and may support cause for termination of the contract.

SITE VISIT

52.237-1 SITE VISIT (APR 1984)

(a) Vendors are urged to inspect the site where services are to be performed and to satisfy themselves regarding all general and local questions that could affect the cost of contract pricing. In no event shall failure to inspect the site constitute grounds for a claim after contract award.

(b) At this time there is no Scheduled Site Visit. If more than one contractor requests a Site Visit on or before two weeks before the closing due date of this solicitation, then an amendment may be issued in order to provide a site visit according to the requirements below, and at which time and date for the visit will be issued.

There can be no substitutions of one individual for another. If an individual arrives at the site visit without having called ahead of time and/or without picture identification, that individual may not be allowed on the project.

Participants of scheduled site visit must abide by the U.S. Army Corps of Engineers Safety and Health Requirements Manual (EM 385-1-1, latest version) in accordance with Section 5, “Personal Protective and Safety Equipment.” It is the responsibility of the participants to wear personal protective and safety equipment as required by this regulation. Failure to comply could result in denial of access to site visit location.

The ACCESS FOR FOREIGN NATIONALS clause applies to site visits as well as to performance of the work.

Foreign Nationals must have received clearance prior to being granted access to the project site during the site visit.
