SECTION M - EVALUATION FACTORS FOR AWARD

The following have been modified:

52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.

The following factors shall be used to evaluate offers:

FACTOR 1 TECHNICAL ACCEPTABILITY (ACCEPTABLE/UNACCEPTABLE)

To be determined technically acceptable the offeror shall:

a. The offeror shall provide a certification letter from the manufacturer verifying the contractor’s capability in properly installing the manufacturer’s HDPE product.

b. Materials:

The offeror shall provide documentation demonstrating that the materials to be supplied (HDPE and grout, etc.)

meet the minimum quality required by the technical specifications.

c. Film Equipment:

The offeror shall submit their means of capturing pre-installation and post-installation videos of the conduit. The videos shall be of sufficient quality and clarity with regards to lighting, steadiness, camera speed, and focus, such that all joints and flaws can be clearly observed in the video. The video must also capture and display the distance traveled into the conduit by linear feet.

FACTOR 2 PAST PERFORMANCE (SATISFACTORY/UNSATISFACTORY)

To demonstrate past performance, the Offeror shall provide documentation of satisfactory performance on two (2) past or current contracts of a similar type, size, scope, and complexity, performed within the last five (5) years. The Offeror is cautioned that while the government may consider data from other sources, the burden of demonstrating satisfactory past performance rests with the Offeror. Satisfactory past performance is defined as completion of the required work in accordance with the terms and conditions of the applicable contract. In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available, the offeror will be evaluated as neutral on past performance, providing the offeror supplies a certified statement with their offer that no past performance information is available. For the purposes of this evaluation, neutral past performance is equal to satisfactory past performance.

Offerors shall provide contracts that are relevant and recent.

Relevant:

Relevant contracts are similar requirements that demonstrates a record of providing towboat services similar to those required in this Solicitation to commercial/industrial clients and/or federal, state, municipal government agency clients. Past performance submittals shall include the point of contact name, telephone number, and email address for each contract included in the past performance submission.

Recent:

Contracts that are recent are defined as those that have been completed within the last five (5) years of the solicitation issue date. Offerors are cautioned to select relevant contracts for review that accurately reflect the Offeror’s past performance capabilities. Please note that if the Offeror chooses to provide more than two (2) contracts, the government will evaluate only the first TWO (2) contracts submitted under this evaluation factor. Any additional contracts submitted beyond the TWO (2) requested will NOT be evaluated. Offerors shall include relevant past performance history

NOTE: Past Performance shall be contracts held by the prime offeror or major subcontractors. A major Subcontractor is defined as a Subcontractor responsible for 25% of more of the performance required.

The government’s approach to evaluating past performance is to check the references provided by the contractor to verify past performance as well as data obtained from other sources available i.e.

government database, past contract files, etc. The offeror is cautioned that while the government will consider data from other sources, the burden of demonstrating past performance rests with the offeror.

FACTOR 3 PRICE

Pricing shall be provided on the attached pricing scheudle. The unit prices submitted will be binding thorughout the life of the contract.

For award purposes only, the lowest price will be determned by the summation of all units priced items. An authorized official of the firm shall sign the SF 1449 and all solicitation amendments.

The unit prices submitted for this SATOC shall be for the price per linear foot of the pipeliner only. Other costs associated with the performance of this contract will be submitted on a per task order basis such as:

mobilization/demobilization, delivery, equipment cost, etc…

(b)( If Applicable) Options. The government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the government to exercise the option(s).

Quotes will be examined to determine the extent to which quoted prices are comparable with the government estimates, previous procurement history, and a determination made of Price Reasonableness. The government may reject any price quote that is determined to be Not Fair and Reasonable, unrealistically high, or low in price when compared to government estimates, or are unbalanced, such that the price quote is deemed to reflect an inherent lack of competence or failure to comprehend the requirements.

Award:

It is incumbent upon the offeror to submit sufficient documentation and information for the government to determine technical acceptability, satisfactory past performance, and the quoted pricing. Failure to submit sufficient information for the government to determine technical acceptability, satisfactory past performance, and price may be cause for rejection of your quote.

Award will be made to the contractor whose price is the lowest of all offers determined to be technically acceptable with satisfactory past performance. The government will evaluate the lowest priced offer with satisfactory past performance for technical acceptability. If the lowest priced offer with satisfactory past performance is determined to be unacceptable, the next lowest offer with satisfactory past performance will be evaluated for technical acceptability until an acceptable offer is determined.

NOTE: All quotes must be valid for 60 days.

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
