Special Notes to the Contractor: THIS PROCUREMENT IS UNRESTRICTED.
NOTE 1: The bidder is required to bid on all line items on Casting at Delta, LA. Failure to submit a bid on all line items shall result in a non-responsive bid, requiring rejection thereof. If a bidder is willing to waive costs associated with the individual line item, he/she is required to insert descriptive words or abbreviations such as "no charge" or "N.C.". Award will be based upon the lowest responsible, reasonable bid. See note below regarding evaluation of options.
NOTE 2: END ITEMS. For small business concern representative purposes, the end item being procured under this solicitation are completed squares of articulated concrete mattress. Ingredients such as Portland Cement and Fly Ash, etc., are not end items.
NOTE 3: Cement and Fly Ash quantities are based on theoretical quantities and will be used to evaluate bids.
Actual amounts will depend on the various mix designs furnished by the Government during the contract performance period. Fly Ash may vary from 0 to 35 percent of total cementitious materials as directed by the Government.
NOTE 4: For variation in quantity clause see Section F – DELIVERIES OR PERFORMANCE, paragraph entitled
“VARIATION IN QUANTITY (FAR 52.211-16 - APR 1984)”.
NOTE 5: OPTIONAL WORK ITEMS. The Government may require the delivery of the numbered line item(s), identified in the schedule as OPTIONAL WORK Items, in the quantities and prices stated in the schedule. The Contracting Officer may exercise the OPTION WORK Items by written notice to the Contractor. Option 1 and/or 2 can be exercised and awarded by the Contracting Officer up until August 1, 2023. Option 3 and/or 4 can be exercised and awarded by the Contracting Officer up until September 1, 2023. Options are not required to be awarded in consecutive order. The Contracting Officer may elect not to award any options or may award any combination of options at his discretion. Bidders shall bid on all items including optional items (see “EVALUATION OF OPTIONS” FAR 52.217-5). Failure to bid on all items will result in a non-responsive bid.
NOTE 6: EVALUATION OF OPTIONS (FAR 52.217-5 - JUL 1990). The Government will evaluate offers for award purposes by adding the total price for all options to the total price for this basic requirement. Evaluation of options will not obligate the Government to exercise the option(s).
NOTE 7: Bid Items 0001AB, 0001AC, 0002AB, 0002AC, 0003AB, 0003AC, 0004AB, 0004AC, 0005AB, and 0005AC are estimated quantities only. (See Note 3 above.) Actual pay quantities will be the theoretical quantities based on government mix design and the actual number of accepted mats. The Government mix design may vary as directed during casting operations.
NOTE 8: Bidders shall furnish unit prices for each item listed in the schedule requiring a unit price. If the bidder fails to insert a unit price in the appropriate blank for required item(s), but does furnish an extended total, or an estimated amount for such item(s), the Government shall deem the unit price to be the quotient obtained by dividing the extended amount for that line item by the quantity. IF A BIDDER OMITS BOTH THE UNIT PRICE AND
THE EXTENDED TOTAL OR ESTIMATED AMOUNT FOR ANY ITEM, ITS BID SHALL BE DECLARED
NON-RESPONSIVE AND THEREFORE INELIGIBLE FOR AWARD.
NOTE 9: Any bid may be rejected if the Contracting Officer determines in writing that it is unreasonable as to price. Unreasonableness of price includes not only total price of bid, but the price for individual line items as well.
Any bid may be rejected if the prices for any line items or sub line items are materially unbalanced (See FAR 14.404-2).
NOTE 10: RAPID VENDOR PAYMENT. Web based instructions for the submission of invoices;
http://www.mvn.usace.army.mil/BusinessWithUs/Contracting/RapidVendorPayment

B4EDGDML
Cross-Out shall require the bidder to cast the squares required for this contract at either St. Francisville, LA Casting Field or Richardson Landing, TN Casting Field depending on availability. If this situation arises where the location of performance changes, the bidder may upon request and approval of the Contracting Officer, be allowed to request an equitable adjustment in contract price for concrete mattress pursuant to the Contract Clause, CHANGES – FIXED
PRICE (FAR 52.243-1).
