SECTION 00100 - BIDDING SCHEDULE/INSTRUCTIONS TO BIDDERS
A. BASIS FOR AWARD
The award will be made based on the best overall (i.e., best value-tradeoff) proposal that is determined to be the most beneficial to the Government, with appropriate consideration given to the three (3) evaluation factors:
Technical, Price, and Past Performance.
All sub-factors of Factor I, Technical, are equal in importance to each other. Factor I, Technical, is more important than Factor III, Past Performance. When combined, the non-price factors (Factors I and III) are significantly more important than Factor II, Price. As proposals become more equal in their technical (non-price) merit, the evaluated price becomes more important in determining the best value proposal.
B. SUMMARY OF WORK
Miter Gate Pintle Repairs – The contractor will be replacing the cast steel pintle heels with new Government Furnished Property (GFP) pintle heels and new GFP pintle balls. In addition to replacing the pintle heels and balls, the contract will require demolition of existing cracked structural steel members that support the pintle heel and gate. Areas that are demolished will require fabrication and welding of new structural members to support the pintle heel and gate. Structural welding of new steel in the pintle areas will require welders and weld inspectors to be certified as described in the summary of work below for “Crack Repair on Structural Members of Downstream Miter Gate”.
Miter Gate Gudgeon Repairs – Procedures include replacing the gudgeon linkage assemblies that connect each gate leaf to their respective gudgeon anchor frames. New gudgeon linkage assemblies have already been procured by the Government and will be furnished as GFP. The anchor frames are embedded in concrete and will not be replaced.
The gudgeon and pintle repair work will require experience with jacking and shoring support of large structures.
Each miter gate leaf weighs approximately 400 tons. The miter gate leaves will be required to be jacked, moved and supported in order to remove and replace the pintle heels, pintle balls, and gudgeon linkage assemblies. The Contractor will be responsible for developing a jacking, moving, and shoring plan with drawings and calculations to be performed by a registered professional engineer.
Crack Repair on Structural Members of Downstream Miter Gate -- The Contractor shall perform various forms of crack repair to include stop-drilling, bolted plate repairs, partial penetration welds, and complex complete joint penetration welds. Weld repairs will be performed on non-fracture critical members and fracture critical members.
Welding shall conform to American Welding Society (AWS) D1.5 and welders shall be qualified in accordance with AWS D1.5. The Contractor will be responsible for submitting welding procedures for each weld to be made.
Welding repairs will require the Contractor to have experience with and equipment for preheating and interpass temperature control. The contract will require full time services of Certified Welding Inspectors certified in accordance with AWS QC1 during all on-site welding activities.
Repaint Structural Members of Downstream Miter Gate -- Upon completion of all crack repairs, the Contractor will be required to prepare and paint all repaired areas with Vinyl Paint System 4. The Vinyl Paint System 4 consists of five coats of alternating white and gray formula V-766e double-spray coats. Surface preparation for the Vinyl Paint System will require white metal blast in accordance with SSPC SP 5.
Quoin and Miter Block Replacement -- The contract will require replacement of the quoin and miter bearing blocks for the bottom 22 feet (approx.) of the gate. This work will consist of fabrication and installation of new bearing blocks including new adjustment screws and hardware, as well as epoxy backing filler material. Existing filler materials will have to be removed or ground to a smooth surface prior to installing new bearing and miter blocks.
Install New Safety Railing & Cover Plates – The contract will require fabrication and installation of new safety railing around the top perimeter of each gate leaf. The contract will also require some concrete removal, demolition of old safety railing, and installation of new railing and concrete repair at the edges of the gudgeon anchor recesses.
New safety railings will be fabricated from welded steel pipe and painted upon completion. Painting of handrail and other non-immersed will be in accordance with Unified Facility Guide Specification (UFGS) 09 97 02 paint system 23-C-Z. The contract will require fabrication and installation of new diamond plate aluminum cover plates over large access holes in several of the main structural members. The cover plates will be welded aluminum and will replace existing rotted wood cover plates.
Install New Fender Materials – The contract will require removal of existing and replacement of the timber fender systems on each gate leaf. The contractor will be required to provide all fasteners and hardware necessary to complete this work.
