TIME EXTENSIONS CLAUSE

TIME EXTENSIONS FOR UNUSUALLY SEVERE WEATHER

This provision specifies the procedure for the determination of time extensions for unusually severe weather in accordance with CLAUSE: DEFAULT (FIXED-PRICE CONSTRUCTION) of the CONTRACT CLAUSES. In order for the Contracting Officer to award a time extension under this clause, the following conditions must be satisfied:

(1) The weather experienced at the project site during the contract period must be found to be unusually severe, that is, more severe than the adverse weather anticipated for the project location during any given month.

(2) The unusually severe weather must actually cause a delay to the completion of the project. The delay must be beyond the control and without the fault or negligence of the Contractor.

The following schedule of monthly anticipated adverse weather delays is based on National Oceanic and Atmospheric Administration (NOAA) or similar data for the project location and will constitute the base line for monthly weather time evaluations. A weather delay day is any day when the maximum temperature does not exceed 32 degrees Fahrenheit or when 0.10 inch or more of precipitation occurs. The Contractor's progress schedule must reflect these anticipated adverse weather delays in all weather dependent activities.

Monthly Anticipated Adverse Weather Delay Work Days Based on (7) Day Work Week

Location Jan Feb Mar Ap r

Jackson Hole Wyoming 21 15 7 3 3 3 3 3 3 4 9 24

Upon acknowledgment of the Notice to Proceed (NTP) and continuing throughout the contract, the Contractor shall record on the daily CQC report, the occurrence of adverse weather and resultant impact to normally scheduled work. Actual adverse weather delay days must prevent work on critical activities for 50 percent or more of the Contractor's scheduled workday. The number of actual adverse weather delay days shall include days impacted by actual adverse weather (even if adverse weather occurred in previous month), be calculated chronologically from the first to the last day of each month, and be recorded as full days. If the number of actual adverse weather delay days exceeds the number “Anticipated Adverse Weather Delay Work Days”, above, the Contracting Officer will convert any qualifying delays to calendar days, giving full consideration for equivalent fair weather work days and issue a modification in accordance with the CLAUSE: DEFAULT (FIXED PRICE CONSTRUCTION) of the

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror(s) whose offer(s) conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The government intends to award one contract to the Offeror whose proposal meets all of the technical criteria and offers the lowest evaluated price. The following factors listed below shall be used to evaluate offers. The basis for award is lowest prices, technically acceptable offer.

The three non-price factors are: Licensing, Technical Expertise and Past Performance will be evaluated on an Acceptable or Unacceptable basis. In order to be considered technically acceptable, offers must be rated as Acceptable for all three non-price factors: : Licensing, Technical Expertise and Past Performance.

Ratings: Those Offerors whose proposals meet the requirements of the specifications will be considered acceptable.

Those Offerors whose proposals do not meet the requirements of the specification will be considered unacceptable.

FACTOR 1 – LICENSING

Offerors shall furnish a copy of a valid commercial applicator’s license from the State of Wyoming

Ratings: Ratings for this factor will be entered as: 1) Acceptable; or 2) Unacceptable

Evaluation Standard:

A Rating of ACCEPTABLE will be given if the offeror provides a valid commercial applicator’s license from the State of Wyoming.

A Rating of UNACCEPTABLE will be given if the offeror does not provide a valid commercial applicator’s license from the State of Wyoming.

FACTOR 2 – TECHNICAL EXPERTISE

Proposals will be evaluated to determine the Offeror’s experience in performing vegetation maintenance contracts of the scope and complexity required in the solicitation. Offerors shall provide enough information to demonstrate the breadth and depth of an Offeror’s relevant experience. Offerors should furnish information to demonstrate two years of experience performing commercial spraying work similar to that required in this solicitation.

