Comment Classification: Unclassified\\For Official Use Only (U\\FOUO)
We see that this solicitation is listed as a RFQ and not a IFB or a RFP. With this being said, we are concerned that that the statement of work as noted in the solicitation might not be contractually legal. Could the USACE please have their legal department review.
Example: Liquidated Damages of $2,124.00 per calendar day of delay, but there is not period of performance noted.
Also, the following statement sounds a little excessive: If the Government terminates this contract in whole or in part under the Default-Fixed-Price Supply and Service clause, the Contractor is liable for liquidated damages accruing until the Government reasonably obtains delivery or performance of similar supplies or services. These liquidated damages are in addition to excess costs of repurchase under the Termination clause.
Would it suit the government better to have bonds required (bid bond, payment and performance bonds)?
If the supplier never attempts to make delivery, how can the government withhold liquidated damages? Essentially, how can the government enforce the supplier to pay back money that this above and beyond what the government might or might not owe the supplier?
On: May 15 2020.
Government Response. . This requirement has been determined commercial; therefore, FAR Part 12, Acquisition of Commercial Items, is applicable. FAR Part 13, Simplified Acquisition Procedures, is also applicable. The solicitation for this requirement is issued as a request for quote and as such bond requirements are not applicable to this requirement.
Deliveries will be authorized when a notice to proceed is issued. The notice to proceed will be issued after all post award submittals have been approved and the delivery schedule has been coordinated with the Government. The contractor will be notified when all post award submittals have been approved other than the delivery schedule. The contractor will have two business days to submit an updated delivery schedule to be coordinated with the Government. The contractor shall be able to schedule a delivery start date to begin within 10 calendar days upon notification that all post award submittals are approved.
The contractor's quote in response to this solicitation shall identify an estimated delivery start date as a number of days after the notice to proceed has been issued, but must be within 10 calendar days of the NTP. An example of how a contractor may quote the delivery schedule is: "deliveries will begin within 10 days of the NTP being issued at a delivery rate of 350 tons per day with deliveries being made Monday through Fridays until complete. An actual delivery schedule will be submitted to the Government within 2 business days of all post award submittals being approved." The liquidated damages will be applicable to the schedule that is coordinated between the contractor and the Government when the notice to proceed is issued.
The liquidated damages amount of $2,124.00/day reflects the labor and equipment rental costs the Government incurs on a daily basis to support receiving the 650 limestone. Labor to support this project includes a Quality Assurance Representative, Area Engineer, Project Engineer, Chief Engineer, Administrative Assistants, and hired labor. The contractor is responsible for complying with the delivery schedule approved in the notice to proceed.
In the event a contractor is unable to obtain approval of the post award submittal requirements, the contractor will not be responsible for liquidated damages, but may be responsible for contract termination costs as identified in FAR Clause 52.249-8. On: Jun 23 2020

As the USACE is aware, we provided pricing for this same scope of work / supply of material back on 02-28-20 and the USACE did not accept the pricing. Obviously this was not and is not an emergency. Our question is why is there so much liability is being placed on the supplier / contractor related to liquidated damages? We feel that this amoutn of liability is going to either not allow suppliers and / or contrators to submit quotes, or if they do submit a quote it is going to be high due to the potential amount of liability.
On: May 15 2020.
Government Response. . The liquidated damages amount of $2,124.00/day reflects the labor and equipment rental costs the Government incurs on a daily basis to support receiving the 650 limestone.

R650 material is larger material then what is typically stored on any commercially available yard in close proximity to the delivery location. Meaning that upon award, most likely the supplier / contractor will have to aquire the material from a quarry (have the material loaded on a barge, delivered to a yard, unloaded, and reloaded onto over the road trucks to make delivery). This all takes time and is sensative to the required quantity. The solicitation does not state that there will be any timeframe allowed for procurement of the material and / or the actual quantity that will be required.
On: May 15 2020.
Government Response. . The contractor's quote shall list the estimated delivery dates as a number of calendar days after the notice to proceed has been issued. Deliveries shall begin no later than 10 calendar days after the notice to proceed has been issued. Upon approval of the post award submittal requirements the contractor will have two business days to coordinate/confirm the actual delivery dates. The notice to proceed will not be issued until the delivery dates are confirmed. On: Jun 12 2020

Please confirm that USACE standard barge draft measurements will be allowed for measurement of materials for payment.
On: May 15 2020.
Government Response. . Measurement of materials for payment shall be in tons by industry standards to include either barge measurement or certified scale/weight measurement. Each truck load shall be weighed to the nearest 0.01 ton and the final quantity rounded to the nearest 0.1 ton. The method of measurement for payment of materials, barge measurement versus scale weight measurement shall be established and discussed with the USACE Technical POC prior to beginning delivery at each location. If the materials are unloaded from barges at a port (Greenville, Vicksburg, Natchez, St. Joseph, etc.), barge measurements will not be accepted and a certified scale system shall be used to weigh each truck load of material and account for each truck load of stone hauled to the delivery site; if the certified scale system is not used, then barge measurements will not be accepted. If barges are offloaded within 10 miles of the delivery site location, not at a port, then barge measurement may be used if an accounting system is used that will account for each truck load of material loaded at the barge site and unloaded at the delivery site/levee. For example, an accounting system shall include a paper ticket for every truck load of material loaded at the barge site with a paper copy provided to the government representative at the delivery site, verifying delivery. The use of barge measurements for deliveries in excess of 10 miles from the point of unloading will require the approval of the USACE Technical POC. All barge measurements shall be made by the contractor in the presence of a government representative. Any free or excess water in the barges shall be pumped out before the initial barge measurements. The initial barge measurements shall be made before moving any material from the barges. Material that is loaded out, hauled to the delivery location, and found to contain excessive moisture, or, free water will be rejected. On: Jun 23 2020

Section B - Supplies or Services and Prices notes the unit of measurement for CLIN 0001 and 0002 to be "Job".
Other parts of the solicitation state: "The government reserves the right to decrease or increase the final quantities of each delivery order depending on quoted unit prices and available funding."
Our question is, is it anticipated for the governement to decrease or increase the quantity of "Job"? If so, each "Job" for CLIN 0001 would be for the "supply and delivery of 1,100 tons of R650".
On: May 15 2020.
Government Response. . No, the unit of measure for this will be job. Job is the appropriate unit of measure for a supply and delivery contract. CLIN 0001 is for the supply and delivery of 1,100 tons of R650 and CLIN 0002 is for the supply and delivery of 425 tons of R650. The Government anticipates the resultant contract being issued for the solicited quantities; however, the Government reserves the right to increase or decrease the awarded quantities based on available project funding. Is the USACE or contractors/suppliers that are supplying material for the USACE exempt from obtaining additional county road bonds as long as legal weight limits are hauled accessing the delivery location. Essentially, we are being told that there is a "ransom" / "fee" that will be incurred, and from previous experience with hauling in this local area
– as recent as last year, we were required to pay the county approximately $25,000 for "repairs" to their county roads even though we were hauling less than the legal weight limit.

8592472 Site tailgate dump tailgate dumo
Comment Classification: Unclassified\\For Official Use Only (U\\FOUO) the "tailgate dump" mentioned in the solicitation, is this a tailgate spread with R650, or just 6 foot stockpiles placed next to each other so that they can be placed by the excavator?
Also will we be able to use Truck and Trailers for the delivery? If it is not tailgate spread, would a side dump work, or would an end dump work best?
Thanks!