The contract requires completion of all work at the navigation lock within a finite work window of approximately 100 calendar days. Work must be completed within the specified work window in order to return the navigation lock to service in accordance with a coordinated Columbia/Snake River navigation system outage plan. The Contractor must be able to staff (supervision and labor) and provide on-site physical plant to support multiple daily work shifts to meet the requirements of the aggressive construction schedule constraints.
All on-site work shall be performed in accordance with the Corps of Engineers Safety and Health Requirements Manual (EM 385-1-1).

Miscellaneous work within the project includes the delivery of As-Built Drawings to the USACE prior to final payment and final contract closeout.
C. FACTORS AND SUB-FACTORS TO BE EVALUATED
The following evaluation factors and sub-factors will be used to evaluate each proposal. Award will be made to the offeror whose proposal is most advantageous to the Government based upon an integrated assessment of the evaluation factors and sub-factors described below.
1. FACTOR I Technical - The technical evaluation will be comprised of two (2) Sub-Factors. Risk assesses the degree to which the offeror’s proposed technical approach for the requirements of the solicitation may cause disruption of schedule, increased price, degradation of performance, the need for increased Government oversight, or the likelihood of unsuccessful contract performance. Risk will be evaluated as one aspect of the technical evaluation, inherent in the technical evaluation factor or sub-factor ratings.
Sub-factor A: Technical Work Plan and Capabilities Sub-factor B: Management and Schedule
The two (2) sub-factors are of equal importance.
Evaluation of the offeror’s proposal shall address each sub-factor as it applies to the scope of work. A detailed explanation of the criteria for the evaluation is set forth in the Evaluation Approach, Paragraph C of this section.
During evaluations of each proposal, the Government will assign each sub-factor an adjectival rating and write a narrative evaluation reflecting the identified findings.
2. FACTOR II Price - The resulting award will be a firm-fixed price contract. Price reasonableness will be utilized in the evaluation of the proposal.
3. FACTOR III Past Performance - Each offeror’s current and past performance will be reviewed to determine relevancy and confidence.
D. EVALUATION APPROACH
All proposals will be evaluated by the Source Selection Evaluation Board (SSEB).
1. The overarching evaluation approach for all factors and sub-factors is as follows:
a. Adequacy of Response. The proposal will be evaluated to determine whether the offeror’s methods and approach have adequately and completely considered, defined, and satisfied the requirements specified in the RFP. The proposal will be evaluated to determine the extent to which each requirement has been addressed in the proposal in accordance with the proposal submission section of the RFP. Marginal levels of overall detail could indicate a lack of understanding concerning the requirements and may result in the entire factor receiving an unfavorable rating and/or being eliminated from the competitive range.
2. Factor I Technical - This factor is comprised of the following sub-factors:
a. Sub-factor A: Technical Work Plan and Capabilities
This sub-factor evaluates the offeror’s experience, approach, capabilities, equipment and reasonableness related to the removal and shoring of each miter gate leaf to allow access for replacement of the pintles, pintle heels, and gudgeon linkages. The offeror should propose methods, applicable drawings, analysis, and technical plan(s) necessary to clearly define:
1) Past experience in lifting/jacking large structures of 75 Tons or greater. Minimum experience shall be not less than three examples performed in the last six years.
2) General scope and sequence for how each miter gate leaf will be jacked, moved, and temporarily shored to allow safe access to and replacement of the pintle heels.
3) Document capabilities and availability of resources necessary to complete all required major tasks.
4) List of all major pieces of equipment and specialty tools necessary and available to complete all major tasks.
b. Sub-factor B: Management and Schedule
This factor will evaluate the offeror’s proposed management and quality team experience and capabilities, and will evaluate proposed schedules necessary to complete the requirements of this contract.
1) Identify key management structure and team for completion of all contract requirements to include:
Resumes that describes the experience and responsibility of key personnel with projects of similar type, size and complexity as that required for this contract.