For experience that is not considered fully relevant, the Government will evaluate for experience that demonstrates various aspects of relevancy. Offerors are encouraged to submit experience with as many relevant aspects as possible. Relevant projects are those that have one or more aspects as listed below (in descending order of importance):

Demonstrate expertise with vegetation control methods:

a. Experience with chemical control of vegetation.

b. Experience in filing Notice of Intent(s) with the State for commercial spraying.

c. Experience in implementing Best Management Practices during spraying activities.

d. Experience in handling spray chemicals.

e. Experience in operation of different types of application equipment.

f. Ability to provide adequate number of licensed applicators for non-aquatic, non-crop, pesticide categories.

Ratings: Ratings for this factor will be entered as: 1) Acceptable; or 2) Unacceptable

A Rating of ACCEPTABLE will be given if the offeror clearly demonstrate their experience performing vegetation maintenance contracts of the scope and complexity required in the solicitation.

A Rating of UNACCEPTABLE will be given if the offeror does not clearly demonstrate their experience performing vegetation maintenance contracts of the scope and complexity required in the solicitation.

FACTOR 3 – PAST PERFORMANCE

The past performance evaluation will result in an assessment of the Offeror’s probability of meeting the solicitation requirements. Past Performance Information shall include recent and relevant contracts for the same or similar scope and complexity. Any State or Federal Contract work should be noted. Information shall include contract numbers, dollar amount, and points of contact with telephone numbers, email addresses and other relevant information. Proposals will be evaluated based on the information provided and any other information determined appropriate by the Government.

When evaluating past performance the following will be taken into consideration for evaluation purposes:

a. The relevance of the project to the requirements of the solicitation. Relevancy of past performance information will be determined on the same basis as Factor 2.

b. How well the offeror performed.

c. The number of problems, type and severity of the problems, and the effectiveness of corrective actions taken to minimize the schedule and cost impacts, and overall quality.

d. Evaluations, letters of appreciation, and commendations from customers

The Government reserves the right to verify claims made by the Offeror and not to consider relevant those that are not substantiated.

Offerors are reminded that the Government reserves the right to obtain past performance information from any source available. At no time during this process, nor during the debriefing, nor after award, will the names of the individuals providing reference information about an Offeror's past performance be revealed to the Offeror's or to any other party.

Other sources may include, but are not limited to, past performance information retrieved through the Past Performance Information Retrieval System (PPIRS), including Contractor Performance Assessment Reporting System (CPARS), using all CAGE/DUNS numbers of team members (partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified in the Offeror’s proposal, inquiries of owner representative(s), Federal Awardee Performance and Integrity Information

System (FAPIIS), Electronic Subcontract Reporting System (eSRS), and any other known sources not provided by the Offeror.

Ratings: Ratings for this factor will be either Acceptable or Unacceptable

Acceptable – Based on the Offeror’s performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort, or the Offeror’s performance record is unknown (see note below).

Unacceptable – Based on the Offeror’s performance record, the Government has no reasonable expectation that the Offeror will be able to successfully perform the required effort.

Note – In the case of an Offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the Offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305(2)(iv)). Therefore, the Offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable”.

FACTOR 4 – PRICE

The Government will evaluate the price quote for the project to determine whether the offered price is reasonable. The contract line items will also be analyzed to determine whether the prices are realistic and balanced for the work to be performed, reflecting a clear understanding of the Statement of Work requirements.

a. Reasonableness of an Offeror’s proposal is evaluated through cost or price analysis techniques as described in FAR Subpart 15.305(a)(1) and 15.404-1(b). For a Price to be reasonable, it must represent a price that provides the best value to the Government when consideration is given to prices in the market, (market conditions may be evidenced by other competitive proposals) and the technical and functional capabilities of the Offeror.

b. Price will also be a factor in establishing the competitive range prior to discussions (if held) and in making the final best value determination for award.

c. Price proposals that are unrealistically high or low in price when compared to the Government estimate and market conditions evidenced by other competitive proposals received may be indicative of an inherent lack of understanding of the solicitation requirements and may result in the proposal being considered unacceptable.

(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(End of provision)