NOTE 12: The Contractor shall provide a vehicle and operator for hauling and delivering the field concrete specimens to the onsite testing laboratory. 1.4 RIGHTS-OF-WAY
a. The rights-of-way for Contractor performance under this contract, within the limits indicated on the drawings, will be provided by the
SECTION 01 00 00.00 09 Page 3
Government without cost to the Contractor. It is the Contractor's responsibility to carefully review and determine the scope of the rights-of-way. Any questions should be clarified with the Government prior to use. If these rights-of-way are used by the Contractor, he shall, at his own expense, do all work necessary to make such rights-of-way suitable for safe travel to and from the worksite. Upon completion of the Contractor's work, any such rights-of-way furnished by the Government shall be left in a condition satisfactory to the Contracting Officer.
b. When so directed by the Contracting Officer, the Contractor shall, without expense to the Government, promptly vacate and clean up any part of the Government grounds or rights-of-way that have been allotted to or have been in use by the Contractor.
c. The Contractor shall not obstruct any existing roads or any other means of existing ingress or egress on lands controlled by the United States except with written permission of the Contracting Officer and shall maintain such roads and other means of ingress or egress in as good condition as exists at the time of commencement of work performance under this contract.

The Contractor shall provide the Contracting Officer with an authenticated copy of the conveyance under which the Contractor acquired such property rights, prepared and executed in accordance with the laws of the State in which the land is located. The Contractor shall also obtain from the property owners and present to the Contracting Officer a release of all claims against the Government which may result from the Contractor's use or possession of such real estate or property rights. The written conveyance and release shall be provided to the Contracting Officer prior to the Contractor's use of Contactor obtained real estate or property rights. If temporary rights-of-way are obtained by the Contractor the period of time for those rights shall coincide with Section 00 80 00.00 09 SPECIAL CONTRACT REQUIREMENTS, paragraph COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK, plus a reasonable time for any extension granted for the completion of the work. Any agreements or permits with levee boards, counties, parishes, municipalities, or other political subdivisions for moving material and equipment will be the responsibility of the Contractor and shall be obtained at no expense to the Government. Any delays to the Contractor resulting from delays in procuring access roads, rights-of-way, permits, or other real estate and property rights necessary for moving material and equipment for his work under this contract will not be a basis for any claim for increase in the cost of this contract. The Contractor shall make his own investigations to determine the conditions, restrictions and difficulties which may be encountered in acquiring such real estate, rights-of-way, or other property rights and in the transportation of material and equipment. In addition, the Contractor shall be solely liable for any and all damages and claims of any nature whatsoever arising from, related to, or growing out of the acquisition and use of this real estate, rights-of-way, property rights, etc.
e. Notwithstanding any language or drawings to the contrary in this contract, the United States will not provide access or rights-of-way
SECTION 01 00 00.00 09 Page 4 over any public lands and will not be responsible for acquiring such.
f. The Contractor shall repair at no expense to the Government, any and all damage to any existing roads or other means of existing ingress or egress when such damage is a result of his operations under this contract.
1.5 LAYOUT AND MARKING OF RIGHTS-OF-WAY
The Contractor shall layout and mark the rights-of-way limits as indicated on the drawings prior to beginning any other work, unless otherwise approved. The marking shall be placed at intervals approved by the Contracting Officer. The rights-of-way limits shall be marked by stakes, flagging or other approved means. The marking shall be highly visible from a distance of at least 100 feet, and shall be maintained for the duration of the contract. If the rights-of-way marking should fade significantly in color, become damaged or lost as a result of the Contractor's operation or as a result of vandalism, or in any other way cease to function as a highly visible marker of the rights-of-way limits, the Contractor shall layout and restore the marking to the original condition. After all work is complete and upon approval of the Contracting Officer, the Contractor shall remove all marking. No separate payment will be made for layout, marking and maintaining the rights-of-way limits or for removing the marking.