2) Provide a schedule that identifies the Mandatory Tasks (Section 01 32 01.00 28), order of tasks, task dependencies, durations and critical path proposed to successfully accomplish the entire project from notice to proceed to commissioning of the gate. For evaluation purposes only, the Offeror should use the arbitrary, non-binding Notice to Proceed date of 15 May 2016. A baseline schedule will be prepared by the Government and used for comparison purposes.
The Technical Factor Ratings, excerpted below focus on the strengths, deficiencies, weaknesses, risks and uncertainties of the offeror’s proposal. The rating depicts how well the offeror’s proposal meets the Technical sub-factor requirements.
Rating Description Outstanding Proposal meets requirements and indicates an exceptional approach and understanding of the requirements. Strengths far outweigh any weaknesses. Risk of unsuccessful performance is very low.
Good Proposal meets requirements and indicates a thorough approach and understanding of the requirements. Proposal contains strengths which outweigh any weaknesses.
Risk of unsuccessful performance is low.
Acceptable Proposal meets requirements and indicates an adequate approach and understanding of the requirements. Strengths and weaknesses are offsetting or will have little or no impact on contract performance. Risk of unsuccessful performance is no worse than moderate.
Marginal Proposal does not clearly meet requirements and has not demonstrated an adequate approach and understanding of the requirements. The proposal has one or more weaknesses which are not offset by strengths. Risk of unsuccessful performance is high.
Unacceptable Proposal does not meet requirements and contains one or more deficiencies.
Proposal is not awardable.
3. Factor II - Price - The contract will be a Firm Fixed-Price Contract. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement.
Evaluation of options will not obligate the Government to exercise the option(s). The Government will evaluate offers for award purposes by evaluating the prices proposed in the Bid Schedule. The Offeror must provide a price proposal by completing the Bid Schedule as instructed in Section 00100.
Firm Fixed Price Requirements
a. The RFP requires firm-fixed-price contract line items. A price reasonableness approach will be utilized by the Government to determine that the proposed prices offered are fair and reasonable and that a “buy-in” or unbalanced pricing between CLINs is not occurring.
b. The Government will examine price proposals for artificially low unit prices. Offers found to be unreasonably high, unrealistically low (an indication of “buy – in”), or unbalanced, may be considered unacceptable and may be rejected on that basis.
4. Factor III - Past Performance - The Government will evaluate the offeror’s record of past and current performance to ascertain the probability of successfully performing the required efforts of the scope of work.
a. Evaluation of past performance shall be in accordance with this plan utilizing the forms and questionnaires set forth in Appendix D.
b. The Government will focus its inquiries on the offeror’s (and major subcontractors’) record of performance as it relates to all solicitation requirements, including price, schedule, performance and management of subcontractors. Major subcontractors are defined as members of an offeror’s overall team who are expected to perform ten (10) percent or more of the proposed effort or who will be providing critical hardware/services. A significant achievement, problem, or lack of relevant data in any element of the work can become an important consideration in the evaluation process. Therefore, offerors will be reminded to include the most current and relevant past efforts (within the past six years) in their proposal. Absent any current and relevant past performance history or when the performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned, the offeror will be assigned an “unknown confidence rating” and its proposal will not be evaluated either favorably or unfavorably on past performance. The Government may use data provided by the offeror in its proposal and data obtained from other sources, including data in Government files or data obtained through interviews with personnel familiar with the contractor and their current and past performance under Federal, State or Local government or commercial contracts for same or similar services as compared to the North American Industry Classification System NAICS 237990, Other Heavy and Civil Engineering Construction. Data used in conducting performance risk assessments shall not extend past six years prior to the issue date of the RFP, but may include performance data generated during the past six years without regard to the contract award date.
c. Offerors shall submit all Government and/or commercial contract numbers and descriptions for the prime offeror and each major subcontractor in performance or awarded during the past six years, from the issue date of this RFP, which are relevant to the efforts required by this RFP. The Government may consider a wide array of information from a variety of sources, but is not compelled to rely on all of the information available.
d. The past performance factor considers each offeror’s demonstrated current and relevant past record of performance in supplying products and services that meet the contract requirements. There are two aspects to the past performance evaluation: relevancy and performance confidence assessment.
(i) RELEVANCY: The Government will conduct a performance assessment based on the relevancy of the Offeror's current and past performance, as well as that of its major subcontractors, as it relates to the probability of successful accomplishment of the required effort. These efforts include all aspects of schedule, performance and customer support, including the Offeror’s submitted subcontracting plan for this project and the Offeror’s record of: 1) Conforming to specifications and standards of good workmanship; 2) Maintaining program execution within price; 3) Adherence to contract schedules, including the administrative aspects of performance; 4) Ability to resolve technical and manufacturing problems quickly and effectively; 5) Businesslike concern for the interest of its customers; 6) Establishing and maintaining adequate management of subcontractors; and 7) Compliance with subcontracting plans submitted on previous projects.
Past Performance Relevancy Ratings
Rating Definition
Very Relevant Current/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.
Relevant Current/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.
Somewhat Relevant Current/past performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires.
Not Relevant Current/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.
(ii) PERFORMANCE CONFIDENCE ASSESSMENT: The final step is for the team to arrive at a single consensus performance confidence assessment for the offeror, selecting the most appropriate rating from the chart below. This rating considers the assessed quality of the relevant/current efforts gathered (documented results from Past Performance Questionnaires, interviews, CPARS, and other sources form the support and basis for this assessment). Ensure the rationale for the conclusions reached are included.
Performance Confidence Assessments
Rating Definition
Substantial Confidence Based on the offeror’s relevant performance record, the Government has a high expectation that the offeror will successfully perform the required effort.
Satisfactory Confidence Based on the offeror’s relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.
Limited Confidence Based on the offeror’s relevant performance record, the Government has a low expectation that the offeror will successfully perform the required effort.
No Confidence Based on the offeror’s relevant performance record, the Government has no expectation that the offeror will be able to successfully perform the required effort.
Unknown Confidence (Neutral) No relevant performance record is available or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned.

ADJECTIVE RATINGS AND DEFINITIONS TO BE USED TO BEST REFLECT
YOUR EVALUATION OF THE CONTRACTOR’S PERFORMANCE
RATING DEFINITION NOTE
(E) Exceptional Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit.
The contractual performance of the element or sub-element being assessed was accomplished with few minor problems for which corrective actions taken by the contractor was highly effective.
An Exceptional rating is appropriate when the Contractor successfully performed multiple significant events that were of benefit to the Government/Owner. A singular benefit, however, could be of such magnitude that it alone constitutes an Exceptional rating. Also, there should have been NO significant weaknesses identified.
(VG) Very Good Performance meets contractual requirements and exceeds some to the Government’s/Owner’s benefit.
The contractual performance of the element or sub-element being assessed was accomplished with some minor problems for which corrective actions taken by the contractor were effective.
A Very Good rating is appropriate when the Contractor successfully performed a significant event that was a benefit to the Government/Owner. There should have been no significant weaknesses identified.
(S) Satisfactory Performance meets minimum contractual requirements. The contractual performance of the element or sub-element contains some minor problems for which corrective actions taken by the contractor appear or were satisfactory.
A Satisfactory rating is appropriate when there were only minor problems, or major problems that the contractor recovered from without impact to the contract. There should have been NO significant weaknesses identified. Per DOD policy, a fundamental principle of assigning ratings is that contractors will not be assessed a rating lower than Satisfactory solely for not performing beyond the requirements of the contract.
(M) Marginal Performance does not meet some contractual requirements. The contractual performance of the element or sub-element being assessed reflects a serious problem for which the contractor has not yet identified corrective actions. The contractor's proposed actions appear only marginally effective or were not fully implemented.
A Marginal is appropriate when a significant event occurred that the contractor had trouble overcoming which impacted the Government/Owner.
(U) Unsatisfactory Performance does not meet most contractual requirements and recovery is not likely in a timely manner. The contractual performance of the element or sub-element contains serious problem(s) for which the contractor's corrective actions appear or were ineffective.
An Unsatisfactory rating is appropriate when multiple significant events occurred that the contractor had trouble overcoming and which impacted the Government/Owner. A singular problem, however, could be of such serious magnitude that it alone constitutes an unsatisfactory rating.
(N) Not Applicable No information or did not apply to your contract Rating will be neither positive nor negative.
